Mr Westerling did go the ZBOA with a request for a variance for using his own water supply which was granted because of hardship . In the original h earing Mr Westerling agreed to hook up to municipal water when it became available . Mr Westerling - if he is required to , but if he were to hook up at existing rates it would increase each lot rent by $ 31 . 52 a month and he felt that mobile home parks are one of the few places where affordable housing is available . They have the e lement of ownership and own their own house and get appreciation . If he has to up the rent by $ 31 . 00 a month he feels it is a lot but if it is required he will go ahead with it . The $ 31 . 52 is the village rate and Bolton Point rate would be about $ 22 . 00 a month , this is just the cost for the water . Clm Evans - thought the the addition to the mobile home park should not cone under the Site Plan Review , but under the Mobile H ome Park Ordinance . H enry Slater - this is by special permit application and not a site plan review . This application will have to be passed by the ® Town Board and than turned over to the Planning Board . S upv Schug - so if there are any restrictions or requirements they should be put on at this time before it is referred to the P lanning Board Clm Evans - agreed that the water hook up should be included when it becomes available . Clw Walbridge - wanted to know the reason for allowing a trailer park to expand without going on municipal water and sewer . She thought the whole purpose of the zoning board was to insure that trailer parks were on municipal water and sewer . That is a fairly substantial expansion in terms of water and sewer . Wanted to know the rational to allow the expansion without existing water and sewer . She still questions the whole issue of allowing extra lots w hen the zoning ordinance specifically states no expansion unless it is on municipal water and sewer . Now you are overriding the zoning ordinance . S upv Schug - sewer is available and it is hooked up . Mr W esterling does have water available and is approved by the H ealth Dept . Clm Evans - if Mr Westerling has a variance that would over ride ® anything . I ' TB12-21 -89 page 2 Henry Slater - has all of the figures available , engineering ✓ eport and Health Dept approval with regard to the water . He has more water pressure than the Village of Dryden . 'Karl Westerling - he provided the 7. BOA with a letter from the Health Dept with regard to his water system . His two wells are e ach producing double the amount of water that he needs . He can u se his pressure pump , the well or the tanks and have a completely functional trailer park . W ILCOX PRESS S upv Schug - they would like to see the final drawings on the d rainage and landscape RESOLUTION # 28 3 WILCOX PRESS Clm Evans offered the following resolution and asked for its adoption : RESOLVED , that this Town Board approve the sewer and water plans to go under the existing Route 13 to Wilcox Press property and sized so that it can be used to extend water and sewer beyond the W ilcox site and that it be terminated with a I at that point and approved by the Town engineer . In concept of the print of 10 - 9 - 89 . Approval is conditioned upon : 1 ) The project during and following construction comply with all applicable local , county , state and federal Ordinances , Codes , Laws , Statutes , Rules and Regulations . 2 ) That the project be constructed according to the plans ® submitted by the applicant and approved and filed with the Town . 3 ) That the project during construction and upon completion not constitute a public or a private nuisance . 4 ) That when municipal water and / or municipal sewer is available the applicant shall connect to the same upon notice to do so from the Town . 5 ) That should the Town require easements for municipal water lines and / or municipal sewer lines and necessary appurtenances , that the applicant , its successors and assigns grant them to the Town without the necessity of compensation for the same .
