HomeMy WebLinkAbout1962 Town Board MinutesIX' January 3, 1962,- S P.M. r The first regular meeting of the Town Board of the Town of Cortlandville-was held at the Town Clerk's residence and to start the New Year out right, every member of the Board was present and on time. Supervisor Glenn Alexander presided.: Members of the Board Justices Me-rton Bean and KXNYX Earl Hedges, Councilmen Henry Wadsworth and Sherman Griswold, -others present were, Mr. R. Krauklis, Book. -keeper for Supervisor, Floyd Colegrove, Hgwy Sup't., Mr. James Yaman and XXU.YXXX sN dXMX= LaVdrne Niederhofer. - The.Town Clerk presented each member with a copy of the minutes of the las•t� m-e-eting which were read and approved, Councllma�n Sherman Grisold offered this resolution for adoption . which was seconded by Mr. ladsworth, THAT the First National Bank of Cortland b.e-d.e-signated for the accounts of the General Fund, Highway Fund, Town Clerk's accounts,Tax accounts and Sewer account; and that the Marine'Midland Bank be designated fo.r the Water District accounts. This motion .was carried unanimously and therefor adopted. A resolution by Mr. Bean and seconded by Mr. Hedges that the Cortland Standard be designated as the offical Newspaper was unanimously adopted. - A resolution offered by Mr. Wadsworth and seconded by Mr. Griswold that Homer D-eZong 'be appointed Chairman -of the Board of assessors for 2 years was unanimously adopted. A motion was made by Mr. Griswold and seconded by Mr. Bean that Lelan M. Brookins 'be appointed Registrar of Vital Statistics for 2 years, this motion was carried unanimously. On motion of Mr. Bean and seconded by Mr. Hedges, Mr. Edwin Berean was appointed Constable for 2 years, unanimously approved. A motion was made by Mr. Wadsworth and seconded by Earl Hedges that Dexter. Paddock be appointed to a 5 year term on the Appeals Board. This motion carried. A motion by Mr. Griswold and seconded by Mr. Bean that Ray Penney be re -appointed for a 5 year term on the Planning Board was unanimously carried. A motion by Mr. Bean and seconded by Mr. Wadsworth that Theodore Fenstermacher be appointed Town Attorney for a period of 2 years was unanimously approved. '(Form of resolution to be entered ) On motion(for setting a mileage rate ) by Mr. Hedges and seconded by Mr. Bean a rate of $.08 per mile was established for officers on Town business. This motion was unanimously carried. On motion of Mr. Wadsworth and seconded by Mr. Bean that a .Cortland Water Board Claim of $802.60 and a City Claim for Sewer of $327.50 be paid was unanimously approved and carried. A motion by Mr. Hedges and seconded by Mr. Griswold that the low bid -of Armstrong Motors for a Pick-up Truck for the Highway Department in the amount of $1969• be accepted, was unanimously approved and carried, � Motion by Mr. Bean and seconded by Mr. Hedges that the sum of $400.00 be appropriated to buy furniture for Town Offices, Motion carried, Supervisor to name committee to buy the same. A motion was offered by Mr. Griswold and seconded by Mr. Bean that the following Salary Schedule be set for 1962.; This motion was unanimously approved and adopted. Summerville (Dog Warden) 660.00 " Earl Gorton ( Dump Attend.) 1200.00 " Mr. Yaman and Mr. Niederhofer were present to discuss the possibilj5y of the Water District being extended from the present Main near Cary Mfg. Co. on McLean Road to the former Space Farm which they have purchased and plan to build 20 to 25 homes per. year, this tract would be large enough for 75 homes, more or less. This project will entail more study and dis- cussion by the Town Board and Planning Board, a report to " Yaman and Niederhofer" is desired before April 1, 1962. The regular meetings will continue to -be held on the first Wed. in egch month, there being no further business at this time the meeting was adjourned. Lelan M. Brookins, Town Clerk mb .5, Re: Appointment as Town Attorney "Resolved, pursuant to Section 20 (2) of the Town Law, that the office of Town Attorney be, and it hereby is, established; and. be it further "Resolved that the Town Board of the Town of Cortland- ville does hereby appoint Theodore Fenstermacher,Esq., of the City and County of Cortland as Town Attorney for a term of two (2) years commencing as of January 1, 1962; and be it further "Resolved that. the salary of Town Attorney be, and it