The first regular meeting of the month of the Town Board
was held at the Town Hall, 15 Terrace Rd. with Supervisor,
Robert P. Blatchley presiding. Other Board members present
were: Justices,Donald Eaton & Ronald Fish and Councilmen, Sherman
Griswold and Ray Miller. Others present were: Town Attorney,
John Gardner; Town Engineer, William Rowell; Town Clerk, Christine
Canestaro; Town Highway Supt., Louis Wagner; Town Assessor, Robert
Wells; Town Water & Sewer Dept. Supt., Fred Walker; bookkeeper to
the Supervisor, Rudy Krauklis; Legislators, Shirley Fish &
Delmar Palm; newspaper reporter, Skip Chapman; Mr. Edward
McNeil of Pyramid Properties Co. with his Attorney, Mr. Spaulding;
Mr, Ulmer & Mr. Wright and several residents of the Town.
At 7:15 a public hearing was held on the matter of the
petition of Pyramid Properties Company for the establishment of
a water district to be known as Water District #4 of the Town of
Cortlaridville. All interested parties were heard. The hearing
was declared closed at 7:55 P.M. A transcript of this hearing
is on file in the Town Clerk's office.
The Town Board meeting was called to order at 7:55 P.M. by
Supervisor Robert Blatchley. The pledge of allegiance was given
by all in attendance.
The Town Clerk read the minutes of the last meeting. There
were no corrections or additions, Motion was made by Coucilman
Griswold, seconded by Coucilman Miller that the minutes be approved
as read. Motion Carried.
Acceptance of Bids for the furnishing and delivery of one
new 1975 front end loader was closed at 8:00 P.M. The Town Clerk
read the legal notice which appeared in the Cortland Standard
November 23, 1974. Sealed bids were opened by the Town Clerk and
read as follows:

Motion was made by Justice Eaton, seconded by Councilman
Miller to receive and file all bids. Motion carried.
Justice Eaton suggested that the bids be looked over by
the Highway Supt. and the Town Attorney for sufficiency and
legality.
The Town Clerk read a letter received from Supervisor Blatchley
addressed to the Town Board stating that his bookkeeper, Rudy
Krauklis wished to resign his position early in 1975 and that •
Mrs. Scudamore, general clerk, had resigned her position as of
November 26, 1974 and since both positions were part time, he
recommended that the postion of Supervisor's bookkeeper and
general clerk be combined into one position as of February 1,1975
and that the Supervisor be impowered to fill this position.
Motion was made by Coucilman Miller, seconded by Justice Eaton
to receive and file the letter. Motion carried.
The Town Clerk read a petition signed by 26"residents ,
owners of businesses, and other persons interested in business
requesting that the Town of Cortlandville continue the street
lighting from a point on rte.11, opposite the Riverside Motel,
south on rte.11 over the overhead to the Cortland City line."
Motion was made by Councilman Miller, seconded by Justice Eaton
that the petition be received and filed. Motion carried.

The Town Clerk reported she had sold 8 building permits
during the month of November with a total valuation of $209,600. 00
and that 100 building permits have been sold this year to date,
ILI with a total vaulation of $0,398,724,00; the zoning board was
inactive during November; and the planning board had not sent in
the minutes of their November meeting,
Mr. Rowell reported that he and the Supervisor had met with
the owner of the Riverside Motel and his Attorney, Mr. Purser, to
discuss the motel's sewage problem.. The motel owner was advised
to discuss it further with the Village of Homer, since part of
his property lies within the village of Homer.
Mr. Rowell advised he had also met with a representative of
Barden Homes regarding construction details of proposed apartments
on the property adjacent to Chelsea apartments, at the end of
Allen dr. He will review the preliminary plans further and
report on them.
Bookkeeper, Rudy Krauklis reported the financial status of
the town as of November 30 as follows:

