Slater SPECIAL PERMIT HEARING SEPTEMBER 13 , 1988 Karina ' s Bridal Boutique Shop Supv Lotter ill read the notice that was published in the newspaper to consider the application of Joseph & Karina Draghi to open a bridal boutique retail sales shop in an existing commercial • structure at 21Ba Dryden Rd . [RJESTTONS AND / OR COMMENTS Mr Draghi - they would like to open a bridal boutique specializing in formal wear . There will be no changes to the structure other than minor . changes to the inside . .Joseph Osrneloski - was concerned about par~ kiin@ near his property line where he has shrubbery planted . He has no objection with the business itself . Z . 0 , Slater - stated that there . was sufficient parking without being near the rje ;ighbcrs property line . Closed public hearing : 7 = OPM RESOLUTION # iOr_ GROW SPECIAL PEi ri :I: T DRr=1e ii - Clrn Evans offered the following resolution and asked for its adoption : RESOLVED , that this Town Board grant a special permit to Joseph & Kaarina Draghi to open a bridal boutique at 2iB6 Dryden Rd , with the condition that this permit is not transferable by sale or lease . End Clm Hatfield Rol / call vote -- all voting Yes • SPECIAL PERMIT HEARING SEPTEMBER 13 , 1988 Black Star - 1 '922 Dryden Rd Minutes of special permit for Jaynes Black 7 : 45PM S upv Cotterill - read the notice that was published in the newspaper tr consider the application of Black Star Bicycle & Cross . Country Ski Store , James Black , to open a retail sales and service store at 1922 Dryden Rd in an existing commercial structure O UESTIONS AND / OR COMMENTS J ames Black - his hours now are 9 : 00AM to 7 : 00PM Mon thru Fri and 9 : 0QAM to 5 : 00PM He is experimenting with the hours because they are different than the hours he had on East Hill . Eventually he would like to have ski and bike trails in back of his building . J ames Black - there is parking in front of the building that he is going to eliminate and there is plenty of parking on both sides of the building . On the west side there is 504 sq yds of parking ( 18 x 28 yds ) . On the other side of the building varies from 20 yds wide to 12 yds wide and is 120 yds long . There is over 179000 sq ft of parking space . Clm Evans - the Board requires a diagram showing where the spaces are to be located . Also wondered about a sign ., James Black - they plan to put a sign on the existing pole and a sign on the front of the building over each entrance . Z . O . Slater - the sign that Tweitmann had on the pole was not in compliance with the zoning ordinance , and since this is a new business this would not be an allowed use without a variance . J ames Black -- he has moved his portable sign back near the building and turned off the flashing light . Clrn Evans - is concerned that their is no diagram showing the parking places . J ames Black -- gave the Board member a sketch of his plan with the measurements . S upv Cotterill °- the Board needs a diagram with the parking places sketched on the plan which he will have to submit to the Zoning Officer before the permit would be issued . S upv Cotterill - wanted to know if there was Health Dept approval . Z . O . Slater -- he has verbally received approval from the Health Dept , but does not have it in writing yet . • • 7' • D an Eastman - was in favor of the ski shop but was concerned about it being opened before any permits were issued . I Supv Cotterill - they have been served with a notice of violation . The policy has now been changed by the Board that there will be no more building permits of any kind issued to any place of preexisting buildings that is going to be worked on for a business u ntil all other permits have been approved . There was considerable d iscussion . Clm Garlock - questioned about the flashing sign that was in front o f his place of business . J ames Black - Z . O . Slater has notified him that was in violation of the zoning ordinance and he has moved the sign back from the road and the sign is not flashing any more . Clot Garlock hoped that when he was ready to open his trails and planned on installing lights that he would refer to the zoning o rdinance before he did anything . Closed public hearing : 8 : 00PM Motion was made by Clrn Evans and seconded by Clrn Garlock that the minutes if the Board meeting held Aug 16th and Site Plan Review meeting held Sept 2nd be approved as submitted . Carried . ® COUNTY BRIEFING Rep Tillapaugh - reported that the Solid Waste Committee will demonstrate a recycling project in various areas of the county . - - reported that the Public Works Committee has received notification that Landstrorn landfill might be filled before the deadline date . The Public Works Committee is requesting that the towns and villages do not have cleanup days this fall or in the spring of 1989 in their municipalities . Clrn Evans - was concerned about DR7 landfill site in that the dEIS report calls for the cost of the DR7 landfill to be built for $21 million dollars . On 8 -25 a report was received from Dunn Geoscience , a well known engineering firm for landfills in the state , and are used as consultants by DEC . They claim that they can build a landfill to operate for over 20 years within compliance on the existing Landstront property for $ 9 million . He wanted to know that if this was a legitimate quote and a landfill can be built somewhere else in Tompkins County for $ 9 million and we have to pay $ 21 million for DR7 , there is something seriously wrong and felt that the county should look into this , and an explanation should be made . Monica Crispin from Co - Operative Extension went over the new ag p district reap with the Board members . " 7 There was considerable discussion and the Town Board felt that the application from Cornell University to be in the Ag Dist near Rt 366 and Rt 13 should not be that district and they should pay their fair share for the proposed water and sewer district since that property will be benefited by it . Co Rep Tillapaugh - will take the decision to his meeting from the Town Board that Cornell Univ should not be in the Ag Dist for the property located near Rt 366 and Rt 13 . CITIZEN PRIVILEGE OF THE FLOOR Robin Rerneck - gave the Town Board a proposed bid for dog control service to the Town . She felt that the Town Board should consider the SPCA since they are located in the Town of Dryden . S upv Cotterill - said that they would consider