The second regular Town Board meeting of the month was held at the
Town Hall, 15 Terrace Rd., with Supervisor, Robert P. Blatchley presiding.
Other Board members present were: Justices, Donald Eaton & Ronald Fish,
and Councilman, Ray Miller. Councilman, Sherman Griswold was absent.
Others present were: Town Attorney, John Gardner; Town Engineer, William
Rowell; Town Clerk, Christine Canestaro; Deputy Town Clerk, Theresa Fortin;
Highway Supt., Louis Wagner; Water & Sewer Dept. Supt., Fred Walker; Zoning
Enforcement Officer, Don Fowler; Bookkeeper to the Supervisor, Re'nee
Bilodeau; Legislators, Delmar Palm & Henry Wadsworth; new$reporter, Skip
Chapman; Mr. Francis Gorman and his attorney, J. Fitzgerald; Bell Dr.
residents and their attorney, George Yeager; Mr. & Mrs. Ray Ingraham;
and several residents of the town.
The meeting was called to order by Supervisor Blatchley and the pledge
of allegience was given by all in attendance.
The Town Clerk read the minutes of the last meeting. There were no
additons or corrections. Upon motion of Councilman Miller, seconded by
Justice Eaton, all voting aye, the minutes were approved as read.
At 8:00 P.M., Attorney Gardner asked if anyone present had a bid on
the construction of the 12" well to present. There were none. Acceptance
of bids was thereupon declared closed.
The Town Clerk read a petition, signed by 50 residents of Bell Dr.,
in the matter of the annexation of Certain lands in the Town of Cortlandville
to the Village of Homer. A copy of this petition is attached to and made a
part of these minutes.
Attorney Gardner advised that the Village of Homer had enacted a local
law on the annexation and papers had been filed with the Secretary of State.
Attorney Gardner reported he had talked with Attorney Fitzgerald who told
him, if he were given another week, he could come up with a solution to the
problem which he believes would be satisfactory to the people on Bell Dr. and
asked him to �,sk the Town Board to table this matter for another week.
Attorney Gardner advised that he had been apprised of the solution but could
not disclose what it was at this time. However he feels it would be a
satisfactory solution to the problem.
Attorney Fitzgerald, personnaly confirmed that it would be advisable to
accept the postponement so that a "viable compromise can be worked out to the
best interest of all parties concerned".

Attorney Yeager, representing the residents of Bell Dr. stated that he and
the residents of Bell Dr. were unaware of any "compromise" and had.come fully
expecting to resolve the matter this evening. "However," he said, "in their
best interest, I do not feel it would be satisfactory to them if this were
pushed through, perhaps prematurely, tonite and in the interest of working
out a viable solution, I would think that it would be to their best interest
if Mr. Fitzgerald were allowed to contact the residents of Bell Dr., through
whatever orginazation or committee they might wish- and to that end, I would
not oppose a tabling of this matter for a period of one week". He also stated
that"if nothing is resolved, to protect the interests of the residents on Bell
Dr., he would ask the Town Board to put this matter on the agenda in sufficient
time for the Board to act and also to give the residents time to go to the Village
Board to ask them to act upon the matter also, since it is a matter between the •
two municipalities.'
RESOLUTION #74: Announcement of a Special Town Board Meeting 5/28/75
Re: Bell Dr. Residents and Annexation to Village of Homer
Upon motion of Councilman Miller, seconded by Justice Eaton, all voting
aye, the following resolution was adopted:
RESOLVED,That the Town Board will hold a special meeting 5/28/75 at 7:30 P.M.
to resolve the matter of the annexation of the Gorman Property and to act
upon the petition presented by the residents of Bell Dr.

As you know, I've been thinking of retiring as Town Highway Superintendent
for several months. Following a recent medical examination, my Doctor
has recommended that I resign as soon as convenient with all parties
concerned. Therefore, I plan to resign as Town Highway Superintendent
as of June 30, 1975-
At this time, I wish to thank all Town Board members; Town Clerk,
Chris Canestaro; a special thanks to Rudy Krauklis who has been a
tremendous help to me; and others who have been so cooperative and
helpful. After nearly six years on the job, it is not easy to take
this step but for my own health, I feel I must.