Justice Eaton reported he had 254 completed cases for the
month of November and $4,137.50 in fines and forfeitures had been
turned over to the State Comptroller; and that$4,630.00 has been
received by the Court and held in pending cases.
Fred Walker reported he had noticed a vibration in the
40 HP water pump and had discussed it with the Town Engineer and
the Supervisor. 'Mr. Rowell stated that this pump has been in
service for many years and that, in view of the continued expansion
for water service in the area, he feels that the Town should
consider replacement of the pump with a larger diameter pump and
12" casing. However, he wishes to investigate the situation
further before making final recommendations. He also recommended
that parts be ordered to repair the present pump, in case it
should break down before a replacement pump was installed. Mr.
Rowell requested authorization to purchase the needed parts.
RESCLUTIOLAL41-. AUTHORIZATION TO INVESTIGATE THE NEED FOR A
NEW WATER PUMP & TO ORDER REPAIR PARTS FOR THE EXISTING PUMP
Upon motion of Justice, Donald Eaton, seconded by Councilman,
Ray Miller, all voting aye, the following resolution was
adopted:
RESOLVED,that the Town Engineer, William Rowell, be, and he
hereby is, authorized to conduct an investigation on the
need for a new water pump and well with cost of the investigation
not to exceed $500,00, and be it further
RESOLVED, that Mr. Rowell be, and he hereby is, authorized to
order parts needed to repair the existing 40 HP motor and pump.
Louis Wagner reported he and Attorney Gardner had reveiewed all the
bids received and he would like to discuss them further with the
Board before any decision is reached on awarding of the bid,
Mr. Blatchley reported he had met with two youth groups to discuss
town government; and he had been approached by the Extension Service
to start some governmental youth work in conjunction with the
Extension Service. Details have not been worked out, as yet. He
also had met with Mr. Gifford to discuss housing needs for S.C.M..
He reported he had called Albany regarding the proposed 1975 census

and was informed that a moratorium had been declared on the
dissemination of State Aid funds for 197197203.74 and they
were unsure of what would be done in 1975 and henceforth.
He had discussed building inspection work and zoning enforcement
with Mr. Harry Thomas. Mr, Thomas advised him he would help out,
if the need arose.
Justice, Ronald Fish reported he had spoken with Walter Tennant,
County Highway Supt., regarding the lighting on Rte. 11 between
Homer and the City of Cortland, which the county was considering
terminating. He was advised that action had not, as yet, been
taken by the Cortland County Legislature to discontinue the
lighting. It was determined that, until the legislature acted
upon the issue, the Town Board could do nothing about it.
Mr. & Mrs. Fairchild of Lime Hollow Rd. were present to request
the Board to do something about the hazardous parking situation
in front of the Ponderosa & McDonald's restaurants. Cars-:& trucks
are parking on the shoulder of the road -making visability impossible
from Lime Hollow Road. Mr. Blatchley said he would write to Mr.
Richard Bassler, State Resident Engineer, advising him of the
hazard and requesting that the state take action to eliminate
the problem, since it is a state highway.
Mr. Ulmer & Mr. Wright reviewed their plans of the proposed
apartments they wish to construct on Starr Rd, at the Corner of.
Glenwood Ave. Mr. Rowell said he would like to review these plans
further with them and suggested that perhaps it would require the
extension of the sewer district to service them, as only a portion
of the property lies within the sewer district. Mr. Rowell also
discouraged the possibiity of them tieing into the private lateral
that services the Plaza Theater and advised them to put in their
own line.
Mr. John Barrett, McLean Rd., complained that there are no
shoulders on the 14 miles of the road that had been replaced. He
also complained that there were drop-offs of 2-7 inches and
3 foot ditches very close to the highway. He was advised that
this is a county road and that he should contact the county
highway department. Mrs. Shirley Fish said she would bring this
to the attention of the County Legislature, to see if something
could be done about the situation.
A short discussion was had on the proposed change in the zoning
ordinance to relieve the Town Clerk of the zoning enforcement
duties.

