S upervisor Oltz called the meeting to order at 8 : 05 P . M . and led
all present to the Pledge of Allegiance to the American Flag .
APPROVAL OF MINUTES OF JANUARY 13 , 1992 TOWN BOARD MEETING
A motion was made by Councilperson Marisa acid seconded by
Councilperson Hile to approve the minutes of January 13 , 1992 Town
Board Meeting as published .

TOMPKINS COUNTY REPRESENTATIVE - REPORT
County Representative Proto reported on the following :
1 ) New York State Land Acquisitions - The report was released
last month and there is concern that land owners have not been
included in the processl •and should write Senator Seward and
Assemblyman Luster with their concerns .
2 ) Danby Bus Service - Ridership numbers in Danby for 1991
- 1412 .
3 ) West Danby Water Well Protection Program - A committee has
reviewed the draft for a West Danby Water Well Protection
Program for the properties surrounding the County Landfill .
A protocol has been set up to determine where wells would be
tested . A meeting will be set up with Resource Associates ,
West Danby Water Commissioner and the Town for details of the ilk
testing .

4 ) Tompkins County Airport - The County approved the design phase
for the airport and there are no county funds in this project .
The project is funded through the FAA , New York State , and the
airlines through passenger facility charges . The plan is to
have the design done by July , go to bid in July and start
construction in August or September of 1992 . The new
terminal , parking lot , access roads and runway extensions
should be completed by September 1993 .

5 ) Rabies - There has been one confirmed report of rabies in
Danby and thirty - two ( 32 ) recorded in Tompkins County . A
meeting has been set up with Tompkins County Health Department
to address procedures for removal of nuisance wildlife and
suspected rabid animals ,
6 ) Medicaid - Access to dental services . The County has received
a grant in the amount of $ 18 , 000 to provide dental services
• for medicaid recipients .
7 ) Spring Clean - up Day - If the Town is interested , the County
is promoting a Spring Clean - up Day at no charge to the towns
for disposal fees .
8 ) Fiscal Plan for Eight Per Cent Sales Tax - A resolution was
approved to embark on a major fiscal plan for the County .
They must ask permission from New York State to raise the
County Sales Tax to 8 % .
Discussion followed regarding the proposed increase in the County
Sales Tax .
Representative Proto said that the first step was to request
permission from the State to amend the present sales tax , the
second step is to pass a local law raising the tax to 8 % .
PRIVILEGE OF THE FLOOR :
Mary Lou Hardesty - Thanked the Town Board for allowing the
Taxpayers Association to meet in the Town Hall . Representative
Proto will be attending the meeting on Thursday , February 13 , 1992
at 7 : 30 P . M .
COMMUNICATIONS :
1 ) Danby Fire District Organizational Meeting Minutes of January
21 , 1992 .
2 ) Councilperson Oltz read a letter to the Town Board from Donna
Decker , Coordinator / Director of the Danby Reading Center .
Donna recommended Joanne Denison as her replacement .
COMMITTEE REPORTS :
Highway Department - William Hall
Superintendent William Hall reported that the highway department
has had serious breakdowns with the plow trucks this winter . The
equipment is very old and we need to think about the purchase of
new plow truck . The 1980 pickup truck has a cracked frame , the 4 -
wheel drive does not work and over 180 , 000 miles,
Senior Citizen Report :
Edw . M . Roberts reported that the Senior Citizen ' s will be going
on a trip February 29 , 1992 to Three Rivers Inn for dinner and
entertainment .
Zoning Department Report : Susan Beeners submitted a Year - end report
for 1991 from the zoning office and the Monthly Report for January
1992 . Susan reported that she is working on new instructions for
building permits and related items .
NEW BUSINESS :
RESOLUTION # 25 OF 1992
APPOINTMENT OF CARETAKER FOR WEST DANBY METHODIST CEMETERY
By Councilperson Oltz : Seconded by Councilperson Miller
RESOLVED , That the Town of Danby Town Board appoint Gerald Belles
of 53 Depot Road , Newfield , New York as caretaker of the West Danby
Methodist Cemetery for 1992 , and be it further
RESOLVED , That payment is to be at the rate of $ 150 . 00 per month
for the 1992 season .

Planning Board Appointment :
Supervisor Oltz reported that the Town Board has received two ( 2 )
letters from persons interested in serving on the Planning Board .
1 ) Lorene Gilbert - Gilbert Road
2 ) William Farrell - East Miller Road
Discussion followed :
Councilperson Schwartz said he felt that William Farrell would be
an asset to the Planning Board as he is from the construction
field .
Councilperson Marisa suggested that we hold the resume from Lorene
G ilbert for future reference as she is well qualified and may be
interested in openings at a later date .
RESOLUTION # 26 OF 1992
P LANNING BOARD APPOINTMENT
B y Councilperson Schwartz : Seconded by Councilperson Hile
RESOLVED , That the Town of Danby Town Board appoint William Farrell
t o fill a vacancy on the Town of Danby Planning Board , and be it
further
RESOLVED , that the term of appointment is to begin immediately and
expires on June 30 , 1998 .

RESOLUTION # 27 OF 1992
BOARD OF ZONING APPEALS REAPPOINTMENT

RESOLVED , That the Town of Danby Town board appoint Susan Hautala
of 134 Hornbrook Road , Ithaca , New York to the Board of Zoning
Appeals for a term to expire on June 30 , 1994 .

