SECTION 1 , Designation of Building. Official as Public
Official
-- —
There is hereby designated in the Town of Dryden a
public official to be known as the Code Enforcement Officer
( CEO ) , who shall be appointed by the 'Town Supervisor with
the approval of the Town Board at a, compensation to be fixed
by it . Such person shall meet the qualifications for code
• enforcement personnel as prescribed in Title 19 NYCRR Part
443 .
SECTION 2 . Acting Code Enforcement Officer
In the absence of the CEO , or in the case of inability
to act for any reason , the Town Supervisor shall have the
power , with the consent of the Town Board , to designate a
person to act as CEO and to exercise all the powers
conferred upon the CEO by this Local Law . The compensation
of such Acting CEO shaJ. 1 be fixed by the Town Board .

. SECTION 3 . Appointment of . Building Inspectors
The Town Supervisor , with the approval of the Town
Board , may appoint one or more building inspectors , as the
need may appear , to act under the supervision and direction
of the CEO and to exercise any portion of the powers and
duties of the CEO as may be directed . The ' compensation . of

such building inspectors shall be fixed by the Town Board .
The CEO may also be a building inspector .
• SECTION 4 . Restrictions on _ DiTp1oyees
The CEO , Acting CEO , or Building Inspector ( s ) shall not
e ngage in any activity inconsistent with their duties , or
• with the interests of the Town ; nor shall they , during the
term of their employment , be engaged directly or indirectly
in any building business , in the furnishing of labor ,
materials , supplies , or appliances for , or the supervision
o f the construction , alteration , demolition , or maintenance
o f a building or the preparation of plans or specificiations
thereof within the Town of Dryden . This provision shall not
prohibit any employee from engaging in any such activities
in connection . with the construction of a building or
structure owned by them For their own personal use and
o ccupancy , or for the use and occupancy of members of their
immediate families , and not constructed for sale .
.SECTION S . Duties _ & _ Powers of Code __ Enforcement
Officer
i a ) Except as otherwise specifically provided by law ,
ordinance , rule , or, regulation , of except as herein
otherwise provided , the CEO shall administer and enforce all
of the provisions of the following laws , ordinances , etc . :

( 1 ) The New York State Uniform Fire Prevention
and Building Code
( 2 ) The Town of Dryden Zoning Ordinance
( 3 ) The Town of Dryden Mobile Home Ordinance
( 4 ) The Town of Dryden Mobile Home Park Ordinance
( 5 ) The electrical code of the Town of Dryden
( 6 ) Flood damage prevention local law
and all other laws , ordinances , rules , and regulations j
applicable to the plans , specifications , or permits for the
construction , alteration , and repair of buildings and
structures , and the installation and use of materials and
equipment therein , and the location , use and occupancy
thereof .
( b ) The CEO shall promulgate rules and regulations ,
subject to the approval of the Town Board , to secure the
intent and purposes of this Law , and a proper enforcement of
the laws , ordinances , rules , and regulations governing
• buildin
g plans , specifications , construction , alteration , or
repairs , building safety , and land use in the Town .
( c ) The CEO shall receive applications , approve plans

and specifications , and issue permits for the erection and
alteration of buildings or structures or parts thereof and
shall examine the premises for which such applications have
•
been received , plans approved , or such permits have been
issued for the purpose of insuring compliance with the laws ,
ordinances , rules , and regulations governing building
construction , alterations , or occupancy .
( d ) The CEO shall be responsible for conducting
inspections and maintaining records as required by Rules and
Regulations promulgated by the Secretary of State in Title
19 of NYCRR , Part 444 .
( e ) The CEO shall issue , in . writing , all appropriate
n otices or orders to remove illegal or unsafe conditions , to
✓ equire the necessary safeguards during construction , and to
insure compliance during the entire course of occupancy with
® the requirements of such laws , ordinances , rules , and
✓ egulations , and such notices or orders may be served upon
the property owner or his agent personally , or by sending by
certified mail / return receipt requested , a copy of such ,
o rder to the owner or his agent at the address set forth in
the building permit application , or as shown on the tax
rolls , and by posting the same upon a conspicuous portion of
the premises to which the , notice applies . He shall make all
inspections which are necessary or proper for the carrying
o ut of his duties , except that he may accept written reports
o f inspection from building inspectors or other employees of
the Town , or from generally recognized and authoritative
service and