RESOLUTION 1142: AUTHORIZATION TO HOLD PUBLIC HEARING REGARDING PROPOSED
AMENDMENT TO. SECTION 1500 OF THE ZONING ORDINANCE
Upon motion of Justice, Donald Eaton, seconded by Councilman
Ray Miller, all voting aye, the following resolution was
adopted:
RESOLVED, that a public hearing be held, by the Town Board,
of the Town of Cortlandville, Cortland, N.Y., pursuant to
section 264 and 265 of the town law, at the Town Hall, 15
Terrace Rd., on December 18, 1974 at 7:30 O'Clock p.m., in
the matter of a certain proposed amendment to the 1968
Zoning Ordinance of the Town of Cortlandville adopted on
October 2, 1968 and there after amended on June 4, 1969 viz:
To amend Section 1500 of such Ordinance to read as
follows: "Section 1500 Enforcement
This ordinance.shall be enforced by the Zoning
Enforcement Officer who shall be appointed by the
Town Board"
The freedom of information law was discussed and the following
resolution was adopted.

RESOLUTION #143: RESOLUTION ADOPTING RULES AND REGULATIONS WITH
RELATION TO PUBLIC INSPECTION AND COPYING OF SUCH TOWN RECORDS
AS ARE SUBJECT TO PUBLIC INSPECTION BY FREEDOM OF INFORMATION LAW:
Upon motion of Justice, Ronald Fish, seconded by Councilman,
Ray Miller, all voting aye, the following resolution was
adopted:
RESOLVED,That the following Rules and Regulations shall apply
to the public inspection and copying of such town records as
are subject to public inspection by law and shall continue in
effect until altered, changed, amended or superseded by further
Resolution of this Town Board or by action of the Committee on
Public Access to Records established pursuant to Chapters 578,579
and 580 of the Laws of 1974:
A. PLACE OF INSPECTION.
Such records shall be made available at the office of
the Town officer or employee charged with the custody and
keeping thereof.
B. TYPE OF INSPECTION.
Such records shall be made available for public inspection
on regular business days between the hours of 10:00 o'clock A.M.
and 12:00 o'clock noon and 2:00 o'clock P.M. and 4:00 o'clock
P.M. if readily available. If not readily available, written
requests specifically of records to which access is desired
shall be filed with the Town officer or employee charged with
the custody and keeping thereof, who shall produce the same
within 48 hours after such request. Such written request
shall be on the form prescribed by the Comptroller of the State
of New York. If the Town officer or employee charged with
the custody and keeping of the records elects to refuse access,
he shall submit a written statement of his reason therefor
within 48 hours of such request.
C. FEES
(1) Copies. The Town officer or employee charged with
the custody and keeping of the records shall, upon request,
make a copy or copies of any records of such inspection upon the
payment of a fee of fifty cents (500) per page. If a copy or
copies are desired thereof by the requestor, the Town officer
or employee charged with the custody and keeping of the
records shall make the same and mail or deliver the same to
the requestor within one week depending on the volume and
number of copies requested.
(2) Certification, Any Town officer or employee charged
with the custody and keeping of such records, shall, upon
request, certify a copy of the document or record prepared
pursuant to the provisions of Subdivision c (1) hrreof upon
payment of a fee of fifty cents (500), per certificate.

