PETITION
TO THE TOWN BOARD AND THE BOARD OF ZONING -APPEALS. OF
THE TOWN OF CORTLANDVILLE, CORTLAND COUNTY, NEW PORK:
The petition of STILES FARM, INC., respectfully shows:
1a Your petitioner, Stiles Farm, Inc. , a domestic corporation organized
and existing under the laws of the State of New York, is the owner of certain
real.property consisting of approximately 18. 3 acres, exclusive of certain
proposed highways, located on Lots #63 and #73 in said Town of Cortlandville.
2. Your petitioner is in the business of developing residential property
within the said Town of Cortlandville, and the. premises heretofore mentioned
are a portion of premises owned by your petitioners and intended to be used
for such residential development purposes.
$. In connection with the development of the premises described heretofoa
your petitioner has planned to provide sewer systems for the purchasers of
said properties, and in order to make said proposed properties more saleable
to prospective p1. urchasers, your petitionerrequests the variance which is
mentioned herein®
4. Upon information and belief, petitioner's .lands heretofore mentioned
are currently zoned Rr1 pursuant to the Zoning Ordinance of the Town of
Cortlandville and Zoning Map made part of said Ordinance. Further, upon
.e
information and belief, any .lot built within such a zoning use classification
requires a minimum of 20, 000 square feet. Your petitioner is further advis
and believes that the square footage requirement for a building lot in an R-2
zone is .less than 20, 000 square feet.
5. By utilizing a square footage area of less than 20, 000 square feet,
your petitioner will be able to offer lots for sale to prospective purchasers
at lower prices than would be required in the larger lot size because of the
reduced sewer requirement for the individual lots. Your petitioner is advise
II and believes that said lots would.be more desirable by reason of the
economic advantage to be gained by the change of the lot size requirement
as set forth herein.
6. , Your petitioner is advised and believes that there is no objection to
this petition on the part of property owners adjacent to the property sought
to be rezoned as a result.of this application.
WHEREFORE, your petitioner respectfully requests, pursuant to the
applicable provisions of the Zoning Ordinance of the Town of Cortlandville
and the Zoning Map made part thereof that: (1) Said Zoning Ordinance and
Zoning Map be amended so as to change the use classification of the real
property hereinafter described from R-1 to R-2; and (2) That such proposed
amendment be submitted to the Zoning Board of Appeals for its report and
recommendation; and (3) that the Zoning Board of Appeals and the Town
Board of the 'Town of Cortlandville grant to the petitioner such other and
further relief as may seem just and proper;'the premises to be affected by tle
proposed request are described as follows:,
