HomeMy WebLinkAbout07-02-1973'(SyCortlandville SUBJECT: Cortland @Teen Development July 2,1973, 7:30 P.M. Town.,Hall 15 Terrace Road, Cortland, N.Y. Special meeting of the Planning Board held at the Town Hall in the Office of the Town Clerk. Members present were, Victor Metcalf, acting chairman, due to the absense of Gordon Hatheway, William Clemens and Willard Griswold. Mr. William Bean was not present. :lotion was made by Mr. Clemens seconded by Mr. Griswold that Mr. Metcalf be named chairman at this time. Twelve residents of Bell Drive were present at this meeting. The Cortland Green Development was reviewed by the Planning Board and the following recommendations of the Board will be presented to the Town Board by the Secretary of the Planning Board,at the next scheduled Board meeting on July 5, 1973• The Planning Board has reviewed the request of the Developer for annexation of certain property east and south of Bell Drive and is requested tby Town Board . The Planning Board recommends that the area not be annexed to the Village of Homer and the Developer's request be denied. The basis of the Planning Board's recommendation is as follows 1. Density of proposed project -is much greater than other developments in the. area and will probably have a-noonsiderable adverse effect on property values. 2. Entrances and exits for the planned project are insufficient — The proposed use of Maryland Ave will cause the Town to expend considerable funds to develop this road; and the eventual exit to old N. Homer Ave, Fisher Ave. and Route 11, will send traffic to a dangerous intersection which has poor visibility at any time. The entrance and exit to 281 will be the main entrance and this will compound the already congested traffic from other streets. The entrance and exit to the east over the D.L.& W.R.R. is very poor and not de- velped and in any event will be a dangerous crossing and exit. 3. The drainage for the area tar.normally to the south and to the creek which eventually enters the river by the _ County Highway Garage. phis drainage problem is not resolved and may cause flooding of properties to the South of Fisher Ave e 4. There has been no indication of the probable zoning of this area if annexed to the•Village of Homer and it is poss- ible, gas stations and other commercial development could take place on the corner of Fisher Ave & 281. j. The residents of the area have built in this area based on present zoning and control and if control passes to the Village of Homer the Control and Protection by.the Town is lost. 6. in regard to Sewers and Water installation, the same result can be obtained by formimg Water and Sewer Districts® as has been done for the S.E. side of the Town. ?. it would appears the precendant of annexation, everytime a develper comes forth with a plan, is not in the best interests of the Town. The Planning Board respeefully submits this negative rec- ommandation to the Cortlandville Town Board. Victor Metcalf Willard Griswold William Clemens RESOLUTION-. Motion therefore by Mr. Metcalf seconded by Mr. Clemens that the Planning Board recommend to the Town Board that the Petition for annexation be denied. Motion passed. Lelan M. The Town Clerk is to inform the Planning Board of this App- lication and ®f the date for the Public Hearing, the Town Board would welcome any comments from the Planning Board in regard to this Application. Mr. Fish reported that after investigating the need of lights on Gunzen Drive,he would recommend 4, 175 Watt lights on Gunzen Drive. Resolution was passed on motion of R. Miller seconded by S. Griswold that 4 lights be installed on Gunzen Dr. This motion was passed unanimously. Mr. Taylor stated that he and Mr. Miller attended a meeting on "Beautification" in Cortland County, a Town of Cortlandville group have formed a Beautification Counsel, with Mrs. Jane Edlun& as chairman, other members are Mr. & Mrs. Robert Blatchley, Mr. i% Ray E. Miller and Frank K. Taylor. RESOLUTION: Motion was made by Mr. Fish seconded by Mr. Eaton that the above residents of the Town of Cortlandville be accepted as the Town of Cortlandville, Beautification Counsel. 'phis motion was passed unanimously. Mr. Taylor stated he had another communication in regard to the Revenue Sharing Mr. Ed Purser, Attorney presented his report to the Town Board as to his findings in regard to the Clar*nce Homer property. See next pages for this report. Mr. Lou Wagner reported to the Board regarding Bowling Green, The cost to Mr. Niederhofer would be roughly2300 for Double Surface, after getting a figure of $5415.00 from Cortland Asphalt for Blacktop which would last a 10 year period, Mr Niederhofer is agreeable and will pay his share plus his 2300.00 , the difference between 5400.00 and 2300.00 being 3100, in round figures the Town would be paying $1500.00 and Mr. Niederhofer $1500.00, more or less. 0 otion was made by Mr. Eaton seconded by Mr. Miller that Mr Wagner be authorized to proceed with this project. this motion was passed. Mr. Ed. Purser, Attorney acting for the Town,presented:his report to the Town Board as follows: TO: MEMBERS OF THE TOWN BOARD OF THE TOWN OF CORTLANDVILLE FROM: EDWARD R. PURSER Re: Clarence S.'Homer property - Delaware Avenue I have examined various