RESOLUTION #75: ACCEPTANCE OF RESIGNATION OF LOUIS WAGNER, TOWN HIGHWAY SUPT.
Upon motion of Councilman Miller, seconded by Justice Eaton, all voting
aye and adopted.
BE IT RESOLVED, That the resignation of Highway Supt., Louis Wagner be,
and it hereby is, accepted with regret and his letter of resignation be
received and filed.

Upon motion of Justice Fish, seconded by Councilman Miller, all voting
aye, the bids were ordered received and filed.
Justice Eaton reported for the month of April he had completed 332 cases,
turned over $5,007.50 in fines and forfeitures to the State Comptroller and is
holding $4,080.00 in pending cases.
Louis Wagner reported that Bowling Green would be paved in approximately
® two to three weeks; Lamont Cr. Basketball Court had been completed; and
recommended that the Town advertise for bids on a new cinder and sand spreader.
RESOLUTION #76: AUTHORIZATION TO SOLICIT BIDS FOR A NEW CINDER AND SAND SPREADER
Upon motion of Justice Eaton, seconded by Councilman Miller, all voting aye,
the following resolution was adopted:
RESOLVED, That the Town Clerk be, and she hereby is, authorized and directed
to advertise publicly for sealed bids for the furnishing and delivery of one
new and unused cinder and sand spreader per the specifications set forth in
the "Information for Bidders",and be it further
RESOLVED, That the bids received will be opened at 8:00 P.M., at the Town
Hall, 15 Terrace Rd., Cortlandville, N.Y. on June 4, 1975.
Mr. Wagner recommended that the Town Board give some thought to the
purchasing of a pick-up truck for the new highway Supt., as he had been using
his own truck for Town purposes.

RESOLUTION #77: AUTHORIZATION FOR HIGHWAY SUPT. TO DRAW UP SPECIFICATIONS
FOR A NEW PICK-UP TRUCK
Upon motion of Councilman Miller, seconded by Justice Eaton, all voting
aye and adopted.
RESOLVED, That the Highway Supt., Louis Wagner, be, and he hereby is,
authorized to draw up specifications for a new pick-up truck to be
purchased for the use of the Highway Superintendent.
Louis Wagner reported he had talked with several persons whom he thought
might be interested in the highway superintendent job and the one he thought
most qualified and most willing to take the job and its responsibilities is
Carl Eaton and recommended that the Board appoint him to the position.
Justice Fish stated he wished an opportunity to talk with Carl Eaton
before an appointment was made. After some discussion, the following resolution
was adopted.
RESOLUTION #78: ANNOUNCEMENT OF SPECIAL TOWN BOARD MEETING 5/23/75
FOR THE PURPOSE OF APPOINTING A NEW HIGHWAY SUPERINTENDENT
Upon motion of Justice Eaton, seconded by Councilman, Miller, all voting
aye and adopted.
RESOLVED, That the Town Board will hold a special meeting on Friday, 5/23/75
at 1:00 P.M. for the purpose of making an appointment to the Highway
Superintendent Post being vac#ed_ by the resignation of Louis J. Wagner.
Councilman Miller reported on his investigation of prices for a two-way
radio for the Water & Sewer Dept. Estimates were as follows:

