Present were: Supervisor Glenn Alexander presiding: Justice E. Hedges Councilmen Sherman Griswold and Henry Wadsworth, Supervisor's Book-keeper Rudy Krauklis, Hgwy Sup't. Floyd Colegrove,Town Attorney Ted Fenstermacher and Mr. Donald Eaton of McGraw. The resignation of Merton Bean as Justice of the Peace was read by Lelan M. Brookins, Town Clerk, and accepted, on motion of Mr. Griswold and seconded by Mr. Wadsworth, with unanimous approval of the Board. Mr. Bean has been elected as Assessor . On motion of Mr. Wadsworth and seconded by Mr. Griswold, Mr. Donald Eaton of McGry ,- was �IDooiRted for the year of 1963 to fill the unexpired term as Justice of the Peace. Roll call vote, Glenn Alexander -- aye Sherman Griswold- aye H. Wadsworth -- aye Motion Carried: Motion by Sherman Griswold and seconded by Henry Wadsworth that the Cortland Standard be designated as Official newspaper for 1963, motion carried. (Due to Assoc. of Towns meeting) Motion by Mr. Griswold and seconded by Mr. Eaton that Gordon Hatheway be re -appointed for a 5 year term on the Planning Board. Motiinn carried. Motion by Mr. Wadsworth and seconded by Mr. Griswold that Ray Thorpe be apponted to the Appeals Board for a 5 year period. Motion by Mr. Griswold and seconded by Mr. Wadsworth that any Town members of the Official Family attending the Assoc. of Towns Meeting, that their expenses be paid (Feb. 4,5,6, 1963) New Y9rk City, Motion carried. Motion by Mr. Eaton and seconded by Mr. Hedges that water bills on District # 1 and District ## 2, be paid.. Motion carried. Motion. by Mr. Wadsworth and seconded by Mr. Hedges that the lst Nat. Bank be designated for General Fund Account s, Highway Aecount's, Town Clerk's Accounts, Taxes and Sewer accounts. This motion was carried. 2. Motion by Mr'. Eaton and seconded by Mr. Wadsworth that the following Salary Schedule be approved for the year 1963. Lelan M. .Brookins, Town Clerk,/ F-if ;2,44 d January 14, 1967, Special meeting of the Toifn Board following a Public Hearing by the Appeals Board. Subject: Amendment of Section 21 Zoning Ordinance. On reccommendation of the Appeals Board a motion was made by Donald Eaton (newly appointed Justice from the Village of MlcGraw) seconded by Justice Earl Hedges of West Road, that this Section 21 of the Zoning Ordinance be amended as follows: Section 21. Commercial Excavation and Stripping of Top Soil. The excavation and sale of sand and gravel, clay or other natural mineral deposit or the quarring of any kind of rock formation or the stripping of top soil is oermitted in any district, except In a res- idential district, provided such excavation or quarrung or stripping of top soil will not endanger the stability of adjacent land, and Is not located within 350 feet of a street or highway line. This motion eras carried and approved by roll call vote, Supervisor G. Alexander aye Justice D. Eaton aye Justice E. Hedges aye Councilman H. Wadsworth aye Councilman S. Griswold absent. Town Hall, Terrace Road, Regular meeting of the Town Board was held at 8 PM, Supervisor Glenn Alexander presiding: Present were Justices Earl Hedges and Donald Eaton, Councilmen Henry Wadsworth and Sherman Griswold, also R. Krauklis,(Supervisorrs book-keeper) Floyd Colegrove , Highway Supt., Ted Fenstermacher, Toim Att. and Mr. Robert Clark and Mr. Kalilec of Halstead Road. Mr. Clark and Mr. Kalilec were concerned as to whether there would be adjustments made in their water bills ,due to the fact they have had to leave their water running to avoid more freezing. Town Clerk read letter from Jerry Happek ,Architect, about the cracks in walls of the Town Building. This letter was turned over to Town Attorney, Fenstermacher, Another letter was read by the Town Clerk, from Sam . Cincotta in regard to planning recreation and a playground for children in the South Cortland area. This letter will be referred to the Planning Board and taken up in the new Plan- ning Program. Town Clerk read two letters from Mr. Frank Schadt of Syracuse owner of the former Edson property where he had established a laundermat. Both letters were