D. DELETION OF IDENTIFYING DETAILS
To an unwarranted invasion of personal privacy,

available. An unwarranted invasion of personal privacy includes,
but shall not be limited to:
Disclosure of such personal matters as may have been
reported in confidence to the Town and which are not relevant or
essential to the ordinary work of the Town;
(2) Disclosure of employment, medical or credit histories
or personal references of applicants for employment, except such
records may be disclosed when the applicant has provided a
written release permitting such disclosure;
(3) Disclosure of items involving the medical or personal
records of a client or patient in a hospital or medical facility;
(4) The sale or release of lists of names and addresses
in possession of the Town if such lists would be used for
private, commercial or fund-raising purposesl
(5) Disclosure of items of a personal nature when
disclosure would result in an economic or personal hardship to
the subject party and such records are not relevant or
essential to the ordinary work of the Town,

The Town shall maintain and make available for public
inspection and copying in conformity with such regulations
as may be issued by the committee on public access to
records, a current list, reasonably detailed, by subject
matter of any records which shall be produced, filed, or
first kept or promulgated after the effective date of
this resolution. Such list may also provide identifying
information as to any records in the possession of the
Torn on or before the effective date of this resolution,
(1) In addition to such requirements as may be imposed
by this resolution or by Chapter 578 of the Laws of 1974,
each Board, Commission or other group of'the Town having
more than one member shall maintain and make available
for public inspection a record of the votes of each
member
F. EFFECTIVE DATE
This resoluticn shall take effect after publication.

RESOLUTION #144: AUTHORIZATION FOR SUPERVISOR TO DESIGNATE A
BOOKKEEPER AND CONFIDENTIAL SECRETARY
Upon motion of Justice, Ronald Fish, seconded by Justice
Donald Eaton, all voting aye, the following resolution
was adopted:
RESOLVED, That the Supervisor be, and he hereby is,
authorized to designate a bookkeeper and a confidential
secretary to be employed by the Town Board.
Mr. Blatchley read a letter he had received from Thomas E.
Smith in which he stated he was resigning his post on the
Zoning Board of Appeals as of 12/31/74 as he will be moving
from the Town of Cortlandville at that time.
Motion was made by Justice Ronald Fish, seconded by Justice
Donald Eaton that the resignation be accepted with regrets and
that the letter be received and filed. Motion carried.
RESOLUTION #145: APPOINTMENT OF MILTON GREENE TO THE ZONING
BOARD OF APPEALS
Upon motion of Justice, Donald Eaton, seconded by Justice
Ronald Fish, all voting aye, the following resolution was
adopted:
WHEREAS, The resignation of Thomas E. Smith has created a
vacancy on the Zoning Board of Appeals as of 12/31/74, be it
RESOLVED, That Milton Greene be, and he hereby is, appointed
to fill the unexpired term of Thomas E, Smith, commencing
January 1, 1975 and expiring December 31, 1978.
RESOLUTION 1146: APPOINTMENT OF CHARLES FINN TO ZONING BOARD OF
APPEALS
Upon motion of Coucilman, Ray Miller, seconded by Councilman,
Sherman Griswold, all voting aye, the following resolution
was adopted:
BE IT RESOLVED, That Charles Finn be, and he hereby is,
re -appointed to serve a five year term on the Zoning Board
of Appeals, commencing January 1, 1975 and expiring December
31, 19?9.

delegate to the annual Association of Towns meeting in
New York City on February 10, 11, and 12, 1975, and be

RESOLVED,That Justice Donald Eaton be, and he hereby is,
designated as alternate delegate to that meeting.
After a short discussion, it was decided to hold the final
meeting of the year on December 27, 1974 at 7:30 P.m,

