TOWN BOARD MEETING
APRIL 10 , 1990
S upv Schug called the meeting to order at 7 : 30Pm
Members and guests participated in the Pledge of Allegiance
Roll call was by the Town Clerk :
P resent : Supv Schug , Clm Roberts , Clm Walbridge , Clm
H atfield , Clm Corrigan , fatty Perkins and Z . O . Slater
Motion was made by Clm Hatfield and 2nd by Clm Roberts that the
minutes of the Town Board meeting held March 13th be approved as
submitted . Carried
CITIZEN PRIVILEGE OF THE FLOOR
Fred Pritt , 1632 Slaterville Rd - was interested in getting
water and sewer service in his area on Slaterville Rd . There is
w ater and sewer service from the Town of Ithaca within one house
o f his location . He has only had time to call a few people and
t hey all expressed an interest . He has heard that there is an
approved sewer connection when the development on Snyder Hill Rd
is established which would be on Rt 79 . He is here to find out
w hat is being considered and if there is the possibility of
connecting Slaterville Rd to the sewer the same time the
® development is approved . There definitely is a need for water
and sewer service in that area .
S upv Schug - you should get a petition requesting the Town Board
to see what the cost would be for the people in that area . The
Town Board would then get a preliminary engineering study done
as to the feasibility .
ATTORNEY
Atty Perkins - reported on the informational meeting that will
be held May 9th at 7 : 30PM at the Varna Community Center . They
w ill try to discuss all of the questions that have been asked in
all of the formal and informal meetings that have been held
already . This will include who can vote , what the costs are
involved , what the district includes . There will be
✓ epresentatives from Hunt Engineers at this informational
meeting .

— SEWER DISTRICT
Councilperson Walbridge offered the following
® resolution and asked for its adoption :
WHEREAS , the Town Board adopted Resolution No . 89 on
February 13 , 19 9 0 approving the establishment of the Turkey
Hill Sewer District which resolution was adopted subject to •
a permi shrive refer endum , and
WHEREAS , Notice of Adoption of said resolution was duly
posted on the Town signboard and published in The Ithaca
J ournal as required by . law , and
WHEREAS , the Town Clerk has received petitions
requesting that the proposition be put to a vote of the
qualified voters of the proposed Turkey Hill Sewer District
at a special town election , and
• WHEREAS , there are sufficient signatures on enough of
said petitions and the same were filed in the time required
by law and are otherwise legally sufficient to require such
a special town election ,
NOW, THEREFORE , BE IT RESOLVED AS FOLLOWS :
1 . That a special town election to vote on the
0 proposition on the establishment of the Turkey Hill Sewer
D istrict shall be held May 22 , 1990 at the Varna Community
Center in the Town of Dryden , County of Tompkins and State
o f New York with the hours of voting from 12 : 00 noon until
8 : 00 p . m . prevailing time .
2 . The proposition to be voted on by the qualified
voters at the special election shall be as follows :
" Shall Resolution No . 89 adopted by the Town Board
o f the Town of Dryden on February 13 , 1990 establishing the
Turkey Hill Sewer District and providing for the improvement
t herefor consisting of the purchase of additional treatment
plant capacity at the Ithaca Area Wastewater Treatment Plant
and the purchase and installation of approximately 16 , 400
linear feet of 8 - inch diameter gravity sewer collection main
t ogether with necessary related appurtenances and one pump
station with force main at a maximum estimated cost to the
sewer district of $ 990 , 000 be approved " ?
3 . The Town Clerk is authorized and directed to
publish and post the required Notices of the special
e lection according to law .

Pg . ( 2 ) Auto Crushing on Bone Plain Road Freevi Ile , New York .
® Raymond Dennis has committed to completing the clean up
o f the auto crushing site by Tuesday June 12th of this
year . The crushing company has also , as part of their
contract , committed to regarding the site area affected
by the crushing activity . They also , by their contract ,
are required to remove all materials such as the fuel
tanks and all other, salvage materials other than tires .
I believe that this should be the end of this issue . Ray
h as indicated that he ' ll be applying for a " Special
P ermit " to open and operate a salvage yard at this site .
This application is expected shortly . As you are aware ,
u nder the Allowed uses of the R . C . Zoning District ,
S alvage Yards are permitted by Special . Permit .
Please find attached a copy of a request from Cayuga
Press and A - 1 Restaurant & Pizzeria to amend their
e xisting Approved Site Plan Reviews .
O ther than this , the normal actions are ongoing each
d ay . We continue with car removal . We also are having a
large influx of commercial structure applications
construction . These bui ld substantial tax base , however ,
® there take alot of time to review and to inspect .

