Other Board members present were: Justices Donald Eaton and Ronald Fi sh; Councilman, Ray Miller; Coucil.ma.n, Sherman Griswold was absent. Also present were: Town Attorney, John Gardner; Town Engineer, Wi.liimm Rowell.; Superi_nte-n.dent, Louis Wagner; Assessor, Robert Wells; Bookkeeper to the Supervisor, Rudy Krauklis; Town Clerk, Christine Ca.nesta.ro; Deprt�T Town Clerk, Mildred Brookins; Legislators, Shirlev Fish, Henry Wadsworth and Palm: Newspaper reporter, Skip Ch.a.pman. The Town Clerk read_ the minutes of the last meeting. There were no corrections. The minutes were approved as read. RESOLUTION #30: Motion was made by Donald Eaton, seconded by Ray ® Miller that the house trailer renewal. permit be granted to John Spadaloni upon payment of the $10.00 renewal fee. Motion passed. The Town clerk read a letter from Agway Petroleum Corp. relative to a. price change notification. The price of diesel fuel is being decreased $.0100 per gallon. A petition bearing 29 signatures opposing the re-zoni'1g from residential to business transitional_ of the property being petitioned by Mr. and Mrs. Wm. Pa.uldine, which property is 10ca.ted. on Fisher Ave. was presented by Thomas Tae,iyer, a. resident of Fisher Aire. RESOLUTION #31: Motion was made by Mr. Eaton, seconded. by Mr. Miller that the petition be received and filed. Motion carried. The Town Clerk read a letter from the Cortland Colinty Planning_ Board stating that the re -zoning; of the Fisher Ave® propertY would. have no conflict to a.ny CountlIT -program, Approval_ or denial of the petition would be _left at the local level_. RESOLUTION #3,2: Motion was made by Mr. Miller, seconded by Mr. Fish that the letter be received and filed. Motion carried. RESOLUTION #33: Upon motion. by Mr. Fish, seconded b,* Nir. Eaton, the following Resolution was, unanimously adopted - WHEREAS, The Town Board on September. 6, 1972, made and signed a written order approving the annexation to the City of Cortland, consisting of 27.37 acres of land lying within the confines of the Town of Cortlandville and owned. by Walter 0. Westendorf and 'St'. Mary°s Church; and WHEREAS, the City of Cortland. or November 21 ,1972 , enacted Local. RESOLUTION #34: Motion was made by Mr. Eaton, seconded by Mr. Miller -that the bids for the 1974 Demonstrator Hydraulic Ditching Machine be opened to all interested bidders at 8:00 p.m. on April 3, 1.974 at the Town Hall, 15 Terrace Rd. Motion carried. RESOLUTION #35 Upon Motion of Mr. Milleip, seconded by Mr. Eaton, the following .resolution was unanimously adopted.: WHEREAS, The Town Board in behalf of the Town of Cortlaridville intends to build a new multi -purpose municipal building which it wishes to heat with natural_ gas, which is available in the area. But because of present rulings of the New York State Public Service Commission, the supplier is prevented from furnishing said gas without • some form of standby fuel. NOW THEREFORE; Be it RESOLVED, That the Town. Fn gi neer -prepare such petition_ with any supporting documents which may be deemed appropriate; and it is further V-OLVED, That the Town Supervisor be, and he hereby is, - authorized to sign such petitions and forward same to Mr. Samuel R. Madison, Director, Public Service Commission, 44 Holland Avenue, Albany, New York 1-2208. Ronald Fish asked Highway Supt, to check the culvert under Fairground drive, which seemed. to be plugged. Mr. Wagner said he would check it out. Mr. Taylor reported that the Volunteer Fire Co. 4 of Homer Fire Station 2 was the first on the scene at the Asher Goodale fire and because of the speed in getting to the fire, was credited with sav:i.n.g much of the property, together with the help of Homer's main force, McLean, McGraw,&Virgil fire departments. John Gardner reported on his meeting with Atty. Briggs regarding the Vesta Corset Co. final appraisal made by Pomeroy Appraisal Assoc.. The appraisal was not finished by the 15th of February as requested so an order by sti.pulati.on was obtained for an additional month's time to file the appraisal. It was granted and extended. to Friday, March 22. Mr. Wells received. four copies of the appraisal Firday, March 15. Mr, Gardner delivered two copies to Robert Briggs, attorney for -the Village of McGraw. The Villas?e, through it's attorney, wishes tohave another appraisal made, as they were not satisfied with the Pomeroy appraisal. Attorney Briggs wishes to retain Northeast Appraisal_ Services, operated by Richard E. Casey, for the second appraisal. Northeast Appraisal Services was one of the original bidders. RESOLUTION #36: Motion was made by Mr. Eaton, seconded by Mr. Miller that Attorney Gardner be authorized to obtain another appraisal_ with the town paying one half of the fee, not to exceed $650.00. Motion passed, • Mr.. Ta%ilor read a. letter dated 3/1.4; 74 which he had received from Mayor Sam Forcucci regarding the Infiltration Inflow Study. Mr_. Taylor, Mr. Rowell and Atty. Gardner met with Mayor. Forcucci., AttAr Gi1_hooley, and Mayor Cal -ale on March 20 to discuss the Federal aid grant for the construction of -the Waste Water Treatment plant. In order for the City -to obtain. the Federal. a.id grant in the expected amount of. 87p%, certain stipulations have to be met rega.r_ ding industries and collection of monies. The meeting was to inform the V1-11.ae of Homer and the Town of Cortlandv;lle that some :r_cd.ifi.cati.ons may have to be made to their ordinances and when more information is obtained, it will be passed on. 19 Mr. Rowell reported he hE�d met wi.th a .r.-epresentat_ve o_f the Hayward Co. relative to water ,.nd_ sewer- service along Rt. 13 which is to serve the proposed. Ponderosa Restaurant. After he reviewed the plans, certain mod.ificati.ons were recommended and made. Approval was given by the Health department subject to one modification. The proposed location is within the Sewer District. The faci_1_i_ties are to be bui_I t by Hayward Co, on behalf of Ponderosa Restaurant. The part within the State Highway is intended to be transferred to the Town Sewer District for operation and mai.ntainence. pump station will be i.rstalled on the Ponderosa property to serve the restaurant; to be operated and maintained by them. A force main will run from -there to a sanitary sewer within Rt. 1..3. Tree ws_11_ obtain the necessa.r;r permits for construction within the State Highway. ® A letter had been submitted by the Hayward Co. authorizing them to tie in to the 14" water line contingent to the approval of the Town Board. The letter was not accepted because of the 1Q72 date. Approval was not given. Another letter will be requested. Mr. Taylor read a. letter he ha.d. received from DeLeuw, Cather & Co. and accompanying information from the Dept. of Housing & Urban Development, Federal Insurance Administration, Washington, D.C.. A discussion followed. There being no further Business, motion was made by Mr. Eaton, seconded by Mr. Miller that the meeting be adjourned. Meeting was ,adjourned. at 9:135 P.M.
