O . Slater Absent : Clm Corrigan S upv Schug appointed Cim Roberts to audit the general fund bills Approval of the minutes : Motion was made by Clm Roberts and End by Clm Walbridge that the minutes of the Site Plan Review held Jan 24th be approved after the typos have been corrected . Carried Motion was made by Clm Roberts and 2nd by Clm Walbridge that the minutes of the special board meeting held Jan 24th be approved as submitted . Carried Motion was made by Clm Roberts and 2nd Clm Hatfield that the minutes of the Feb 13th Board meeting be approved as submitted . Carried O COUNTY BRIEFING Co Rep . Watros - they have received the resolution regarding the D R7 landfill from the Town and are working on it . Co Rep Evans - would like to receive all information that is available for back up for the DR7 landfill that will be useful so that he can try and fight the battle with the committee . CITIZEN PRIVILEGE OF THE FLOOR H elen Lang , 1121 Dryden Rd - request regarding the proposed Turkey Hill water and sewer district . She has been given two totally different sets of figures of what our assessments would be if the district was established . She would like to get a set o f figures in writing of what the figures would be for the property numbers that she as given the Supv and a detailed mathematically explanation in writing as to how those numbers w ere derived , because they do not seem to follow the formula that was given to them at the informational meeting . S upv Schug - you have to understand that these are budget figures at this point based on the formula that was used The f irst set of figures were lower than the second set of figures . TB3- 13 - 90 page 2 ® ATTORNEY Atty Perkins -- would like a resolution setting May 22nd , 1990 for a special town election for the establishment of the Turkey Hill Water and Sewer Dist . The election to be conducted between the hours of 12 noon and 8 : 00PM at the Varna Community Center . RESOLUTION # 102 SPECIAL ELECTION FOR PROPOSED TURKEY HILL WATER & SEWER DIST . Clm Walbridge offered the following resolution and asked for its adoption : RESOLVED , that this Town Board schedule a special election for the proposed Turkey Hill Water and Sewer District at the Varna Community Center on May 22nd , 1990 . Hours of voting will be from 12 noon to 8 : 00PM 2nd Clm Hatfield Roll call vote - all voting Yes Atty Perkins - there are 3 classes of voters . Property owners , h usbands , wives , tenants in common , partnership is entitled to one vote , and a corporation is entitled to one vote . All electors residing within the district even though they are not property owners . All qualified electors residing within the d istrict who is a citizen over the age of 18 and has resided within the district at least 30 days next preceding the 0 election . TOWN CLERK - has received the required number of signatures on petitions requesting a special election for the proposed Turkey H ill Water and Sewer Dist . Robert Kirk - he understood that Senator Seward had sent some information regarding potential help for this proposed district and wanted to know the status of the report . S upv Schug - he has just received the material and he has not h ad time to go over all of the material . C1m Corrigan who is absent tonight but has agreed to be responsible for applying for help in receiving money . We will look at all options for money that might be available to try to reduce the cost . H oward Evans - wanted to know if there was tax relief for certain income levels , is that a possibility ? S upv Schug - it might be possible under the tax laws to deduct the interest port ion of your payment . Atty Perkins - thought the question was actual payment of the assessments . At a point during that session , Supervisor Schug opened the session to the general public . At that several residents from the Pone Plain area indicated that they would like to file a complaint concerning the action by the Dryden Town Zoning Office , in particular , the actions taken by myself in permitting the assembly of the vehicles on the property owned by yourself . Much discussion followed and after a lenity exchange , the Dryden Town Board directed me to permit the current crushing action , however , I ' m also to inform you of the following conditions that are to be ® strictly enforced by this office . Once you have completed the crushing operation , you must comply with the terms of my letter of March 27th , 1990 . For purposes of recall , I ' ve attached a copy of that writing . Once this operation is completed , you ' ll not ask to , or without asking , assemble any more unregistered vehicles on this property or any other property that is not authorized for salvage operations . At this time the only property , within the Town of Dryden , that may be qualified , is that of John and Edith Cooper on Wood Road . Lastly , I ' m directed to inform you that , if on April 11th , 1990 , these unregistered vehicles are still at this location , this office will be writing violations for unregistered vehicles , a violation of section 804 subsection 4 of the Dryden Town Zoning Ordinance . DR - 7 Site : Since meeting with the Town ' s agronomist we have not had any activity regarding the review of the County ' s plans for the DR - 7 site . ® 2 . Overall Town map : We have not received any information from the DOT regarding the base map and per your instructions have put this project on the inactive list . We will not be taking any further action on it until we receive your go ahead . 3 . Cortland Road Water District : No further action has been undertaken on this project and we expect that it will be put on the inactive list . 