HomeMy WebLinkAbout1988-07-12 ry TOWN BOARD MEETING SPECIAL PERMIT HEARING JULY 12 , 1988 S upv Cotterill called the meeting to order at 7 : 30PM Members and guests participated in the Pledge of Allegiance Roll call was by the Town Clerk : Present : Supv Cotterill , Clm Evans , Clm Garlock , Clm Hatfield , Clm Crawford , Atty Perkins and Z . O . Slater S upv Cotterill read the notice that was published in the newspaper to consider the application of Richard Cutia for a special permit to establish a produce warehouse at or about 2025 Dryden Rd within the RD zone . Q UESTIONS AND / OR COMMENTS p Richard Cutia - there is 400 feet of road frontage on Rt 13 and he will be using 225 feet road frontage . The building will be 90 feet by 60 feet . This will be used as a produce warehouse . There is only o ne employed person other than himself and his son . There will be o nly 2 trucks going in and out of the warehouse about 2 or 3 times in one day . He makes delivery to local restaurants and institutions . He has not yet received Health Dept approval . ® Clm Evans - wanted to know about the landscaping . Richard Cutia - he will be planting shrubbery and seeding for a lawn , and eventually blacktop the driveway . He also has no problem w ith planting a buffer strip between his property line and the ✓ esidential property . Closed ublic hearing . P 9 RESOLUTION # 133 GRANT SPECIAL PERMIT RICHARD CUTIA Clm Evans offered the following resolution and asked for its adoption : RESOLVED , that this Town Board grant the special permit to Richard Cutia to establish a produce warehouse at or about 2025 Dryden Rd w ith the following conditions : 1 - that a buffer strip be planted on the west and south side of the property line that conforms with the MA zone requirements ; 2 - that general business hours are from 6 : 00AM to 8 : 00PM and one truck to leave about 4 : 00AM 6 days a week ; 3 - that this permit is not transferable by sale or lease outside of the Cutia family members . 2nd Clm Garlock Roll call vote - all voting Yes go APPROVAL OF THE MINUTES Motion was made by Clm Evans and End by Clm Hatfield that the minutes of the Town Board meeting held June 10th and special meeting held June 28th be approved as submitted . I i CITIZEN PRIVILEGE OF THE FLOOR P hoebe Erdman from the Arts Council presented the Town Board with a service agreement for the corning year and literature . RESOLUTION # 134 GRANT SPECIAL PERMIT:_, COUNTY ACRES MOBILE HOME PARK Cim Evans offered the fol lowing resolution and asked for its adoption : RESOLVED , that this Town Board grant the special permit to Melvin and Philip Simons the expansion of 8 additional units to their mobile home park with the following conditions that all requirements are met as so stated in the Planning Board minutes d ated June 16 , 1988 . 2nd Clm Garlock Roll call vote all voting Yes COUNCILMAN PRIVILEGE OF THE FLOOR Clm Evans - wanted to know the status of the Snyder Hill Water 4 Dist ? S upv Cotterill - by June 22nd all hook ups should be available to all of the residents . Clm Garlock °- has a matter for executive session . RESOLUTION # 135 ACCEPT LOW BID FOR ROOF REPAIR Clm Garlock offered the following resolution and asked for its adoption : RESOLVED , that this Town Board accept the low bid from DBT E nterprises of $ 12 , 500 . 00 for the repair of the roof on the Town H all and Town Highway garage . E nd Clm Hatfield Roll call vote - all voting Yes ATTORNEY 0 Atty Perkins - has 2 matters for executive session . Also reported that Clm Garlock and he will meet with the Village of D ryden Board regarding water extension to the Cortland Rd water d ist . The Town is also proceeding with well drilling on the L ivermore Rd test site . This office closed out the last ( 2 ) remaining fire damage compliance inspections . We also completed ( 2 ) Fire Safety Inspections . One ( 1 ) was found to not be incompliance . In speaking with John Copper , John has indicated that many people are calling him for vehicle removal . John also indicates that many of the people who are calling him , are people who want to comply before we sent them violation notices . John is running about ( 2 ) to ( 3 ) weeks behind in the removal of vehicles . This is due to the number of people who are using the service . I have also observed residents using other methods - and sources of removal . All in all , this action has been very successful and will continue to be so . We can understatedly find the fact that there was much neighborhood o pposition to this proposed variance . 6 . There was ecological questions raised regarding the paint pellets • and their effect on the flora and .fonta and also the traffic through the woods , what effect in excess of 3000 people stomping around the woods would have on the hills and valleys .