TUESDAY MAY I , 1990
A public hearing to consider the application submitted by ROBERT AND LOIS
FOX of 366 Virgil. Road , Dryden , New York to operate a Lawn Mower Repair
Business at their residence , 366 Virgil Road , Dryden , New York requesting
a variance to the Dryden Town Zoning Ordinance section 701 .
A public hearing was duly conducted by the Town of Dryden Board of Zoning
Appeals on Tuesday , May I , 1990 with members present : Ann Everett ;
Chairman John ( Jack ) Baker ; Dominic Dordonaro ; Francis DiTommaso and Alan
Lallottc .

FINDINGS :
I . The neighborhood response was emotional , mixed and fifty , fifty
response for / against .
2 . The Zoning was changed after the land had been purchased .
3 . It is the Boards estimation that the probable impact of granting
this variance is low .
ODominic Bordonaro moved that a variance be granted with the following
stipulations :
1 . That the variance be granted specifically and solely to Mr .
Robert Fox .
2 . That it be limited solely to a Lawn Mower Repair Business .
3 . That it is not conveyable to others .

appear before the Dryden Town Site Plan Review Board for the
purpose of having my existing Site Plan Approval Modified .
I would request permission to expand my existing structure at 151
N orth Street , site of p - 1 Pizzeria & Restaurant , by 315 Square
feet . The purpose of this expansion is to provide a second means
of egress and an window opening for outside service .
W e will not want to change our use approval in any way , only the
f oot print of the structure . So that can see what we are
proposing , The Eagle Building Company has attached a copy of the
proposed plans .

Unsafe Structures
The ( 2 ) remaining unsafe structures have now been
completely demolished . All that remains of either the
Anderson or Keene Barn is the salvage materials .
At this time , I would take this opportunity to inform
y ::".0 that Mr . Keene has a second structure that has
fallen dawn . I meet with Mr . Keene on the site to review
the cleaned - up , of this structure . Mr . Keene indicated
that structure will be cleaned up within 90 to 120 days .

Raymond Dennis Auto Crushing , Boone Plain Road . As
directed by the Supervisor , I ' ve sent further
communications to Raymond concerning the terms of this
project to him and the actions that this office will be
taking with regard this project as well as all future
actions of this type . We continue to keep watch of the
project . To this date and time we have sent steps number
1 & 2 of the Court Process .
Mr . Dennis was in our office along with Mr . Roger Moore
o f Northern Car Crushers on May 2nd . At that time , they
informed me that they would be starting on Thursday May
3rd and would be completed by Tuesday May 8th , 1990 . As
o f today ; I see no evidence of that occurring .
Please find attached a copy of an application from Party
Time Rental, for a Site Plan Review to rel ' rate one of
their existing rental offices to 1771 Hanshaw Road
w ithin an M . A . Zoning District . I ' ve completed review of
this proposed project , and Find that it is adequately
complete and would recommend that a hearing date be
e stablished .
Other than this , the normal actions are ongoing each
day . We continue with car removal . We also are having a
large influx of commercial structure applications
construction . These build substantial tax base , hc' wever ,
there take alot of time to review and to inspect . I
would like to request , that the Board take alook at
upgrading the fee schedule for commercial construction .
It should be a user charge rather than a taxpayer
funded .

Dear Supervisor Schug :
On behalf of all the employees of Hi - Speed Checkweigher and my -
self , personally , I would like to express our sincere thanks to
you , your town board members and planning board members for their
assistance and patience in our recent exercise in obtaining per -
mission to build a new facility in your town . We are all ex -
t remely excited about getting started on our new building and
look forward to being part a part of the Town of Dryden Community
and hope that we can assist continued growth of the Town of Dry -
den .
J im , I would like to express a special note of thanks to your
Town Zoning Enforcement Officer , Henry M . Slater . It is indeed a
pleasure to work with a gentleman like Henry . Bob Tallman , Rick
Holt and I all look forward to working with him during the
construction phase of the project . Henry has been very helpful
in that many times he went out of his way to assist us with the
various matters that you are well aware of .

