The proposed amendments are as follows : Section 401 of the Town of Dryden Zoning Ordinance as last amended is hereby amended as follows : " Section 401 . All land in the Town of Dryden shall fall within one of the established zones as shown on a map entitled " Town of Dryden Zoning Map " orgi na lly prepared by E gner and Niederkorn Assoc . , Inc . and last revised 3 / 14 / 88 " . [ The area to be effected by such change is more particularly described as follows : ALL THAT TRACT OR PARCEL OF LAND situate in the Town of D ryden , County of Tompkins and State of New York bounded and described as follows : B EGINNING at a point in the centerline of New York State Route 13 where the same is intersected by the former centerline of the tracks of the Lehigh Valley Railroad Company and proceeding thence generally northeasterly and . along the centerline of the abandoned tracks to a point in the centerline of Pinckney Road ; proceeding thence northerly and along the centerline of Pinckney Road to its intersection with the centerline of Lower Creek Road ; proceeding hence generally westerly and along the centerline of Lower Creek Road to its intersection with the centerline of New York State Route 13 ; proceeding thence southwesterly along said centerline of New York State Route 13 to the point or place of beginning . Susanne Lloyd Town Clerk S e;:e41 NOTICE OF PUBLIC HEARING ® TOWN OF DRYDEN TRAFFIC ORDINANCE TOWN OF DRYDEN PLEASE TAKE NOTICE that the Town Board of the Town of D ryden will hold a public hearing on a proposed Town of D ryden Traffic Ordinance . The proposed ordinance is as follows : 1 . This Ordinance shall be known and cited as the Town of Dryden Traffic Ordinance . 2 . This Ordinance is adopted pursuant to Article 41 of the New York Vehicle and Traffic Law and Article 9 of the Town Law . 3 . This Ordinance shall apply to all the Town highways outside of the Villages of Dryden and Freeville . 4 . Upon the recommendation and report of the Town H ighway Superintendent indicating that it is in the public good and in the best interests of the Town road in question , t he Town Board may by order : a ) Temporarily exclude from any portion of any Town highway any vehicle with a gross weight of over four or more tons or any vehicle with a gross weight in excess of any designated weight on any wheel , axle , any number of axles , o r per inch width of tire when in its opinion such highway would be materially injured by the operation of any such ✓ ehicle thereon . Such exclusion shall take effect upon the e rection of signs on the section of highway from which such ✓ ehicles are excluded , and a notice that such vehicles are e xcluded shall be published in the official Town newspaper . The exclusion shall remain in effect until the removal of the signs as directed by the Town Board . Upon written application by any operator of a vehicle subject to this section , the Town Board may issue a permit providing appropriate exemption to such vehicle , if it is deemed that said vehicle is performing essential local pickup or d elivery service and that a failure to grant such permit would create hardship . Every such permit may designate the ✓ oute to be traversed and contain other reasonable ✓ estrictions or conditions deemed necessary . Every such permit shall be carried on the vehicle to which it refers and shall be open to inspection of any peace officer , acting pursuant to his special duties , or to any police officer . Such permits shall be for the duration of the restriction imposed under this section . • b ) Exclude trucks , commercial vehicles , tractors , • tractor - trailer combinations , tractor - semitrailer combinations , or tractor - trailer - semitrailer combinations from highways specified by such Town Board . Such exclusion shall not be construed to prevent the delivery or pickup of merchandise or other property along the highways from which such vehicles and combinations are otherwise excluded . c ) Exclude trucks , commercial vehicles , tractors , t ractor - trailer combinations , tractor - semitrailer combinations , or tractor - trailer - semitrailer combinations in excess of any designated weight , designated length , designated height , or eight feet in width , from highways or segments of .such highways . Such exclusion shall not be construed to prevent the delivery or pickup of merchandise o r other property along the highways from which such ✓ ehicles or combinations are otherwise excluded . 5 . The Town Board shall cause to be determined , for all bridges , culverts and elevated structures under its jurisdiction , the capacity in tons ( of two thousand pounds ) w hich the bridge , culverts or structure will safely carry . At bridges , culverts or structures of insufficient strength to carry safely the legal loads permissible by section three hundred eighty - five of the New York Vehicle and Traffic Law signs shall be erected to inform persons of the safe ® capacity . 