WHEREAS, A petition for the creation of a water district to
be known as "Water District No. 4" in the Town of Cortlandville,
Cortland County, New York, the said petition being dated the
5th day of September, 1974, was duly presented to this Town
Board, together with the necessary map and plan attached
thereto; and
WHEREAS, An order was duly adopted by the Town Board, on the
6th day of November, 1974, reciting the filing of said petition,
the improvements proposed, the boundaries of the proposed
district and the estimated expense thereof and specifying
December 4th, 1974,at 7115 o'clock P.M., as the time and the
Town Hall in the said Town of Cortlandville where said Board
would meet to consider the petition and to hear all persons
interested in the subject thereof, concerning the same; and
WHEREAS, Such order was duly posted and published as required
by law; and
WHEREAS, A hearing in the matter was duly held by the Town
Board on this 4th day of December, 1974, commencing at 7:15
o'clock P.M. at the Town Hall in the said Town, and
considerable discussion upon the matter having been had and
all persons desiring to be heard having been duly heard,
including the petitioner in person, and various other persons
speaking in favor of the establishment of the proposed district;
Now, upon the evidence given upon said hearing and upon motion
of Justice of the Peace, Ronald J. Fish, seconded by Councilman,
Sherman 0. Griswold, and unanimously passed, it is
RESOLVED AND DETERMINED, That
(a) The petition aforesaid is signed and acknowledged or
proved as required by law and it duly complies with the
requirements of Section 191 of the Town Law as to sufficiency
of the signers and it is otherwise sufficient;
(b) all the property and property owners within the proposed
district are benefited thereby;
(c) all the property and property owners benefited are included
within the limits of the proposed district; and
(d) it is in the public interest to grant in whole the relief
sought; and it is further
RESOLVED AND DETERMINED, That the establishment of a water
district as proposed in said petition be approved; and that
the improvements therein mentioned be acquired and the service
therein mentioned be provided for upon the required funds
being made available or provided for; and that such district

ten (10) days after the adoption of this resolution, file
certified copies thereof in duplicate in the office of the
State Department of Audit & Control at Albany, New York,
together with an application by this Board in duplicate,
for permission to create such district as provided by the
Town Law, Section 194; and that such application shall be
executed by and in behalf of the Town Board by the Supervisor
of the Town.
The Bond Maturity Schedule is attached to and made a part of these
minutes.

Upon motion of Justice, Ronald Fish, seconded by Councilman
Sherman Griswold, all voting aye, the audited claims were
unanimously approved for payment as follows:

A special Town Board meeting was held on December 9, 1974
at 10:30 A.M. at the Town Hall, 15 Terrace Rd., Cortlandville,
New York.
PRESENT: Deputy Supervisor, Coucilman, Sherman 0, Griswold
Councilman, Ray Miller
Justice, Ronald Fish
Justice, Donald F. Eaton
Town Highway Superintendent, Lewis Wagner
Deputy Supervisor, Councilman Sherman Griswold called the
meeting to order and stated that he had received requests, in
writing, from two (2) Town Board members on December 4, 1974,
asking him to call a special Town Board meeting (directed to Mr.
Griswold in the absence of Supervisor Robert Blatchley).
Purpose of the Special Meeting - to discuss bads for a new 1975
Front End Loader received and opened at the regular Town Board
Meeting on December 4, 1974, 1974 and to accept the lowest
responsible bid. Meeting scheduled for 10:30 A.M. on December
9, 1974•
After a discussion of the bids and the specifications presented,
and further discussion with the Supt. of Highways, and on motion
of Justice Ronald Fish, seconded by Councilman, Ray Miller, all
voting aye the following resolution was adopted:
RESOLUTION #150: ACCEPTANCE OF BID -FOR NEW 1975 FRONT END LOADER
WHEREAS, pursuant to resolution #133 for the year 1974, sealed
bids were solicited for the furnishing and delivery of one
new 1975 Front End Loader, and
WHEREAS,. Three sealed bids were received and opened, and
WHEREAS, C.C.O. Equipment, Inc., Rt.290 Manlius Center Rd.,
East Syracuse, New York submitted the lowest bid, now therefor
be it
RESOLVED, That the Town Board accept the bid of C.C.O. Equipment
Inc. in the amount of $35,777.00 net, F.O.B. Cortlandville, N.Y.,
for the furnishing and delivery of one new 1975, Trojan
model 1900, Front End Loader, per the specifications set forth
in the bid information.
There being no further business scheduled for this special
meeting, on motion of Justice Donald Eaton, seconded by
Councilman, Ray Miller, all voting aye, the meeting was
adjourned at 10:50 A.M..