Atty Perkins - reported on the realignment of Hall Road that is
a matter for executive session since it involves the purchase of
property . Also for executive session is a matter for the new
proposed water and sewer district . There is no need to take any
action so you will not need to come back into regular session .

Follow up of the unsafe structures Keane and Anderson property
Car crushing on Bone Plain Rd ° Ray Dennis
O ak Brook Lane complaint
S upv Schug - regarding the car crushing on the Ray Dennis
property which was to have been completed on April 10th . The
person with the car crushing equipment stated that the ground
was to wet and would need at least 2 weeks of dry weather before
h e could bring the crusher in on the land . The Town Board can
e ither grant Mr Dennis additional time for dry weather to crush
the cars or we can instruct the Zoning Office to go through the
normal procedure for the violation .
Clm Walbridge - felt that the people on Bone Plain Rd and
Caswell Rd were upset to what seems to be a continual violation
o f the zoning ordinance and not just a one time issue . She does
not feel comfortable with granting the 2 weeks of dry weather
which you can not depend on . She felt that the Town Board should
start the notification process .

has checked out the property after she
received a complaint and thought that there were cars there a
lot longer then was reported . She thought that Mr Dennis has
repeated a pattern of performance even in the face of complaints
and warnings . She agrees with Clm Walbridge as to what is 2
weeks of dry weather . Maybe he could haul them to a different
place without being fined .
RESOLUTION # 121 START COURT ACTION
AGAINST RAY DENNIS AND CAR CRUSHING
Clm Walbridge offered the following resolution and asked for its
adoption :
RESOLVED , that this Town Board instruct Z . O . Slater to proceed
w ith legal action against Ray Dennis since he has not fulfilled
h is agreement that all the cars were to be gone by April 10th
and everything cleaned up .
2nd Clm Corrigan Roll call vote - all voting Yes
S upv Schug - with regard to the 2 unsafe structures . Z . O . Slater
h as written them both a letter ( Thomas Keane and Benedict
Anderson ) that if the property is not cleaned up within 15 days
the Town will contract the completion without further notice .
Atty Perkins - the only thing that would need to be done is to
awards the bids to a contractor .
S upv Schug - the Zoning Office should have the contractors check
the property over before they submit a bid because there has
been some work done .
H IGHWAY SUPERINTENDENT
Hwy Supt Gilbert - gave the Board members information on a front
loader .
Clm Walbridge '- would like to see figures on what it would cost
to fix the 17 year old loader .
S upv Schug - suggested also to have the down time on the
e quipment and what has been spent until the present time .
D ISCUSSION

Varn Brothers concerning their project .

® RESOLUTION # 122 VARN BROTHERS PROJECT
PEREGRINE HOLLOW SUBDIVISION
Clm Walbridge offered the following resolution and asked for its
adoption :
RESOLVED , that pursuant to the authority of Town Law 281 the
Town Board hereby empowers the Planning Board , simultaneously
w ith the approval of the PEREGRINE HOLLOW subdivision plat , to
modify applicable provisions of the Town Zoning Ordinance
subject to the conditions set forth in such section and Section
IV subsection 7 of the Land Subdivision Rules and Regulations of
the Town of Dryden , New York and the following conditions :
1 . Developer to determine if project is within the original
planning area of IAWWT Facilities Plan . Town is to receive a
letter to effect that the IAWWT plant will accept all
wastewater flows from the project and those flows will not
be counted toward toward the Town ' s available capacity for
areas outside of the original Facilities Plan area .
2 . Developer ' s engineer to review the Town concerns about
keeping the existing Hungerford Hill water tank full and the
existing constraints of the distribution system within the
Town of Ithaca .
3 . Developer ' s engineer to address all items expressed in
S chlecht letter of February 12 , 1990 . ( copy attached )
4 . Design of entrance to Snyder Hill Road and work to be
performed along Snyder Hill Road to be addressed by
D eveloper . See Town Board Resolution # 242 of 10-- 10 - 89 .
5 . Developer to provide information for alternate sewer
route along Route 79 and along southern Foote property line
to service subdivision .
6 . Developer to check and address the cost to individual
h omeowners of sewer transportation charges to be paid for
transporting wastewater through Town of Ithaca sewer lines .
7 . Developer to prepare a comprehensive environmental report
in connection with the review of the Full Environmental
Assessment Form and SEG! R review to be undertaken by the
Planning Board as lead agency ( after notice to Town Board ) .
FURTHER RESOLVED , that nothing contained herein shall be deemed
o r construed as approval of any proposed water or sewer
facilities in connection with the proposed subdivision .

