HomeMy WebLinkAbout08-02-1972145 Wednesday -August 2, 1972 7:30 P.M. -The first regular meeting of the month was held by the Town Board at the Town Hall with Supervisor Frank Taylor presidin'. Other Board members present were JusticesDonald Eaton and Ronald Fish, Councilmen,Sherman Griswold and Ray Miller. Also present were Rudy Krauklis, bookkeeper to the Supervisor; Assessor,Henry Wadsworth; Town Engineer,Wm. Rowell; Town Attorney, John Gardner; Highway Superintendent, Lou Wagner; Deputy Town Clerk, Mildred Brookins; Christine Canestaro, who took the minutes in the absence of Town Clerk, Lelan Brookins who was ill; Dan Fagan of the Cortland Standard and an observer, Tom Smith. Justice Eaton read the minutes of the last meeting and they were approved as read. • ' Mrs. Brookins read a petition signed by 97 residents living in, and adjacent to, the Hamlet of Blodgett Mills, requesting a 30 MPH speed limit within and adjacent to the Hamlet. Rmald Fish made a motion, seconded by Sherman Griswold, that the petition be received and filed and that the County Highway Superintendent make application to the N.Y. State Dept. of Transportation (Traffic Safety Division) for the lowered speed limit. Motion Carried. The Smith Brook project was discussed. Mr. Wagner reported he did not feel there would be any difficulty in obtaining easements from property owners involved. John Gardner is to prepare the necessary easements for the project. av-W A copy of the new manifesto,published by the Cortland County Board of Health was given to each of the Board members and read by Ronald Fish. A copy of this manifesto is attached to these minutes. 105 Mr. Rowell read the report which he submitted regarding the /a nnexation of the Westendorf Properties on Pendleton St. by the City of Cortland. Mr. Rowell said he had sent a copy of this report to Mayor Noss, Mr. Neiderhofer & Mr. Fitzgerald A copy of this report is attached and made a part of these minutes. The Board reviewed the report in detail -and all agreed that the suggested precautions should be taken. Mr. Gardner is to write to the James H. Morrisey Est., Box 45, River Rd., RD#l, Ogdensburg, N.Y. regarding the release which should be obtained (item #1 of the report). The Board resolved that Oak St. should be removed from item #5 of the report. They also agreed that the turn -around at the end of Oakcrest Avenue (item #5) should be a "hammer -head", 50 ft. wide with a 5 ft. buffer. Justice Eaton asked if any precautions should be taken to protect the Town if any extreme drainage problems should arise. Mr. Rowell said that the developer should provide for proper drainage. Justice Fish stated that drainage to be provided by the developer should be incorporated into and clearly shown on the map submitted by the developer. All agreed. Mr. Gardner called the Board's attention to the fact that if the annexation plan, as submitted, is not disapproved within the 90 day period alloted, it would be presumed to be approved. The deadline date is Sept. 12, 1972 and a decision must be made before then. Mr. Taylor suggested that the City people should be advised to come to the next meeting. They must also be advised that th must meet the specifications as presented by Sterns & Wheler. M.1f �lhoer suggests specifications are agreed to by the City, they must have all the necessary instruments in order, or the Town will have to vote down the annexation. o'� NI Justice Fish said he had three requests for street lights on Crestwood Court. Justice Eaton made a motion, seconded by Ray Miller, that Mr. Fish investigate and make recommendations accordingly. Motion carried. 146 Wednesday -August 2, 1972 (continued) Justice Fish said he also had a request that the turn -around on Crestwood Court be investigated to see if some improvements could be made. He was told by Dan McNeil and James Ball, residents, That they would give the Town a right-of-way to increase the size of the circle. No action taken. Lou Wagner expressed the need for a new grader. He and Justice Eaton had been investigating the feasibility of repairing the 9 yr. old grader vs. the purchase of a new grader. Justice Fish said that Mr. Wagner should name this as a priority in order for the Board to -take action on it. Mr. Wagner stated he felt this was indeed,a primary priority since a grader in good working condition was of the utmost necessity. Mr. Wagner reported that he and Mr. Eaton had looked at new graders which had been recently purchased by the County and by the Town of Virgil. They also had looked into the cost of repairing the old grader. Since it would cost approximately $8,000.00 to repair the old grader, all members agreed that it would be better to buy a new grader rather than to put all that money into repairing a 9 yr.old grader. Justice Eaton made a motion, seconded by Sherman Griswold that the Highway Superintendent be authorized to advertise for bids on a new all wheel drive grader, with a 14 ft. snow plow wing, using the old Austin Western,Model #Super 300 as a trade-in. Bids to be opened on Sept. 6, 1972 at 8:00 P.M. at the Town Hall, 15 Terrace Rd., Cortland. On review of the data submitted and as a result of our field inspection, we suggest that certain precautions be made so as to properly protect the interests of the Town of Cortlandville. We believe the following items to be of particular concern as it relates to this project: 1) Morrisey reportedly owns Lots 78 through 86, as shown on the record -filed map of 1912. Lots 85 and 86 front on Oak Street (Paper Street). If the developer proceeds with subdivid- ing this area as now planned, these lots will be landlocked, The Town should have a release, in writing, from Mr. Morrisey stating that he is aware of the proposed plans and will not later hold the Town, developer or City responsible for decrease in value of his property as a result of omission of this street. 