and several residents of the Town.
At 7:30, a public hearing was held on the matter of the
adoption of a resolution raising the income ceiling on aged
tax exemption from $4,000 to $5,000. All interested persons
were heard. The transcript of this hearing is on file in the
Town Clerk's offce.
The regular meeting of the Town Board was called to order
by Supervisor,Robert Blatchley at 7:40 P.M. with the pledge of
allegience given by all in attendance.
The Town Clerk read the minutes of the last meeting. Upon
motion of Justice Eaton, seconded by Justice Fish, all voting aye,
the minutes were approved as read.
Justice Eaton stated he had read the minutes of the Planning
Board of 2/24/75 which also included a meeting of the Task Force
Committee. He wished to have entered into the record that he
felt those minutes were incomplete as they did not include the
recommendation of the Task Force Committee to revise the 1968
Zoning Ordinance and to update the Master Plan, as reported both
by Justice Fish and Supervisor Blatchley per minutes of Town
Board Meeting 3/5/75 as read by Town Clerk tonight.
Fred Walker reported the Health Dept. had approved the
tree plantings and that he had ordered the trees.
Supervisor Blatchley advised that the public meeting he
had scheduled for 3/.,7/75 had been cancelled and not rescheduled.
The Town Clerk read a Notice of Order received from the
New York State Dept. of Transportation regarding weight limits
set for vehicles using Rte. 90 between Rte. 11 and the Hamlet of
Virgil. Upon motion of Councilman Griswold, seconded by Justice
Fish, all voting aye, the notice was ordered received & filed.
The Town Clerk reported she had ahapplication for the
renewal of a house trailer permit from Donald Gage, Pg. Green Rd.
She reported that the Zoning Officer -had investigated the site
and had approved the renewal request.
RESOLUTION #40: AUTHORIZATION TO ISSUE'HOUSE TRAILER RENEWAL
PERMIT TO DONALD GAGE
Upon motion of Justice Fish, seconded by Councilman, Griswold,
all voting aye, the following resolution was adopted:
RESOLVED that the Town Clerk be, and she hereby is, authorized
to issue a house trailer renewal permit to Donald Gage, Page
Green Rd., upon payment of the proper fee.
The Town Clerk reported that Mr. Clarence Homer wished a
refund of the application fee for -water service to 8 Louise St.
This application was paid for on 5/15/73 and installation of
service has never been made, nor meter picked up. (Verified by
Fred Walker, Supt. S & W) The lot has since been sold by Mr.
Homer.

RESOLUTION #41; AUTHORIZATION TO REFUND WATER SERVICE
- APPLICATION FEE TO MR. CLARENCE HOMER
Upon motion of Justice, Fish, seconded by Justice, Eaton,
all voting aye, the following resolution was adopted:
RESOLVED that the Supervisor be, and he hereby is,
authorized to refund $125.00 to Clarence Homer for
the application fee for water service to 8 Louise St,
which was paid to the Town of Cortlandville Water Dist.#1.
on 5/15/73 with Mr. Homer's check #937; and water service
never installed.
Assessor, Robert Wells requested peiinission to attend a •
meeting in Albany for the purpose of securing survey information
and to attend a training session in Syracuse on the processing
of applications and other information regarding agriculture
value assessments.
RESOLUTION #42s AUTHORIZATION GIVEN ROBERT WELLS TO ATTEND
MEETING IN ALBANY
Upon motion of Councilman Griswold, seconded by Justice
Fish, all voting aye, the following resolution was adopted:
RESOLVED that Assessor, Robert Wells be, and he hereby is,
authorized to attend a meeting in Albany at the State Board
Office on March 25, 1975 for the purpose of obtaining
information regarding commercial, industrial, and utility
rate survey appraisals; and be it further
RESOLVED that he be reimbursed for all necessary expenses
incurred in connection with same, subject to audit by the
Town Board,
RESOLUTION #43: AUTHORIZATION GIVEN ROBERT WELLS TO ATTEND
TRAINING SESSION IN SYRACUSE
Upon Motion of Justice Eaton, seconded by Justice Fish,
all voting aye, the following resolution was adopted:
RESOLVED that Assessor, Robert Wells be, and he hereby is,
authorized to attend a training session for assessors
being held on April 16, 1975 at the U.S. Dept. of Agriculture
at Syracuse, New York on the processing of applications for
agriculture value assessments;and be it further
RESOLVED that he be reimbursed for all necessary expenses
incurred in connection with same, subject to audit by the
Town Board,
Justice Eaton reported he had completed 270 cases in the
Town Justice Court during February; he had turned over $3,787.00
to the Dept. of Audit & Control for fines and forfeitures collected]
and is holding $3,350.00 in pending cases.
Justice Fish read a memo from Niagara Mohawk Power Corp.
regarding N.Y.State Industrial Code Rule #53 relating to
"Construction, Excavation, & Demolition Operations at or near
underground facilities" which will go into effect 4/1/75•
He asked if the Town of Cortlandville had published its
notice to excavators of the establishment of a list of operators
of underground facilities.
. Supervisor Blatchley replied that he had checked with other
Super visors at the Association of Towns Meeting in N.Y.City and
he said "It -.was strongly -urged by Supervisors in attendance that
enforcement of this code be delayed".
William Rowell advised that maintenance and enforcement
of this code would be very time consuming and that the registry,,:
would have to show the location of all underground facilities.
Justice Fish statedhe felt that the Town of Cortlandville
should publish a news item in the paper, stating the -fact that
the Town of Cortlandville has adopted the State Building Codes

