O . Slater PUBLIC HEARING SPECIAL PERMIT - Carl Riese S upv Cotterill read the notice that was published in the newspaper t o consider the application of Carl Riese for a special permit to ✓ elocate his existing business of small engine repair sales and services to 298 Cortland Rd within a RC Zone . Q UESTIONS AND / OR COMMENTS L etter was received from the Health Dept stating that it would be approved with the condition that all oils and solvents would not be d ischarged into the sewage system . Any plans for expansion that Swould result in a sewage flow of greater than 150 gallons per day o r any change in the characteristics of the waste could not be approved because the lot does not meet the minimum lot size ✓ equirements . Clm Garlock - how many employees would there be ? Carl Riese - right now it would just be himself and maybe later on t here would be one part time person Clm Evans - wanted to know the hours that would be involved ? Carl Riese - right now , he is working 8 : 00AM to 5 : 30PM and Sat 8 : 00AM to 1 : 00PM Avery Park - wanted to know how the oil and solvents would be d isposed of ? Carl Riese - the oil would be stored and picked up by Safety Clean and the solvents would also be picked up by Safety Clean to be ✓ ecycled . Atty Perkins - wanted to know what section of zoning would this come under ? ® Z . O . Slater - it would come under retail business in the RC Zone . This is the same way Willis Marion ' s business was established , so that set the precedent since it is the same type of business . Closed public hearing 7 : 35PM CRoZ ® APPROVAL OF MINUTES : Motion was made by Clm Schlecht and seconded by Clm Garlock that the minutes of the Jan 12th Board meeting be approved as submitted . COUNTY BRIEFING Co Rep Tillapaugh - The County Administrator is requesting that Atty Perkins send a letter stating what specific information is n eeded for the Town to receive on any of the site work that is done o n DR7 or any testing etc . Clm Schlecht - last meeting you were asked what plans the County h ad to do with testing all of these sites and wanted to know what h as happened on that ? Co Rep Tillapaugh - nothing yet , they have a solid waste meeting on Feb 18th . The consulting engineers have been asked to look the sites over ( just driving and walking around ) and to get something t o them in writing in regard as to whether or not it is valuable f or them to test any of these other sites or not . Clm Evans - wanted clarified what was printed in the Ithaca Journal that a landowner in Lansing came to the Board and asked them that n o testing be done on his property and that he was assured by the B oard that there would be no testing done . ® Co Rep Tillapaugh - he thought that this was an incorrect statement . Co Rep Watros - the Board heard the comments and concerns of his and no action was taken . Co Rep Tillapaugh - there is a state environmental law that states t hat you can ' t put a landfill on any active farm land where soil is considered to be of one or two soils . This particular area is a productive farm land , and he doubted very much that this farm would be tested . Atty Perkins - it won ' t be tested ? Co Rep Tillapaugh - it is a very productive farm , and as far as he is concerned it will not be tested . Atty Perkins - is the soil type one of the types that would exclude it ? Co Rep Tillapaugh - they have several hundred acres , and if they t ook a piece of land out of it for the landfill it would destroy t heir farm and destroy their family business that has been there for years . ® Atty Perkins - isn ' t that true no matter where you put it ? You aren ' t going to destroy other peoples lives and property ? a3 Co Rep Tillapaugh - no , he is talking about productive farm land . Atty Perkins - you will get a good argument from the people who live on North Wood Rd and West Dryden Rd . Co Rep Tillapaugh - that could be , but his theory is a good productive farm land is not an ultimate qualification . Atty Perkins - but does it come within the kind of land that e xcludes it ? Co Rep Tillapaugh - not within in that area no . That kind of farm and that kind of soil which produces crops and has milk production , w ill have his support . Atty Perkins - so that is an arbitrary subjective decision . Atty Perkins - wanted to clarify that the County Administrator w ants his request in writing a commitment to share this test protocol and the data as it comes off . Co Rep Tillapaugh - he wants you to write a letter to him stating w hat information you want and when you want it . He wants the letter in writing for his records . Atty Perkins - how does the Solid Waste Committee and the County • intend to respond to the comments the public made at the scoping session held last week ? Co Rep Tillapaugh - he believes from the scoping session the statements that were made by the public will be used by the consulting engineers to develope their SEAR review . Co Rep Watros - that was his understanding also . Atty Perkins - there is no formal response then ? Co Rep Watros - everyone of those