HomeMy WebLinkAbout10-16-1974Wednesday, October 16, 1974 7:30 P.M. (pg.l) PUBLIC HEARING RE: TOWN OF CORTLANDVILLE BUDGET FOR 1975 A public hearing was held on the matter of the Town Budget for 1975. Present were Supervisor,.Robert Blatchley; Councilmen, Sherman Griswold and Ray Miller; Justices, Donald Eaton and Ronald Fish; Town Attorney, John Gardner; Town Engineer, William Rowell; Town Assessor, Robert Wells; Town Clerk, Christine Canestaro; Bookkeeper to the Supervisor, Rudy Krauklis; Legislators, Henry Wadsworth and Delmar Palm; Newspaper reporter, Skip Chapman. The Town Clerk read the legal notice which appeared in the Cortland Standard on October 11 and 14, 1974. ® Bookkeeper, Rudy Krauklis reviewed the preliminary budgets as approved by the Town Board on Oct. 2, 1974. No one in attend- ance raised any questions or objections to the approved preliminary budget. The Public Hearing was declared closed at 7:40 P.M. The second regular meeting of the month of the Town Board was called to order by Supervisor, Robert Blatchley at 7:40 P.M. The Town Clerk read the minutes of the last meeting. There were no corrections or additions. Motion was made by Coucilman Miller, seconded by Justice Fish. that the minutes be approved as read. Motion carried. Attorney, George Yager presented a petition in behalf of residents of Bell Dr. requesting that the designation of Bell Drive as a dead end street be confirmed. The petition with 42 signatures was ordered received and filed on motion of Justice Eaton, seconded by Coucilman Miller. Motion carried. RESOLUTION #123: CONFIRMING BELL DRIVE AS A DEAD END STREET Upon motion of Councilman Sherman Griswold, seconded by Justice Donald Eaton, all voting aye, the following resolution was adopted: WHEREAS, Bell Drive was deeded to the Town of Cortlandville on October 20, 1955 in its entirety, and WHEREAS, The land encompassing the turn -around on said Bell Drive was deeded to the Town of Cortlandville on November 21, 1955, and WHEREAS, Said Bell Drive has been maintained as a Dead End Street since 1957 and posted as a Dead End Street,pursuant to section 125A of the General Municipal Law of New York State, since that date, now therefore be it RESOLVED, That the Town Board of the -Town of Cortlandville hereby confirms that Bell Drive,has been and still is, designated a Dead End Street and shall continue to be main- tained as such, pursuant to the provisions set forth in Sec. 125A of the General Municipal Law of New York State. Supervisor, Robert Blatchley reported he had spoken with residents of Bowling Green, regarding drainage problems that exist there. He also talked with Mr. Oaks, regarding the drainage problem at his property on McLean Rd. He also reported he had spoken with Mr.Bassler, Resident Engineer, Dept: of Transportation, State of New York in Cortland County, regarding the trafficcontrol problem which exists at Rte 281 & Rte 13 intersection. Mr. Bassler advised him the problem was currently under study. Mr. Blatchley reported one had attended a meeting relative to the preservation of Railroad passenger and freight service in New York State. He also attended a few meetings sponsored by the Cortland County Legislature. Z Wednesday, October 16, 1974 Pg.2 Mr. Rowell reviewed briefly the water and sewer problems which now confront the Town including Bell Drive water, sewer and drainage; P.T.M. sewer; and Cortlandville Mall Water District; and Groton Avenue sewage,; He also stated that it is now necessary for the Town to decide on what direction it would take and what steps would be needed to connect to the inter municipal sewage system. Attorney, John Gardner read a letter from the Engineering Firm of Stearns & Wheler confirming the termination of their agreement with the Town, to furnish professional engineering services for the calendar year 1974, as of Sept-30, 1974. RESOLUTION #124: TERMINATION OF CONTRACT WITH STEARNS & WHELER Upon motion of Coucilman Ray Miller, seconded by Justice Donald Eaton, all voting aye, the above letter was ordered received and filed and the following resolution was adopted: RESOLVED, That the Town of Cortlandville hereby terminates the contract agreement it now has with Stearns & Wheler for furnishing Professional Engineering Services as Town Engineer during the calendar year 1974, and BE IT FURTHER RESOLVED, That the contract be terminated as of September 30, 1974 and is effective for the period of October 1, 1974 through December 31, 1974. Attorney'Gardner reviewed the substance of a letter received from George K. Bernstein, Federal Insurance Administrator, of the Dept. of Housing & Urban Development, relative to the Federal Flood Insurance Program. The letter advised that our community contains one or more areas which have special flood hazards. Upon motion of Justice Eaton, seconded by Justice Fish, all voting aye, the letter was ordered received & filed. RESOLUTION #125: DIRECTING SUPERVISOR TO WRITE LETTER TO THE COMMISSIONER OF ENVIRONMENTAL CONSERVATION Upon motion of Justice Eaton, seconded by Justice Fish, all voting aye, the following resolution was adopted: WHEREAS, The Town Supervisor has received from the :Department of Housing and Urban Development, formal notice of the tentative identification by the Federal Insurance Administration (FIA), on behalf of the Secretary of Housing and Urban Development, that the community contains one or more areas having special flood hazards, now therefore be it RESOLVED, That the Supervisor be, and he hereby is, directed to write a letter to the Commissioner of Environmental Conservation of the State of New York, advising that the Town of Cortlandville has been tentatively identified as having special flood hazards, Mr. Blatchley announced there would be a meeting,pertaining to the Federal Flood Insurance Program, on October 30, 1974 at the