Pg.1 The second regular meeting of the month of the Town Board was held at the Town Hall, 15.Terrac.e Rd., with Deputy Supervisor, Councilman Sherman Griswold Presiding. Other Board members present were: Justices: Donald Eaton and Ronald Fish; and. Councilman, Ray Miller. Also present were: Town Engineer, Wm. LaRo.se; Town Highway.Superintendent, Louis Wagner; Bookkeeper to the Supervisor, Rudy Krauklis; Town Clerk, Christine Canestaro; Legislators, Shirley Fish and Delmar Palm; Mr. & Mrs. Robert P. Blatchley; Mr. & Mrs. Warren Bartholomew; Mr. James LeFever, Fire Co-ordinator for Cortland County; Mr. Ronald Petrecca; and Skip Chapman, new$aper reporter. • The Town Clerk read the minutes of the last regular meeting. Upon motion of Justice Fish, seconded by Councilman Miller, all voting aye, the minutes were approved as read. The Town Clerk read the minutes of the Special Town Board meeting held on August 14, 1974. Justice Fish stated one correction should be made. The title "Justice of the Peace" as it appears in the resolution adopted should be changed to "Town Justice", as the office "Justice of the Peace" no longer exists. Upon motion of Justice Eaton, seconded by Councilman Miller, the minutes were unanimously approved as corrected. RESOLUTION #93: AUTHORIZATION TO RELEASE FEDERAL REVENUE SHARING MONIES FOR TRANSPORTATION PURPOSES. Upon motion of'Councilman Miller, seconded by Justice Eaton, all voting aye, the following resolution was adopted: RESOLVED, that the Supervisor be and he hereby is authorized to release $20,000.00 of the Federal Revenue Sharing Fund for transportation use to repair and resurface Town Roads. The Town Clerk read several pieces of mail as follows: 1) A copy of a letter sent to Rauch, Gordon & Hoffman, Attorneys for Groton Avenue Shopping Plaza, by the New York State Department of Environmental Conservation regarding the variance request for the Groton Ave. Shopping Plaza sewer hook-up. Motion was made by Justice Eaton, seconded by Councilman Miller to receive and file the letter. Motion carried. 2) A letter from Haskell & Foley addressed to the Town Board regarding the formation of a Sewage -works Corp. for the proposed Meadowbrook sub -division. Motion was made by Councilman Miller, Seconded by Justice Eaton to receive and file the letter. Motion carried. 3) A letter from Mr. & Mrs. Walter Joy addressed to the Town Board opposing the PUD of Stiles Farms Inc. and urging the Town Board to adopt building, electrical, and plumbing codes to protect the home buyer. Motion was made by Councilman Miller, seconded by Justice Eaton to receive and file the letter. Motion carried. 4) A letter from the Cortland County Legislature, Public Safety Committee, addressed to the Town Board relative to the Board's request that the Public Safety Committee conduct a County wide study of the present mutual aid system. They advised that a special committee consisting of the Cortland County Fire Coordinator, the Deputy Coordinators, and the Fire Chiefs of the county, was appointed to conduct an investigation of the present system. The committee is currently working on the study. Motion was made by Justice Eaton, seconded by Councilman Miller to receive and file the letter. Motion carried. M Wednesday August 21, 1974 Pg. 2 5) A letter from J. Baker, Inc., Div. of National Shoes, Inc. asking if a license or permit was required to operate a shoe dept. in the Big N. Dept. Store, The Town Clerk said she had replied to this letter stating that no permits or licenses were required, -by the town for this operation. Motion was made by Coucilman Miller, seconded by Justice Eaton to receive and file the letter. Motion carried. 6) A letter- from the Consumer Protection Service, Action line column, Cortland, N.Y. addressed to the Supervisor regarding a.complaint received by their office contending that the Town of Cortlandville does not enforce the Trailer Park Zoning Ordinance. The Town Clerk advised the Board that the letter was • turned over to her as zoning enforcement officer, for reply. She read her response to the Consumer Protection Service, advising them that the Town of Cortlandville does enforce the Trailer Park Ordinance and that there had been no complaints registered in her office, regarding any violations. Motion was made by Justice Fish, seconded by Councilman Miller to receive and file the letters. Motion carried. 