M . by Chairperson Weitzel and the following publication of hearing was read : NOTICE IS HEREBY GIVEN , that a public hearing will be held by the Planning Board of the Town of Danby at the Town Hall , 1830 Danby Road , Ithaca , New York 14850 on the 26th day of March 1992 at 7 : 30 P . M . Purpose of hearing is to consider a proposal submitted by Michael Hovanec for a subdivision of 5 . 27 acres into three ( 3 ) lots and a special permit to place a doublewide mobile home on one lot . The proposed site is located on Town of Danby Tax Parcel # 11 . - 1 - 6 . 103 located on Route 96B near Steam Mill Road . At such time and place all persons interested in the subject matter thereof will be heard concerning the same . A special meeting of the Planning Board will follow the public hearing . Sczepanski Secretary Dated : March 19 , 1992 Published : March 21 , 1992 Michael Hovanec submitted a completed application for a subdivision of 5 . 27 acres into three ( 3 ) lots and request for a Special Permit to place a Doublewide Manufactured Home on one of the lots . The following information was submitted : 1 ) Notification of Neighbors statement with date of delivery and signatures ; 2 ) Survey Map showing Parcel # 2 ; 3 ) Plot plan for proposed Manufactured Home ; 4 ) Floor Plan of proposed Manufactured Home ; 5 ) Pictures of homes in the neighborhood ; 6 ) Skirting material for the proposed Manufactured Home Mr . Hovanec explained the construction and materials of the proposed Manufactured Home in detail and asked that this application be considered concurrently with the minor subdivision application submitted . . . . 24 2 Planning Board Public Hearing March 26 , 1992 P ublic Comments and Questions : Raymond Mayo of 335 Ridgecrest Road asked Mr . Hovanec how much this house would sell for . Mr . Hovanec said that the package would be considered affordable h ousing of around $ 80 , 000 . 00 . J ohn Benjamin said he owned property near the proposed location and did not have any problems with this proposal . Request for Special Permit for a Doublewide Mobile Home : The Planning Board reviewed the skirting detail of the D ryvit / Sprint System . Mr . Hovanec said that this doublewide becomes a permanent structure when it is put in place . On any mobile home including singlewides only five percent are ever moved . This particular home is even more permanent because of the skirting , footers below the frost line , and the wheels and axles are removed . He explained that this home meets the requirement of a permanent foundation by H UD Standards , New York State Standards , and Fanny Mae Standards . D iscussion followed regarding tie downs or the anchoring of the corners of the mobile home . Mr . Hovanec agreed to anchor or place tie downs on the structure if requested by the Planning Board . Motion to Close Public Hearing : A motion was made by Arch Dotson and Seconded by Joel Gagnon to close the Public Hearing for the Hovanec Subdivision and Request for Special Permit to place a doublewide mobile home on a lot at 1111 8 : 05 P . M . Sczepanski Secretary Dated : March 19 , 1992 Published : March 21 , 1992 Harriet Moore addressed the Planning Board and gave a brief background of the Phinney property and the conveyance of Phinney to Beebe subdivision of one lot . The lot proposed to be subdivided is 1 . 3 acres from Town of Danby Tax Parcel 1 . - 1 - 19 . 2 . Comments from the Public : Ted Crane - West King Road - said he was a neighbor directly across from this property and asked if this lot was the last lot that could be sold from this property . Did it mean ever or this year ? He referred to information received in the mail and said that the lot is smaller than 1 . 3 acres and some of the plots on the map are listed incorrectly . He stated that he would not like to see a change in the character of the neighborhood with development of the back acreage on this property . Susan Beepers explained that this is a minor subdivision and the first on this property under the Town of Danby Subdivision Regulations . Up to four ( 4 ) lots can be created before triggering major subdivision review . New York State also has subdivision , , • 26 2 Planning Board Public Hearing March 26 , 1992 regulations . Dominick Paolilo - West King Road - asked how accurate the papers were in his hand - - and whether this was the last lot that could be subdivided before it becomes a major subdivision . Harriet Moore explained the materials and where there have been previous subdivision of lots . Joel Gagnon explained that New York State Subdivision Regulations were in effect until the Town of Danby adopted its own regulations . Motion to Close Public Hearing : A motion was made by Arch Dotson and seconded by William Farrell to close the public hearing for a proposed minor subdivision of a 1 . 3 acre lot from Town of Danby Tax Parcel # 1 . - 1 - 19 . 2 owned by Charles and Eloise Phinney at 8 : 35 . Purpose of meeting is to consider the following : 1 ) Charles and Eloise Phinney Proposal - - for a minor subdivision o f a 1 . 