Town of Cortlandville was held at the Town Hall, 15 Terrace Rd. with Supervisor Robert P. Bl.atchley presiding. Other Board members present were: Justices, Ronald Fish & Donald Eaton; and Coucilmen Sherman Griswold & Ray Miller. Others present were: Town Attorney, John Gardner; Town Engineer, William Rowell; Town Clerk, Christine Canestaro; Town Assessor, Robert Wells; Supt.T own Water & Sewer Dept., Fred Walker; Legislator, Shirley Fish; newspaper reporter, Skip Chapman and several residents of the town. The Town Clerk read the minutes of the last meeting. there were no corrections or. additions. Upon motion of Coucilman Miller, seconded by Justice Eaton, all voting aye, the minutes were approved as read. Supervisor Blatchley reported he had written to Mr. Porter regarding the parking in fire lanes at the Groton Ave. Shopping Plazza and has not, as yet, received a reply from him. The Town Clerk presented an application for a house trailer permit received from Gary Sweeney. She reported that the Health department had given their approval and that Mr. Thomas, Zoning Officer had investigated the site.and that it was in compliance with the Town of Cortlandville Trailer Ordinance. RESOLUTION #27: AUTHORIZATION TO ISSUE HOUSE TRAILER PERMIT TO GARY SWEENEY Upon motion of Justice Eaton, seconded by Councilman Griswold, all voting aye, the following; resolution was adopted: BE IT RESOLVED, THat the Town Clerk be, and she hereby is, authorized to issue a house trailer permit to.Gary Sweeney for a period of six months commencing February 6, 1975 and expiring August 6,. 1975. Said trailer to be located on Sweeney Rd. and to be occupied by Gary Sweeney and his wife. The Town Clerk presented an application for a Trailer Park renewal permit received from Robert Bean for his C & H Trailer Park. She reported that the application was accompanied by the Board of Health Permit and the proper fee of $50.00. RESOLUTION 28:. AUTHORIZATION TO ISSUE TRAILER PARK RENEWAL, PERMIT FOR C & H TRAILER PARK Upon motion of Coucilman Miller, seconded by Councilman Griswold, all voting aye, the following resolution was adopted: BE IT RESOLVED, That the Town Clerk be, and she hereby is, authorized to issue a Trailer Park renewal permit for the year 1_975 to Robert Bean for the operation of his C & H Trailer park located on Kingsley Ave. Said Trailer Park now accomodates 10 house trailers. The Town Clerk reported she had also received an application from Robert Bean for a renewal permit on his Penguin Starr Trailer Park. However, the Board of Health permit had not been submitted with the application. Mrs. Canestaro read a copy of a letter by Mr. Feuss of the Cortland County Health Dept. to Mr. Bean, asking him for more information regarding sewers and water ldca'tions in Penguin Park. Upon motion of Justice Eaton, seconded by Coucilman Miller, all voting aye, the letter was ordered received and filed. Renewal permit for this Park cannot be granted until the Board of Health permit is received by the Town Clerk. Justice Eaton reported he had completed 220 cases during the month of January 1975 and that $2,379.00 in fines and forfeitures had been turned over to the State Comptrollers with $3,615.00 being held in pending cases. • 139 Wednesday, February 19, 1975 Pg.2 Supervisor Blatchley reported that some $18,000.00 had been returned to the Town by the State from monies received from the Town Justice Court, Supervisor Blatchley reported he had continued with plans to locate a site for the Cortlandville Fire Co. While attending the Association of Towns meeting in New York City, he sought the advise of the Dept. of Audit & Control on how to finance a fire department for the Town. He reported he had attended all sessions held for Supervisors which, he said, were mostly devoted to fiscal problems of the towns. In view of what he learned at these meetings, he anticipated more town monies will be used to purchase certificates of deposits so that interest can be realized on idle money. He has talked with several bankers on the subject and finds that he can obtain short term certificates. Mr. Blatchley said he had contacted Dick Bassler'' of the State Highway Dept, regarding a request for signs for "Polkville" which he had received and was told that the order would be processed and that installation would probably be made within two months. Mr. Bonner, a resident of the Penguin Starr Trailer Park, asked why the Town of Cortlandville was so strict in enforcing the House Trailer Ordinance as to lot size and location, whereas these same requirements are not being enforced in the Penguin Starr Trailer Park. He said he had observed at least seven violations of the trailer ordinance which had been in violation for the past eleven years and not enforced. Mr. Bonner advised that there would be a meeting of Mobile Home owners at the Town Hall on March 7, 1975 at which time a mobile home owners "Bill of Rights" would be discussed. Justice Eaton reported that Fred Walker had purchased a Winco generator for the Water & Sewer Dept. William Rowell reported he had investigated the possibility of providing sanitary sewers on Pleasantview Dr. & Munson Ave., suitable for connection to the proposed sewer which would run easterly on the McLean Rd. His investigation included the running of the server line through the back yards as had been requested bysane -of_ the Pleasantview Dr. residents. He said it could be done however he wished to warn that there would be considerable damage to lawns, trees and fences, possibly beyond repair. He also warned that the sewer line must be made accessible at all times for repairs. There would be an appoximate savings in cost of $12,000.00 if the line was constructed along the back lines. It would also involve a different pumping station than presented in his report -plan 2. Cost estimates were as follows: Plan 2 as presented