inspection bureaus or agencies , provided the same are
certified by a responsible official thereof .
( f ) The CEO shall issue a certificate of occupancy
where appropriate for, a building constructed or altered in
accordance with the provisions of the New York Uniform Fire
Prevention and Building Code which certificate shall certify
that the building conforms to the requirements of such Code .
SECTION 6 . Department Records and Reports
( a ) The CEO shall keep permanent official records of
all transactions and activities conducted including all
applications received , plans approved , permits and
I certificates issued , fees charged and collected , inspection
reports , all rules and regulations promulgated by him with
the consent of the Town Board , and notices and orders
issued . All such records shall be public records open to
public inspection during normal business hours .
( i:0 The CEO shall , annually , submit to the Town Board a
written report and summary of all business conducted ,
including approvals , permits , and certificates issued , fees
collected , orders and notices promulgated , inspections and
tests made t and appeals or litigation pending or concluded ,
SECTION 7 . Violations
( a ) It shall be unlawful for any person , firm , or
corporation to construct , alter , repai :r , move , equip , use ,
o r occupy any building or structure or portion thereof in
✓ iolation of any provision of this local law , as well as any
✓ egulation or rule promulgated by the CEO in accordance with
this local law , or to fail in any manner to comply with a
notice , directive , or order of the CEO , or to construct ,
alter , use , or occupy any building or structure or part
thereof in a manner not permitted by an approved building
permit or certificate of occupancy .
( b ) Any person who shall fail to comply with a written
order of the CEO within the time fixed for compliance
therewith , and any owner , builder , architect , tenant ,
contractor , subcontractor , construction superintendent , or
their agents , or any other person taking part or assisting
in the construction or use of any building who shall
knowingly violate any of the applicable provisions of law ,
.or any lawful order , notice , directive , permit , or
certificate of the CEO made hereunder shall be punishable by
a fine or imprisonment or both as herein provided . Each day
that a violation continues shall be deemed a separate
offense .
( c ) Any person , having been served , either personally
or by registered mail , with an order to remedy any condition
found to exist in , on , or about any building in violation of
the New York State Uniform Fire Prevention and Building Code
who shall fail to comply with such order within the time
fixed by the regulations promulgated by the Secretary of
State pursuant to subdivision one of section three hundred
eighty - one of Executive Law , such time period . to be stated
in the order , and any owner , builder , architect , tenant ,
contractor , subcontractor , construction superintendent , or
their agents , or any other person taking part of assisting
in the construction of any building who shall knowingly
{violate any of the applicable provisions of the New York
Uniform Fire Prevention ' and Building Code or any lawful
o rder of the CEO , or the Town Board , made thereunder
✓ egarding standards for construction , maintenance , or fire

protection equipment and systems , shall be punishable by- a
• fine or imprisonment or, both as herein provided . Each day
that a violation continues shall be deemed a separate
o ffense . .

( CI ) Where the construction or use of a building is in
Niiolation of any provision of the New York Uniform Fire
P revention and Building? Code or any lawful order obtained
thereunder . a justice of the Supreme Court at a special term
in the judicial district in which the building is located ,
may order the removal of the building or any abatement of
the condition in violation of such provisions . An

application Zor such relief may be made by the CEO , the Town
Supervisor or any other person aggrieved by such violation .
( e ) A violation of this local law is an offense
punishable by a fine not exceeding $ 100 . 00 or by
imprisonment for a period not exceeding fifteen ( 15 ) days ,
or both . Each day ' s continued violation shall constitute a
separate , additional, violation . In addition , the Town Board
shall have such other remedies as are provided by law to
enforce the provisions of this Local Law .
SECTION 8 . Abatement of Violation
Appropriate action and proceedings may be taken at law
o r in equity to prevent unlawful construction or to
✓ estrain , correct , or abate a violation or to prevent
illegal occupancy of a building , structure , or premises and
these remedies small be in addition to penalties otherwise
prescribed by law .
S ECTION 9 . Adoption of Procedural Rules for the
bnfor, cement `ol , ttc _ NexYort _ dtate , Uniform Fire Fe Building
Code
The Town Board is hereby authorized and empowered by
Resolution to adopt , amend , supplement , change , modify , and
repeal procedural rules for the enforcement of this local
law .

