Supv Schug read the notice that was published in the newspaper considering the application of Sherman & Smith Construction to use a portion of their existing structure for the purpose of construction tool sales ( copy of notice in minute book ) QUESTIONS AND / OR COMMENTS Z . O . Slater - there has not been any problems or complaints from the neighbors when a similar type business was there . ® Clm Hatfield - wanted to know what kind of construction business that they ran . Edward Smith - they do remodeling , siding and roofing out of this location at 298 Cortland Rd . Closed public hearing RESOLUTION # 128 GRANT SPECIAL PERMIT SHERMAN & SMITH CONSTRUCTION CO . The reason for this delay is , the Ithaca Journal did not receive the Public Notice for printing in the Legal ads section in time so that it would appear no less than S days before the hearing . Carried COUNCILMAN P R I V I L.EUG OF THE FLOOR Co . Rep Evans - the County Board voted to have the construction committee recommend an independentI team of experts to review the W altman alligation against the DR7 site and fEIS . The committee is meeting tomorrow to decide whom to choose . An independent committee review will be done with O ' Brien & Sere and Mr . Waltman on the final environmental statement as regard to soil and drainage . S Lrpv Schug - wanted to know if the Town could gat a dopy of NW . W altrnans review . Co . Rep Evans - Atty Perkins has received a copy of the report - S upv Schug - when the committee is picked he would like the Town ' s soil scientist Mr . Wulfro +.; t to be inf +,irmed and included , Co . Rep Evans - could not see any reason why it could not be done . He had recommended that the solid waste committee select 2 people , Mr . Waltman select 2 people and then the 4 of those select one of their choice , S tpv Schug -- wrote to the County Board concerning the town ✓ esidents having to pay sales tax on the garbage tags and yet the ✓ illage residents do not have to and was what wondering what the • status was . Co . Rep Evans - anybody who has to pay for garbage pickup has to pay the soles tax . It is like paying a mechanic to work on your car . D o . Rep Watros - the villager are tax exempt and they are under contract with the hauler . I f the town wanted to enter into a contract they could do, the same thing . C ';' . Rep Evans - the problem of that is that you have more than o ne hauler and the hauler bill has to be paid before you can ✓ eceive your tags . The hauler has to pay for the trash at the landfill therefore he is recovering in getting the revenue from the tags , Co . Rep Wa. tr ';' s - said that they would get the legal definition . Co . Rep Watros -- they will he discussing the elimination of the equalization rate on the school tax in the City of Ithaca . The City of Ithaca school tax impacts on cnorie parts in the Town of Dryden . The town and county tuxes will be calculated on the basis o f current market value without any adjustment t n the e qualization . The sich '_" o1 requires special legislation before they 'rs5- s -- Jo page 3 can do it , The City of Ithaca has requested that city school tax be computed on the same basis 50 that they don ' t use three year o ld equalization rates to adjust the distribution of tax levy . He f eels that it will pass the board and could have a positive or negative effect on the Town of Dryden residents . It will be a more accurate means because they wi 11 be using the county assessed values which w i l l be adjusted annually and current market rates where in the past they have used the equalization ✓ ates which was based on three year old data with what the state collects . CITIZEN! PRIVILEGE OF THE FLOOR Fred Pr i t t , 1 E3a S 1 at ery i 1 1 e Rd - he has canvassed the S laterville Rd to see if there is an interest in a water and sewer district and has received a good response with h i s petitions . He has covered about 1 1 / 2 miles and will have the petitions ready ady by next board meeting . S upv Schug - if there are a significant number of people that are interested then it will be up to the Town Board to let out bids for an engineering study . COUNCILMAN PRIVILEGE OF THE FLOOR bin Roberts - would like to bring up the issue of the proposed RA zone There was a proposal that came to the Planning Board last year and would like to see what the Town Board cou ld do to get it to the public and find out the interest . ✓ im Walbridge - went over the original proposal with Clm Roberts and Chairperson Caldwell and some of the issues as haw to define o verlay zones and forester . There also needs to be a system for boundary lines as to how they are drawn because it would 90 t hrough different slopes and soils , on property instead of property edges . They need an exemption from Town Law that states the least restrictive zone has preference for 100 feet otherwise they would have to move the