in report $170,000 Plan 2, plus service to Pleasantview Dr. (including pump station modification) 240,000 Plan 2, plus service to Pleasantview Dr. & • Munson Ave. 275,000 This would represent an estimated increase in the tax rate of $2.00 -- $3.00 per thousand, if taxed on overall district, which has an assessment of approximately 71 million dollars. Attorney Gardner advised that the first thing that must be done is for PTM and others in that area to petition the Town Board to enlarge the server district, and that A petition of 51% of the residents in the existing district who will be effected by the proposed sewer installation is also required. Supervisor Blatchley is to contact Mr. Verrando of PTM and advise him what must be done. Mr. & Mrs. Leon Moore will contact the residents on Pleasantview Dr., Munson Ave. & Terrace Rd., to see how many wish to connect to the proposed server line. Wednesday, February 19, 1975 Pg.3 Mrs. Brooks of Pleasantview Dr. complained of water collecting in her driveway. Supervisor Blatchley said he had talked with Mr. Ryerson,regarding this problem, last spring and would talk to him again, as he feels -the solution to the problem would be to install a larger catch basin at -the end of Mr. Ryersons property line. Mr. Bogart of Terrace road complained that -the heavy tractor trailer traffic has torn up the road in front of his house and wanted to know what could be done about it. Justice Fish suggested that perhaps the road should be posted with weight limit signs. William Rowell presented each Board member with a copy of report regarding his investigation of the capacities of the present water supply. He reviewed the modifications recommended in the report. Mr. Rowell proposed that "The Town proceed immediately with the development of a 12 inch well in a location so that a second 12 inch well could be installed at a later date". An approximate cost of the well excluding the pump is $20,000. RESOLUTION #29: AUTHORIZATION FOR TOWN ENGINEER TO PREPARE NECESSARY PLANS &. SPECS FOR DEVELOPMENT OF 12" WELL dllUpon motion by Justice Eaton, and seconded by Justice Fish, all voting aye, the Town Engineer is hereby authorized and directed to prepare the necessary plans and specifications for the development of a 12 inch well, as recommended in said report at a cost not -to exceed $20,000.00 to be appropriated from surplus funds of Water District ##1. Mr. Rowell reviewed -the plan he had prepared for servicing J ,the South Cortland area with municipal water. He recommended (i.�'f the installation of a 12 inch line from the end of the existing line at the Cortlandville mall to extend to the easterly side of route 13 to the far side of the Hamlet of South Cortland servicing both sides of route 13. He asked the Town Board to review what he had indicated as an approximate limit for the water district; and if it meets with their general approval and after any further investigations desired by them are completed, a cost estimate and evaluation of effects on property within the area could be made. Mr. Melvin Pierce said he would contact the residents in. that area to determine how many wish to be connected -to a municipal system. Supervisor Blatchley again asked the Town Board to take action_ on.the adoption of building codes. He explained that this was necessary to facilitate application for -the Federal Flood Control program which must be applied for before 8/31/75. Attorney Gardner explained that if -the Town did not make this application, there would be problems created for persons mortgaging homes and property secured by the Federal Government through Veterans Administration Loans, Federal Housing Administration Loans, & Farmers Home Administration Loans. Mortgage money would be unavailable to them under these programs if they did not have flood insurance. Attorney Gardner went on to explain that it was his understanding that the Town Board has to indicate that the flood regulations are going to be controlled by some officer of the Town. He stated he didn't think this would work with our present ordinance and that it would be best to adopt a building code and appoint a building inspector to enforce the flood regulations. Justice Eaton suggested that a committee be appointed to study the State Building Code, make a brief outline of the contents and report back to the board to determine if the code should be adopted or not. 1 • 1 1 Wednesday, February 19, 1975 pg• 4 1 • L7 F] Attorney Gardner called to their attention that the State Building Codes had been adopted by surrounding municipalities including the Village of Homer, The Town of Homer, the Village of McGraw, Groton, Dryden and the City of Cortland. He also advised that an ordinance must be adopted in conjunction with the adoption of the building codes and that a building inspector must be appointed to enforce the ordinance. Supervisor Blatchley appointed Justice Ronald Fish, and Justice Donald Eaton as a committee of -two to review the State Building Codes and directed them to report back to the Board on March 5, 1975 their recommendations. Attorney Gardner also advised the Board that they might wish to study the State Fire Protection Code,prepared by the State Building Council,for possible adoption. All agreed this would be a wise thing to do and Justice Eaton is to send for a copy of this code. Supervisor Blatchley stated he had spoken with Mr. Gorman regarding the possible annexation of part of his Meadowbrook land to the Village of Homer. Mr. Gorman will have his attorney draw up a petition to the Town of Cortlandville and the Village of Homer requesting the annexation. Attorney Gardner explained the proceedures that would take place after the petition is received. There being no further business, upon motion of Councilman Miller, seconded by Justice Eaton, all voting aye, the meeting was adjourned at 9:45 p.m..