6 . The legal overhead clearance for all bridges and elevated structures on highways under ' the jurisdiction of the Town Board shall be determined . The legal clearance shall be one foot less than the measured clearance . The measured clearance shall be the minimum height to the bridge o r structure measured vertically from the traveled portion o f the roadway . On bridges or structures having fourteen feet or more of measured clearance , no such signs shall be ✓ equired . 7 . The Town Highway Superintendent shall cause to be posted any • such road , bridge , culvert or structure which is subject to any restriction , regulation or limitation in o ccordance with the Vehicle and Traffic Law Section 1683 . 8 . The provisions of paragraphs 4 ( a ) ; ( b ) ; and ( c ) which permit the delivery or pickup of merchandise or other property along the highways on which such vehicles or combinations or otherwise are excluded shall not be deemed to permit or allow delivery or pickup other than as herein set forth . Delivery or pickup shall include : regularly scheduled garbage , trash or rubbish removal from any residence along such highway ; the delivery of building products or materials to a site that can only be reached ® over such highway ; the pickup or delivery of school children ; the use by farm machinery or equipment ; the use by Town employees operating Town highway equipment for paving , reconstructing , rebuilding or maintaining such highway ( including snow plowing ) ; and the use by fire apparatus or 0 other emergency equipment . Delivery and pickup shall not include regular and continuing use by such vehicles as a ✓ oute to reach a particular site or as a through highway between two or more other highways not subject to similar ✓ estrictions , regulations or limitations . 9 . Any person convicted of violating this Ordinance on the first such conviction may be punished by a fine not e xceeding $ 250 . 00 and by a period of imprisonment not e xceeding 15 days . Upon the second such conviction of said person the fine shall not exceed $ 500 . 00 or. and /or 90 days imprisonment and for a third and all subsequent convictions the fine shall not exceed $ 1 , 000 . 00 and the period of imprisonment shall not exceed 1 year for each such conviction . 10 . For the purposes of this Ordinance the owner of the vehicle in question shall be deemed to a person as well as the operator of such vehicle and both the registered owner and the operator may be convicted of a violation of this Ordinance and punished as set forth herein . 11 . The Town Board may also maintain an action or proceeding in the name of the Town in a court of competent jurisdiction to restrain by injunction the violation of this Ordinance or any rule , regulation or order promulgated by lip the Town Board notwithstanding that this Ordinance provides a penalty or other punishment for such violation . 12 . This Ordinance shall take affect upon publication and as provided by law . The public earing on the proposed ordinance will be held at 7 : 45 p . m . prevailing time at the Dryden Town Hall , 65 East Main Street , Dryden , New York , on April 11 , 1989 , at which time interested parties will be heard . Susanne Lloyd Town Clerk RESOLUTION NO . 93 - 1989 Councilman Evans offered the following Resolution and asked for its adoption : WHEREAS , the Town Board has from time to time amended t he Town of Dryden Zoning Ordinance including amendments which were most recently passed and effective in April 1988 , and WHEREAS , certain residents of the Town of Dryden have ✓ equested a ' change in an area of the M - A Zone located near H all Woods Road and which was created by the amendments to t he Zoning Ordinance effective in April 1988 , and WHEREAS , this Town Board ought to be receptive to the wishes and desires of property owners affected by zoning changes when it has been demonstrated that such change is inappropriate for some or all of the area affected by such change , and WHEREAS , a change from M - A Zone classification to R - C Zone classification will change the zone back to its classification prior to the changes effective April 1988 , and WHEREAS , no property owner will be adversely affected by such change to R -C classification and in fact several property owners have requested such a change for the area S - affected by this resolution , and WHEREAS , it is not the intention of this resolution or any change to the Town of Dryden Zoning Ordinance to effect any approvals which have been given prior to the effective date of this amendment or to create any additional requirements for any approvals , projects or construction which have been given , are under way or in existence , NOW , THEREFORE , BE IT RESOLVED BY THE TOWN BOARD OF THE TOWN OP DRYDEN AS FOLLOWS : 1 . TRAFFIC ORDINANCE Councilman Evans offered