documents relative to whether certain property located to the rear and west of 42 Delaware Avenue, Cortland, New York is located in the corporate limits of the City of Cortland or the Town of Cort- landville. This property is further designated and known as Lots Nos. 3 and 4 of Block No. 3 as shown on a map of Village Lots of the John Curtin Tract, dated November 16, 1887, made by Frank Place, L. S. and filed in the Cortland County Clerk's Office on March 31, 1888. The subject property was conveyed to Mr. Homer.by deed dated September 28, 1954. Stearns & Wheler, Engineers, surveyed the said property and have made a map of the premises dated June 18, 1973. According to said survey and map the corporation line for the City of Cortland divides Lots Nos. 3 and 4 as referred to above. Further according to said map of Stearns & Wheler approximately 90% of the buildings or struct- ures on said premises are in the Town of Cortlandville. I have discussed this matter with George Yager, Corporation Counsel for the City of Cortland, New York. He advised me that the corporate city line on this area has not changed since Cortland became an incorporated city. It is therefore my opinion, based upon maps, surveys and deeds of the area, that a portion of Lots No. 3 and 4 of yi1 y f 1 • 1 • 1 -2- Clarence Homer located in the rear of 42 Delaware Avenue are in the Town of Cortlandville and subject to the zoning ordinanc of the Town of Cortlandville. According to the Zoning Map of the Town of Cortland- ville the premises are zoned Residential R2. This limits the use of the property to single family dwelling unless a special permit or variance is obtained. It further appears that the Zoning Board of Appeals of the Town of Cortlandville on March 22, 1972 affirmed the Zoning Officer's denial of a building permit to Mr. Homer to build a three family multiple dwelling on the same premises heretofore referred to. Lelan M. Brookins, Town Clerk 25 Wed. July 18, 1973, Public Hearing, 7 P.M. on the Application of William and Diane Pauldine to rezone lands on Fisher Ave. This hearing declared closed at 8 P.M. Regular meeting called to order by Supervisor Frank K. Taylor, members present were Justices bonald Eaton Ron Fish, Sherman Griswold and Ray E. Miller. Also present were Town Engineer Wm. Rowell, Town Assessor R. Wells, T. Attorney John J. Gard- ner, Rudy Krauklis, Bookeeper for Supervisors accounts and Mildred Brookins, Deputy Town Clerk, Christine Canestaro, also Fred Walker , Water & Sewer Maintenance Dept. Mr. & Mrs. Weeks and Mr. & Mrs Patrick were present from Isabel, regarding Clarence Homer property. Mr. & Mrs. Guy and Mr. & Mrs. Greene of Allen Drive, regarding a petition to enforce the issue that Allen Drive be maintained as a dead end street. Mr. Priest of Groton Road was present also George Cook, Tom Smith from Lamont Acres, Shirley Fish of Fisher Ave. Wm Clemens and Willard Griswold of the Planning Board and others. The Town Clerk read the minutes of the last meeting and there were no corrections ` I - The Town Clerk presented a petition with 23 names of residents of Allen Drive asking the Town of Cortlandville to take approp- riate measures which will restore said street to its designated status of Dead End,thus eliminating any thru traffic to and from the apartment complex, except in instances of emergency, i. e. fire. This petition dated July 14, 1973. Motion was made by R. Miller seconded by D. Eaton that this pet- ition be accepted and filed, this was passed unanimously. Motion was made by Mr. Fish seconded by S. Griswold that Att. Gardner make a search as to the proper status of Allen Dr. This motion was passed. Mr. Taylor had a communication from Michael Walsh, Deputy County Highway Supt. regarding the Center st Bridge in the Village of McGraw, N.Y. in the Town of Cortlandville. A copy of a letter was enclosed from N.Y.S.D,O.T. disapprari the Center St. Bridge as a project funded under the Donovan Plan. �i Motion was made by D. Eaton seconded by A. Fish that the Town Attorney review the La.w(Article 8 A of the Highway Law) and report back to the Town Board,this motion was passed unanimously 44 Mr. Eaton requested permission to attend a Summer Training Program July 22 thru July 27, 1973 at St. Lawrence University, Canton, Motion was made by R. Miller seconded by S. Griswold that Mr. Eaton y attend this program at the expense of the Town. This motion was passed. Mr. Greene asked the Board when to expect clarification in regard to Allen Dr. being a Dead End Street. It is expected that the Town Attorney will feport on this at the next meeting. Mr. Weeks asked the Board what was going to be done regarding the Violation of Clarence Homer building an apartment on to his barn for which he never had a permit for, Therefore, motion was made # 96' by-R. Fish, seconded by R. Miller that the Zoning officer investigate this violation, this motion was passed unanimous with the except- ion of Mr. Eaton, who abstained. Also, the Zoning Officer is re- quested to ask Mr. Homer to clean up the junk, bed springs etc. and make a report to the Board of this investigation. Mr. Taylor explained different options o,'suggested Fire Protection District. These options will be reviewed at a future date as further study is made.
