Public Hearing held to enlarge the Sewer District to
include all the Barker Store Land on West Road and McLean
Road. Notice of Public Hearing, published in the Cortland
Standard was read by Town Attorney John J. Gardner. After
discussion by Board members and interested parties, the Hearing
was declared closed by Supervisor Taylor.
• Regular meeting was then called to order by Supervisor
Taylor. Members present were Justices Ron Fish and Don Eaton
Councilmen Sherman Griswold and Ray E. Milder. Also present ,
�li,,ecy,iKrauklis, _hook -keeper for Supervisor, Town Engineer, Wm.
Rowell, Town Attorney John J, Gardner, Town Assessor, Henry
Wadsworth,Mr. Albin Rothe, and Attorney Morris Fitts, repre-
senting the Barker Stores. Also, Patrick Hamil, Dorthea Allen,
Phil Allen, Carryl Bogart, Mr. Peterson ,Wm. Burdick,Mr. Stisser
Mr. & Mrs. Wm Porter, Mr. Louis Sosnowich, Mrs. Mildred Thomas,
and Surveyor Donald McKee. and Erving Reeve•
Town Clerk read the minutes of the previous meeting and they
were approved.
Resolutions, 1,2 and three were passed by the Town Board, see
pages248,24.9 and 2505" i r f .
Mr. Taylor explained"the Sewer situation in vicinity of Highland
Rd. to Mrs. Mildred Thomas.
Mr. Porter presented a contract he has to put up the 6' Chain
Link fence on 2 sides of the property at Village Terrace Apt's.

otion was made by Mr. Eaton seconded by Mr. Griswold that a
Public Hearing be held Sept. 16, 1970 at 7:30 P.M. on the Pre-
liminary Budgets for Water Dist. 1,2, 3, and Sewer Dist. # 1/
This motion was carried.

Motion was made by Mr. Griswold seconded by Mr. Miller, that
the following bills as presented by the Town Clerk and audited
by the Town Board be paid, this motion was carried.
Gen Fund $1829.79, Highway Fund,$5950.52, Water Dist. 1,$398.11,
Dist. 2 417.20, Sewer Dist.l,#14.7.00
There being no further business at this time, meeting adjourned..

The petition dated August 19, 1970, having been presented by
Cortlandville Center Associates'Corp., requesting an extension of tie
boundaries of Sewer District No. 1 in the Town. of Cortlandville, an.
it appearing that a portion only of lands owned by said Cortlandvil e

RESOLUTION
WHEREAS, a. Petition for the extension. of Sewer District No. 1
in the Town of Cortlan.dville, Cortland County, New York, the said
Petition being dated August 19, 1970, was duly presented to this Tc
Board, together with the necessary Map attached thereto; and
WHEREAS, An Order was duly adopted by the Town Board on Augus
19, 1970, reciting the filing of said Petition, the improvement pr
posed, the boundaries of the proposed extension. to such District,
-anal that the cost of such improvement will be borne by the petitio
er, Cortla.ndville Center Associates Corp., and specifying September
2, 1970, at 7:30 P. M. as the time and the Town. Hall, at 3577 Terra
Road in. the Town. of Cort.landville as the place where the said Board
would meet to consider the Petition and to hear all persons inter-
ested in the subject thereof concerning the same; and
WHEREAS, Such Order was duly published and posted as required
y law; and
WHEREAS, A hearing in the matter was duly held by the Board on
the said 2n.d day of September, 1970, commencing at 7:30 P. M. at th
Town. Hall, 3577 Terrace Road in the Town of-`Cortlandville, and con-
siderable discussion -upon the matter having been had, and all perso
desiring to be heard having been duly heard:

RESOLVED AND DETERMINED, That (a) The Petition aforesaid is
signed and acknowledged or proved as required by law, duly complies
with the requirements of Section 191 of the Town. Law as to suffi-
ciency of signers with respect to the boundaries of the proposed

extension. of such District as herein approved, and is otherwise su4-
ficient; (b) all the property and property owners within the pro-
posed extension of such District are benefited thereby; (c) all thE
property and. property owners benefited are included within the
limits of the proposed extension of such District; and (d) it is
further
RESOLVED AND DETERMINED, That the extension. of such Sewer Dis-
trict No. 1 as proposed In such Petition., being in the public inte4-
est be approved, upon condition, however, that the said Petitioner
construct the improvements and provide the services therein, mentioned
'and turn over and convey the same, without any cost or obligation
whatever, to said Fewer Dist-dnt No. 1 of the Town. of Cortlandville.,
and that the boundaries of said Sewer District No. 1 be extended t
include the following described parcel of land:
ALL THAT TRACT OR PARCEL OF LAND situated in the Town of
Cortlandville, County of Cortland and State of New York being
part of Lot Y73 being bounded and described as follows: Begin-
ning at the center line of West Road (New York State Route
l;�281) at the southwest corner of lands of State of New York,
Department of Public Works; thence running N-890-53'-E along
lands of said State of New -York a, distance of891.28 feet to a
point; thence running S-10- 09'-W along the Allen Tract a. distance
of 112.96 feet to a point
; thence running West a distance of
200.0 feet to a. point; thence running 3-10-09'-W along lands of
Cortland Gospel Associationa distance of 524-75 feet to a
Point in. the center line of McLean. Road; thence running S-89o-
46'-W along said center line of McLean, -Road a. distance of 666. q
feet to a poin.-II-1 being the Southeast corner of lands of L. F.
Smith; thence running N-15 -57'-E along lands of said Smith a
distance of 218.05 feet to a point being the southeast corner
Of lands of John, J. Stevens; thence running N-220-28'-E along
lands of said Stevens a distance of 175.0 feet to a. point;
thence running S-890-43'-W along lands of Stevens 9, distance -or
250.0 feet t8a point in the center line of West Road; thence

feet to the point of beginning and containing 10.68 acres Of
land, more or less.
There is excepted from the above described lands the portio
thereof that presently is located In CortlanAville Sewer Distr-ct
#1 bounded and described as follows: Beginning at the southea3t
corner of the above described premises in. the center line of t le
McLean. Road; then.cp running S-89u-461-W along said center line a
distance (f 301.25'1 to a point; thence running N-01 X -091-E a
distance of 20().0 ' to 9 Point; thence -running N-890-469-E, a
distance of 301.25' to a point in. the westerly line of the Cor-'_
land Gospel Association, lands; thence running S-olv

RESOLVED, That the Town. Clerk, pursuant to Section 195 of the
Town Law, cause certified copies of this Resolution to be duly re-
corded in the Cortland CountyClerk's Office and to be duly filed
with the office of the State Department of Audit and Control at
Albany, New York, within:ten. days from the date of the adoption. of
this resolution.