Cortlandville Grange at 7:30 P.M. A short discussion was had relative to the drainage problem on Bowling Green. Justice Eaton advised that he and Highway Supt. Louis Wagner had investigated the area after a heavy rain and had determined that the problem existed because several of the residents had put in black top driveways without consulting anyone and had either,forgot to put tubes in or had them in too high. Also Mr. Niederhofer had not graded the lawns Up -to the specifications of his plot plans and when he constructed the road to the town°s specifications, it resulted in the road being higher than the lawns, thus creating the ponding problem. It was concluded that the problem was created by Mr. Niederhofer and he should solve it. 1 • 1 • 1 Mr. Blatchley said he had talked with Mr. Ryerson of Ryerson Motors regarding the drainage problem at the Oaks resident on the corner of McLean Rd & Pleasantview Dr. Mr. R e on agreed to open Up the dry well in hopes of alleviating the p olsem. Z Wednesday, October 16, 1974 Pg.3 Mr. Blatchley advised he had contacted Mr. Anthony DeSanta and Mrs. Annabelle Alexander and asked them to be Co -Chairmen of a Bi-Centennial Committee for the Town of Cortlandville. Both accepted. RESOLUTION #126: APPOINTMENT OF BICENTENNIAL COMMITTEE CHAIRMEN Upon motion of Justice Donald Eaton;:; seconded by Councilman Ray Miller, all voting aye, the following resolution was adopted: WHEREAS, The U.S.A. will be celebrating its American Revolution Bicentennial anniversary in the year 1976, and • WHEREAS, All States, Communities and Municipalities have been asked to participate in the celebration of this anniversary, now therefore be it RESOLVED, That the Tom Board of the Town of Cortlandville hereby appoints Mr. Anthony DeSanta and Mrs. Annabelle Alexander Co -Chairmen of a committee to plan the Town of Cortlandville's active participation in the Bicentennial celebration, and be it further RESOLVED, That the Town Board will lend their support to the committee. The Town Clerk advised that she had appointed Mrs. Theresa Fortin as her deputy with full responsibilities, and asked the Board's approval of the appointment. RESOLUTION #127: APPROVAL OF APPOINTMENT OF DEPUTY TOWN CLERK Upon motion of Justice Eaton, seconded by Justice Fish, all voting aye, the following resolution was adopted® WHEREAS, The position of Deputy Town Clerk has been vacant since the resignation of Mildred Brookins on June 30, 1974, and WHEREAS, The Town Clerk has appointed Mrs. Theresa Fortin to fill the position, now therefore be it RESOLVED, That the appointment of Theresa Fortin as Deputy Town Clerk be, and it hereby is, approved, and be it further RESOLVED, That she be paid an annual salary of $5,200.00, commencing October 1, 1974. Justice Fish asked Legislator,Delmar Palm if the County was seriously considering the formation of a County wide sewer district and registered his concern for the Town's preparation for connection to the inter -municipal sewage system. He asked, "in view of the Town's immediate problems, would it not be feasable to go ahead with plans for the Town and connect to the City system when they are ready to accept us". Mr. Palm stated he felt the Town should start • some very serious planning along these lines. Mr. Rowell agreed and stated he would discuss the subject in detail with the Town Board. RESOLUTION #128:RESCINDING APPROVAL OF 7/3/74 PAYMENT OF CLAIM OF ARCHITECT, KARL H. WENDT Upon motion of Justice Eaton, seconded by Councilman Griswold, and votes poled as follows: Councilman Miller, aye; Councilman Griswold, aye; Justice Eaton, aye; Justice Fish, abstain; Supervisor Blatchley, aye; the following resolution was adopted: WHEREAS, The Town Board of the Town of Cortlandville did approve at its regular meeting held on July 3, 1974, the General Fund Claims in the amount of $8,579.91, which included 92 WEDNESDAY, October 16, 1974 Pg. 4 the claim of Karl H. Wendt, Architect, :n the amount of $4,341.80 for the balance due for professional services and expenses in connection with preparation of plans and specifications for construction of a new municipal building and there is now a question of the validity of the amount of this claim; be it RESOLVED, That said approval of said claim be, and it hereby is, rescinded by the Town Board and not be paid by the Supervisor. Justice Eaton proposed that Karl Wendt's final bill_ be paid on the basis of 8130-,000, the cost estimated by Mr. Wendt at the time contracts were a:dverti'sed'for bid. • RESOLUTION '12 : PAYMENT OF MONIES DUE ARCHITECT,KARL H. WENDT Upon motion of Justice Eaton, seconded by Councilman Miller and votes poled as follows: Councilman Miller, aye; Councilman Griswold, aye; Justice Eaton,aye; Justice Fish, abstain; Supervisor Blatchley, aye; the following resolution was adopted. WHEREAS, On May 1, 1974 Architect, Karl H. Wendt did submit to the Town Board final plans for the construction of a new municipal building, and WHEREAS, The cost of construction estimated by the architect, at that time, wars $130,000.00, now therefore be it RESOLVED, That final payment in amount of 8112.50 plus $245.07 expenses be paid to Karl H. Wendt in full payment of his claim against the Town, this figure being based on the estimated cost of construction of $130,000.00. RESOLUTION #1'0: ADOPTION OF BUDGET FOR 1975 Upon motion of Justice Eaton, seconded by Councilman Miller, all voting aye, the following resolution was adopted: WHEREAS, the preliminary budget for the year 1975 has been duly presented to the Town Board by the Town Clerk and a duly advertised public hearing has been held thereon, be it RESOLVED, Pursuant to Sec. 109, Subdivision 1 through 3 of the Town Law, the said preliminary budget, as approved be, and it hereby is, adopted as the budget for the Town of Cortlandville for the year 1975.