hereby is, fixed at the sum of $2,500 per year payable in quarterly installments; and be it further ."Resolved that the duties of such Town Attorney and the compensation herein fixed shall not include professional services and advice rendered to or in connection with the eztablishment, extension or expansion of any.special improvement district within the Town of Cortlandville or in connection with =§. I Net Bid $150.00 Special Meeting of the Town Board held at the Town Garage, January 23, 1962,11 A.M. Members present were: Glenn Alexander, Justice Earl Hedges, Council- men, Sherman Griswold, Henry Wadsworth, Highway Sup ° t.. Floyd Colegrove. Motion by Mr. Wadsworth and seconded by Mr. Hedges that the low bid of L.B.Smith Inc. of 8150.00 on a Back -hoe be accepted. This motion was unanimously carried by the members present. (Justice Merton Bean, being absent at this meeting) Regarding a petition from empbyee's of Cary Mfg. Co. on McLean Road requesting a Traffic light at the intersection of.McLean Road and State Highway 281, a motion was made by Sherman Griswold and seconded by Justice Hedges, that t?e.Town Clerk write to the State Traffic Commission in regard to _said petition and request, Motion carried. Brookins, 'own Clerk L&M: 15- February 7, 1962,REGULAR MEETING of the TOWN BOARD of the TOWN of CORTLANDVILLE held at the Town Clerk's residence ,492 S. Cortland road. Present were Supervisor Glenn Alexander, presiding: Justices Earl Hedges and Merton Bean,Councilmen Sherman Griswold and Henry Wadsworth, also; Town Attorney Ted Fensterma,cher, Highway Sup't. Floyd Colegrove, Supervisor's Book-keeper Rudol-oh Krayk-lis. Also present were Albert Stich -from Niagara Mohawk Power Co. ,Albert Roberts from State Conservation Department, Francis King of Hal.stead Road and Mr. LaRQ se from Stearns & Wheeler Engineer's from Cazenovia, Ay. r Mr. King appeared before the Board in regard to ff eeze-ups from his house to water main. The Board suggested that he keep his water running when very cold and that further investigation of this problem would be covered in the Spring of the year. Mr. LaRose appeared before the Board at the invitation of Mr. Glenn Alexander in regard to the proposed extention of the water district and the installation of tanks on the hill for said water district storage. Mr. Stich of Niagara Mohawk and Mr. Roberts of the State Conser- vation Dept. offered proposals to the effect that their company Engineer's would make a survey in regard to supplying water for the proposed buildings on. Fisher Ave. This would include installation of a six (6) inch water main on a street (formally used as an entrance to the Fairground) said line to be deeded to the Town. The Board will make further study of this project after said survey has been made and a report in written form has been submitted to the Board. Notion by Mr. Griswold and seconded by Mr. Hedges that the following be permitted to attend the Association of'Towns meeting at Buffalo at Town expense February 14,1962 thru February 16th, 1962.Town Clerk, Lelan M. Brookins„Willard Griswold of the Planning Board, Frank Taylor and Dexter Paddock of the Appeals Board, Rudy Krauklis,Book-keeper for Supervisor, Floyd Colegrove, Highway Sup't. Ray Penney, Gordon Hathaway and Merton Bean. This motion was carried all voting aye. (The last 4 officials were unable to attend) Motion by Mr. Griswold and seconded by Mr. Wadsworth that \$7000. be transferred from the surplus fund to the building Fund. This motion was carried ,all voting aye. Motion by Justice Bean and seconded by Councilman .Wadsworth that the dog warden be paid a sum of $50.00 for checking on the delinquent list of dog owners. .Motion carried. (Dog Warden,R.D.Summerville) Motion by Mr.,Bean and seconded by Mr. Hedges that the Town Hall be formally accepted .from McCarthy Builders,. the contractor,as of, Feb. 9, 1962. Carried. Motion by Mr. Bean and seconded by Mr. Griswold.that Cortland Floorcraft be given the job of furnishing and tiling all floors at the Town Hall and installing the baseboard furnished `6y the contract- or for the sum of $997.70, complete. Motion carried. Motion by Mr. Wadsworth ,and seconded by Mr. Bean that there be insurance on Town Building $20,000 on building and $4000.00 on contents. Motion carried. Motion by Mr. Griswold and seconded by Mr. Bean that two lights