RESOLUTION # 28 OF 1992
BEQUEST FOR FINAL APPROVAL OF THE RAPTOR HEIGHTS 11 ( FIELDSTONE
CIRCLE ) DEVELOPMENT
By Councilperson Schwartz : Seconded by Councilperson Marisa
WHEREAS , The Town of Danby Town Board , acting as Lead Agency in the
environmental review of the proposed Raptor Heights II Planned
Development District ( also known as Fieldstone Circle ) , on February
11 , 1991 determined that the proposed action would not have a
'significant effect on the environment , and also granted preliminary
and conditional approval to the project , and ;
WHEREAS , the Town of Danby established the boundaries of the

D istrict on the revised Zoning Map of December 11 , 1991 as part of
its 1991 legislative program , and also enacted a revised Zoning
O rdinance and new Subdivision Regulations , and ;
WHEREAS , Scott Hoffay , the Applicant for the project , has submitted
a proposed final Subdivision Plat , Engineering Plan , road plans and
profiles , well and septic details , and other engineering plans , and
h as also submitted draft final deed restrictions , and has now
requested final approval of the project by the Town , and ;
WHEREAS , the Tompkins County Department of Health has approved the
final Subdivision Plat and Engineering Plans ; now , therefore be
it
RESOLVED , that upon consideration of the documents submitted for
final approval , and upon consideration of the prior review and
d eliberations made by the Town related to this project , the town
board hereby accepts the application for final approval as
essentially complete for Town Board purposes , and hereby refers the
application and further consideration of Final Site Plan and Final
S ubdivision Plat Approval to the Town of Danby Planning Board .

FLOW CONTROL LEGISLATION :
RESOLUTION # 29 OF 1992
FLOW CONTROL RESOLUTION
B y Councilperson Schwartz : Seconded by Councilperson Marisa
WHEREAS , the Tompkins County Board of Representatives is
considering the passage of " flow control " legislation that would
force trash haulers to patronize only county - controlled disposal
facilities , and
WHEREAS , government control of free market prices is unjust and
unwise , and
WHEREAS , a competitive environment in the private sector will , in
the long run , provide the most economical trash disposal , and
WHEREAS , Tompkins County landfill tipping fees are grossly inflated
over rates in neighboring counties , and
WHEREAS , such " flow control " legislation is an undue restriction
on free enterprise , now therefore , be it
RESOLVED , that the Town of Danby opposes the passage of any " flow
control " legislation . The Town of Danby also urges county
legislators to search for the most economical disposal site , inside
or outside the county borders , and pass any cost savings to county
consumers , and be it further
RESOLVED , that Tompkins County further investigate methods to cut
the solid waste budget .

TOMPKINS COUNTY SALES TAX INCREASE
Councilperson Marisa introduced the following letter regarding the
Tompkins County Sales Tax increase proposal .
Dear Legislator :
We , the elected representatives of the Town of Danby , New
York , emphatically oppose the passage of an 8 percent sales tax for
Tompkins County .
As town officials , we understand the economic plight of our
county government . In Danby , we have postponed capital projects ,
frozen salaries , and cut budgets to save our taxpayers money .
The county faces a similar economic crunch , but the Board of
Representatives has not demonstrated a sufficient effort to cut
costs . Instead , it passed a 15 percent property tax rate increase
and is asking for an increase in the county sales tax from 7
percent to 8 percent . County officials promise they will cut their
budget once they get their sales tax increase .
When times are tough and people are hurting - economically ,
these large tax increases are unjustifiable . We urge the State
Legislature to deny the request for a sales increase . In addition ,
we urge state officials to relieve county governments of unfunded
mandates which put an undue burden on county governments across
our state .
While we sympathize with the county ' s plight , county officials
must demonstrate a greater effort to cut costs before they ask the
taxpayers to dig still deeper into their pockets .

A motion was made by Councilperson Schwartz and Seconded by
Councilperson Miller to approve the appointment of Joanne Denison
as Danby Reading Room Coordinator / Director as recommended by Donna
Decker .

REAPPORTIONMENT FOR TOMPKINS COUNTY VOTING DISTRICTS
Harry Missirian from Tompkins County Planning Board and Stu Stein
from the Tompkins County Board of Representatives presented the
Town Board with a demonstration of the proposed plan for

Reapportionment of Tompkins County voting districts . There are
three proposals now under consideration . Descriptions of the
proposed districts under consideration were explained . Three maps
n umbered 28 , 29 and 30 were presented and described in detail .
P roposed District Map # 29 would create a change in the northern
line in the Town of Danby / Carboline district . The districts are for
e lected officials to Tompkins County Government only and would not
e ffect Town elections .
D iscussion followed :
Councilperson Marisa asked if the Town of Danby was the only
d istrict that would share a representative with three ( 3 )
townships .
Councilperson Schwartz said that he would hope that the Town of
D anby would not share a County Representative with three ( 3 ) towns .
We already share a representative with the Town of Caroline .
H arry Missirian and Stu Stein asked the Town to respond to the
County in writing with a preference and supporting reasons for of
o ne of the plans presented for reapportionment of Tompkins County
E lection Districts .
APPROVAL OF WARRANTS :
G eneral Fund Warrant # 2 of 1992
A motion was made by Councilperson Marisa and seconded by
Councilperson Miller to approve the General Fund Warrant # 2 of 1992
in the amount of $ 7 , 728 . 45 with the addition of an amount not to
e xceed $ 100 . 00 for the Dog Control Officer ' s voucher that was
omitted in error .
