Pg.l F� The second regular meeting of the month of the Town Board was held a.t the Town Hall, 15 Terrace Rd. with Supervisor Robert P. Blatchley presiding. Other Board members present were: Justices, Donald Eaton and Ronald Fish and Coucilmen, Sherman Griswold and Ray Millfr. Others present were: Town Attorney, John Gardner; Town Engineer, William Rowell, Town Clerk, Christine Canestaro; Town Assessor, Robert Wells; Bookkeeper to Supervisor, Rudy Krauklis; Legislators, Shirley Fish, Delmar Palm and Henry Wadsworth; Mr. Donald Dixon, Field Engineer, with the State Division of Housing and Community Renewal; Anthony Musci & M,D.Langlois of the New York Board of Fire Underwriters; Mr. Harry Thomas, Building Inspector and zoning enforcement officer for Homer; Mr. Morris Winchell, Building Inspector for City of Cortland; Mr. Theodore Zollendeck, County Planner; Skip Chapman, -newspaper reporter; and several interested residents of the Town. A public hearing was held at 7:30 on the matter of a proposed amendment to the 1968 Zoning Ordinance. The amendment concerns Section 1500®Enforcement and the proposed change would read "This ordinance shall be enforced by the Zoning Enforcement Officer, who shall be appointed by the Town Board". All interested parties were heard. There were no objections to the proposed amendment. The hearing was closed at 7:55 P.M. A transcript of this hearing is on file in the Town Clerk's office. The regular meeting was called to order by Supervisor Blatchley at 7:55 P.M. and the pledge of allegience was given by all in attendance. The Town Clerk read the minutes of the last meeting. Justice Eaton questioned the accuracy of the text of Resolution #143, first sentence under "D" and the last sentence in E-(1). Attorney Gardner agreed that the text should be amended. RESOLUTION #151 AUTHORIZATION TO AMEND THE MINUTES OF 12/4/74 Upon motion of Justice Eaton, seconded by Coucilman, Miller, all voting aye, the following resolution was adopted: RESOLVED That Resolution #143 recorded on 12/4/74 be amended as follows: D. DELETION OF IDENTIFYING DETAILS To prevent an unwarranted invasion of personal privacy The Town Officer or Employee charged with the custody of the record, may delete identifying details when he makes records available. E. LIST OF RECORDS (1) In addition to such requirements as may be imposed by this resolution or by Chapter 578 of the Laws of 1974, each Board, Commission or other group of the Town having more than one member shall maintain and make available for public inspection a record of the votes of each member and the manner in which he votes, Upon motion of Justice Eaton, seconded by Coucilman Miller, all voting aye, the minutes were approved as.amended. The Town Clerk read the minutes of the special meeting of the Town Board held on Dec. 9. 1974. There were no corrections or additions. Upon motion of Justice Eaton, seconded by Councilman Griswold, all voting aye, the minutes were approved as read. The Town Clerk reported she had received a voucher in the amount of $150.00 from Mr. Alfred Zogg to cover rental fee of his auction barn used as a polling place on 9/14/74, and had questioned it's accuracy, since the Town had rented the auction barn in 1973 for $50.00 for the entire year. She reported that Mr. Zogg had come into the office and told her that he had made a verbal agreement with the late Town Supervisor, Frank Taylor for a rental fee of $50.00 per day. Mr. Eaton advise the Board that he had been present in Mr. Taylor's office when the phone 142 Wednesday, December 18, 1974 Pg.2 conversation between Mr. Taylor & Mr. Zogg was going on and he had understood Mr. Taylor to say "$50,00 for the entire year". He advised the Board he had spoken to Mr. Zogg regarding this conversation and that Mr. Zogg agreed to abide by the decision of the Board. RESOLUTION #152 AUTHORIZATION TO SIGN CONTRACT WITH CORTLAND FREE LIBRARY FOR THE YEAR 1975 Upon motion Justice Ronald Fish, seconded by Coucilman, Sherman"Griswold, all voting aye, the following resolution was adopted: RESOLVED, That the Supervisor -be, and he hereby is, authorized,.to sign a Contract with the Cortland Free Library.for the year 1975, in the amount of $14,000.00. EFSOLUTION #153 AUTHORIZATION TO SIGN CONTRACT WITH LAMONT MEMORIAL LIBRARY FOR THE YEAR 1975 Upon motion of Justice, Donald Eaton, seconded by Justice, Ronald Fish, all voting aye, the following resolution was adopted: RESOLVED, That the Supervisor be, and he hereby is, authorized to sign a Contract with the Lamont Memorial Library for the year 1975, in the amount of $2,500.00, RESOLUTION 1154: AUTHORIZATION TO SIGN CONTRACT WITH SPCA FOR THE YEAR 1975 Upon motion of Justice Donald Eaton, seconded by Justice Ronald Fish, all voting aye, the following resolution was adopted: RESOLVED, That the Supervisor be, and he hereby is, authorized to sign a contract with the Society for the Prevention of Cruelty to Animals, Inc. for the year 19?5, in the amount of $270,00 per month. William Rowell reported he had placed a verbal order with Mr. Ray Randolph for repair parts for the water pump and asked thatlodeliver the parts to Mr. Walker, Water & Sewer Dept. Supt. Mr. Rowell reported he had met with Mr. Francis Gorman regarding the Meadowbrook Development and stated that Mr. Gorman wishes to begin construction in the early spring. Mr. Rowell was advised that Mr. Gorman had made an agreement withthe Village of Homer for water to service the project, including the part that lies within the Town of Cortlandville. Mr. Rowell stated he felt it was esential to establish proceedures, as soon as possible, for servicing the Meadowbrook project facilities, particularly water, sewer, drainage, and public highways. Justice Eaton reported that Mr. Wagner, Highway Supt., had advised him that the