2) The developer and City should make plans for drainage facilities that will permit present drainage from lands now draining onto the "annexed" properties, and also adequate for all future flow that will result from drainage across the "annexed" properties, and on properties upstream thereof when these lands become completely developed. 3) The developer should negotiate with Morrisey, R. Dorn and L. Dorn, reputedly owners on the north side of Oakcrest Avenue, and grant or deed them 15 feet of additional land at the rear f, of their properties (along northerly boundary line), and in turn have them give the Town an additional 15 feet of property along ` the southerly boundary line (northerly boundary of Oakcrest Avenue)® This will permit the Town to have a 60-foot right-of-way PARTNER EMERITUS PARTNERS ASSOCIATES ENGINEERS GEOLOGIST Donald E. Dedication to the Town should actually be for a strip of land 37. 5 feet in depth from the centerline of the present -right-of-way and for the entire width of their properties. 4) The developer should dedicate to the Town of Cortlandville a strip of land 42. 5 feet in depth, running northerly from the centerline of Oakcrest Avenue, as shown on a map of tract filed June 21, 1912, as Map No. 269, which shows a 45-foot right-of-way. This strip of land should extend from the L. Dorn property easterly to the end of the properties shown on the map of 1912. 5) The developer should dedicate to the Town of Cortlandville such additional land as may be necessary to provide a turn- around at the end of Oakcrest Avenue an4_0a4-�f et-, the rr limits of such dedication should meet the approval of the Town's Superintendent of Highways. 6) The developer should dedicate to the Town and City a right-of-way from Oakcrest Avenue to the first City street i northerly thereof, of width adequate for present and future drainage and sanitary sewerage facilities. 7) The Town should investigate the ownership on the southerly half of Oakerest Avenue and should receive official dedica- tion of the properties on the southerly side of the centerline, all in accordance with the record map of 1912. It would be advisable for the Town to request approval of develop- ment of these lands as finally laid out by the City before construction of facilities in this area. E. .�. liu1 _tl,i_ Whereas, it is well recognized that Cortland County, which is traversed by one major high road, Route 81, and is expected to have a new major link through an expanded Route 13 to Ithaca, lies astride a natural growth corridor between Syracuse to the North, and Binghamton to the South -East and Ithaca, to the South-West, and, Whereas, such growth is presently evident, especially in the area of the County served by the Route 281 -(Bypass), and, Whereas, growth is also in evidence both sides of Route 11 from Preble through Homer to Cortland, and, Whereas, growth is in evidence and may potentially increase in major amount, especially if, as has been suggested the new Route 13 enters the County in the region of South Cortland, and thence to Polkville to link up with Route 81, and, Whereas, the growth, in evidence, particularly in the Town of Cortlandville has been most marked during the inter -census period (1960 - 1970), and, Whereas, there is also some haphazard and unplanned growth in various other locations in the County, In order to secure the safety of the ground water supply, and otherwise protect the general environment, the Cortland County Board of health, faced as it is with increasing requests for variances of the Sanitary Codes of the State of New York and Cortland County, now makes it policy, and so resolves (a) that such variances will not normally be granted, in any particular, or for any other reason, unless the person, developer, firm, or other party, demonstrates that a grave hardship will be rendered if the request for variance is not approved, and, that there will be, through the granting of such variance, no environmental hazard created; and, (b) that in those areas of the County which are designated as "growth areas", ( individual homeowners, as well as builders and developers, will connect their i homes, or proposed housing, to a public water supply, a public sewerage system, preferably both. iT 16 M�IiASIZED THAT THE BOARD HAS DECIDED THAT NO SUCH APPROVALS FOR INDIVIDUAL HOMES OR FOR HOUSING IN SUCH NEW SUBDIVISIONS, OR IN EXTENSIONS OF EXISTING SUB® DIVlsZo3ac, WILL BE ROUTINELY GIVEN AS IN THE PAST MERELY BECAUSE THE NUMBER OF LOTS, AS PRUFOSED, v­ n� u mFv MAY EXIST, DO NOT EXCEED THE CORTLAND COUNTY CODE'S 25-LOT RULE , BUT THE BOARD OF HEAi'rn wmr,n ate, GUIDED, IN SO DETERMINING ITS DE- CISIONS BY THE REQUIREMENTS OF THE NEW YORK STATE StuvrrAm CODE, AND ITS MOD- IFICATIONS, AS THEY APPEAR NOW, OR MAY BE MODIFIED FURTHER IN THE FUTURE, OF THE CORTLAND COUNTY SANITARY CODE, < The Cortland County Board of Health, may, therefore, under this new policy and interpretation of these Sanitary Codes, as specified, refuse to grant approvals for new subdivisions, or extensions of existing subdivisions, or issue permits for individual homes, if it deems it in the best interest of the County so to decide whether these homes and/or new subdivisions, or extensions of existing sub- divisions are proposed in the designated growth areas, or elsewhere in the County. Outsid© of the designated growth areas a request for any new subdivision must be in accordance with a Master Plan for the County. A Master Plan is in the process of development.