the following (II Resolution and asked for its adoption : WHEREAS , Section 1660 of the New York Vehicle and Traffic Law gives power to the Town Board to enact Town Ordinances restricting , regulating , limiting and otherwise controlling traffic on Town Roads outside of any Village and subject to the limitations contained in that section , and WHEREAS , the Town of Dryden has over 125 miles of Town Roads which it is charged with maintaining and overseeing , and WHEREAS , the annual cost of such maintenance of Town Roads is a major part of the Town Budget , and WHEREAS , it is in the best interests of the taxpayer' s and residents of the Town of Dryden for the Town to exercise its jurisdiction over Town Roads as provided in Section 1660 for the preservation and protection of such roads and the protection of persons and property and for the general health , welfare and safety of the residents of the Town all o f which restrictions , regulations and limitations will save t axpayer monies in reconstruction and maintenance costs , now therefore , BE IT RESOLVED BY THE TOWN BOARD OF THE TOWN OF DRYDEN AS FOLLOWS : 1 . This Ordinance shall be known and cited as the Town o f Dryden Traffic Ordinance . 2 . Seconded by Councilman Hatfield toll call vote - all voting Yes 43 -t • 95 LAND RESIDUE DISPOSAL RESOLUTION NO . - 1989 FROM CAR WASH IN TOWN OF DRYDEN • • Councilman Evans offered the following resolution and asked for its adoption : S WHEREAS , in the County of Tompkins there are a number o f car washes and other commercial operations which employ processes that involve waterborne particles and solids which are leftover residue of the operation , and WHEREAS , such residue is presently pumped out of ✓ eceiving or holding tanks or vaults and is disposed of by land spreading in apparent violation of applicable New York D epartment of Environmental Conservation Rules and Regulations regulating the disposal of the same , and WHEREAS , the Tompkins County Health Department has not I taken agressive enforcement measures regarding the unlawful d isposal of such residue , and WHEREAS , such disposal is contrary to the public health , safety and welfare and it is in the best interests o f all residents of the County of Tompkins to have the safe and lawful disposal of such residue , NOW , THEREFORE , BE IT RESOLVED , by the Town Board of t he Town of Dryden as follows : 1 . That the Town Board go on record as opposing any continued or further land disposal of such residue . a 2 . That the Tompkins County Board of Representatives pass applicable County legislation including necessary regulations to be made part of the Tompkins County Sanitary Code prohibiting such disposal except in a regulated sanitary landfill equiped to receive the same and in strict compliance with all such applicable rules and regulations . 3 . That the Town requests the Tompkins County Health Department to immediately begin vigorous enforcement of existing applicable regulations regarding such disposal . Seconded Catl.ock Roll call. vote - all voting Yes f F 3- • SEPTIC TANK DISPOSAL RESOLUTION NO , 96 - 1989 IN THE TOWN OP DRYDEN Councilman Evans offered the following resolution and asked for its adoption : WHER €AS , there currently exist in Tompkins County t housands of septic tanks , vaults , holding tanks or other ✓ eceptacles of wastewater from domestic , commerical and o ther uses all of which need emptying from time to time and the wastewater and solids therein disposed of , and WHEREAS , presently the preferred method of disposal is by land spreading as evidenced by the permits issued by the Tompkins County Health Department for the land spreading and d isposal of such wastewater and solids , and WHEREAS , such land spreading is necessary only in the event alternative disposal facilities are not available , and WHEREAS , the Ithaca Area Waste Water Treatment Facility is now in operation and the septage receiving station o perated for the County of Tompkins by the Ithaca Area waste Water Facility is now receiving wastewater and solids for treatment and disposal , and WHEREAS , it would be in the best interests of all of t he residents of the County of Tompkins to have such wastewater and solids properly treated in such a facility to avoid the necessity of spreading septage , sludge , untreated waste water and solids on the land where it may come in contact with animals and people and may lead to the 01/ pollution of such land or streams because of run off or uncontrolled or unregulated disposal , and ® WHEREAS , it is in the best interests of the public , health , safety and welfare of the residents of the County of Tompkins to restrict such land spreading , NOW , THEREFORE , BE IT RESOLVED by the Town Board of the Town of Dryden as follows : 1 . That the County of Tompkins should prohibit the continued land spreading of wastewater and solids from septic tanks , holding tanks , vaults and other receptacles including from domestic and commercial facilities . 