HomeMy WebLinkAbout06-25-1975Wednesday, June 25, 1975 7:30 p.m. Pg. 1 SPECIAL TOWN BOARD MEETING A special meeting of the Town Board was held at the Town Hall, 15 Terrace Rd., for the purpose of discussing the Bell Dr. matter. Supervisor Robert P. Blatchley presided. Other Board members present were: Justices Donald Eaton and Ronald Fish, and Councilmen, Sherman Griswold and Ray Miller. Others present were: Attorney, John Gardner; Town Clerk, Christine Canestaro; Attorney George Yeager; Attorney John Fitzgerald; Francis Gorman; William Griswold, member of Town Planning Board; Legislator, Shirley Fish; Mr. & Mrs. Tarbell; Mr. & Mrs. Bartholomew; Mr. Carl Edlund; Mr. Ross Allen; Mr. Paul Beuscher; and Skip Chapman, news reporter. Attorney Yeager reported that he had received a memo from Attorney Fitzgerald late this afternoon, regarding the terms of the escrow agreement, which he and the committee of Bell Dr. residents felt was satisfactory to all parties concerned. He stated there would be no need for the Town Board to take action tonight, on the petition the residents had submitted on 5/21/75• However, he wished to reserve the right to bring the matter back to the Town Board in the event the final agreement was not prepared per the memorandum received today and duly signed by both parties involved. Supervisor Blatchley stated he had asked Mr. Gorman to prepare formal petitions for the formation of a water and sewer district. Mr. Blatchley said he had talked with the Town Engineer and the Chairman of the Town Planning Board, Mr. Hatheway and they both feel that the plans are quite satisfactory. Mr. Blatchley said he had a copy of a letter writtten by Mr. Rowell, addressed to Mr. Hatheway, in which Mr. Rowell has approved the plans for phase 3 of the Meadowbrook Sub -Division. Attorney Fitzgerald confirmed the general terms of the escrow agreement between the Tarbells and Mr. Gorman. He said there had been a change in the overall program, not covered by the escrow agreement at the present time; in that they would not request the Town to purchase the sewer and water systems, but would accept it as a cost to the developers. Attorney Fitzgerald wished to file petitions for the formation of water and sewer districts at the Meadowbrook tract. Attorney Gardner advised him to file the petitions and technical maps with the Town Clerk and that the Board could take them under consideration at their regular meeting a week from tonight. Attorney Fitzgerald filed the petitions and maps (not the technical maps) with the Town Clerk. The technical maps, he said, would be ready on Friday. Mr. Blatchley read the letter written by Mr. Rowell to Mr. Hatheway regarding the modification of the sewer line from a 15" line to an 8" line, to be installed at the Meadowbrook tract. A copy of the letter is attached to and made a part of these minutes. A discussion followed on the area encompassed by the proposed Sewer & Water Districts and the future development plans of an adjoining six acre plot of land owned by the developers and included in the proposed water & sewer districts. Y. 15 Terrace Road Our File 022 Cortland, New York 13045 Gentlemen: We have had numerous discussions with Mr. Gorman relating to development of .the referenced tract. As a result of some of these discussions, part of the properties within -the tract have been annexed to the Village'of Homer, New York. The part of the development that is intended to,remain within the Town of Cortlandville is shown on a plan, entitled "Final, Meadowbrook, Part of Farm Lot 54, Town of Cortlandville, Cortland County, New York, dated May 3, 1974", as prepared by Alfred N. 2anuzi, Jr.,'Licensed Surveyor, Syracuse, New York. Copies of the plan on cloth background have been submitted to the Board for suitable action. The referenced properties include 34 single-family lots plus another section presently not desig- nated for development. Said plans also show the proposed con- struction of an 8-inch water main, 15-inch sanitary sewer, together with some 8-inch sanitary sewers and appropriate storm drainage system. The 15-inch sanitary sewer was requested by Stearns & Wheler, as Town Engineer for the Town, as an effort to serve the drainage area. The developer has now requested that the 15-inch sanitary sewer be modified to read "8-inch sewer" and so desig- nated on the maps now on file with the Town. There has been some discussion regarding this matter as it relates to the cost Of providing a sewer in excess of the minimum 8-inch sewer required by the State and County Health Departments. It was originally intended that others might help in the cost of installing the 15-inch sewer but we know of no way to provide this money unless a substantial increase is made in the proposed sanitary sewer district. '23 , :1975 Page :�2= in cost -between the'8-inch and15-inch sewers.- The developer has requested permission to install 8-inch sewers and I believe it is the only reasonable thing to expect from him. The drainage system was given consideration by Stearns & Wheler, as Town'Engineers, at the time the plans were originally submitted. We have no reason to feel the plans submitted are not completely in agreement with that which was negotiated at the time of the original submittal. We have not reviewed the lot size in detail but we believe that the original submittal was adequately reviewed by the Plan- ning Board and any and all modifications required were properly taken care of. If this is not the case, I am sure the Planning Board is aware of the details involved and if any variances are needed that they will be granted for the plans submitted. On the basis of the lot lay -out shown on the map and indi- cated herein, we believe the Planning Board should proceed with the approval of the documents as submitted so that the developer may proceed with construction without further delay. The County Health Department will be reviewing the design of utilities in their normal manner and will request any changes in the utilities that they feel are necessary. This, however, will not be reviewed by the County Health Department until the Planning Board has approved of the lay -out of streets and lots. if there is anything further we can do to assist the Plan- ning Board please do not hesitate to call us so that we may move ahead with the details of the development.