the proposed bid from the SPCA along with the one from Lorraine Bard and no decision has been made at the present time . Alan Green - representative from the City of Ithaca Youth Bureau - H e is willing to answer any questions that the Board members might h ave . Clm Evans - does use the City Youth Bureau services and feels that h e would have no problem with making a contribution to the City . There is also a Dryden Youth program so there is a problem has how t o distribute the money for Ithaca and Dryden . Ithaca is not 411 dealing with a majority of children from Dryden . He would support a f ee for those people who do want to use the Ithaca Youth Bureau services rather than an assessment on the Town for the majority that does not use it . There was some discussion . Clm Evans - said that he would be willing to meet with the City of Ithaca Youth Bureau Catherine Brown - have asked several times before that a double solid line be painted on a port ion of Lower Creek Rd from Rt 13 to Hanshaw Rd . because it is a speedway and would like to have something done . She has checked with Hwy S '.tpt Gilbert and was told if they do one road they would have to do them all . H wy Supt Gilbert - would like to wait until after the county is finished working on the intersection of Rt 13 and Lower Creek Rd . There was some discussion and Hwy Supt Gilbert said that he would try and do something on that portion of the road for them . Dan Eastman - was concerned about the runoff from the Armory and felt that this should be looked into . The current culvert is not large enough to take care of the runoff . There was considerable discussion . S upv Cotterill -- has not received any information and the Town is ® willing to put a bigger culvert under the Town road but they have been asked not to until all other alternatives have been studied . S upv Cotter ill - felt that we should but the Armory on notice that they are going to be liable for the Town read or anything else if this runoff situation is not taken care of properly „ Catherine Brown - had attended the Site Plan Review Board meeting and ZBCR meeting concerning the Guthrie Clinic since they asked for 2 variances . ' I - for reducing the number of parking spaces , which they did not object to and is - to be relieved of the necessity of a buffer . onto They don ' t need a buffer zone along most of their frontage alonq the road because the south side of the road is a MA Zone . They felt that they should have to buffer the part of their property which is adjacent to RBI . They were told that they were n ot adjacent because there is a road between . Her concern was that o ther developers would be exempt from putting in a buffer zone if there is a read established ; h upv Cettenill - did not think that the Planning Board would accept a road to be used for a buffer; zone , and this is not the intention o f the zoning ordinance when it was written . D avid bishro - wanted to know if there was information about a h elicopter larding pad at the Armory ? The Town Board did not have any . information and was not aware of anything . a COUNCILMAN PRIVILEGE OF THE FLOOR hlm Evans - reported that Larry Chase and all of the people involved with CROWD would like to thank the Town of Dryden for their support concerning DR7 landfill site , ATTORNEY Atty Perkins - tRoyal Road ) although Town Hwy rapt Gilbert has indicated the installation of the road improvements are to town{ specifications and acceptable to him as a town road . His records indicated that it will be 1 year since he first explained to the attorney of the developers what those requirements were . kitty Perkins suggested that the Town not take any action until all of the documents are in proper order . reported an the status of hr . betrillose and the connections to the Cortland Rd Sewer Dist . Flt t y Perkins has been informed that he has mace all of his hookups on Aug 18th , tatty Perkins contacted Ed Dell with the Village of Dryden to see if they had been inspected , and he had raver been contacted for an inspection or that there was any work done . He than contacted ,J .7 Associates Engineers , who had donne some preliminary work for Mr . hetrillose . httt Perkins felt that everything shads be inspected to make sure that the connection to the transmission pipe is installed properly and all of the laterals are in properly . The pipes to the sewer pipe only have been inspected . him Turner was going to let him knew what they had inspected and what they knew . • • - I - I reported on the procedure to be taken on the application of Richard & Patricia Dayton for a private landing area . Atty Perkins felt that use of the property would require a variance , and comply w ith Section 751 of the zoning ordinance . Mr Dayton would also have to make application under~ General Business Law Section 249 to the NYS Cc' rnrnis , icner of Transportation . Mr Dayton has done this and n ow the obligation is on the Town to request the Commissioner of Transportation to determine whether or not the establishment of this airport complies with the standards for a private airport , There is some documentation to that affect that it does comply with federal standards . In connection with the NYS Commissioner of Transportation determination the Town Board can request the Commissioner to conduct a hearing . Atty Perkins recommendl , this procedure , because that will give the neighbors an opportunity to be heard and local concerns expressed . Before that the Commissioner w ill need from the Town a statement that the airport is privately owned and all of the owners of all the surrounding land have consented to the establishment of the airport . reported that Tom Neiderkorn ,n , conssultant for the Dryden Lake project has requested that the Town of Dryden formalize his employment with the Town . The total estimated cost for his services range from $ 1500 to $ 1900 . This includes pr + paring the map and materials and all other information , develop a program for ✓ ecreational 'Facilities , a sketch plan 'For ' parksnq . He asked the Town to approve the letter of agreement which he has locked at and found no objection to Atty Perkins asked Mr Neiderkorn if he would oversee the Town ' s compliance with the affirmative action program ✓ equirements and the minority womens owned business enterprise ✓ equirements and he indicated for a nominal charge he would do this .