Zoning Enforcement Officer, Don Fowler reported that the number of
building permits issued is increasing. "Good results, he said, "were being
realized from junk car removal in problem areas of the Town." He also
reported he had been attending Planning Board and Zoning Board of Appeals
meetings, as well as Town Board meetings.
Supervisor Blatchley reported he had received a phone call from Phil
Rosen who told him that all but a few cars had been removed from the property
of Emery Knight.
Justice Eaton cautioned that the,Town Zoning Ordinance only permitstwo
unlicensed, un-inspected, motor vehicles on a property and asked who had
given Mr. Knight permission to keep the cars. The Zoning Officer said he
had not approved anythingthat was not in the ordinance and that he would
® check on the matter.
Supervisor Blatchley reported he had received two letters from Mr.
Gorman, one requesting the formation of a Water District on the Meadowbrook
Tract and another requesting the formation of a Sewer District on the Meadowbrook
tract. Attorney Gardner advised that a formal petition for the formation of
these districts would be forthcoming.
Supervisor Blatchley read a letter he had received from Mr. Hennessy in
reply to his letter of 14/29/75 to Commissioner Schuler regarding the Contento
junk yard site. Mr. Hennessy advised him that the State could not take any
action. The land is zoned "Industrial" and he suggested the imposing of a.
local ordinance to clear it up.
Upon motion of Justice Eaton, seconded by Councilman Miller, all voting aye,
the letter was ordered received and filed.
Supervisor Blatchley reported he had received a letter from Legislator,
Delmar Palm regarding a drainage situation on Louise Dr.. Supervisor Blatchley
advised Mr. Palm that he and Highway Supt., Louis Wagner, had looked over the
problem site and will try to have some answers for him soon.
Upon motion of Councilman Miller, seconded by Justice Eaton, all voting aye,
the letter was ordered received and filed.
Supervisor Blatchley read a copy of a letter from James Feuss to Mr. Larry
Gross regarding Mr. B. Cornelius-Septage Disposal site, Rte 13, Town of
Cortlandville. The letter is attached to and made a part of these minutes.
William Rowell stated he was a little familiar with the program but that it
seemed odd to him the Town was a third party to the action and for the County
to accept a disposal site within. the Town of Cortlandville for raw materials that
originate outside the County is a bit unusual. He suggested the Town be on
record as not being in favor of it.
RESOLUTION #80: DIRECTING ATTORNEY JOHN GARDNER TO WRITE LETTER TO JAMES FEUSS
RE: SEPTAGE DISPOSAL SITE
Upon motion of Justice Eaton, seconded by Justice Fish all voting aye and
adopted.
RESOLVED, That Town Attorney, John Gardner be, and he hereby is, directed
to write a letter to James Feuss, Cortland County Health Dept., advising
him that the Town of Cortlandville is not in favor of recieving any offal
from any other county or any other township being disposed of in our town.
Supervisor Blatchley read a letter he received from R. Lewis, District
Manager, Suburban Propane, Rte. 11 South, Cortland, N.Y. complaining that
adequate supplies of water are not near enough to their plant for use in case
of emergency.
Supervisor Blatchley said he had a few verbal requests for water for this
area in the past two months.
Justice Fish stated the Board could not take action unles residents of the
area petitioned the Town Board for water service.
Wm. Rowell stated that if there is a sincere effort for the people in that
area to have some sort of water system, there are three possibilities
1. Install a minimum pneumatic type operation which would provide
a�pressure only for residential use. �i'
2. Provide a Municipal Well and storage tank -i
3. Purchase water from the city of Cortland.
Motion was made by Justice Eaton, seconded by Justice Fish, that the letter
be received and filed. All voted aye. Motion carried.