4 . Signal Tower Road : The status remains unchanged . We will be waiting for an indication from Don Gilbert that the turn - around has been finalized . 5 . Yellow Barn Road Reconstruction : Field work has been completed and within the next several weeks we will be preparing a right - of -way map . 6 . Snyder Hill Road Planned Development : We have reviewed the preliminary drawings submitted by Larry Fabroni . We have met with Mr . Fabroni and Ralph Varn to discuss our concerns . This project remains on - going . 7 . Hall Road Reconstruction : Our office has been helping to coordinate with the New York State Department of Transportation . Further action is pending the outcome of land 401 acquisition . b 8 . Yellow Barn Road Water District : The report will be available for distribution to the Town Board at the next regular monthly meeting . We ' ve had ongoing discussions and coordination with the interested parties . I think we should plan on having an in depth discussion on the status of this project during the month of April . 9 . The Moore Woods Subdivision : We had previously been requested by the Planning Board to review plans for the Moore Woods Subdivision . That review has been undertaken and is presently undergoing discussions with the design engineer , 10 . Dryden Mutual Insurance Company : Bob Siegart , architect for Dryden Mutual Insurance Company project , has informed me that he will be forwarding to the Town a drainage report and plan , which we would expect to review . Flumerfelt to Dryden Town Board , 03113 / 90 Page 2 Recommendations 1 . Seek agreement with Hr . Eastman to develop a Swale along his westerly property tine directing runoff to the existing 26 " culvert " C " under Lower Creek Road . This smooth steel culvert is in good condition and carries much of the roadside ditch drainage from the north side of Lower Creek Road across to a drainageway on the south side of Lower Creek Road . The proposed berm on the Abbott Subdivision Parcels # 2 and 43 could be ended where shown in the sketch at the westerly line of the NYS property , The drainage originally proposed to be d irected along the north side of this berm to the storm drain system on the west side of Abbott Road would then be directed t o culvert " C " , the culvert to which most of it now drains w ithout the berm but in several poorly defined drainage swales across the yards of Lower Creek Road residents . 2 . Abandon culvert " s " and construct new culvert '{ R " where shown in the sketch . This would eliminate the need to construct a ✓ oadside ditch on the south side of Lower Creek Road as was suggested by one resident at the Planning Board meeting as e possible improvement to keep the flow from culvert " B " from meandering across private property " P " as it does now . In the process , the ditch between culvert " A " and culvert " D " should be deepened to create a proper gradient for the flow from A " to " D rf culvert " D " is relocated as shown , it will discharge into a natural , well - defined Swale through a wooded area instead of across property " P " where it is now objectionable . The new culvert should probably be 30 " diameter , however the Town should determine the proper size and slope of the culvert after a more thorough study of the entire area draining to it . A natural location exists for this new culvert with its inlet e nd near the cedars at the southwest corner of property " Q " . The ditch in front of property " Q " would not have to be disturbed , Please contact me if additional clarification is needed , or if I may be of further assistance . Aery Tr y� , �v Robert R . S upv Schug - would like to schedule a Site Plan Review meeting f or HEP Materials on March 27th at 7 : 00PM with a Town Board meeting to follow . TOWN ENGINEER - gave his report and copy in minute book ZONING OFFICER - report given to Board members S upv Schug - wanted to know the status of the unsafe structures ? Z . O . Slater - has contacted Atty Perkins has to how he should h andle these situations and there should be more information for next board meeting Supv Schug - Z . O . Slater has a request to discuss building permit life . At the present time there are no restrictions on the life of a building permit . Z . O . Slater -- in Section 1800 there is no limit , however the State of New York specifies that a building permit shall expire within 3 years from the date of issue once it has been utilized . The Town says the building permit expires 1 year after date if ® substantial start has not begun . He is not sure what a substantial start means , but he would consider it to be a foundation . He sees that a person could keep applying and getting a new permit and continue with what they are doing . He h as one permit that is 5 years old . Atty Perkins - felt by definition that is not substantial progress . H IGHWAY SUPERINTENDENT - H wy Supt Gilbert would like a resolution accepting a bid for a body and hoist in the amount of $ 9 , 225 . 00 from Tracy Road Equipment RESOLUTION # 103 ACCEPT BID FOR BODY & HOIST Clrn Walbridge offered the following resolution and asked for its adoption : ( copy in minute book ) 2nd Clm Hatfield Roll call vote - all voting Yes H wy Supt Gilbert - has a 1973 loader with 5400 hours that needs major work on the engine . He has received some estimates of between $ 8 , 000 and $ 10 , 000 just to rebuild the engine . There is a trade in value of about $ 24 , 000 and a new loader is about $ 160 , 000 . 