items should be addressed in the S EAR review . If they aren ' t then the question should be made as to w hy they weren ' t addressed . He felt with the scope of the SEAR ✓ eview should include not only those items they had outlined , but in addition all of those items mentioned the other evening . Any q uestions that were raised that is relevant in any manner w hatsoever should be addressed in the SEAR review . Co Rep Tillapaugh - they are after the concerns that they haven ' t t hought about . Clm Schlecht - are you suggesting that the engineers will tell you w hether or not they are going to review it . It seems more appropriate that you as the Solid Waste Committee or the County 110 should order them to do certain things . AA Co Rep Tillapaugh - they have a questionnaire environmental impact statement that they have to answer . Clm Schlecht - he was at a meeting last night where Frank Proto suggested that certain requests that were made might not or probably not be done because it was going to cost to much . Clm S chlecht wanted to know who was going to make that decision ? Who is g oing to decide what is studied and what is not studied in the SEQR process as part of the environmental impact statement . Are you g oing to rely on your engineers or are you going to make the d ecision ? Co Rep Tillapaugh - the form that they have to fill out includes all of these things . It is up to the engineers and the county , who are responsible , to answer those questions . Now as far as cost , he d id not know what Frank Proto was talking about . Clm Schlecht - his statement was that some of the people asked for studies to be done which he didn ' t think would be done because the cost would be exorbitant . Clm Evans - thought it was irritating that the cost of study and t he property is exorbitant . They are unwilling to put a limit on h ow much it will cost to build that site . This strikes him as incompatible . I Co Rep Watros - it is obvious to him that the engineer will make a ✓ ecommendation to the Board of Representatives and the Board of Representatives will decide what is and what isn ' t reviewed . Atty Perkins - wanted to know if there was a time frame for that ? Co Rep Watros - only what they suggested the other night , within 3 months . In addition to that the State has to agree to exclude or include items , preferably exclude those items which the County w ishes to exclude that were mentioned . The State of New York as w ell as the Board of Representatives make the decision . Clm Schlecht - the critical item now is what alternatives they are g oing to look at and how closely they have to look at those alternatives . If the engineers state that they looked at the other alternatives in the Phase I study , which he objects . They come back and say they looked at S other sites ignoring the fact that they ignored the better sites and the County buys off on that . He t hought that was a critical decision . Co Rep Watros - DR7 was as critical as well , and you know our position on it . How much influence will the engineers have on the majority of the Board of Reps , this is the issue that we have to d eal with . Once there is some sort of draft , between Ken , himself and the Town Board and others that are concerned have to try to ® insure that the majority of the board will support our point of ✓ iew . He felt this is the only course we have unless there is another suggestion . Clm Schlecht - it is the question of trying to understand what is g oing to happen next . At the scoping meeting questions were raised and other questions will be forth coming in writing . Now at what point is the decision going to be made ? Are you going to look at those questions or ignore them ? Co Rep Watros - their interest will be to make sure all of those items are included and to have any of them pointed out by the e ngineers that were excluded and for what reason . Their admission w ill be to try to include all of those items . The majority of the items were legitimate concerns and should be addressed and they w ill attempt to make sure they are addressed and the concerns are put to rest or at least some accommodations are made for those concerns . Until there is some kind of a draft as to what O ' Brien and Gere is going to do , he is sure they will be back to the Solid W aste Committee and the full board . There will be another public h earing at some point , he would presume , before they proceed . He is n ot sure what the schedule of events are . He is sure they will all h ave an opportunity to raise those issues you are suggesting and w elcome any comments that you have . Clm Schlecht - the chance to comment on the draft EIS is after the e ngineers expense of 8300 , 000 . 