boundary to that zone . Also the d efinition of a licensed engineer , a licensed drainage plan an t he wording has to be consistent . S uper Schrg - thcorght that all of this information should be given to Atty Perkins so that he could draft what would be needed for the zoning book by the next board meeting . After the board agrees t hat this is the net that it should be written then we can hold some public hearings , After much discussion it was decided to hold an informational meeting on May 31st at 7100PM at the Town H all Cle Walbridge - spoke to the sewer board about the Town of Dryden buying more capacity . They need from Hunt Engineer or the town engineer a specific proposal with how much would come from d ifferent areas and address it to the & .IS sewer committee , Also TU -yA - 9O page 4 the board was not exactly sure what the procedure was so they put it off for a month so they could check on it . S upv Sch '.sg - he understood that it was $ 50 , 000 . 00 a share and the share was whatever the total of the plant was divided by 100 . The additional shares were owned by the Town of Ithaca and that was w here we were to buy the shares from , Clm Walbridge - there was discussion on all different d isagreements as to whether you buy the excess capacity or w hether you buy from the Town of Ithaca . ATTORNEY Atty Perkins ma annually the Town board approves a fire works permit for the Snyder H i l l Civic Assoc . Mr . Robert Fletcher the applicant has applied and all of the insurance requirements have been met and based on his review of the past applications and documents he finds that the application is in order and would ✓ ecommend approval . RESOLUTION # 129 (AUTHORIZE SUPERVISOR TO sicN APPLICATION FOR FIRE WORKS Clrn Walbridge offered the following resolution and asked for its adoption : RESOLVED , that this Town Board authorize Supv Schug to sign the application of Mr . Robert Fletcher to hold fire works for the S nyder H i l l Civic Assoc . and Clm Hatfield Roll call vote ma- all voting Yes Atty Perkins - distributed to board members a memorandum of u nderstanding concerning the new water district on Hall Rd and the realignment of Hall Rd . The water district would be largely funded by Wilcox Press which is set forth i n the outline of u nderstanding which we should approve . It contemplates continuing w ork to be done on both sides in order to reach a satisfactory conclusion of the project and the construct - on of the additional capacity would be available to the water districts in the town . RESOLUTION # 00 APPROVE THE CONCEPT AS SET FORTH IN OUTLINE or UN17ERSTANDIN3 rim Corrigan offered the following resolution and asked for its adoption : RESOLVED } that this Town Board approve the concept as set forth in the outline of understanding concerning the new water district on Hall Rd and the realignment of Hall Rd . and Clm Roberts Roll call vote - all voting Yes 0 • ® THIS AGREEMENT made this j 14 day of fd4C , 1990 , by and between : THE VILLAGE OF DRYDEN ( " Village " ) and THE TOWN OF DRYDEN ( " Town " ) , Municipal Corporations organized and existing under the laws of the State of New York . RECITALS 1 . The Village currently accepts the wastewater into the Village ' s sewer system from a sewer district in the Town known as the Cortland Road Sewer District pursuant to an agreement between the parties dated October 12 , 1982 and the addendum thereto . 2 . Such agreement provides for the division of expenses in the e vent of the upgrading of the Village plant . 3 . The parties agree that upgrading of the sewer plant may be ✓ equired and that an engineering study to consider the following is in the best interest of the parties : a ) to investigate the capacity of the Village ' s sewer plant for increased flows , including an analysis of a proposed plant expansion or duplication , and b ) to upgrade the existing elements of the Village ' s 41 sewer plant to handle immediate increased flows . V 4 . Novelli & Co . Consulting Engineers has proposed to perform the engineering study for the total sum of $ 21 , 160 and has estimated the respective benefit to each party and proposed a division of the cost between the parties as set forth in the letter from Peter D . Novelli , P . E . , dated April 4 , 1990 , which is incoporated herein by ✓ eference . 5 . The parties are willing to proceed with the engineering studies in accordance with the proposal and recommendation of Novelli & Co . Consulting Engineers . TERMS 1 . The parties and each of them do hereby authorize the e ngineering studies mentioned hereof . 2 . The Village agrees to pay for such studies the sum of $ 13 , 688 ( $ 8 , 635 plus $ 5 , 053 ) . 3 . The village had warted ten or twelve thousand dollars in the past and the engineer is saying that the town share of the study will be $ 7 , 492 . 