discussed and it was decided a meeting should be set up with Mr. Schadt and Mr. Gehm (NNN XXMXXX Manager of the Laundermat)and Mr. Rowell,Engineer to see what could be done to enable Mr. Schad-" and Mr. Gehm to re -open the Laundermat. On motion of Mr. Griswold and seconded by Mr. Hedges the Town Board unanimously resolved as follows: Be it resolved by the Town Board of the Town of Cort- landville, New York, that the -City of Cortland, New York be and hereby is authorized and designated to be the respon- sible party to receive and expend State funds for the joint application from the Town of Cortlandville and the Village of Homer and the City of Cortland to the New York Slate Depart- ment of Health for a State Grant under the provisions of Section 12, of the Public Health Law, to finance the cost of a comprehensive study and report for the collection, treat went and disposal of sewage in and for the above mentioned communities. Adopted February 7, 1963, Motion by Mr. Eaton and seconded by Mr. Wadsworth that all bills on General Fund, Water District � 1 and Sewer District # 1 as read by the Town Clerk be paid. This motion was carried The Town Clerk presented copies of his yearly report to the Supervisor and to members of the Town Boards. The yearly report of the Supervisor was filed with the Town Clerk at this meeting. There being x1ga no further business at"this time ,meeting was adjourned. Lelan M. Brookins, Town Clerk February 15, 1963 ------ 1 PM. Special meeting of the Town Board held at the office of Justice Earl Hedges on West Road. ( Regarding purchase of lands of Louis Russell.) Present were: Justice Hedges,Councilman Sherman Griswold R#3, Councilman Henry Wadsworth, Rol, McGraw and Justice Donald Eaton of McGraw. In the absence of Supervisor Glenn Alexander[who is spend- ing some time in Florida !I a motion was made by Councilman Wadsworth and seconded by Justice Hedges that Councilman Griswold be apponted chairman, this motion was carried unanimously. Upon motion duly made and seconded, by Mr. Eaton and Mr. Wadsworth it was unanimously: RESOLVED, pursuant to Section 64 (2) of the Town Law, that the Town acquire by purchase from, Louis Russell for the sum of $1, 800,, approx- imately 8 acres of lsnd situate in the Town of Cortlandville adjacent on the east to the Snell Road;, and be it further RESOLVED that a contract of purchase and sale of such land be ex- ecuted, on behalf of the Town of Cortlandville, by the following members of the Town Board, viz: Messrs, Eaton, Hedges, Griswold and Wadsworth, upon the approval of such contract by Town Attorney. There being no further business at this time,the meeting adjourned. February 26, 1963, 8 PM. Town Office, 15 Terrace Road A .",.meeting was held at the request of Justice Earl Hedges to discuss the water line difficulties for the Schadt-Gehm ,Launder -mat on Route 13 towards S. Cortland, which was broken in August 1962. Present were Justice Earl Hedges and Donald Eaton, Councilmen Sherm. Griswold and Henry Wadsworth, William.Rowell,, Engineer for Stearns & Wheler, Floyd Colegrove ,Highway Sup't. Town Attorney Theodore Fenstermacher and Mr. Schadt of Syracuse, Mr. Gehm of Killawog. After lengthy discussion it was decided that Mr. Schadt will hire a Surveyor(D. McKee) fora complete picture of this area and after the survey is completed and presented to Engineer W. Rowell, he,(Mr. Rowell) will prepare plans and estimated cost for a proposed extention of the water dist. to include Mr. Schadt's property. Mr. Schadt informed the Board at this time that he wishes to have all of his land zoned commercial for a proposed enlargement of his business. This will be taken up by the Appeals Board when his application has been filed with the Town Clerk. There being no further business at this time the meeting was adjourned. Lelan M . Regular meeting of the Town Board of the Town of Cortlandville was held at 8 PM., Supervisor Glenn Alexander presiding: present at this meeting were Justices Earl Hedges and Donald Eaton, Councilmen Sherman griswold and Henry Wadsworth. Also present were Supervisor's