Supervisor Blatchley introduced Mr. Hinkle and Mr. Kessler of
Middle Dept. Inspection Agency, who requested an audiance with the Board.
Mr. Hinkle stated his purpose was to make a formal introduction to the
Town Board that his agency is an acredited electrical inspection agency and
to make a request to be recognized in the Town of Cortlandville'as a representative
of the Town, to do the work of the town and residents under the town's
jurisdiction. He made reference to Sections 3 and 5 of the recently adopted
Electric Code of the Town of Cortlandville and asked that the Middle
Inspection Co. also be designated as an inspection agency for the Town.
Mr. Kessler, Regional Supervisor for the agency stated he felt their name
should be added to the Electrical Code so that people would have a choice
of who did.their electrical inspection work.
Supervisor Blatchley advised the Board that he had signed and sent
back 5 copies of a work sheet and agreement between the Town and the State 0
of New York regarding 281 & McLean Rd. improvements. He asked Mr. Rowell
to elaborate on negotiations that should be made regarding payment for work
that will be done.
Mr. Rowell stated that he understood the state would be letting work
out to contractors and that it would be the contractors responsibility for
adjustment of the valve boxes and other utilities that may be necessary to
meet the desired grade. From a previous investigation, he had determined
that some of the water lines would be under the paved area when the improvements
are made. If the water lines are to be relocated, negotiations should be
undertaken to determine who is to stand the expense. He advised there are
provisions in the law whereby the state can reimburse the Town for relocating
utilities. If negotiations are worked out that way, Mr. Rowell recommended
that the lines be.relocated, at state expense and that the state be alerted
to this fact.
RESOLUTION #81: AUTHORIZATION FOR WILLIAM ROWELL TO NEGOTIATE WITH THE DEPT.
OF TRANSPORTATION REGARDING THE RELOCATION OF WATER LINES.
Upon motion of Justice Eaton, seconded by Councilman Miller, all voting
aye and adopted:
RESOLVED, That Town Engineer, William Rowell be, and he hereby is,
directed to contact and negotiate with the Dept. of Transportation
relative to the relocation of underground water lines at the intersection
of route 281 and McLean Road, prior to the time the intersection is
rebuilt, and
BE IT FURTHER RESOLVED, That he report his negotiations back to the Bowrd.
Supervisor Blatchley reported he had a request for a street light on
McLean Rd. from the Church of the Nazarene. Justice Fish said he had
investigated the area and advised that a street light be installed there, as
it would also help other residents in the immediate area.
RESOLUTION #82: AUTHORIZATION TO INSTALL STREET LIGHTS ON THE MCLEAN RD.
Upon motion of Justice Eaton, seconded by Councilman Miller, all voting
aye and adopted.
RESOLVED, THAT one 175 Watt Mercury light be installed on the McLean Rd.
on the pole in front of the Church of the Nazarene. •

be, and it hereby is, accepted with regrets and her letter of

BE IT FURTHER RESOLVED, That the Supervisor be, and he hereby is,
directed to write a letter extending these regrets and thanking
her for her years of service to the Town of Cortlandville.
Supervisor Blatchley recommended the appointment of Mrs. Ray Ingraham
to the post of Town Historian, stating she is doing an excellent job as
Co -Chairman of the Town°s Bicentennial Committee.
RESOLUTION #84: APPOINTMENT OF MRS. RAY INGRAHAM AS TOWN HISTORIAN
® Upon motion of Justice Eaton, seconded by Justice Fish, all voting aye
and adopted.
BE IT RESOLVED,That Mrs. Ray Ingraham be,and she hereby is, appointed
Town Historian for the Town of Cortlandville, commencing immediately,
to serve out the remainihg'term of Annabelle Alexander.
Mrs. Ingraham accepted the position and stated she would pursue and
record the history of the Town to the best of her ability. One of her
first projects,she said, would be to make an industrial survey, as one has
never been done for the Town.
Mr. David Olp again asked the Town to undertake a study of water and
sewage service to his proposed project.
Supervisor Blatchley asked Mr. Rowell for his recommendations. Mr.
Rowell explained that if public water and sewer facilities were to be
furnished to the privately owned homes in the proposed project, the Town
whould be obligated to take over the sewers from that area to the pump
station and the operation and detail of the pump station. Before he could
recommend taking over those facilities, he would want to investigate to make
sure that the facilities were in good condition and in proper working order.
If the privately owned homes were not to be built, then there would be no
need to take over the now, privately owned facilities. Mr. Rowell
recommended that if the privately owned homes are to be built, that the
Town Engineer undertake the investigation of the sewer facilities, as he would
be working in the best interest of the Town. The investigation should be paid
by the Town, with the stipulation that monies paid out be reimbursed by the
developer. Another possibility, he said, was to have the developer have his
own engineer make the investigation and submit certified test results. The
Town Engineer would make a few spot inspections at that time as well. However,
he did not feel this was the best solution.
The consensus of the Board was that they would have the Town Engineer do
the ins>esti aaton w th the expense paid by the developer and that a contract should
be drawn up setting forth all conditions under whlch the facilities would be
taken over.
Several residents of Allen Dr. were in attendance and registered their
concern over the type of housing to be constructed and the manner in which the
additional traffic would be taken care of. Mr. Olp assured them that the homes
would be quality homes and that the single family houses would have garages.
He explained in detail the provisions made for handling the traffic.
Supervisor Blatchley reported that the accident which demolished the
jungle gym at the Blodgett Mills playground was being investigated by
Winchell Insurance Co.
Supervisor Blatchley advised he is arranging to make application for
matching state funds for recreation purposes for Lamont Cr. and Blodgett Mills
playgrounds.
Supervisor Blatchley advised that he had been contacted by Mr. Tucci of
the Dept. of Transpot-tation, who requested that the Town adopt a resolution
requesting a 4.0 MPH speed limit on Starr Rd. Extension.
RESOLUTION #85: REQUEST FOR 40MPH SPEED LIMIT ON STARR RD. EXTENSION