Trojan, model 1900, front end loader had been delivered to the Town Highway Garage in satisfactory condition. :Mr. Blatchley reported he had a letter from Mr. Bassler, Resident Engineer, State Highway Dept., regarding the parking problem in front of the Ponderosa and McDonalds Restaurants and was advised that it is currently under investigation and that a recommendation and action is expected very shortly. Justice Eaton made a motion, seconded by Coucilman Griswold, all voting aye, that the Board adopt a resolution to amend section 1500 of the 1968 Town Zoning Ordinance to read, "This Ordinance shall be enforced by the Zoning Enforcement Officer who shall be appointed by the Town Board." Mr. Thodore Zollendeck, County Planning Director, advised the Board that any amendments to the Town Zoning Ordinance should be brought before the County Planning Board, pursuant to section 239-1 and m of the General Municipal Law, and that action on the motion should be deferred until such time as the amendment could' be reviewed by the County Planning Board. JL _1 Wednesday, December 18, 1974 pg•3 Justice Eaton withdrew his motion, pending an interpretation of the law by the Town Attorney, Mr. Blatchley introduced Mr. Donald Dixon, Field Engineer for the State Division of -Housing and Community Renewal, who spoke on the New York State Building Construction Code and the advantages in its adoption. He stated that the code is not mandatory but is made available to municipalities to adopt in its complete form,,as their own local code. The State Building Construction Code consists of four booklets a- One and two Family Dwellings b- Multiple Dwellings (3 Family, motels, hotels, etc.) c-General Building Construction (factories & merchantile offices, other than residential) p- Plumbing Mr. Dixon stated that the State Code could be adopted as an ordinance, in its entirety, by a resolution of the Town Board, without a,public hearing. Any municipality which adopts the code cannot make it more restrictive. He went on to state, that the code is free and that it is .simple to implement and enforce. The State works with local building inspectors, when they ask for help, in the interpretation or enforcement of the code. Other advantages to the adoption of the code, Mr. Dixon said, was that the State kept it updated and that it lends,uniformity to adoption of building codes throughout the state. He also advised that.the code does not control farm out buildings and that it was not retroactive, up®n' adoption. He also advised that the zoning enforcement officer and building inspeetor be the same person. Mr. Anthony Musci, of the New York Board of Fire Underwriters spoke on the advantages of adopting an electrical code ordinance to go along with the adoption of the New York State Building Construction Code. His Company is a private non-profit organization and provides an inspection service for municipalities and will furnish a copy of their inspection and re -inspection reports, to the Town, if the code is adopted. Mr. Harry Thomas, re -affirmed his willingness to help the Town during the interim period before a zoning enforcement officer is appointed. He said this would be at no charge to the town and if it became involved, and he had the time to do it, whatever fees are decided upon would go direct in even proportion to the Town and Village of Homer. Mr. Blatchley raised the question of "Who will issue building permits during this time?". Mr. Thomas stated the Town Clerk could issue the permit application and accept the fee, subject to approval of the Zoning Officer® as is done in the Town and Village of Homer. Mr. Winchell stated he would also be glad to help during this time. RESOLUTION 1 : AUTHORIZATION TO ATTEND CONFERENCE & SCHOOL Supervisor) Upon motion of Justice Donald Eaton, seconded by Councilman Ray Miller, all voting agye, the following resolution was ® adopted: RESOLVED,That the Supervisor be, and he hereby is, authorized to attend the 25th annual Winter Conference- School.of the Supervisors and County Legislators Association of the State of New York being held on Jan.19-22, 1975 at the Holiday Inn, Johnstown, New York, and be it further RESOLVED, that he be reimbursed for all necessary expenses incurred in connection with same, subject to audit by the Town Board. RESOLUTION #156: AUTHORIZATION FOR ASSESSOR TO ATTEND CONFERENCE Upon motion of Councilman, Ray Miller, seconded by Councilman, Sherman Griswold, all voting aye, the following resolution was adopted: RESOLVED,That the Assessor be, and he hereby is, 114 Wednesday, December 18, 1974 Pg.4 authorized to attend the annual Conference on Assessment Administration of the New York State Assessors Association being held on Jan.12-15,1975 at the Flagship in Rochester, New York, and be it further RESOLVED,That he be reimbursed for all necessary expenses incurred in connection with same, subject to audit by the Town Board. Motion was made by Justice Eaton, Seconded by Justice Fish, that the regular Town Board meetings for January 1975 be scheduled for January 8 and January 22, Motion carried. Supervisor Blatchley advised the Board he had hired Renee Biladeau of McGraw as his bookkeeper and confidential secretary at an annual salary of $6500.00, commencing February 3, 1975. The appointment was approved by the board, informally. Mr. Blatchley said he had a request for street lights on Pendleton St. Ext. Justice Eaton suggested that the Town Board should hold off on any further street lighting until an analysis could be made of the energy crisis. Motion was made by Coucilman Griswold, seconded by Justice Eaton to table the request. Motion carried. There being no further business, upon motion of Coucilman Griswold, seconded by Justice Eaton, all voting aye, the meeting was adjourned at 10:18 P.M..