2 . That the County of Tompkins should require all septage and other untreated wastewater and solids from septic tanks , holding tanks , vaults and other receptacles • including from domestic and commercial facilities be transported to the septage receiving station at the Ithaca Area Waste Water Treatment Facility for treatment and disposal . 3 . That the enactment of such a program should be as soon as practicable but in no event later than September 1 , 1989 . 4 . That copies of this resolution be distributed to all elected officials of Towns and Villages within the County and to all members of the County Board of Representatives . Details of each are attached on attachment ft { I ) , Other Action : This office has been activily enforcing the Provisions of the Dryden Town Zoning Ordinance and some details of results Follows , 55 Notices of Condition of Violation have been sent out during the first ( 3 ) months o f the year , Of these ( 12 ) residents compiied with the first notice . Another ( 29 ) required a second notice , There were ( 3 ) who registerd a seasonal use vehicle with this office ¢ i believe that some people think that they can simply claim any old vehicle as such and that will be the end of the issue , Some residents are finning that things are not as simple as that , We do a very good job of follow - up on these cases . Many of this years ( 55 ) notices were to people who had registered vehicles as seasonal o r that the vehicle in question was under repair for one resort or another and would be in compliance within the allowed C to 12 month time frame , A check by this office found that these agreed to allowances had not been completed , therefore , we followed o p . I would guess that about 90 of these cases end In a second violation issue . There have been ( 14 ) vehicle cases sent on to the Dryden Town Court for Compliance , It will take some time for all of these to be resolved , The court has to schedule cases as to the order that case come to the court , Take it from me , crime is alive and doing very weil in our Town . We have had some cases resolved at this date , One of our seasonal use abusers found out that we keep track of their commitments . We also have ( 2 ) N . Y ., S , Fire Prevention h Building Code Violators in the Court as well . You will note that I ' ve attached a copy of the Abandoned d Unsafe Structure Local Law for your review . The reason for this is the fact that you will be receiving From this office up to ( 6 ) such cases that we are going to ask you to resolve the removal of as detailed by the local law ., I expect chat you will have these for your review by the May 1989 Town Board Meeting . Be it enacted by the Town Board of the (Nre• a/ Leahasti a Body ) emory • ittax of • Dryden as follows : Town WINO( . Section 1 . Purpose . Unsafe buildings pose a threat to life and property in the Town of Dryden . Buildings and structures may become unsafe by reason of damage by fire , the elements ; age or general deterioration . • Vacant buildings not properly secured at doorways and windows also serve as an attractive nuisance for young children who may be. injured therein , as well as point of congregation by vagrants and transients . A dilapidated building may also serve as a place of rodent infestation thereby creating a health menace to the community . It is the purpose of this local law to provide for the safety , health protection and general welfare of the persons and property in the Town of Dryden by requiring such unsafe buildings be repaired or demolished and removed . IIISection - 2 . -- Title . This local law shall be known as the " Unsafe - Buildings - Law " of the Town of Dryden . , Section 3 . Definitions . (1 ) " Building " means any building , structure , or portion thereof used for residential , business or industrial purpose . • (2 ) " Building Inspector " means the zoning enforcement • officer of the Town of Dryden , or such other person appointed by the Town Board to enforce the provisions of this law . Section 4i Investigation and Report . When in his own opinion or upon receipt of information that a building ( 1 ) is or may become dangerous or unsafe to the general public , ( 2 ) is open at the doorways and windows making it accessible to and an object of attraction to minors under eighteen years of age , as well as to vagrants and other trespassers , ( 3 ) is or may become a pace of rodent infestation , ( 4 ) presents any other danger to the health , safety , morals , and general welfare of the public or ( 5 ) is unfit for the purposes for which it may lawfully be used , the building inspector shall cause or make an inspection thereof and report in writing to the Town Board his findings and recommendations in regard to its repair or demolition and removal .