7) A copy of a letter from Town Engineer Wm. LaRose addressed to the Town Planning Board relative to the sanitary trunk sewer at the Meadowbrook Development in which he stated he had consulted with Calocerinos & Spina consulting Engineers for the project and that they had submitted revised drawings dated Aug. 6, 1974 showing a 15" trunk sewer in Maryland Avenue and that a 20 ft. wide permanent easement is to be provided between two of the building lots opposite to and south of manhole 9A in order that the trunk sewer can be extended (in the future) south to the low point in Fisher Avenue." He recommends that"no structure be erected nearer than 5 ft. to the easement line." Motion was made by Justice Fish, seconded by Justice Eaton to receive and file the letter. Motion carried. 8) A letter from Firestone Tire & Rubber Co. addressed to Mrs. Canestaro with a carbon copy addressed to the Town Counsel, thanking her and all concerned for the assistance received in obtaining a building permit for the construction of their new store at the Groton Ave. Shopping Plaza. They also requested that the letter of consent from the Town Board regarding the proposed establishment of a sewage transportation corporation at the Groton Ave. Shopping Plaza, be sent to the New York State Dept. of Environmental Conservation as soon as possible. Motion was made by Justice Eaton, seconded by Justice Fish to receive and file the letter. Motion carried. Acceptance of Bids for the furnishing of materials for the construction of a structural (sectional) plate arch was closed at 8:00 P.M.. M Wednesday August 21, 1974 Pg. 3 Town Engineer, and Town Highway Superintendent adjourned to another office to inspect the bids to see if they were in compliance with the information to bidders. Justice Eaton read a proposed resolution relative to the appointment of a new supervisor. Justice Fish requested a ten minute executive meeting of the Town Board. The request was granted and the Board adjourned to a private office for the executive meeting, The meeting was reconvened in ten minutes, and the following resolution upon motion of Justice Eaton, seconded by Councilman Miller was unanimously adopted after votes were poled as follows. - Ray Miller, aye; Donald Eaton, aye; Sherman Griswold, aye; Ronald Fish, aye: RESOLUTION #94: APPOINTMENT OF SUPERVISOR WHEREAS, the office of Supervisor of the Town has been vacant since the death of Hon.'Frank K. Taylor on July 14, 1974, be it RESOLVED, That Robert P. Blatchley of Virgil Road, Town of Cortlandville, be and he hereby is, appointed Supervisor of the Town to serve until December 31, 1974, at an annual salary of $7,250.00. : Mr. Blatchley gave a brief acceptance speech stating he was pleased to take this part in the community and that he has "big shoes to fill". Also, he said, he was "impressed with th attitude and professionalism of the Town Team". He said he would work closely with the Town Planning Board and that the Town should develop a philosophy for the development of the Town not only now, but for the distant future. Mr. LaRose and Mr. Wagner reported they had found all bids',to be in order. RESOLUTION 195: ACCEPTANCE OF BID -MATERIALS FOR STRUCTURAL (SECTIONAL) PLATE ARCH Upon motion of Justice Fish, seconded by Councilman Miller, all voting aye, the following resolution was adopted: WHEREAS, pursuant to resolution #89 for the year 1974, sealed bids were solicited for the furnishing and delivery of materials for a structural (sectional) plate arch,and WHEREAS, Four sealed bids were received and opened, and WHEREAS, Hanna & Hamilton, Inc., Bath, New York, submitted the lowest bid, now therefore be it RESOLVED, That the Town Board accept the bid of Hanna & Hamilton, Inc. in the amount of $5,398.00 for the furnishing and delivery of materials for a structural (sectional) plate arch (steel) per the specifications set forth in the bid information. The advisability of obtaining an easement for a future trunk sewer line which will run south of the Gorman tract,on Fisher ave, was discussed. Mr. LaRose will determine easements needed and Attorney Gardner will attend to the legal details. At this time, Deputy Supervisor,,Sherman Griswold turned the meeting over to the new Supervisor, Mr. Blatchley; who .presided over the rest of the meeting. Mr. & Mrs. Warren Bartholomew of Bell Dr. requested assurance from the Town Engineer that the drainage swale to be developed at the Gorman Meadowbrook project would work. Mr. LaRose told them he could.not give them this assurance. However, He and Mr. Feuss of the Cortland County Health Dept. both feel it is the best solution 72 Wednesday, August 21, 1974- Pg. 4- to the drainage problem which exists there at this time. He suggested that Gorman°s engineers be invited to a Town Board meeting to answer any questions regarding the Swale, which the residents of the area wish answered. Justice Fish stated