book-keeper, R. Krauklis, Town Attorney T. Fenstermacher, Highway Superintendent, Floyd Colegrove, Engineer from Stearns & Wheler, Mr. William Rowell. Planning Consultant for the Town, Mr. Arthur Reed, Frank Taylor, chairman -of the Appeals Board, Russell Parson , and L.D. Thomas, Mr. Gordon Hatheway, chairman of the Planning Board, Mr. Ray Penney and Willard Griswold. Mr. Phillip Allen of Allen Drive and Mr. Frank Natoli appeared before the Board for reimbursement in regard to bills for thawing out the water at their residences, Mr. Allen's bill amounted to $22.50 and Mr, Natoli's amonted to $30.00. On motion of Mr. Eaton seconded by Sherman Griswold it was unanimously approved by the Board that the Town should Day these bills. Mr. James Yaman was present and some unidentified residents of Morningside Drive, the proposed Gravel Piton the McEvoy property was discussed. At this time Mr. Arthur Reed explained about the new ex- cavation ordinance. He read the present ordinance and also read the proposed ordinance. The Town Clerk read a letter from Mr. Russell Parsons, secretary of.the Appeals Board in regard to the rezoning of the Arthur Yacovone property as per the petition of Arthur Yacavone and Cortland Develop- ment Company Inc. After consideration, upon motion of Dexter Paddock , seconded by L,D,Thomas it was unanimously approved by the Appeals Board to rezone this land from r4sidential to industrial. On motion of Mr. Hedges seconded by Mr. Eaton the Town Board goes on record as approving this zoning change, Mr. Alexander --- aye Mr. Hedges aye Mr. Eaton aye Mr. Griswold aye Mr. Wadsworth aye On motion of Mr. Griswold and seconded by Mr. Hedges with the unanimous approval of the Board it was agreed to employ the Foot Bros. to exterminate the rats at the Town Dump at -a rate of 47.00 per month. Mr. William Rowell, Engineer, informed the Board that the Water Tank and System will be ready to operate by June 1, 1963. He also reported that it would require and estimated 900 ft. of Iron Pipe to the 8chadt Property on Route 13, ( 09700 in front og Gas station, 49000 if in rear, plus eashent) . Mr. Hedges will set up another meeting with Mr. Schadt and Mr. Gehm, The Town Clerk read a letter in regard to the Bronz Tablet which Balch Bros. & West Company are making for the Town Hall and which will be ready for shipment in about three weeks. A motion was made by Mr. Griswold and seconded by Mr. Eaton that all bills on General Fund and Water District # l as presented by the Town Clerk be paid. This motion was carried unanimously. Brookins, Town Clerk LMB :mb 24 At the regular meeting -of the Town Board of the Town of Cortlandville held at the Town Hall, 15 Terrace Road, in the Town of Cortlandville, Cortland County, New York, on March 6, 1963, the following Resolution recommended by the Zoning Board of Appeals, was, on motion of Justice Earl Hedges, seconded by Justice Donald F. Eaton, unanimously adopted, pursuant to section 264 and 265, of the Town Law: RESOLVED that -the boundaries of R sidential and Industrial Districts in the Town of Cortlandvielle, as shown on the Zoning Map of the Town of Cortlandville, be, and,they are hereby, changed so that all that tract or parcel of land hereinafter described be-, and it hereb is SXXX placed entirely in a Industrial Districts ALL THAT TRACT OR PARCEL OF LAND situate in the Town of Cortlandville, County of Cortland and State of New York, bounded and described as follows: BEGINNING at the intersection of the west line of New York State Public Highway 281 and the south line of lands of Cary & Co. Inc.: thence running southerly along the said west line of route 281 a distance of approximately 170 feet to the center of a dry creek; thence run- ning in a northwesterly direction along the center of said dry creek a distance of approximately 350 feet to a point in the south line of lands of said Cary & Co.,Inc; thence running Easterly along the south line of said lands of said Cary & Co., Inc. a distance of approximately 300 feet to the place of beginning, being a triangular shaped piece of land containing five -eighths of an acre more or less; and be it further .RESOLVED that the Town Clerk be, and he hereby is ,authorized to publish and post such changes as required by the Town Law. Regular meeting of the Town Board was held at 8 P.M., members present were: Supervisor Glenn Alexander presiding, Justices Earl. Hedges and Donald Eaton, Councilmen Sherman Griswold and Henry Wadsworth,/Book-keeper for Supervisor, Mr. Rudolph Krauklis, Highway Superintendent Floyd Colegrove, Town Attorney Ted Fenstermacher, Engineer from Stearns & Wheler, Mr William -Rowell also, Don McKee, Surveyor .and Mrs. Wallace Kampney representing her father Mr. Warren Osbeck. Don McKee spoke on the "Osbeck Tract" and explained that the water would be put in this tract and -then deeded over to the Town at a later date. The Town Clerk presented the water bills of several residents of Halstead and Allen Drive,/due to the freeke -ups during Feb. and March the bills of the following were adjusted (on motion of Mr. Griswold and seconded by Mr. Hedges with UNANIMOUS approval of the Town Board) Ray Bristol from $10.50 to 46.00, Mike Kalelic, from$24.50 to 11?6.00,Robert Clark, from 29.A0 to $8.50, Phil Allen, from $19.00 to $9.00 and Mrs. Vern Abdallah from $15.00 to $7.88. At this time also the Highway Superintendent Floyd Colegrove was instructed to remedy the water problem on Allen Drive and the Halstead Tract in order to over- come the freeze-up situation that has existed. This was a motion made by Mr. Griswold seconded by Mr. Eaton with the approval of the Town Board. A petition was presented to the Board by the Town Clerk, containing the names of over 100 area residents near to Starr Road and McLeanocrossing route 13, requesting a traffic light or some relief of the danger presented by the traffic and speed. The Town Clerk will send a letter to the State Traffic Colilrilission in AlVany in regard to this problem. In regard to the request for lights on Allen Drive (10 families) on motion of Mr. :Caton seconded by Mr. N9RgKX- Griswold, with approval of Board it was resolved to have three lights installed on Allen Drive. z 5 6 The Town Clerk brought to the attention of the Board - the need of an adding machine for office use and presented figures and a statement as to allowance on an old machine,on motion of Mr. Griswold seconded by Mr. Hedges the Town Clerk was empowered to buy an adding machine as per statement from Mullen's Store at a price of 4231.60. This motion was carried unanimously. On motion of Mr. Eaton seconded by Mr. Wadsworth with the unanimous approval of the Board,Warren Osbeck was appointed chairman of the Assessors for the year 1963. On motion of Mr. Wadsworth seconded by Mr. Hedges with unanimous approval of the Board it was resolved that.all bi.11.s on General Fund, Water District # 1 and 2 .and Sewer District be paid. There being no further business at this time the meeting was adjourned. Members present were Glenn Alexander presiding, Councilmen Sherman Gris- wold and Henry Wadsworth, Justice's Earl Hedges and Don Eaton. Also present were Town Attorney Ted Fenstermacher and Supervisor's Book-keeper Rudy Krauklis. A motion was made by Mr. Wadsworth seconded by Mr. Griswold that the Town Board accept the recommendation of the Appeals Board that the lands of Wikstrom gonttactors be rezoned from Agriculture land to Industrial, (this land part of the Charles Alexander Farm) This motion was carried unan- Imous;y. Whereas there has been duly established in this Towh a fire pro- tection district known as "Town of Cortlandville Fire Protection District No.