00 . He suggests that they come back w ith a prepared outline . He would hope based on the scoping session they have prepared another outline which the county would then have a chance to review . If there are things missing that should be in there have a chance to tell the engineers what they want to see in t hat outline . Co Rep Watros - they will find out and be sensitive to what has been said . Clm Evans - felt that the County would want all of the input they could get into the outline before the study took place . It would be a shame if the County ended up in court because the public didn ' t t hink you followed the rules . Atty Perkins - it would be to late at the time of the public h earing to have the draft EIS . This is the point that is being made . Co Rep Watros - they will monitor the situation and see how it d evelops . Atty Perkins - the real danger is that the County is going to sink h undreds of thousands of dollars to study this site in the permit process and SEOR process . He would hate to see the County getting so entrenched in spending so much money that it can ' t walk away w hen it realizes it is not the right site . The danger is that you spend to much money in studying it and not studying the right t hings and just keep saying that it is an engineering problem . You ® have so much money invested that you should walk away and there w ould be a reluctance to do that . This is his concern . 4 Atty Perkins - wanted to ask Co Rep Tillapaugh if the Solid Waste Management Committee talked about a drop dead figure . At what point d oes the development of DR7 cost to much per ton of garbage to abandon ? Is it $ 50 . 00 per ton etc . ? I I Co Rep Tillapaugh - he is sure that this has not been discussed for any site and cannot see how they can . Atty Perkins - it would seem to him that it would be prudent at t his point for your committee to undertake that kind of an initiative . If you keep saying just an engineering problem , all you are doing is making the site more and more expensive and getting f urther down the line . You have used up more of that time that the D ept of Environmental Conservation says that is so critical and h ave cost more money to truck the garbage . He thinks that there should be a drop dead figure set right now . I Co Rep Tillapaugh - what figure do you set ? Clm Schlecht - a number that is larger than it would cost to haul it out of town . Co Rep Tillapaugh -- is sure they wouldn ' t want to do that . They h ave figures on the Phase II report as to what it would cost to h aul garbage , and operate a landfill so they do have those figures and he doesn ' t know how much more accurate you can be . Atty Perkins - no one is asking you to be accurate , but asking if you have set a limit , example not to exceed 25 per cent of a certain figure . If the engineering and construction cost that much more they are not going to do it . Co Rep Tillapaugh - sure they will look at those figures to see if it is going to cost more to have our own garbage dumped or whether it is better to take it out of state . Atty Perkins - you not only have to look at that solution , but you h ave to look at the solution of another site . If that farm in L ansing is cheaper by 30 , 40 , SO per cent to buy , engineer and to construct than they certainly have shirked their responsibilities . Co Rep Tillapaugh - he has to look at the overall picture if he is g oing to take a farm out of production . K aren Belden - but are you thinking about the people around the DR7 area . What about the Lowe ' s that have a business right across the street that are going to lose their income ? Co Rep Tillapaugh - sure he is , and he knows , but this is something that people keep talking about taking farming out of production , and someday we are not going to have food . d7 ® Atty Perkins - we are talking about an issue that effects every single person in the County , every single taxpayer and every single ✓ esident , now what is so sacrosanct about one farm for the public g ood if . that is the better site ? Co Rep Tillapaugh - there are other sites that they are looking at . Atty Perkins - did not think that they have the liberty excluding any of those sites right now . Co Rep Tillapaugh - at the present time this is not excluded , this is just his opinion . K aren Belden - you would vote against it ? Co Rep Tillapaugh - for taking that farm out of production , yes he w ould , but he is still looking at other sites . K aren Belden - if it came down to two sites you would vote against that farm land instead of DR7 ? Co Rep Tillapaugh - they haven ' t come to that situation yet . Atty Perkins - what is the commitment on the other sites , to examine them ? In January you voted to look at 6 other sites . One of ® those farmers you now have struck a nerve with and said please don ' t look at me anymore , what about the other 5 sites ? Co Rep Tillapaugh - the engineers will report to us at our next committee meeting whatever that earlier report is from the e ngineers study . They are looking the sites over as they did on the P hase I to see whether they think it is feasible to do the on site investigation . Atty Perkins - when do you expect to have that report and is the ✓ eport going to be made public ? Cop Rep Tillapaugh - he thinks the report will be available next Feb 17th or 18th and he presumed that it would be made public . K aren