Blatchley presiding. Other Board members present were Justices, Donald Eaton and Ronald Fish and Councilmen, Sherman Griswold and Ray Miller. Others present were Town Attorney, John Gardner; Town Engineer, William Rowell; Town Clerk, Christine Canestaro; Deputy Town Clerk, Theresa Fortin; Town Assessor, Robert Wells; Highway Supt., Carl Eaton; Zoning Enforcement Officer, Don Fowler; Water & Sewer Dept. Supt., Fred Walker; Legislators, Shirley Fish, Delmar Palm, and Henry Wadsworth; John Jackson of S.P.C.A.; Mr. Carl Edlund and Mr. Newton Williams of Bell Dr.; Skip Chapman, news reporter. TEe meeting was called to order by Supervisor Blatchley and the pledge of allegience was given by all in attendance. The Town Clerk read the minutes of the last meeting. Upon motion of Justice Eaton, seconded by Councilman Miller, all voting aye, the minutes were approved as read. Supervisor Blatchley stated that the public hearing time was incorrect as stated in resolution #14.1; whereupon Justice Eaton withdrew his motion and Councilman Miller withdrew his second to the motion. RESOLUTION #142: AUTHORIZATION TO CORRECT RESOLUTION #14.1 Upon motion of Justice Eaton, seconded by Councilman Miller, all voting aye and adopted. BE IT RESOLVED That the minutes of September 17, 1975, Resolution #14.1 shall be corrected to read as follows: BE IT RESOLVED that a public hearing be held on October 15, 1975 at 8:00 P.M., pursuant to Sec. 184 of the Town Law for the purpose of acceptance of a fire protection contract between the Village of Homer and the Town of Cortlandville, and BE IT FURTHER RESOLVED That a public} hearing he held on October 15, 1975 at 8:30 P.M., pursuant to Sec. 184• of the Town Law for the purpose of acceptance of a fire protection .contract between the Village of McGraw and the Town of Cortlandville. Assessor, Robert Wells presented a "Statistical Summary -Town of Cortlandville" which he reviewed for the Town Board. A copy of this report is attached to and made a part of these minutes. Legislator, Delmar Palm reported that several people had suggested to him that a street light be installed at the interesection where the McLean Rd., Lime Hollow Rd. and Gracie Rd. come together, as this is a dangerous intersection and the visability is very poor. He asked if this were a town or a county responsibility. It was determined that this was a town responsibility, since the town is responsible for furnishing lighting within the town. Justice Fish was directed to investigate the matter and to report his recommendations to the Board. Justice Eaton reported that the furnace at the municipal building on the West Rd. had been serviced and necessary repairs made and that it is now working properly. Carl Eaton reported that he is still looking into prices for an air compressor. He reported that the heavy rainfall during the past weekend had created several problems and had kept his department busy cleaning out drainage ditches and streams. Hoxies Gorge bridge, he said, suffered considerable damage. His department made necessary repairs so that it would be safe to traffic. There are still a few minor repairs to be made which will be taken care of as soon as possible. Supervisor Blatchley commended Highway Supt. Carl Eaton and his department for the excellent job they had'done during the storm and for the prompt precautions they had taken to eliminate flood damage. Supervisor Blatchley reported that Mayor Niver of McGraw had called,. him regarding the railroad bed washout east of McGraw. Highway Supt. Eaton advised him that he ia-as?_,aware of the situation and was scheduled to look it over with the Dept. of Conservation tomorrow to see what could be done. 232 Wednesday, October 1, 1975 pg. 2 Zoning Enforcement.Officer, Don Fowler made.the following report: 10 building permits had been issued during Sept. as follows: Sept. Permits issued $ 129.50 $1,274.00 Mr. Fowler reported that he had checked with the Cortland County Health Dept., D.E.C., and with Fish & Wildlife service, regarding the M.V.E. oil storage tanks and found none of them had any requirements to be met. The Town of Cortlandville Zoning Ordinance, he said, only required that they be diked. M.V.E. will comply wth this requirement he was advised. Regarding the fire exits on the new construction of Zu Drit, Mr. Fowler reported he had talked with the owner and he had advised thim that he would adjust the exits. to comply with the fire exit requirements set forth in the N.Y.State building code. Supervisor Blatchley gave the following report on the financial status of the town as of 9/30/75. Balance 126,333.63 comprised of: Repairs & Improvements $58,960.36 Bridges 9,578.25 Machinery 28,260.60 Snow Removal & Misc. _ 29,534.42 $ 126,333.63 Mr. Rowell reported he had met two weeks ago with the City of Cortland representative, Jim Feuss of the County Health Dept., & Mr. Huntly, N.Y.State representative of D.E.C., to discuss the funding program for the Groton Ave. trunk line sewer. Two topics of concern were discussed. They were assured that the city could get the 87 funding for the program even though the Town of Cortlandville had not, as yet, formed a sewer district. The state, he said, has asked the city to proceed with the awarding of the bid for construction of the trunk line sewer as promptly as possible. The second item of concern was the construction cost and funding of the portion of the trunk line which would be between the city line and rte. 281, which lies within the Town of Cortlandville. He was told that there should be no problem regarding funding for the town but details have yet to be worked out. Mr. Carl Edlund of Bell drive reported to the Board that the residents of Bell Dr. were very concerned over the recent rain storm and the effect the water run off had on some of their properties and asked that consideration be given this problem when the storm sewers were developed in the Meadowbrook project. He said he did not feel that the pipes that had been installed to take care of this run off from Cosmos Hill were adequate. Justice Eaton asked Mr. Newton Williams of Bell Dr., for the record, what had caused the water damage to his property. Mr. Williams stated that it was caused mostly by the wash off from the shoulders of the road due to the lack of proper drainage from the street and because the two sluice pipes are too small to accommodate the water running off Cosmos Hill. 11 1 • 1 Mr. Rowell read a letter he -had received from D.O.T.