BE IT RESOLVED, That the Town Board of the Town of Cortlandville does
hereby request the Dept. of Transportation, pursuant to Sec. 1622.1 of
the Vehicle & Traffic Law, to establish a lower maximum speed at which
vehicles may proceed on Starr Rd. Extension, a Town Highway, between
Page Green Rd. and N.Y.S. 90.
Supervisor Blatchley suggested that, in view of the financial condition
of the Town, that the parking lot scheduled to be paved this year be postponed.
The matter was tabled until the next meeting of the Town Board.
Justice Eaton asked Attorney Gardner what should be done with the
check the Town Clerk had received 3/12/75 from Robert Bean for renewal of
his Trailer Park permit, which permit had not been granted because of the
lack of a Board of Health approval. Attorney Gardner advised that the Clerk
should continue to hold the check.
Justice Eaton apprised the Board that Robert Stiles had requested his
certificate of deposits being held by the Town Clerk, so that he could take
it to his bank to be renewed and that the Town Clerk had refused to have him
take it out. He asked attorney Gardner if the certificate should have been
given to Mr. Stiles. Attorney Gardner replied that it should be renewed by
a Town Officer and that Mr. Stiles should be directed to see him regarding
the certificate.
There being no further business, upon motion of Justice Fish, seconded
by Councilman Miller, all voting aye, the meeting was adjourned at 10:15 P.M.

A special Town Board meeting called by Supervisor Blatchley on 5121175
was held at the Town Hall, 15 Terrace Rd. with Supervisor Robert P. Blatchley
presiding. The purpose of the meeting was to appoint a Highway Superintendent
to replace Louis Wagner, whose resignation was accepted by the Town Board 5/21/75.
Other Board members present were: Justice, Donald Eaton and Councilman, Sherman
Griswold. Justice Fish and Councilman, Miller -were absent.
After discussion, the following resolution was adopted:
RESOLUTION #86: APPOINTMENT OF CARL S. EATON AS HIGHWAY SUPERINTENDENT
Upon motion of Councilman, Sherman Griswold, seconded by Justice, Donald
Eaton and votes poled as follows: Councilman Griswold, aye; Justice Eaton, aye;
Supervisor Blatchley, aye, the following resolution was unanimously adopted:
BE IT RESOLVED, That Carl S. Eaton be, and he hereby is, appointed
Highway Superintendent for the Town of Cortlandville, commencing June 1, 1975,
to fill out the term of Louis J. Wagner, and

BE IT FURTHER RESOLVED, That Carl S. Eaton be paid an annual salary of
$11,000.00 0
There being no further business, motion was made by Councilman Griswold,
seconded by Justice Eaton to adjourn the meeting. All voted aye. The meeting
was adjourned at 1:50 p.m.

