Taylor presided at this hearing and Budgets were reviewed. No one appeared to object to these Budgets and motion was made by Justice Eaton seconded by Councilman Griswold that the hearing be closed, this motion was passed. • Regular meeting was called to order by Supervisor Frank K. Taylor, members of the Town Board present were, Councilmen Sherman Griswold and Ray E. Miller, Justices,; Ron Fish and Don Eaton. Also present were*;Rudy Krauklis, book-keeper for Supervisor , Town Assessor, Henry Wadsworth, Town Engineer, Wm.. Rowell, Town Attorney, John Gardner, Town Hgwy. Supt. Lou Wagner, Fred Walker, Sewer and Water Maintenance, also, Skip Chapman from the Cortland Standard, James Yaman, Mr. & Mrs. Verne Niederhofer, Richard and Leon Doran, Mr. & Mrs. Walter Priest, Dick Harris, Mayor Morris Noss, Surveyor, Don McKee, Mr. John DiPietro, Alfred Bielby and three others, not identified , also, M. Brookins, Deputy T. Clerk. Mr. .Jack Fitzgerald,Attorney was present representing the petitioners for annexation. Town Clerk read the minutes of the last meeting and there were no corrections. Mr. Taylor reported to the Board in regard to his com- minication with Dr. MacLeod, relative to the fly problem in Lime Hollow area due to Gunzenhauser Farms, fertilizing their farm lands. Mr. Taylor read another communication from Director of Transportation, Charles Ames, relative to petition for a re- duced speed zone in Blodgett Mills area. Mr. Taylor had another communication from J. Fuess, Sanitary Engineer, regarding McLean Bog Control Problem (Mosquitos, see Mr. Taylor's .letter ) t` Resolution was presented on motion of Mr. Miller seconded by Mr. Eaton that the Town request waivers from County Civil Service Board for 7 County waivers adjoining Cortland County for applicants for Town Assessor from any of these counties. This motion was passed. Westendorf and St. Mary's Church for the Annexation to the City of Cortland of certain territory adjoining said City, now located in the Town of Cortlandville, Cortland County, New York. a • s . • e e • . e e • . e e • • • • • . • • • WHEREAS, Walter 0. Westendorf and St. Mary's Church have filed in the Town Clerk's Office their joint Petition dated May 5, 1972, o the Town Board and to the Common Council of the City of Cortland, N w York, requesting the annexation to said City of certain lands situa ed within the Town and adjoining said City, which lands are described in the aforesaid Petition and a map attached thereto; and WHEREAS, A public hearing before the Town Board and the Common Council of said City was held at the Town Hall on the 14th day of June, 1972, and the testimony and minutes kept and taken at said meeting have since been filed with the Town Clerk; and WHEREAS, Walter 0• Westendorf and St. Mary's Church have filed In the Town Office their joint Amended Petition dated 1972, to the Town Board and to the Common Council of the City of Cortland, New York, requesting the annexation to said City of certa n lands situated within the Town and adjoining said City, which lands are described in the aforesaid Petition and a map attached thereto; and WHEREAS, It appears to be in the over-all public interest to pprove such proposed annexation „ it is RESOLVED and DETERMINED: 151 1 r' -I L. Fish seconded by R.Iqiller that a Public Hearing be held Sept. 20, 1972 at 7 P.M. regarding a three year fire contract with the Village of McGraw', ending December 1975 for the sum of $ 5500.009 yearly. This motion was passed. RESOLUTION: Motion was made by Mr. Eaton seconded by Mr. Miller that a committee be appointed, namely, Supervisor Taylor, Justice Fish -- and Councilman Sherman Griswold to meet with the Mayor of Homer and negotiate if possible to have a two year contract for Fire Protection. This motion was passed. RESOLUTION: ". Miller that the Town attorney prepare specifications and advertize for bids, for a Spreader for the Hgwy Department, bids to be opened Oct. 4, 1972 at 8:15 P.M. Bids were opened by the Town Clerk for a new and unused 1972 Power Grader for the Highway Department. C.C.O.Construction Equip. Inc., Net price F.O.B. $30,897.00 Austin -Western Super Grader Syracuse Supply Co. Caterpillar $36,200.00 RESOLUTION: IYUMotion was made by Mr. Eaton seconded by Mr. Miller that the low, bid of C.C.O.Construction Equip., Inc. be accepted, this motion was asaSsed, all voting aye. 152 1. That the aforesaid petition complies with Article 17 of th (General Municipal Law. 2. That, on the basis of considerations including, but not limited to, those relating to the effects upon (a) the territory proposed to be annexed; (b) the City of Cortland; (c) the remaini�g area of the Town of Cortlandville; (d) the Enlarged School Distric of the City of Cortland and the Fire Protection District of the Tow of Cortlandville, both of which are wholly situated in the territor proposed to be annexed, it is in the over-all interests of the Town Board to approve such proposed annexation. 3. Z=-��- L/�_� , the following Resolution was unanimously adopted: WHEREAS, The Highway Superintendent intends to widen, deepen, clean and straighten the channel of Smith Brook on the south side o Cortland County Highway #116, known as the McGraw-Maratbon Road as it winds and turns across the lands in the Town of Halford S. Rowe, Donald A. Rutan and Donna L. Rutan, his wife, Louis J. Wagner and Florence Wagner, his wife, Percy Leach and Mildred E. Leach, his wife, Chester L. Card and Ruth M. Card, his wife, Vernon C. LeRoy and Eleanor E. LeRoy, his wife, and James Caufield and Patricia Caufield, his wife; and WHEREAS, Each of the aforesaid persons have delivered to the Town, their proposed seven deeds dated August 23, 1972, conveying a perpetual easement over the present bed of said Smith Brook for sai channel improvement: NOW, THEREFORE, BE IT RESOLVED, That the aforesaid seven deeds conveying said ease - meats for said channel improvement be, and the same hereby are, accepted by the Town; and be it further RESOLVED, That the Clerk of the Town be, and he hereby is, authorized and directed to record the aforesaid seven deeds in the Cortland County Clerk's Office. • 1