3 acre lot . The proposed subdivision is located at the intersection of West King and West Jersey Hill Roads on Town o f Danby Tax Parcel # 1 . - 1 - 19 . 2 . 2 ) Hovanec Subdivision Proposal - - for a minor subdivision of 5 . 27 acres into three ( 3 ) lots and to place a doublewide mobile home on one of the lots . The proposed site is located o n Route 96B on Town of Danby Tax Parcel # 11 . - 1 - 6 . 103 . Charles and Eloise Phinney Proposal : The Planning Board reviewed the proposal and the Environmental Assessment Forms submitted by Charles and Eloise Phinney . Susan explained that the survey map shows the acreage to the center of boundary right - of ways of the roads . Net . acreage on the parcel is less than 1 . 3 acres . The following recommendations were made by the Planning Board : 1 ) No . 10 on the Environmental Assessment Form should be " NO " . 2 ) C2 - delete " not expected " and insert " modest impact " 3 ) C7 - delete " not expected " and insert " modest impact " D ) At the hearing on the action a neighbor resident expressed concern about the areas gradual loss of rural character . Resolution No . 2 of 1992 Resolution - Negative Declaration for Phinney Subdivision - Approved By Joel Gagnon : Seconded by Ken Horst WHEREAS , Charles and Eloise Phinney have submitted a proposal for a minor subdivision of a 1 . 3 acre lot located at the intersection of West King and West Jersey Hill Roads on Town of Danby Tax Parcel # 1 . - 1 - 19 . 2 . WHEREAS , the Town of Danby Planning Board has reviewed the Draft Environmental Review prepared by the Interim Code Enforcement Officer , and 28 2 Planning Board Minutes Special Meeting March 26 , 1992 WHEREAS , the Planning Board has made modifications and approved such review , and WHEREAS , the Planning Board is acting as Lead Agency for this unlisted action for which no coordinated review is required , now be it RESOLVED , That the Town of Danby Planning Board acting as Lead Agency makes a Negative Determination of Environmental Significance for this action . A roll call vote on the resolution resulted as follows : Dotson Aye Farrell Aye Gagnon Aye Horst Aye Viscuso Aye Weitzel Aye Carried Unanimously Phinney to Beebe Subdivision Approval A motion was made by Joel Gagnon and seconded by Arch Dotson that the Town of Danby Planning Board approve the Phinney to Beebe Subdivision and the fee of $ 60 . 00 for the Final Plat Application be waived . Carried Unanimously It was noted by Susan Beeners that A fee for the Preliminary Plat was collected . The Planning Board Secretary was directed to send a letter of approval to Charles and Eloise Phinney with a copy to Harriet Moore . A vote on the motion resulted as follows : Carried Unanimously Hovanec - Fee for Final Plat Waived A motion was made by Arch Dotson and Seconded by Ken Horst to waive the fee of $ 80 . 00 for the Final Plat Application for the Hovanec S ubdivision Application . A vote on the motion resulted as follows : Carried Unanimously It was noted by Susan Beeners that A fee was charged for the P reliminary Plat . Hovanec - Request for Special Permit for a Doublewide Mobile Home : Michael Hovanec has submitted a request for a Special Permit to place a Doublewide Mobile Home on a lot located on 96B on Town of D anby Tax Parcel # 11 . - 1 - 6 . 103 . D iscussion followed : Planning Board members expressed concern that the structure was not anchored ( tied down ) to the ' foundation . Hovanec - Special Permit for a Doublewide Mobile Home - Approved A motion was made by Arch Dotson and seconded by Bill Farrell that the Town of Danby Planning Board Grant a Special Permit to Michael Hovanec for a doublewide mobile home to be placed on Town of Danby Tax Parcel # 11 - 1 - 6 . 103 located on Route 96B near Steam Mill Road . A vote on the motion resulted as follows : Carried Unanimously Motion to Draft Language for Addition of the Drivit System for Skirting Zoning Ordinance A motion was made by Joel Gagnon and seconded by Arch Dotson to request the Code Enforcement Officer to work with Michael Hovanec to draft language to amend the Town of Danby Zoning Ordinance to incorporate the Drivit System and standard stucco materials into the specifications for the perimeter foundation . Discussion followed regarding the perimeter treatments around mobile homes that resemble masonry foundations . A vote on the motion resulted as follows : Carried Unanimously Revised Application -- Mark Bristol Susan Beeners reported that she has received a revised Sketch Plan from Mark Bristol for a property on Troy Road near the Town of 39 4 Planning Board Minutes Special Meeting March 26 , 1992 Ithaca . The revised plan is for a subdivision of two ( 2 ) lots and a building for a work shop . The proposed building exceeds the 400 ft . storage building allowed in the ordinance in residential areas . The building in the sketch plan is for 1800 sq . ft . and is for a home occupation . Susan suggested that the Planning Board schedule a Sketch Plan Review of this proposal .