Belden - wanted to know why on Feb 16th the representatives w ere going to meet with a construction and consulting engineer out o n the DR7 site ? You are not talking about dollars and cents , you are talking about a hiring a very large construction and management consulting team . They are going to be out on the site to look it over . Co Rep Tillapaugh and Co Rep Watros knew nothing about this and w ill have to check on it . Co Rep Watros - you have to look at it from the opponents ® prospective . There are 8 members on the county board that would d irect the county staff to proceed . That is exactly what they are d oing until we can demonstrate that there is a reason to stop you w ill continue to see this sort of thing happen . You will see construction management , additional experts , appraisers , etc until w e can stop the process . . f t 410 Atty Perkins - had one more question for Co Rep Tillapaugh and w anted to make sure that it was addressed in the draft EIS and he w ill put his comments in writing to Mr . Liguori . How does the County intend to reconcile the new draft USGS aquifer map with the D R7 site which indicates the presence of a principle aquifer at least on part of the site or directly adjacent to the site ? This is a very important part because you are at direct odds with the Federal Government as to whether that aquifer exists and where . Co Rep Watros - someone suggested to test drill a series of wells . Co Rep Tillapaugh - they have talked about that area according to the aquifer sites and was not sure about it . Atty Perkins - the County ' s official position , as far as he u nderstands it , is that the USGS is wrong . Co Rep Tillapaugh - thought that was what Hr Proto was quoted as saying . Atty Perkins - there is a big difference between the County map and t he USGS map . Co Rep Tillapaugh - he knew that and he is sure that will be answered as far as he is concerned . If they say there is an aquifer there he will mace sure that it is tested . He can ' t believe that I all the water for the wells around there doesn ' t come from someplace . Co Rep Watros - the assessment director has informed the County t hat the revalue that was scheduled for 1989 will now be deferred u ntil 1990 because they cannot update all of the files for the new and existing parcels that are in Tompkins County . Ie 1965 when the f irst evaluation was done there were 16 , 000 parcels and now there are almost 30 , 000 . The plan was tc have the revalue in 1985 on a ✓ easonable cycle to keep assessment more current with values . At the present time it is estimated that the current assessment is about 40 to 50 percent of actual sale vices . He is going to try to h ave in done in 1989 so that they can keep on schedule . They will t hen try to schedule a 5 year cycle to keep everything current . Steve Landau - a presentation was given on ground water to Phi at a meating in Broome County as to what is developed there and what might be possible for Tompkins County . The Tompkins County Board of H ealth peat and present chairman were present and were interested in the ground water program similar to what they are doing in B roome County to see if it could be developed in Tompkins County . H e thought that the Town could get some interest from the County level and maybe something could be done in the Town of Dryden with t he help of the County Board of Reps to support that program . iehm Andersson is trying to hire an engineer now . o COUNCILMAN PRIVILEGE OF THE FLOOR elm Evans - felt that the Town Board should wait on making any appointments to the Citizens Advisory Committee until the County as made their appointments since there might be some resumes that are left to look at and consider . Co Rep Tillapaugh - the Town makes the recommendation to the County and the County appoints the people . The appointments are 5 ✓ esidents , 2 at large and 1 County Board member . ATTORNEY Atty Perkins - attended the sopping session held at MYSE & G ✓ egarding the landfill . He was very impressed with the thoughts t hat the people had put into their comments and efforts that had gone into compiling questions and written comments to be addressed t o the draft EIS . The County should keep in mind that you can ' t f ool all of the people all of time . These people will be looking at whatever product you come up with very carefully and to overlook or n ot address any of their concerns would be a potential fatal crack in your procedure . He would recommend that the County make the studies and spend the necessary time . One comment he kept hearing w as that you need seasonal data which state regulations require . Co Rep Tillapaugh - agreed 100 per cent . - - reported on Monkey Run Sewer Dist . There was a conference with Runt Engineers involving NYSESIG and their position in supplying e w ater tank and will discuss it more in executive session . Also , according to Hunt Engineers it is possible to eliminate one pumping. station which will reduce the cost of the district . Doing this may n ecessitate the installation of a