Re: Mr. B. Cornelius - Septage Disposal Site - Route 13 - Town of Cortlandville
I inspected the site with Mr. Cornelius on 9 May 1975. The site is in
the Cortlandville-Cortland recharge area just behind the gravel pits. Advised
Mr. Cornelius that pits would have to be lined with impervious membrane; that
the site would have to be properly fenced; that a posite program of preventing
mosquito breeding would have to be conducted, and that the site would have to
be properly closed when the new sewage treatment plant is constrercted' and ready
to treat septage.
He was further advised that wastes from Wallace Steel and Ithaca Gun
could not be dumped at the site or along the roads. Mr. Cornelius agreed that
he would comply with these requests. He indicated he understood our reasons
for these restrictions and wanted to avoid a legal confrontation.
We believe our position is technically sound and could be supported in the
courts. We are suggesting that when the town zoning ordinance is amended that
septage disposal be a matter of concern.

TO: THE TOWN BOARD
The petition of the following residents of Bell Drive who have
hereinafter affixed their names, respectfully shows:
.1. The Town Board of the Town of Cortlandville by certain actio
taken on April 1_6, 1975, approved the annexation of certain.lands of the
Town of Cortlandville to the Village of Homer.
2. That a portion of the annexed territory is a strip of land
fifty (50) feet in width and approximately two hundred eighty (2.80) feat
in length running from a point where it abuts the turn -around at the end
of Bell Drive, northeasterly to the remaining annexed lands.
3. That"said strip of land of the annexed territory is surround q(I
on three (3) sides thereof by lands remaining in the Town of Cortlandvi].1_( .
4. That jurisdiction of said strip of land would be in the Vill
age of Homer.
S. That it appears quite probable that said strip of land at ,o
future date, if not immediately, will be opened to traffic, which in turn
would result in increased traffic on Bell Drive.
6. On October 161, 197U, the Town of.Cortlandville officially
designated Bell Drive a dead-end street.
7. That for the reasons set forth in a certain petition from
residents of Bell Drive, filed with the Town of Cortlandville on OetobPr
16, 1974, certain undesireable effects would result from the opening of
Bell Drive to increased traffic, and they are as follows:
a. Bell Drive would be opened to increased traffic of an
undeterminate amount.
b. Such increase in traffic would pose a real threat to the
welfare of the children who reside on Bell Drive, not only in a general
nature but specifically because the children walk to the westerly terminu
of Bell_ Drive that they may be picked up by school buses, and when they
are discharged .from such buses they must naturally walk easterly down

c. Such increase in traffic would necessitate the paving of,
Bell Drive be done to a greater'extent and for more money to handle a
vastly increased traffic load, being not only a greater financial. burden
to the residents of Bell. Drive but also to the Town of Cortlandville.
d. The characteristics of the neighborhood of Bell_ Drive
would be forever 'altered fr. om , its present enjoyable residential nature,
and the residents of Bell_ Drive would be forever frustrated from their
original intent in locating on Bell. Drive.
8. That in order to insure complete determination of the furturr
of Bell Drive as a dead-end street, said strip of land should remain a
portion of the Town of Cortlandville.
WHEREFORE, your petitioners respectfully request that the Toion
Board of the Town of Cortlandville amend its resolution adopted in aecor I
dance with Article 17 of the General. Municipal Law, to exclude slid fifty
(50) feet by approximately -two hundred eighty (280) feet strip of Land,
and to tal<e whatever additional action may be necessary to ensure the
deletion of said strip of land from the lands to be annexed to the Ville*
of Homer.

Dear Chris:
We have reviewed the six bids that were submitted
on May 21 for the referenced project and find that mathe-
matically all of the documents are true and accurate. A
copy of the Canvass of Bids is enclosed, herewith, for your
review and records. We have forwarded copies of the Canvass
of Bids to each of the respective bidders to advise them
of the bidding details.
We propose to make our recommendation to the Town
so that a tentative award can be made at the time of the
next official Board meeting. We understand, however, that
there will be no actual signing of the contract documents
until we have approval for the well development from the
Department of Environmental Conservation in Albany.