effective as of 4/1/75 and that they will be strictly enforced.
Fred Walker reported he was aware of the defective hydrant
located on Starr Rd. and that he was in the process of adjusting
it. The other two hydrants, reported by Chief Riter, are
privately owned and the owners have been notified of the defect.
Supervisor Blatchley read the following letter of
resignation received from Mr. Harry Thomas, Zoning Officer

Dear Bobs
Reviewing the work load which has accumulated.during
my absence on variation in the Town and Village of Homer,
and with activity already starting in the construction
field, I feel it will become difficult if not impossible
for me to devote, time to the Town.of Cortlandville.
.Therefore, in the best interests of all concerned, I
am tendering my resignation as advisor to the Town Clerk
effective March 31, 1975.

Upon motion of Justice Eaton, seconded by Justice Fish, all
voting aye, the letter was ordered received and filed and
the resignation was accepted with regrets and the'Supervisor
was instructed to write a letter to Mr. Thomas thanking him
for his services.
Supervisor Blatchley read a letter from John Morgan,
Chairman of the Airport Committee, County Legislature regarding
the status of the Master Plan Study for the Cortland County
Airport. A copy of this letter is attached to and made a part
of these minutes. Upon motion of Justice Eaton, seconded by
Justice Fish, all voting aye, the letter was ordered received
and filed.
Legislature, Henry Wadsworth requested financial aid to
repair the fallen tomb stones in the McGraw Cemetery. He said
the cost would be approximately $200.00 for materials and that
the Village of McGraw might be willing to share in the cost.
He had contacted Mr. John Whipple of Capeo, who'said his "Green
Thumb" group would be willing to do the work if materials for
repairs were provided.
Legislature,Shirley Fish suggested that an evaluation of
the actual cost involved be made and that the village of McGraw
be solicited for aid and a report made to the Town Board of
the actual funds needed. Mr. Wadsworth said he would do this
and report back to the Board at the next meeting.
Mrs. Moore of Pleasantview Dr. presented a petition
requesting a study be made by the Town engineer for the purpose
of connecting the homes on Pleasantview Dr. to the proposed
sewer line.
Supervisor Blatchley submitted similar petitions from
residents on the McLean Rd. and Terrace Rd. and also a petition
from property owners on the West Rd. & McLean Rd. requesting an
extension of the Sewer District. Copies of these petitions are
attached to and made a part of these minutes.
Upon,motion of Justice .Fish, seconded by Councilman, Griswold,
the petitions -were ordered received and filed.. Motion carried,
all voted aye.