be installed at the entrances of the bowling alley on route 13. Notion carried. Motion by Mr. Griswold and seconded by Mr. Hedges that all bills on Warrants on General Fund, stater District and ,Sewer District be paid. Motion carried all voting aye. Motion by Mr. Griswold and seconded by Mr.. Hedges, that Lelan M. Brookins, Town Clerk, be aut;:iorized to buy necessary supplies for toilets utility room etc. including a step -ladder. (Purchasing) .On motion of Mr. Griswold and seconded by Mr. Hedges, , the Town Clerk was auth6ri.zed to buy 100 folding chairs at $5,85 per. and also storage racks for same, from the Brewer Tichner Co. March 7, 1962, First Regular meeting held at the Town Hall, Terrace Road. 8 P.M. Members present were: Glenn Alexander, Supervisor , Justice's.Earl Hedges Merton Bean, Councilmen Sherman Griswold and Henry Wadsworth, Also Highway Superintendent Floyd Colegrove,Rudy Krauklis, Bk-kp,for Supervisor, Town Attorney ,Theodore Fenstermacher. Mr. Edward Vosburgh appeared before the board,to ask for a renewal for 6 months for his trailer permit. On -motion of Mr. Griswold and seconded by -Mr. Bean this renewal was granted all voting aye. Mr. Stearns, Engineer ,Mr. Niederhoffer, Mr. James Yaman, Mr. John Gardner Mr. Del Preston, Mr. Don McKee and Mr. Carryl Bogart were also present, Messrs Yaman & Niederhoffer presented a sketch of their proposed develop-. went on the LaMont property and discussed the expansion of the water list. to include depth of this development. _After having it surveyed they will present more complete plan for approval. Mr. Stearns presented a .plan for expansion of the water district also storage tanks were discussed. In regard to a petition from the residents of Isabelle street for two street lights, a motion was made by Mr. Griswold and seconded by Mr. Hedges that two lights be installed, this motion was carried all voting aye. The Town Clerk will send a request to Mr. Gordon Day of the Niagara Mohawk Power Co. in regard to same. . A motion was made by Mr. Wadsworth and seconded by Mr. Hedges that the Town Clerk be empowered to purchase 5 sheets of Tim Board and molding and 6 mill ply film to cover same. Motion carried ,all voting aye, On motion of Mr. tadsworth and seconded by Mr. Griswold it .was resolved that Aluminum Blinds be purchased from Mr. Meldrim at $250.00, This motion was carried all voting aye. 157 nos Minutes continued: X. A letter to Mr. Alexander was read by Justice Hedges, from Miss Suzanne Brookins, offering to donate a Stodart Piano in memory of her grandfather (a musician) Mr. William C. Cook, to the Town, to be used for social and community affairs, and to be kept In good order for this purpose. on motion of Mr. Henry Wadsworth and seconded by Earl Hedges, tnis donation was accepted, all voting aye, with many thanks. A motion was made by Mr. Griswold and seconded by Mr. tadsworth that the sum of $5900.00 be transferred from surplus moneys to the building fund, this motion was carried, all voting aye. Mr. Sherman Griswold offered the following resolution and moved it's adoption in the minutes, thatia vote of thanks be recorded in the minutes of this meeting and a personal letter be sent to Raymond Penney of Starr Road for his valuable assistance and advice and the hours of labor he so generously gave (together with the Town Clerk,Lelan Brookins) in building -the beautiful counter for the Clerk's office,, to Roger Bell for 312 gift of a chair and table for the Supervisor's room, to .the first National Bank for three new tables for the meeting room, Mr -.Sam Chaiken on behalf of Alpert's for the Clock for the Clerk's office and to miss Suzanne Brookins for the piano -as a memorial for her grandfather, This motion was carried unanimously,, ,Z Minutes of March 7, -Continued - Rec'd from Town Attorney March 15, 19620 The Town Attorney stated that the Lands and Claims adjuster of the Real, Property Bureau of the Department of Law had called on him in connection with the procurement of General Releases by the Town of Cortlandville of all claims or interest in moneys.to be paid to property owners along Route 13 as compensation for lands appropriated by the State of New fork by reaso: of the widening of such highway, The Towns interest in the matter stems from its being a holder of sewer and water easements granted by such prop- erty owners