(or Westerly and Easterly) embracing certain territory in the Westerly and easterly portions of said Town; and WHEREAS it is proposed that a contract be entered,into with the Village of McGraw, for the furnishing of fire protection for the easterly portion of the Town, and a contract with the Village of Homer, for the furnishing of fire protection for the westerly portion of the Town; and WHEREAS a public hearing', on due notice, was held by the Town Board of the Town of Cortlandville at the office of the Town Clerk, 15 Terrace Road a.t 8 P.M. on the 26th day of August, 1963, to consider such contracts, and all persons interested and appearing having been heard, and there being no opposition to said proposed contracts, dated August 26, 1963, NOt THEREFORE, BE IT RESOLVED that this Town Board contract with said Villages of Homer and McGraw*, New York, respectively, for the furnishing of fire protection to such Fire Protection Districts according to the terms of certain contracts dated August 26, 1963, copies of which contracts are annex`- ed hereto and made a, part hereof; and be it further RESOLVED that such contracts be executed on behalf of this Town Board by all the members thereof. Section 184, Town Law, these contracts must expire on December 31st. of each year. As?Town Clerk, Lelan M. Brookins will notify each Village during July of each year that these agreements will be deemed renewed unless one of the parties notifies the other in writing to the contrary before August lath. The Town Clerk also read another letter from 'Mr. Potter in regard. tc the insurance needs of the Town. -Recommendations follow: AUTOMOBILES You are presently carrying 100,300/500,000 Bodily Injury limits with 1003,000 Property Damage limits. It has been your practice to notify Mr. Den-niston of changes.of vehicles as they occuredi While this is not mandatory with this type of policy, we strongly recommend that you continue to do this simply because it eliminates confusion in the event of a claim involving a a vehicle which may not as yet been added to the schedule. You are properly covered for the use of non -owned automobiles, on the business of the Town. You are also covered for the Hired Automobile Hazard and in this instance, we need -to know the cost of hire at the end of each policy period. No charge is made for this unless you do, in fact, hire vehicles for your use. PLMLIC LIABILITY This policy is referred to a Comprehensive General Liability policy and while it is presently written for a y-ear it could be written on a 'three year basis, either paid annually or if it were paid in advance, You could save ten percent on the on the premium using the three year period prepaid method. Basing it upon the existing policy this wou�_d save 4358.28 You will notice on your present policy an endorsement titled"Location of Premises". There are then eleven locations listed.' This endorsement is not actually necessary since -the policy adequately covers. the towns li- ability for any accident resulting from these locations, while they are being used within the scope of the operation of the Town. The endorsement has the disadvantages of needing correction any time that one of 'these locations change which, in some instances, might be several. times a year. Mr. Jerry Happek, Architect, submitted plans and specificatiois for the construction of the proposed new Town Hall together with_ formof contract for the execution of the work. After careful examination of such plans, specifications and proposed contract, and after full discussion thereon, the following Resolution was, on motion of Councilman Sherman Griswo seconded by Justice of the Peace Earl R. Hedges, unanimously adopted:. WHEREAS the Town Board heretofore and on June 7, 1961� adopted a Resolution,,subject to a.permissive referendum, author- ing the construction of a Town Hall on lands owned by the Town of Cortlandville on the westerly side of Terrace Road, at a -maximum estimated cost of $45,000; and WHEREAS Jerry Happek, Architect, was hired and directed to prepare definite plans and specifications for the construction -of such proposed Town Hall; and WHEREAS such plans and specifications and form of construction contract have been prepared and submitted to and examined by this Town Board; NOW, THEREFORE, it is RESOLVED that the said plans and specifications and form of construction agreement be, and they hereby are, accepted, approved and adopted; and be it further RESOLVED that this Board invite sealed proposals to be submitted to it until 8:00 P.M. on the 18th day of September 1961, at the office of the Town Clerk, R.
