The first regular meeting of the Town Board for the month was
held at the Town Hall and was called to order by Supervisor
Frank K. Taylor. Members present were Justices Donald Eaton,
and Ronald Fish, and Councilmen Sherman Griswold and Ray E.
Miller. Also present were Town Engineer, Wm. Rowell; Town
Assessor, R. J. Wells; Town Attorney, John J. Gardner; Highway
Superintendent, Louis Wagner; Rudy Krauklis, Bookkeeper for
Supervisor's accounts; Lelan Brookins, Town Clerk; Christine
Canestaro. Also present were Mr. & Mrs. Guy, Mrs,, Crumb, and
Mrs. Allen of Allen Dr., and Mr. Chapman of the Cortland Standard.
The Town Clerk read the minutes of the last meeting and there
were no corrections*
yiMotion was made by Mr. Griswold and seconded by Mr. Miller
that alternate, Virginia Shearer be appointed a regular Republican
inspector for District #1-Town of Cortlandville. Motion carried.
4,, The Supervisor read a letter from the Marine Midland Bank
offering assistance concerning the financing of the Fire Protection
facilities. Motion was made by Mr. Eaton and seconded by Mr. Miller
that the letter be received and filed. Motion carried.
%-�% Attorney Gardner reported on his findings on the question of
Allen Dr, being a dead end street. Motion was made by Mr. Eaton
and seconded by Mr. Miller that the report be received and filed.
Motion carried.
Mrs. Allen asked that a Stop sign be placed at the upper
end of Allen Dr. to help slow down the traffic. It was left that
the Highway Superintendent will investigate.
oqq A petition was offered by
Thomas Lawyer objecting to the re-
zoning of the Pauldine Tract on Fisher Avenue. Motion was made by
Mr. Eaton, seconded by Mr. Miller that the petition be received and
filed. Motion carried.

.! Motion was made by Mr. Eaton, seconded by Mr. Miller that
from
the Supervisor be empowered to transfer $4.0,000/surplus funds
outside of the Village to Highway Fund -Item #1. Motion carried.

the following Resolution was
WHEREAS, The Town Board enacted a Resolution on August 6, 19691,
approving a Performance Bond in the amount of $12,400.00 executed
by LaVerne Niederhofer and Carlton J. Niederhofer to guarantee the
construction and grading of certain proposed streets known as Slee
Hollow, Bowling Green and Winkle Way on or before August 1, 1972; and
WHEREAS, Said LaVerne Niederhofer and Carlton J. Niederhofer
executed said Performance Bond in the amount of $12,400.00, dated
July 31, 1969; and
WHEREAS, Said LaVerne Niederhofer and Carlton J. Niederhofer
have partially performed the terms and obligations of said bond anc
have completed approximately one-half of the required improvements
of the proposed aforesaid three streets, and they have requested that
the. amount of said Performance Bond be proportionally reduced in
amount; be it
RESOLVED, That said LaVerne Niederhofer and Carlton J. Nieder-
hofer be permitted to file with the Town Clerk a new Performance Boid
in the amount of $6,400.00 to guarantee the remainder of the con-
struction and grading of Sleepy Hollow, Bowling Green and Winkle Wa
on or before August 1, 1975, in accordance with the specifications
of the Town of Cortlandville for t-own road and street construction
dated September 28, 1968; and be it further
RESOLVED, That the aforesaid Performance Bond dated July 31,
1969, in the amount of $12,400.00 and filed with the Town Clerk as
aforesaid, shall become cancelled and terminated on.:and after the
date that the aforesaid new Performance Bond has been approved by
e Attorney for the Town of Cortlandville as to form and manner of
lexecution and has been filed with the Town Clerk, and the same may
then be delivered by the Town Clerk to said LaVerne Niederhofer and
(Carlton J. Niederhofer.

Motion was made by Mr. Miller, seconded by Mr. Eaton that
all bills as presented by the Town Clerk and audited by the
Town Board be paid as follows:

Motion was made by Mr. Fish, seconded by Mr. Gtiswold
that the Board adjourn. Motion carried.