prior to such appropriations. To eliminate the necessity fo procuring authority from the TownBoard with respect to the execution of each such individual General Release, the following Resolution was$ after discussion, and motion made by Justice Earl He$ges, seconded by Councilman (correction made by Clerk) Justice Merton Bean and unanimou _ ly adopted: RESOLVED that the Supervisor be, and he hereby is, XXXX authorized and empowered, in the name and on behalf of the Town of Cortlandville, to execute a general release with rmg respect to all claims and interest of the Town in moneys to be paid to property owners by the State of New York in consideration; for the appropriation of, lands along Route 13 in the Town of Cortlandville in connection with the widen« XX ing of such highway, arising by reason of the grant of sewer and water easements in the Town. The Town Attorney also stated that he had been negotiating with the adjuster for the insurance carrier representing W.F.Saunders & Sons Inc, in connection with a possible settlement of the Town's cause of action for damages to the Towns bridge on the; Blue Creek road as a result of its collapse on September 14, 1961 by a truck traveling actoss such bridge in excess of the posted weight capacity thereof. Mr. Fenstermacher stated that the bridge had been rebuilt at a cost of $5,004.00 and that an offer of $1,668.00 had been made in full settle- ment of the Town's Claim against W.F. Saunders & Sons Inc, Mr. Fenstermacher stated that in view of the age of the bridge (more than 50 years), bearing in mind that the bridge had been damaged on July 6w 1961 by an automobile owned by James Hoy, and in view of all the facts and circumstances and the uncertainty of outcome end expense of litigation, he believed the offer should be accepted. After discussion and upon motion made by Councilman Griswold and secon ed by Councilman Wadsworth, it was inanimously: RESOLVED that the Supervisor be, and he hereby is, autho rived and empowered, in the name and on behalf of the Town, and in consideration of the payment to the Town of the sum of $1,668.002 to execute a general release of all of the Town's claims and causes of action against W.F. Saunders & Sons,Inc, arising out of an accident which occured on September 14,1961 which ,resulte in damage to the Town's bridge on Blue Creek road. The following Resolution, recommended by the Zoning Board of Appeals was, on motion of'Justice Bean and seconded by Councilman, Wadsworth, unan- adopted, pursuant,to Sections 264 and 265 of the Town Law; RESOLVED that the boundaries of Residential and Commercial Districts in the Town of Cortlandville, as shown on the Zoning map of the Town of Cortlandville, be, and they hereby Are, changed so that the following described parcel of land be and it hereby is, placed entirely in a Commercial DJ&rict: RESOLVED that the boundaries of Residential. and Com- mercial Districts in the Town of CortlRndville, as shown on the Zoning Map of the Town of Cortlandville, be, and they hereby are, changed so that the following described PARCEL OF LAND be, and it hereby is, placed entirely in Commercial 'District: ALL THAT TRACT OR PARCEL OF LAND situate in -the Town of Cortlandville, County of Cortland and State of New York being a part of lot 54 in said Town and bounded and describ- ed as follows BEGINNING at a point in the center of New York State Route 281 (also known as the (West Road) back road from Cortland to Homer) at the northeast corner of a parcel of land described in a mortgage recorded in Liber 150 of Mortgages at page 204 in the County Clerlt-v? Office; extend- ing thence (1) 9:� southerly along the center of said Route �81 672 feet to the Northeast corner of lands `conveyed to Salem Isaf by deed recorded in said Clerk's office'in Liber 231 of Deeds at page 523; thence (2) westerly at right angles to said Route 281, 208 feet more or less, to a point in the east erly line of lands, now or formerly, of Olin Spencer, said point being 315 feet north of the center line of Blue Creek Road d (also known Rs Bell Road); thence (3) northerly on a lino Practically parallel with the center of Route 281, 601 feet to an iron post driven in the ground; and thence (4) easterly, along the south line of lands, now or formerly of Olin Spencer and Elizabeth T. Spencer, 233 feet to the POINT and PlAce of