We are in receipt of a preliminary plat for Peregrine Hollow
prepared by Lawrence P . Fah broni , P . E . , L . S . and dated September
2 , 1989 . The following documents have also been submitted to
this . office in support of the preliminary plat : Five Highway and
Sewer Profile Sheets dated September 6 - 10 , 1989 ; an undated and
untitled overall map depicting the proposed subdivision of tax
® parcel 69 - 2 - 3 . 2 in four phases ; . Petition for establishment of
Snyder Hill Sewer District ; Full Environmental Assessment Form ;
Sewer District Map dated October 5 , 1989 ; and . a Preliminary
Engineer ' s Report , undated . The preliminary plat appears to
portray Phase I of the overall map .
We have reviewed the preliminary plat with respect to Section VI ,
Number 2 , of the subdivision rules and Regulations , Town of
Dryden , and have 'the following comments :
1 . The preliminary plat must have the name of the owners of
all adjacent property .
2 . The disposition of the southeastern corner of the
preliminary plat needs to be addressed .
3 . The contour interval shown on the preliminary plat is 10
feet , which is less detailed than the ordinance requirement of
five foot contours . Potential lot access concerns , among others ,
could arise later , as a result of this inadequacy .
4 . There is no approximate grading plan shown on the
subdivision plat , as required by the ordinance .
5 . The width , location , names and centerline geometry of
® all streets proposed must be shown .
6 . The location and size of the existing water main in
Snyder Hill Road must be shown . The grade of the existing sewer

in Slaterville Road must be shown . Water main profiles are
required . Fire hydrants should be shown on the profiles and
labeled better on the plat +
7 . The location ' of all existing ponds and streams must be
shown ( and labeled ) .
8 + The location and preliminary design of all proposed
culverts must be shown .
9 . The road cross section should depict the pavement depth ,
and the depth and character of the stone base course .
10 , The approximate area of each lot is needed . along with
a clearer description of the Phase I limits .
We have reviewed the submitted materials for compliance with
Section V of the Subdivision Rules and Regulations . Town of
, Dryden , and have the following comments :
11 . The intersection of Peregrine Way with the unnamed loop
road and future cul - de - sac must be a cross type intersection .
12 . The intersection of Peregrine Way with the looped
roadway which crosses the Town of Ithaca boundary should be
designed so that the angle of centerline intersection is as close
to 90 degrees as practicable .
13 . The road profiles are devoid of centerline intersection
equations , vertical intersections , vertical curves , 100 foot
stations , and elevations for curvature points and intersections .
This information is required for a proper review of the street
layout ,
14 . It is not clear from the plans which of the attached
units wf, 11 be retirement housing and this should be clarified .
15 . The town of Ithaca should comment on this subdivision '
with respect to any road connection requirements , the traffic
study , pedestrian access to the park , and general impact on their
infrastructure caused by this development .
18 . This letter assumes that the ordinance intent for
potential future road connections for this and subsequent phases
has been addressed -
17 . Since this proposal depicts improvements in the Town of
Ithaca which are essential to the intent and functionality of the
proposal , the Town of Dryden should ensure that the Ithaca
portion of the project will be constructed as shown on the plans .
The snow removal responsibility for the Ithaca portion should
also be addressed at this time .