00 . He does have $ 30 , 000 in his budget and with the 0 $ 24 , 000 trade in he would have $ 54 , 000 to bid / lease a loader with a 3 or 5 year purchase agreement . He felt that the present 45/ 7D3 - 13 - ) page 4 loader has a lot of hours and this is only the beginning for the ✓ epairs on it . He would like to bid it out both ways with and without trade and a 3 or 5 year lease . There was some discussion and the Board members felt that they should have more information . CORRESPONDENCE L etter of resignation - Gene Rotunda , Planning Board member . Ambulance report D og report D ISCUSSION There is still a vacancy on the IDA Varna pump station has received a report and there will be a meeting with the people involved with the utilities . ✓ illage Wastewater treatment plant - the Village said they would do the report without the Town . We have asked the Village to allow the Town to be party to an expansion since it is part of o ur 10 year contract . At that time the Village wanted to know why and looking et the Cortland Rd sewer district we couldn ' t get water . We have 50 , 000 GWD and are at that capacity now . For $ 10 , 200 it will give the Village a report . The report that they 0 will receive is what is wrong with the existing plant and the amount of work that has to be done to fix it . It does not address things that the Town is interested in , which would be for expansion and if there is room for expansion for 500 , 000 g allons a day so the Town could have another 200 , 000 gallons . Clm Walbridge - wanted to know if the Town does not pay for anything in the report are we some how setting a precedent that w e are not involved with the Village Wastewater treatment plant ? S upv Sehug - we are involved by contract . If the Village expands it they have the right to ask the Town for part of the expense . W e have already requested them the ability of making the plant bigger . This report only addresses things that are wrong with the existing plant . if they were willing to go into greater detail for the expansion of the plant than the Town should pay for part of the report . tatty Perkins - the Town ' s concern would de what would be the bottom line number , can we expand and what swill it cost . The Town is already obligated for the repairs . Whether we participate or not we will be paying for the repairs end the u ser charges that are assessed . If the proposal is to address e xpansion than the report should say that . 0 TF3 - 13 - 3O page 5 IIIGeorge Schiecht - the Town Board should keep in mind that the ✓ eason that the plant is at capacity is not necessarily a hydraulic problem . It isn ' t a question of how much liquid you can get through the plant . It is a problem with the process , so that as the affluent comes out it is not treated properly . If the report can come up with some solutions , he suspects that fixing the process there is going to be capacity without doing any necessarily adding any more facilities . At some point they Are close enough so that facility is going to have to be added to . He thinks that when the process gets fixed you will pick up some extra capacity . It doesn ' t mean that you are thing to need more buildings . S upv Schug - but if the Town paid for half of the present study and the capacity increased we wouldn ' t have any more than what w e already have according to our contract until the plant i s e xpanded . He would like their engineer to address the feasibility of increasing the capacity of plant . G eorge Schlecht - he has gone through the plant and has talked t o him a little bit abet it , but has not seen his proposal . He thought he should discuss this problem because they have talked about other alternatives that relate to the Town . There was a suggestion to consider at the time of building the Pinckney Rd bridge , to save the town money would be to bury water and sewer lines in the creek bed w hile it was dammed up . There also was a suggestion of hanging them from the bridge . The Town Engineer said that was not a good idea to hang then from the bridge . S upv Schug - reported that he has looked at the the expansion of the Town Hall and the possibility of a separate building for town offices . He would like to get a survey of the property that the Town owns and where the buildings are located on the property . He has an estimate of about $ 850 . 00 to $ 1 , 000 . 00 and would like a resolution to have that done . It will take 12 weeks for the Attorney General to ✓ eview the form that we send back to them and we do not have the permit from DEC yet because that is still in review . It will be very hard for the Town to spend the money in 1990 . We will also h ave to discuss what the next step will be as far as the final plans . The Wilcox site requires additional water capacity and pressure in order to meet insurance company underwriters standards . Wilcox will e ither have to construct on site its own 300 , 000 gallon tank , h eat it and provide a booster pump or they can participate with the Town in a joint venture in the construction of a tank on the N YSE & G site with a 12 inch line down to the existing 12 inch main . It would provide enough water , but it would not provide ® enough pressure . Wilcox in any event will have to have their own booster pump . This would provide additional water and additional pressure for the existing Monkey Run water district and perhaps the proposed Turkey Hill water district . If the Turkey Hill w ater district is defeated this night lower the project cost if w e don ' t need a separate tank on the other end of the district . r It was proposed that Hunt Engineer look at the respective costs o n the alternatives . The tank would not only serve Wilcox Press needs , although it would enable them to get their insurance u nderwriters requirements without them having to have their own tank , but would also serve Monkey Run water district and any future districts established . He requested from Hunt Engineer an e stimate of doing the study .