SECTION 10 . Effective Date
This Local Law shall take effect immediately upon
filing with the Secretary of State .
SECTION 11 . Partial _ Invalidity
If• any section of this Local Law shall be held
unconstitutional , invalid , or ineffective , in whole or in
part , such determination shall net he deemed to affect ,
impair , or invalidate the remainder thereof .

RESOLUTION # 102 GRANT SPECIAL PERMIT -- CARL STEL I CK
Clm Garlock offered the following resolution and asked for its adoption :
RESOLVED , that this Town Board grant the special permit to Carl Stelick
for a retail sales and display lot for lawn furniture and accessories , at
2104 Dryden Rd and all zoning requirements are met This permit is not
transferable by sale or by lease .

COUNTY BRIEFING
Co Rep ' Watrc' s - reported on the DR7 proposed landfill site and the damage
that has been done . The County is investigating and ask for a full
e xplanati-on from O ' Brien and Gere . Site studies are under way for the
solid waste and no decision has been made yet .
It is under study for plans for a mental health clinic downtown and there
is consideration to provide space to move the Dept of DSS back downtown .
The taxable status date for revaluation on assessment is 1990 , and will
show up on the 1991 town and county tax bill .
There was considerable discussion regarding the landfill site at DR7 , and
® the routing of the landfill trucks .
Co Rep Tillapaugh - reported can the Pinckney Rd bridge . The design and
installation will be done by the State . The County will not be involved at
all . The Dryden and Ithaca Historical Society are very much opposed to
✓ eplacing this bridge , since it was built by the Groton Bridge Co . in the
late 1800 ' s . The bids should be going out to bid about 1 year from now ,
and take from one to one and a half years to get it replaced .
There are also two other bridges in Tompkins County that needs replacement
and the one that is in Dryden is located on West Malloryville Rd .
CITIZEN PRIVILEGE OF THE FLOOR
• Joanne Mullunix , representing Bethel Grove Community Center requesting
the Town of Dryden help them with some funds to update their playground
f acilities .
S upv Cotteri l l - was not sure of the legality of the Town using taxpayers
money for a community center , but he wi 11 check into this .
RESOLUTION # 103 APPOINT YOUTH COORDINATOR
Clm Garlock offered the following resolution and asked for its adoption :
RESOLVED , that this Town Board appoint Barbara Gardner as the Town of
Dryden youth coordinator for the year 1988 .

COUNCILMAN PRIVILEGE OF THE FLOOR
Clm Evans presented a petition from the residents of Snyder Hill Rd
✓ equesting a lower speed limit on Snyder Hi11 Rd be reduced to 40 MPH from
the Caroline town line to Ithaca town line .
RESOLUTION # 104 ACCEPT PETITION TO REDUCE SPEED
LIMIT ON SNYDER HILL RD
Clm Evans offered the following resolution and asked for its adoption :
RESOLVED ,, that this Town Board accept the petition for a reduce speed
limit on Snyder Hill Rd between Caroline town line and Ithaca town line
and send the request to the County Highway Supt and State Highway Supt .

hire temporary help not to exceed $ 5 . 00 per hour .

RESOLUTION # 106 APPOINT DOG ENUMERATOR
Clm Evans offered the following resolution and asked for its adoption :
RESOLVED , that this Town Board appoint Leland and Marie Kirk as dog
e numerator for the Town of Dryden at a rate of $ 1 . 25 per dog for the year
1988 .

ATTORNEY
Atty Perkins - reported on Snyder Hill Water Dist . , most of the initial
construction is completed . They are waiting for pumps at the present time .
Atty Perkins and the engineers decided to install services on vacant lots ,
S c' that they are in on the initial construction .
Monkey Run Water & Sewer Dist . - negotiations have been completed with
NYSE &G with respect to their water tank . There still has to be approval
from the engineers . Atty Perkins has a matter for executive session with
✓ egard to this .
The wastewater disposal system applications has been made to the Tompkins
County Health Dept . Also this is a matter for executive session .
With respect to Monkey Run Water & Sewer Dist the Town is in the process
o f obtaining easement maps from the engineer . Application has been
forwarded to NYSDOT for a work permit and to DEC for a stream crossing
permit .
Cortland Rd Water Dist - matter for executive session .
Proposed DR7 landfill - matter for executive session .

sign the necessary documents for a test well with Lewis Stuttle .

RESOLVED , that this Town Board authorize Clm Garlock and Atty Perkins to
oversee the test well drilling on the Lewis Stuttle property by Randolph
W ell Drilling within the previously agreed amounts .