beginning. Together with all the right, title and interest to the useofa spring of water on lands of said Olin Xpencer Rnd Elizabdth T. Spencer and all rights granted for entry thereon to lay new pipe and repair old pipe as recited in deed re- corded in said County -Clerk's Office in Liber 225 of Deeds at page 259; and be it further RESOLVED that the Town Clerk be, and he hereby is authorized to publish and post such change as required by the Town Law. The following RESOLUTION recommended by the Zoning Board of Appeals was, on motion of Councilman Griswold seconded by Justice Hedges unanimously adopted, -Pursuant to Sections 264 and 265 of the Town Law: RESOLVED that the boundaries of Agricultural and Residential Distr -icts in the Tow of Cortlandville as shown on the Zoning map of the Town be, and they hereby are, changed so that all that tract or parcel of land hereinafter described be, and it hereby is, placed 2n- tirely in a Residential District All that tract or parcel od land to a depth of 250 feet on both northerly and southerly.sides of the 16 street or highway known as the McLean Road, from its intersection with Fairview Drive on the North to its intersection with the Lime �) Hollow Roadr on 1the south; and be it further -yq'%yu�,/ RESOLVED that the Town Clerk be, and he,hereby is, authorized to publish and post such change As required by the Town Law. SPECIAL MEETING of the TOWN BOARD, TOWN of CORTLANDVILLE , HELD AT THE TOWN HALL, TERRACE ROAD, present were Supervisor Glenn Alexander; presiding, Justices Earl Hedges , Merton Bean, Councilmen Sherman Griswold And Henry Wadsworth also Highwy. Mr. Yaman and Mr. Niederhofer appeared before the Board in regard to the pro- �med extension of the water district , a Petition, dated March 20, 1962 having been presented by Messrs., `': �..:. C4-t. Mr. C.C.Umsted, claims adjuster for State Dept. of Public Works appeared before the Board and explained the effect of the construction of the new Highway in regards to land needed, owned.by:the Town of Cortlandville, that the land had been appraised for the sum of $10,300. Regular meeting of the Town Board of -the Town of Cortlandville held at the Town Hall, Terrace Road. Mr. Ronald Gauthier appeared before the Board , voicing opposition to the rezoning of the Webster property on Route 281. Mr. Fish, representing the Niagara Mohawk Power Co. explained {street lighting" under the new system. Mr. VanGalder asked the Board to take some action in regard to papers and rubbish being littered on his property by the Stores in the Shopping Plaza on Groton Ave. Extension. On motion of Mr. Hedges and seconded by Mr. Wadsworth and being unanimous by the Board, the Town Clerk was instructed to write a letter to the Manager's of each store and also to Mr. Porter of Syracuse in regard to this matter, and to Mr. L.H.Scheidelman of 170 Genesee St. Utica, N.Y. Mr. Max Brookes was interested in expense involved in regard to having both sewer and water for his residence on Tompkins St. Extension. He informed the Board that Mrs. Bostwick a neighbor also was interested. A survey will be made as to how many residents in this area would want to have the sewer and water before the new road has gone through. Mr. Robert Drupieski of the Water Resource Commission,' Albany, N.Y. held a hearing in the Town Hall on the Petition of Water District # 1, to extend the Water District to include the Lamont Ares , as described on ,-page 166 of the minute book ( hearing held April 12, 3-962). Present were Supervisor Glenn Alexander, Justices Merton Bean and Earl Hedges, Councilman Henry Wadsworth and Town Attorney Theodore Fen- stermacher, also Mr. Arthur Klein, from the CountNi Health Department, Mr. Vern Niederhofer and James Yaman, Mr. Drupieski asked questions of Mr. Niede.rhofer, Town Attorney and Town Clerk Lelan M. Bean, seconded by Councilman Sherman Griswold, the following Resolution was introduced: WHEREAS a public hearing was held by the Town Board on June 25, 1962, following due publication and posting thereof, pursuant to Section 202-b of the Town Law, in the matter of the following proposed increase or improvement of facilities including,,the acquisition of additional lands and interests in lands, in Town of Cortlandville dater District No. 1, viz The erection of a new water storage facility, con-1 struction of certain water