O . S later . Supv Cotterill read the notice that was published in the newspaper t o consider the application of County Acres Mobile Home Park for a special permit to expand their existing mobile home park at 750 Fall Creek Rd by 8 lots . Q UESTIONS AND / OR COMMENTS : L etter from Atty Perkins stating that this mobile home park is not o n public water and sewer and this is what the Town of Dryden requires . The special permit expansion is governed by the Town of D ryden Mobile Home Park Ordinance . Section 403 requires a public h earing to reject the application or to accept the application and ✓ efer it to the Town Planning Board , Since the applicant has o btained a variance from the Dryden Zoning Board of Appeals for the e xpansion of this park , the question of suitability of mobile homes in that sone is mute . / Supv Cotterill - the proceMcewould be to refer the application to the Planning Board , RESOLUTION # 93 SPECIAL PERMIT COUNTRY ACRES MOBILE HOME PARK Clm Evans offered the following resolution and asked for its adoption : RESOLVED , that this Town Board grant the special permit to County Acres Mobile Home Park , owners Melvin & Philip Simon and refer the application to the Planning Board for their review , and that all ✓ equirements are met . 2nd Clm Garlock Roll call vote - all voting Yes Supv Cotterill appointed Town Clerk Lloyd as the designated person f or the employee right to know , Clm Oarlock introduced Local Law # 1 - 1966 regarding enforcement of NYS Uniform Fire Prevention and Building Codes , Rules , Laws & O rdinances Pertaining to Building and Construction . 411 RESOLUTION NO . 95 - 1988 Councilman Evans offered the following resolution and asked for its adoption : WHEREAS the Town has formed the Monkey Run Water D istrict and Monkey Than Sewer District in certain portions of the western part of the Town including areas near the New York State Armory and New York State Electric and Gas Corporation , and • WHEREAS it is in the best interests of the citizens of t he Town of Dryden to have public water and sewer available for commercial , industrial and residential development , and W HEREAS the Guthrie Clinic has indicated an interest in t he construction of a clinic in that portion of the Town of D ryden which is currently outside of the boundaries of the Monkey Run Water District and Monkey Run Sewer District but which is immediately adjacent thereto and across Hanshaw Road from the District boundaries and it is possible to hookup to the Monkey Run Water District and Monkey Run Sewer D istrict , and W HEREAS it would be in the best interests of the citizens of the Town of Dryden to have a medical facility located in that area of the Town and such facility should in all respects be served by public water and sewer , and W HEREAS a review of the capacity for water service and sewer service to the proposed project has indicated the availability of capacity , and W HEREAS the capital costs of extension of water lines and sewer lines from the District to the property to be served and owned by the Guthrie Clinic will be borne entirely by the Guthrie Clinic and the same will be constructed in all respects to Town of Dryden specifications in the event that the same should some day be dedicated to the Town of Dryden as public water and sewer lines , NOW , THEREFORE , be it resolved by this Town Board that the Town of Dryden hereby expresses its approval of the concept of the construction of a medical facility by the Guthrie Clinic as set forth in the recitals in this resolution , and the Town on behalf of the Monkey Run Water District and the Monkey Run Sewer District will make every effort to arrange for connections to the Monkey Run Water District and Monkey Run Sewer District by the Guthrie Clinic provided the transmission lines are constructed entirely at the expense of such clinic and according to all Town of Dryden specifications and requirements and such water and • sewer services will be provided on a contractual basis between such clinic and each respective District on terms and conditions to be determined . LflW 4$ 1 -- 1988 O lin Garlock offered the following resoolut ion and asked for its adoption : RESOLVED , that this Town Board schedule a public hearing for May 10th at l : 15PM regarding enforcement of NYS Uniform Fire Prevention and Building Codes:. , Rules , Laws & Ordinances pertaining to building and construction . and Cirn Evans Roll call vote - all voting Yes U utherie Clinic -" regarding contract with Monkey Run for water and sewer . The capital costs for running water and sewer lines from the district termination to their site would be born entirely by that applicant . It would pay all fees required for non district users wti :ich are billed at a (:premium , which will generate additional revenue for the district and will bare no expense on the current d istrict for coats of construction or the services . The district doe :: have the authority to contract for outside users .. They are looking for eappr' ova1 for the concept of their proposal , since it appears with certainty that the water and sewer district will by constructed this year . Rd and ht 13 . • Q UESTIONS AND / OR_ COMMENTS : B arry Kas oni. c -- there are two buildings there now and this will be just an addition for storage only . 410 D anny Eastman - 504 Lower Creek Rd , requested that individuals with bordering properties be protected from the additional noise that will be created by more trucks and traffic to and from the f acility . Also plantings be placed as soon as possible so that the ✓ esidential areas will have some sound deadening and sight pleasing borders . He was also concerned about the increase in traffic and w ould like the weight limits enforced . Also there be some ✓ estriction of time that they would be allowed to work on their ✓ ehicles because of the noise late at night . There was considerable discussion regarding this . Margaret Joyce - requested that the neighboring property owners be protected by additional noise that will be created by more trucks and traffic . Also that the trucks use the Rt 13 and Lower Creek Rd intersection instead of the Hanshaw Rd and Lower. Creek Rd intersection . Mr Burruss - this is more of a seasonal use and there should be no additional traffic . He will also check into the repairing of the t rucks , he did not think that they worked past 8 : 30PM . Closed public hearing . The Town Board tabled the decision . RESOLUTION # 96 FILE AN INJUNCTION AGAINST THE COUNTY OF TOMPKINS ® Clm Evans offered the following resolution and asked for its adoption : RESOLVED , that this Dryden Town Board authorize Highway S uperintendent Gilbert and Town Attorney Perkins to file an injunction against the County of Tompkins not to use Wood Road and Caswell Road over the five ( 5 ) ton weight limit as the roads are currently posted with a weight limit . 2nd Clm Garlock Roll call vote - all voting Yes RESOLUTION # 97 WATER TANK - NYSE & G, Clm Garlock offered the following resolution and asked for its adoption : RESOLVED , that this Town Board authorize Town Attorney Perkins and Clm Garlock to negotiate with New York State Electric and Gas to purchase their water tank not to exceed SS0 , 000 . 0O . 2nd Clm Evans Roll call vote - all voting Yes • 1 16 RESOLUTION # 98 GRANT SPECIAL PERMIT BURRUSS TRANSFER Clm Evans offered the following resolution and asked for its adoption : RESOLVED , that this Town Board grant the special permit to Burruss Transfer for their addition with the following conditions 1 - that drainage , screening of storage areas and other esthetic conditions and all zoning requirements are met , 2 - request that trucks leaving the business turn left to Rt 13 , 3 - plant a buffer strip from the road to the current building approximately 200 feet . 2nd Clm Garlock Roll call vote all voting Yes Adjourned : 12 : 30PM ...,,AL00.012.4‘11.4., / I Susanne Lloyd Town Clerk 1