18 . The relatively high density of the attached units may
warrant sidewalks .
19 . A pedestrian easement should be provided to access the
Town of Ithaca park to avoid pedestrian / vehicle conflicts on
Snyder Hill Road .
20 . On - street parking should be avoided . It is not clear
of any off - street parking is proposed . On - street parking is a
primary factor in accidents on all types of streets , This is
especially true with children in a residential setting . Also ,
some elderly drivers may need off - street parking to access their
homes . Furthermore , elderly drivers are less able to turn their
heads to view on - coming traffic which is needed for curb - side
parking . Parking capacity and layout must be clarified ,
21 . The overall map states that the project will be served
by the Cornell transit system . The plans should depict any
special transit provisions such as bus stops and adequate street
and curb radii .
22 . The road profiles depict grades in excess of ordinance
requirements , which is S % maximum , We recommend a 10 % maximum
grade if a waiver over 8 % is granted .
23 , The drainage portion of the engineers report must
address the capacity of all drainage sweles and culverts both
before and after development . These calculations should be
computed per the ordinance requirements in Section V , No . 6 ,
" Drainage Improvements " .
24 . Sanitary sewer rim elevations are needed on the
profiles .
25 , The gani terry sewer grades are somewhat severe . The
applicant ' s engineer should submit calculations detailing actual
flow velocities in the proposed sewer mains. We recommend that
the elevation drops across the manholes be increased to a maximum
of two feet . This would decrease line velocities and compensate
for exit and entrance losses in the manholes . In addition ,
horizontal changes in flow directions should be 90 degrees or
less at all manholes .
26 . The manhole detail reveals a maximum possible depth of r
12 feet with a four foot diameter section , We recommend a six
foot diameter section for depths in excess of 10 feet .
27 . The standard highway cross section shown on the detail
sheet does not match the section on the road profile sheet .
28 . The estimated sanitary sewer flowrate in the engineer ' s
report is 54 , 000 gallons per day ( gpo ) for the entire site . We
request a breakdown regarding the parameter { s ) used to determine
the 544000 gpd figure .

29 . Are sprinkler systems required for the attached units ?
30 . The adequacy of the 400 gallon per minute fire flow
✓ equirement in the engineer ' s report must be documented + The
Insurance Service Organization or some other acceptable standard
shall be used . A dynamic flow pressure calculation at the
approximate fire flow rate must be submitted .
33 , What form of pressure reduction will be provided for
the water mains or individual services ?
The following comments are general comments related to the
o verall acceptability of the project . Particular attention
should be paid to these issues because they could impact the
e ntire project ,
32 . The capacity of the sewage treatment plant and all
appurtenances or systems conveying sewage from the site to the
plant must be confirmed .
33 , The Pine Tree Road and Hungerford Hill Tank water
systems experience some operational problems . The developer ' s
e ngineer should address any potential operational constraints and
coordinate his findings with the Town of Ithaca and Bo / ton Point
in written form , copying the Town of Dryden .
34 . The construction of Phase I will leave 60 units in the
Town of Dryden and an .additiona•l 19 units in the Town of Ithaca
with one access to Snyder Hill Road . The Town should require an
additional access in case the subsequent phases are never built ,
and to serve in the interim . This could entail the construction
o f the remaining proposed roadways to Snyder dill , an access to
the Town of Ithaca road system , an emergency access , or escrow
fees to insure the construction of a second access .
35 . The disposition of miscellaneous on - site tracts needs
to be addressed if it is not apparent who will own and maintain
these tracts .
36 . The Town may want to consider reducing the amount of
dedicated rights of way along streets . For instance , Peregrine
Way has almost 350 feet of right of way at one point . The burden
for future maintenance of this excessive area would seem to fall
on the taxpayer .
37 , The overall clarity and completeness of this submission
is poor . It is difficult to ascertain the intent and extent of
improvements . The town may pant to consider some additional
submission standards regarding line weights , a checklist , and
plat details , but more importantly enforcement of its existing
IMOstandards is needed . This application would be deemed incomplete

for the reasons listed in the first section of this letter .
Since the future taxpayers are ultimately paying for this
office ' s review , a checklist requirement would save money by
avoiding the lengthy report and study required for this
submission .

DISCUSSION

Residents in the Town of Dryden have to pay sales tax on their
garbage tags yet the village residents do not have to . The Town
Board is going o look into this and talk to our county
representatives ,
Ralph Vern - brought a model of his proposed subdivision and the
basic plan has not changed much . They have been working with the
Planning Board on all of the details . It will consist of
attached town houses of 7 units in a building and there will be
some single family detached houses . There will be no multiple
story type of construction which is allowed under cluster
housing but was a concern of the residents at their hearing so
they have eliminated them . They will be single family houses ,
some attached and some detached . As far as the drainage goes
t hey plan on addressing that in the engineering report . He has
met with Mr . Schlecht to find out all of the information that
w as needed . They hope to have all of the information needed by
n ext month of the full engineering report for the Phase I
project of 80 units .