he had spoken with Mayor Forcucci, who was concerned because he had not received any letters from the Town regarding the additional sewage which would be pumped into the sewer lines as a result of new construction in the Town of Cortlandville (Ponderosa, Anderson Rental, Firestone & Meadowbrook). Mr, LaRose stated he would write a letter to the City relative to the additonal wastewater flow'from Ponderosa, Anderson Rental, and Firestone, but he felt that the Gorman project was a • matter to be dealt with privately between Mr. Gorman, the City of Cortland and the Village of Homer, as they would be hooking into the Village sewer system, and not the Town contracted lines. RESOLUTION #96: AUTHORIZATION TO WRITE LETTER OF CONSENT FOR THE FORMATION OF A SEWER"TRANSPORTATION CORP. AT GROTON AVENUE SHOPPING PLAZA RESOLVED, That the Town Attorney be and he hereby is directed to write a letter of consent to the New York State Dept. of Environmental Conservation, 100 Elwood Davis Road, North Syracuse, N.Y.,, 1-3212 stating that the Town of Cortlandville will accept the establishment of a Sewer Transportation Corporation when a request is made - to form a sewage works corporation to serve the Groton Avenue Shopping Plaza and Firestone Tire & ,Rubber Company Properties and that the Town is not adverse to a variance pursuant to Part 652.8 of the Environmental Conservation Code. Upon motion of Justice Eaton, seconded by Councilman Miller, all voting aye and adopted. RESOLUTION #97: AUTHORIZATION TO FURNISH UPDATED SEWER MAPS & ZONING MAPS Upon motion of Justice Eaton, seconded by Councilman Miller, all voting aye, the following resolution was adopted. RESOLVED, That the Town Engineer be and he hereby is directed to furnish the Town with a linen copy of the updated composite sewer map and ten copies of the updated Town zoning map. Louis Wagner reported he had checked on some prices as he had been told that the Town of Truxton was getting cheaper prices than the Town of Cortlandville. Comparison follows4 Asphalt Dust Oil -with high asphalt content Central Asphalt will suppl y Mr. James LeFever, Fire Coordinator for the County explained the County -wide mutual aid system. He feels that the present system works very well and that all areas are well covered. He stated, "since the establishment of the satellite station in the Town of Cortlandville, response time has been considerably cut down". He suggested that the only area which could possibly use revision is the Pendleton St. Hill area, 11t1hich is now covered by the McGraw Fire Dept. He said the Town Board should consider incorporating this area in the Homer Fire Dept. Dist., so that it could be covered by the Cortlandville station. 11 113 Wednesday, August 21, 1974 Justice Fish read the final bill, dated 8/14/74, submitted by Architect Karl H. Wendt, totaling $2,855,73 and recommended that it be paid. Bookkeeper, Rudy Krauklis contended that the itemized changes read by Mr. Fish were all made and incorporated in the plans prior to the acceptance by the Town Board for bid and that at the time of bid, the estimate made by the Architect was $130,000.00. He stated that the Dept. of Audit and Control would not sanction the payment of a fee based on a rejected bid. Legislator, Delmar Palm suggested that the bill be turned over to the Town attorney for his scrutiny and advise. The matter was tabled until the Town Attorney could review the bill. Justice Eaton suggested that some action should be taken on the ® complaints registered by Mr. Olp in his letter dated 7/29/74. Mr. Blatchley apprised the Board he had talked with Mr. Olp and after consulting with Justice Fish,had to advise him that the Town had no ordinances governing these problems. Justice Eaton said that the manure problem could be solved by the law enforcement agencies under the Vehicle & Traffic Law, as it is considered "noxious" material. is 1 Justice Eaton advised that a bill for a sewer connection charge, billed to Robert Bean, Penguin Trailer Pk, had not been paid and would be turned over to the Town Attorney for his advise. Mrs. Canestaro advised that she had spoken to Mr. Bean regarding this bill and that he had said he would not pay the bill as the connection had been made to his own man hole located on Starr Rd. Louis Wagner reported he had been in contact with Virgil Highway Superintendent, Robert Muncey regarding the request to re -open Taranto Rd. and as a result, felt that it could be accomplished. There being no further business, motion was made by Councilman Miller, senonded by Justice Eaton, all voting aye, that the meeting be adjourned. Meeting was adjourned at 10:00 P.M..