main improvements, develop- ment of an independent water supply by means of an existing new well and the installation of a new 400-gal_on per minute pump; and the acquisition of approximately two acres of land, together with an easement or right- of-way thereto., situate on the southerly side of New York State Public Highway Route 13 between its inter- section with Starr Road on the east and New York State Public Highway Route 281 on the west; and WHEREAS such proposed improvement, the estimated expens( of which is $136,000, will include construction of the following: a) 500,000 gallon ground storage reservoir complete with foundation and approach road. b) 12" supply main to connect the new reservoir with New York State Route 13 and with the existing pipe main on Terrace Road. c) 6" main along the water District Line from Delaware Avenue to Owego Street. d) 6" main on Route 13 to tie in the dead' end on Tompkins Street at Cortland City Lind with Abdallah Avenue. e) 6 connection on New York State Route from present main to Starr Road. f) Pumping station complete, including automatic control, tied in with the present well pump off Terrace Road; NOW, upon the evidence given upon such hearing, it is! Mr. Charles Seymour a resident from the Fer-Cor Tract appeared before the Board, requesting a light be installed on the Ferris Development. Motion by Mr. 4adsworth and seconded by Mr. Hedges that 2 lights be installed on this tract. This motion was carried. Motion by Mr. Hedges and seconded by Mr. Bean that 2 lights be installed on Delaware Ave. as per requests of residents in that area. This motion was carried unanimously. He stated, further, that Stearns & Wheler, apparently through inadvertance and oversight, had not taken into consideration the fact that approximately $5,500.00 of moneys had been expended from the Town's General.Fund in 1959 for the cost of soil probings, construction of a new well and other improvements that had been completed pur- suant to agreement with Stearns & Wheler,-and that such sum would have to be repaid to the Town's General Fund as a part of the total authorized cost of 0136,000 for the entire improvements in Water District # 1. 23 Mr. Fenstermacher stated that he had discussed the matter of the estimated excess'of $1,982 over the authorized cost of $ -- $136,000 with A.Gordon Wheler of the firm of Stearns & Wheler; and that he and Mr. Wheler had agreed to absorb the excess of any costs over,and above the authorized amount of $1 6,000 from their engin- eering and attorney's fees on a two-thirds one-third basis, respectively, tb the end that the total cost of such Improve- ments to the Town not exceed $136,000. After discussion, and upon motion duly made and seconded, i was unanimously: RESOLVED that the offer of Stearns and Wheler and Theodore Fenstermacher to absorb from their engineering and legal fees, respectively, the amount by which the total capital cost of the proposed increase and improvement of facilities to Water District # 1 exceeds $136,000, to the end that the total cost to the Town ofCo.rtlandville Water District # 1 not exceed the authorized sum of $1369000,be, and it hereby is, accepted- it being understood and agreed, however, that any sums expended for interest on bond anticipation notes be excluded from the computation of such total capital cost of such improvements and be raised as part of an annual assessment therefor pursuant to the provisions of Section 231 (@) of the Town Law. Re: Schadt and Gehm vs. Town of Cortlandville The Town Attorney reported that he had forwarded to Charles J. Mullen,Esq., of Cortland , N.Y. ,attorney for National Grange Mutual Insurance Co., the Notice of Claim filed on October 12, 1962 by Frank Schadt and Raymond Gehm for damages arising out of the interruption of water service to their business premise: on Route 13 on or about August 5, 1962. H6 further stated that he had been in- formed by Mr. Mullen that the insurances company had disclaimed liability in the matter inasmuch as the Notice of Claim was based upon the breach of an alleged agreement to supply water to such premises, and that the policy issued to the Town by it (#163 771 covering the period Sept. 19, 1961-Sept 10, 1962) RX92 expressly excluded liability under any contract or obligation for which the Town_ might be held liable in an action on a contract.