larger pipe which would be e change . According to the bond counsel in New York there would have to be another public hearing . You would not need State approval as long as you are not asking for more money . Hunt Engineers will make the modifications to the map , plan and report so that a public h earing can be held on those changes , - - received from Hunt Engineers correspondence to the Office of G eneral Services in connection with certain proposed easements to w ater and sewer lines across the armory . He has reviewed them with Hunt Engineers and found everything to be in order . This is also a matter for executive session . - - also has another matter for executive session regarding Cortland E d water dist for potential drilling site . TOWN CLERIC L etter from EPVA advising the Town of a problem with accessibility to District # H Bethel Grove Community Center polling place . Attar P erkins will check into the matter . UPDATES : I now have put together an inspection process for structures of PUBLIC USE and MULTIPLE DWELLINGS , 1 hare mailed to first notices to such occupants requesting a time of inspection appointments be made with this office . I also have sited my authority little about the orgin of this inspection program . As you are also aware ' I ' ve found a gentleman who has a salvage yard permit and the necessary equipment to hail unregistered , abandoned and junk vehicles to his yard on Wood Road . The owner at this time is interested in this program and depending upon e few details that he needs to work out will provide the service that will make the program work . p Salvage yard cont . : i ) . He needs to determime what the cost of liability insurance will I> e .; for this . Z ) . He needs to work up a Fee schedule for vehicle removal . 3 ) . His yard is for ( 5 ) acres , He has only developed ( 2 ) acres of it and would like to develope the entire ( 5 ) acres . His question to the hoard is : would the Town of Dryden he willing to bring in the equipment to clear the remaining ( 3 ) acres t • 3 ) . Since the crusher will not take tires , he needs to find a method for disposing o f tires . i ' ve made some phone calls and have found a person in Binghamton who buys tires for salvage , I will be turning this information over to him this week . I ' ve also turned over copies of my communications with Roth Steel' of Syracuse . Roth Steel is the crusher who comes to a site to crush and remove vehicles . He and Roth will make their own deal as far as to salvage of the vehicles from his yard . f1 ) . The last point that he needs to address is , if a registration it required when a vehicle is crushed for salvage . What I would like to do Co encourage and aid people in compliance is : I ) . Run an ad in the " Shopper " telling how to contact this person for removal o f such vehicles . I ' ve built money into my budget for such action . • d ) . print up handouts to give to people who are found to be in violation of this section of the Dryden Town Zoning Ordinance . What l ' m asking you for is : he you want to get this program onboard and to what degree is the Town of Dryden willing to support this program f I think that the hulk of the work would be completed within the first year . After this pereid of time there should be very few vehicles that are in ✓ iolation of the ordinance . There isn ' t a lot that the Town needs to support in cost . Since this is rot a town function , I don ' t think that the Town would have any liability . I do think that the Town Attorney should render an opinion o n this issue ! There was considerable discussion regarding the proposed zoning changes . Clm Evans wanted to know if there was a recommendation from the committee on mobile homes as to where they would be allowed . Clm Garlock the committee recommended that mobile homes should be allowed in RD , RB1 and RC zones . .' Clm Garlock - for the record , because of the work that the committee has done in preparing report he is going to support the committee . S upv Cotterill - he assumed that the mobile home committee ' s job w as to determine how the mobile homes were to installed . The P lanning Board was to do the mapping and zoning and the ✓ ecommendations of the allowed uses . It is appropriate to take the comments from both the Planning Board and the mobile home committee . Motion was made by Clm Evans to allow mobile homes on individual lots in RC ; RB1 and RD zones and the mobile home parks to be allowed in the same areas and same zones that were previously allowed prior to the 1986 amendments except the MA zone and in any case only where they can be served by municipal water and sewer . The motion was seconded by Clm Garlock . Atty Perkins - one question that has to be looked at is that since you have drawn new lines on the proposed zoning map , you will have t o look at whether the new lines encompass areas that are different t han that which previously allowed mobile homes parks that now d on ' t allow them . 3R, ® Motion was made by Clm Schlecht that any decision be tabled until next meeting .