A motion was made by Jus ice Eaton, seconded by Justice
Fish, all voting aye, that thIminutes of 3/5/75 (pg.147) be
amended by striking out in Resolution #36, item (2) the words
"Municipal Buildings" and substituting the words "Municipal
Fire Station",
Supervisor Blatchley stated that two public hearings
must be held on the application for public funds under
the Community Development Act.
RESOLUTION #44: SETTING DATE FOR PUBLIC HEARING RE:
APPLICATION FOR FUNDING UNDER THE COMMUNITY DEVELOPMENT
ACT OF 1974
Upon motion of Justice Eaton, seconded by Justice Fish,
all voting aye, the following resolution was adopted:
RESOLVED that the Town Board of the Town of Cortlandville
hold a public hearing on Tuesday, April 1, 1975 at 7:00
P.M. on the matter of Funding under the Community
Development Act of 1974; and be it further
RESOLVED that a second public --hearing be held on
Wednesday, April 2, 1975 at 7:30 P.M. on the same matter.
Supervisor Blatchley apprised the Board that Mr. Contento
had offered the Town a five week option, at no cost, for the
purchase of his property. The consensus of the Board was that
a five week option was not sufficient as it would be at least
75 days after application for funds, before the Town would
know if the application had been accepted.
Supervisor Blatchley stated there was a home at 8 Carroll
St. which had been damaged by fire and wished to point out
the weakness in the Town's Ordinance which does not provide
for the,condemnation and cleaning up of delapitated and
unsafe buildings) and he feels the revision of the Ordinance
should cover this area.
RESOLUTION 45: SETTING DATE FOR JOINT PUBLIC HEARING RE:
BY THE VILLAGE OF HOMER
Upon motion of Justice Eaton, seconded by Councilman
Griswold, all voting aye, the following resolution was adopted:
RESOLVED, That a joint hearing will be held by this Town
Board and the Board of Trustees of the Village of Homer,
at the Cortlandville Town Hall, on April 9, 1975, at 7:30
o'clock P.M. upon the petition of Francis L. Gorman, Robert
T. Kelly and Bernard J. Dill for annexation by the Village
of Homer, of certain territory adjoining said Village and
located in the Town of Cortlandville, and that the Town
Clerk publish the necessary notice of said hearing.
Supervisor Blatchley asked the Board, in view of Mr.
Thomas's resignation, to consider the appointment of a Zoning
Enforcement Officer and Building Inspector at the next meeting
of the Town Board.
RESOLUTION #46: SETTING INCOME LIMIT ON AGED TAX EXEMPTION

the Town of Cortlandville, at the Town Hall, 3577 Terrace
Road, in the Town of Cortlandville, on March 19, 1975, at
7:30 o'clock p.m. in the matter of the adoption of a
Resolution exempting real property from taxation pursuant
to the provisions of Section 467 of the Real Property Tax Law:
Upon motion of Councilman, Sherman Griswold, seconded by
Justice, Donald Eaton, and carried unanimously, be it

RESOLVED, That the Assessor of the Town of Cortlandville
shall exempt from taxation real property owned by persons
sixty-five (65) years of age or over, Whose in om r
combined income for the income tax period immediately

preceding the date of application does not exceed
Five Thousand Dollars ($5,000.00), to the extent of
fifty percentum (50%) of the assessed valuation thereof,
upon all future Assessment Rolls of the Town of
Cortlandville pursuant to the provisions of Section 467
of the Real Property Tax Law.
A general discussion was had between Chief Riter and
the Town Board on the possible extension of the Fire
Protection District boundaries covered by the Homer Fire Dept.
He said he had discussed this with the McGraw Fire Chief and
they were in complete agreement that this would give better
protection to the area involved.
Supervisor Blatchley appointed Councilman, Sherman
Griswold and Justice, Donald Eaton as a special sub -committee
to negotiate for the purchase of municipal property for the
Town of Cortlandville.
There being no further business, upon motion of Justice
Fish, seconded by Justice Eaton, all voting aye, the meeting

A special meeting of the Town Board was called by
Supervisor Blatchley on March 26, 1975 at 4:00 p.m. at the written
request of Justice, Donald Eaton and Councilman, Ray Miller for
the purpose of discussing the appointment of a Zoning Enforcement
Officer and to discuss with Attorney Edward Purser the claim of
Architect, Karl H. Wendt.
After some discussion and reviewing of the pros
and cons,
it was decided to settle the claim of Karl H. Wendt without

going to arbitration.