00 , Se '_' rge has reviewed it and this is information that the town could use therefore does the town want to be part of t his study . The information that she has received is part of the formula that is used is the acreage and road frontage . The way she sees it the acreage charges are only applied to parcels which don ' t have road frontage . She did not think that this was an equitable way to distribute the cost . ® Supv Schug - it is percentage of assessment , road frontage and units . TB5 - 8 - 90 page tO Clm Walbridge - you were told that if there was no road frontage you would be charged for acreage , so that the ones that did have ✓ oad frontage ware not being charged acreage . H elen Lang - that is what she was told . Clm Walbridge - this should be looked into before tomorrow nights informational meeting . Clm Corrigan - she was also told this and that S or 9 parcels are similar to that in the district . H elen Lang - if they took the cost that was part of the budget that was supposed to he allotted for 5 percent of the cost for each parcel and put that 5 percent on the parcels which didn ' t have road frontage and are listed in the maps as acreage . They are being asked to pay almost as much on a 2 acre property which H as no road frontage on a lot that is not buildable and isn ' t e ven being serve by the sewer as they are on a parcel which has their house on it . Atty Perkins - wanted to know if it was contiguous ? Helen Lang °- yes , it is . Bubv & chug -- wanted to knew if it could be subdivided ? Atty Perkins - you would have to 1oink. at what is under common o wnership . If you have a house parcel that is a minimum size lot and you have all of this acreage that adjoins it in the rear owned by the same people it could be a rational basis . H elen Lang - it is under ' parcel numbers , but she is also saying that if you have a lot with l : 5 feet of road frontage and 200 feet deep , you are charged the same for road frontage and acreage w hich is nothing for acreage with someone who has 125 feet of ✓ oad frontage and hh acres behind it . Atty Perkins - the formula is subject to review every year and there is a public hearing that anyone can come and comment on so that if it needs to be adjusted it can be . H elen Lang - you can do that on an individual basis , but she could not find anything in writing as to how the formula is arrived at . Atty Perkins - there isn ' t anything in writing , but annually there is a notice that is published and a resolution . Clm Walbridge - how can people vote on a proposal if they don ' t know what they are voting on . Atty Perkins -- they are not voting on the formula . 9y T25 - 8 - 90 page 11 III Clrn Walbridge -- what the people are voting on is what they feel are the annual costs for this . There are other issues as well and if the formula does not mean anything why did we do it . We need to give the people representative numbers . Atty Perkins - the question is how do you administratively interpret the 5 percent of the total to be raised on the acreage . Clrn Corrigan - said she had brought this question up twice so that it could be discussed . She was told that there are 9 parcels that have this same type of problem . Helen Lang - the parcel that has road frontage would not be charged for acreage and the parcel that has acreage has no road frontage . She has 3 properties that are contiguous , 2 have f rontage and 1 does not have frontage . The c acre parcel has almost as high assessment on it , which has no read frontage , no u nits on it , canrn_ot be developed and cannot be served by the w ater and sewer . S upv Schug - if someone has 54 feet of road frontage and behind that there is 90 acres , on that 50 for 60 feet of road frontage t hey could build a road and subdivide the property because there w ould be water and sewer available . Atty Perkins - a person who has this available could afford to O sit on the property if they were not paying a fair share of it Helen Lang - did not see how you could legally apply different criteria to different properties , because every property has acreage Clrn Corrigan ° is looking at some sort of equity and did not q uestion the legality of it because the town has the right to e stablish a formula . Clrn Walbridge - the people at the meeting tomorrow night would like to know exactly how things are going to be figured out so if there is a rationale for charging acreage we will be able to answer them . S upv Schug - will get the figures together and have them available for the meeting . H elen Lang - the question isn ' t the formula itself , but the mathematics and the logic as to how it is applied . This does not e xist anywhere in writing so people can ' t challenge it when it can change every year and get applied differently . She thought that the procedure for putting it into the assessment and making the values needs to be in writing and available to the people who have to vote on it .