-giving authority for letting of contracts regarding the relocation of water mains at the intersection of rte. 281 & McLean Rd. Wednesday, October 1, 1975 Pg/3 RESOLUTION ##143: AUTHORIZATION FOR SUPERVISOR TO SIGN CONTRACT WITH EDLUND MFG., INC. FOR RELOCATION OF WATER MAINS Upon motion by Councilman, Sherman Griswold and seconded by Justice, Ronald Fish, all voting aye and adopted. BE IT RESOLVED, That the Supervisor be, and he hereby is, authorized and directed to sign contract documents, upon approval of the Town Attorney, with Edlund Mfg. Co., Inc. for the Furnishing, delivering, and installing complete 8, 10, & 12 inch water mains, valves, hydrant and appurtenances at the interesection of N.Y.State rte 281 & McLean Rd.; and be it further ® RESOLVED, That no work may be started on the project until the Comptroller of the State has approved the municipal agreement. Attorney Gardner advised the Board that a cash flow report should be obtained to ascertain that funds are available for the anticipated expenditures in Water Dist. I. He cautioned them that there must be funds available to pay for the water main relocation work as there will be a lapse of time between completion of the project and re-imbursement by the state. Mr. Rowell stated that he would make a projection on the anticipated expenditures and will confer with D.O.T. regarding when the town can expect payment from the state. Mr. Rowell reported that the new well had been installed by Hall & Co. and that the water had been tested. Mr. Rowell advised he had rejected Hall & Co.'s preliminary report as the data was insuffcient. Mr. Rowell said he had completed contract documents, based on the results of the pump test, for a new pump, clorination equuiment, electrical equipment, pipe lines and other related items and is now ready to present them to the Water Resources Commission for their final approval. The Board gave Mr. Rowell their approval to send the contract documents to D.E.C. Mr. Rowell said he would review the plans with Fred Walker, so that he will know what is going on. It will take 4-to 6 weeks before the documents are returned and before the advertising for bids on the new pump and its installation can be accomplished. . Justice Fish inquired if Mr. Rowell had prepared a cost estimate on the new pump installation. Mr. Rowell replied that he had not done so, as yet, as -there is a considerable amount of details which have yet to be worked out. However, he anticipated that it would be in the vicinity of $50,000. Regarding the rte. 11 sewer, Mr. Rowell reported that the mapping had been blown up to a scale which could be used, basic data had been obtained and he is now proceeding with the final mapping of the area. There are financial rather than engineering problems still to be resolved. Mr. Rowell reported he would have the preliminary plans of this project ready for the next Town Board meeting. Supervisor Blatchley read the tentative budget and a copy was given to each Board member for their review. Mr. John Jackson, representing S.P.C.A., presented a copy of their 1975/76 budget to each member of the Town Board and reviewed it in detail to justify their request for additional funds from the Town of Cortlandville. RESOLUTION #144: FIXING DATE FOR PUBLIC HEARING ON PRELIMINARY BUDGETS Upon motion of Justice Fish, seconded by Justice Eaton all voting aye and adopted. BE IT RESOLVED, That a public hearing be held on the preliminary budgets for the Town of Cortlandville, Water Dist. 1, Water Dist. 2, Water Dist-3 & Sewer Dist. 1, on October 22, 1975 at 7:30 p.m. in the Town Hall, 15 Terrace Rd., and be it further RESOLVED, That a notice of such public hearing shall be published in accordance with the requirements of the laws of the State of New York. 4c�t' 234 Wednesday, October 1, 1975 pg. 4 Supervisor Blatchley apprised the Board that Don Hall of kwrn-s—&-Whel-er P Y PP has offered to make re -application to H.U.D. for funding for municipal projects. This will be done at no cost to the town. However, if the application is approved and funding made available, there will be a small charge for his services. Mr. Blatchley said he and Mr. Rowell had discussed new Priorities for the town such as: South Cortland Water, Sewer for Terrace Rd. & Pleasantview Dr. to protect the Town water supply, sewer for r+te.11 problem area, sewer trunk line along the railroad track, & Polkville water supply for fire protection. Justice Eaton stated he felt some investigation should be made to find out what priorities are considered high priority items by H.U.D. so that when application is made, the town priorities can be listed to enhance the possibility of acceptance by the federal H.U.D. program. Supervisor Blatchley presented each Board Member a map of a "Modified Master Plan for Meadowbrook Development" prepared by the Cortland County Planning Dept.. He advised that sometime in the near future, the County Planning Board will ask them to accept or reject this modified plan. No action was taken tonight. A copy of this map is attached to and made a part of these minutes. Justice Fish stated it was not up to the Town Board to accept or reject this plan, that it was a Town Planning Board action. Mr. Blatchley said he thought the County Planning Board would like the Town Boards input on the plan.
