HomeMy WebLinkAbout02-05-1975133 Wednesday, February 5, 1975 Pg.1 The first regular meeting of the month of the Town Board was held at the Town Hall, 15 Terrace Road, with Supervisor, Robert P. Blatchley presiding. Other Board members present were: Justices, Donald Eaton and Ronald Fish and Councilmen, Sherman Griswold and Ray Miller, Others present were John Gardner, Town Attorney; William Rowell, Town Engineer; Christine Canestaro, Town Clerk; Renee Bilodeau, Bookkeeper to the Supervisor; Rudy Kraullis; Fred Walker, Water & Sewer Dept. Supt.; Legislators, Shirley Fish and Delmar Palm; Tony DeSanta, & Mr. & Mrs. Raymond Ingraham of the Cortlandville BiCentennial committee; Chief Riter and members of the Cortlandville Fire Dept., and Skip Chapman, newspaper reporter. The meeting was called to order by Supervisor Blatchley and the pledge of allegience was given by all in attendance. The Town Clerk read the minutes of the last meeting. There were no corrections or additions. Upon motion of Justice Eaton, seconded by Coucilman Miller, all voting aye, the minutes were approved as read. The Town Clerk reported she had sold three building permits during the month of January with a total declared valuation of $22,200.00. The Zoning Board of Appeals was inactive during the month of January and the Planning Board's only action was the recommendation made to the Town Board regarding the Zoning Ordinance, written in the minutes of the meeting of January 22. udy Krauklis reported the financial status of the Town as of 031775 as follows: General Fund Balance $215,553.50 Water Dist. I 101,089.95 Water Dist. 2 1,638.40 Water Dist, 3 3,761.54 Sewer Dist. 1 °' 38,223.58 Highway .Fund 30,829.34 comprised of: Repairs & Improve. $6836.59 Bridges 9:415.53 Machinery 4,433.12 Snow Remov.&Misc, 10,144.10 Mr. Krauklis reported that the Supervisor had invested Town monies in C.D's as follows: General Fund $90,000.00 General Fund - outside 40,000.00 Highway Fund 120,000.00 Supervisor Blatchley read a letter he had received from Legislator, Delmar Palm regarding the fire at the Super Saver at the Groton Ave. shopping plaza and the hazardous condition which exists there due to people parking in the fire lane. Mr. Palm referred to a call he had received from Mr. Thomas Morton who was concerned that had the fire occured during the daytime hours, it could have been a more disastrous situation due to the parking situation. Mr. Palm requested that something be done about this if possible. Upon motion of Coucilman.Miller, seconded by Justice Eaton, all voting aye, the letter was ordered received and filed. Mr.. Palm made a verbal suggestion to the Board, asking that the Board take corrective measures when making revisions and adopting new codes for the Town of Cortlandville. Supervisor Blatchley.reported, in furthering the beautification cause, he had received permission to burn two more delapidated barns and also had received assurance that one of the largest junk car yard problems would be cleaned up. Also, he stated, he would keep a close watch of the dangerous intersection at Starr Rd. & Rte.90. 134 Wednesday, February 5, 1975 Pg.2 He said there had been another accident there on Sunday (2/2) which lie reported to the State Dept. He promised -to pursue the problem until some action is taken by the State. He reported that as a result of an investigation he had made at the Penguin Trailer Park, one lady found out she was on the wrong electric rate charge and would receive a substantial rebate from Niagara Mohawk Power Co. . Tony.DeSanta, Chairman of the Cortlandville BiCentennial committee introduced Mr. & Mrs. Raymond Ingraham, members of his committee. He advised that there would be a meeting of the committee on February 20, which would be open to the public. Mrs. Ingraham explained about the trip that some townspeople would be making to Lexington and Concord, Mass. on Patriots Day and gave a brief description of the celebration which would be taking place there. "This'oshe said, "is part of the Heritage phase of being a Bicentennial Community. Profits realized from this bus excursion would be used for fund raising purposes. Mr. DeSanta stated, the committee plans to have exhibits on the Town Hall lawn this summer, as part of the celebration. Mr. DeSanta requested $200.00 to help finance committee projects for fund raising. RESOLUTION #22: AUTHORIZATION TO APPROPRIATE FUNDS FOR TOWN OF ORTLANDVILLE BICENTENNIAL COMMITTEE Upon motion of Justice Eaton, seconded by Justice Fish, all voting aye, the following resolution was adopted: BE IT RESOLVED, that $200.00 be appropriated from the General Fund Unexpended Balance to be used by the Town of Cortl.andville Bicentennial Committee for use in the Town's patriotic observation of the Bicentennial. Mr. Rowell reported he and Fred Walker had inspected the South Cortland Water system and he is deeply concerned for the safe use of the water supply. He'is presently preparing a map showing details of the facility and will be making V) further investigation and costs involved. The Town's liability to the problem was discussed. Attorney Gardner advised that the Town would have no financial liabilities but there was a moral liability involved. Mr. Lewis Yaman, a South Cortland resident, said he had been on the system for 26 years and has never known it to be polluted and he has always had an ample supply of water and is satisfied with the existing system. He suggested that the spring well could be extended up above the ground so that water would run around the well rather than into the well. Another resident of the area stated he and Roland Oaks were not interested in the line coming down from the spring for the number of reasons stated by Mr. Rowell, but they were interested in the extension of the district, so that they could get water pressure for fire hydrants, especially. Mr. Rowell reported on his investigation of the adequacy of the water wells and pumps. His"proposes-1 at this time"he said "is to center on the installation of,a new casing, a new screen and. a new pump facility with the intent for full development of the aqua-fer; such that some years Bence, we will put in a second large pump so that we have two pumps, either of which can take care of our demand". "This", he said, "would be time consuming and costly", "but," he advised, "any monies to be spent, should be used in this direction". He stated that with the installation of a larger pump, the cone of influence would be increased and was concerned with the probability of pollution from the septic systems on Terrace Rd. and for the same reason, he advised, he would discourage any building on the Town property on the corner of McLean and Terrace Rds. If a building was to be permitted on this property, 1 • i Wednesday, February 5, 1975 Pg. 3 "My thoughts", he said, "would be to not develop the aqua-fer to its utmost, but to look to other possible sites for water .supply in the future and to me, this would not be proper service, as we know the water is here. If we concentrate our supply where it is now, it will mean that our electric needs, supervision and chlorination will be centralized and operation costs will be beneficial in that direction", Justice Eaton suggested that, in view of Mr. Rowell's report and recommendations, that the Town should look to other areas for a permanent fire station. Justice Fish inquired of Chief Riter if the feelings of the Homer Fire Dept. had changed regarding coverage of the Cortlandville area by the Homer fire dept. Mr. Riter stated that he had talked with Mayor Calale and neither could forsee any problems and that the Dept. was prepared to assume coverage for a number of years yet. Justice Fish state=he was concerned for the residents of this section of Cortlandville as they would be burdened, in the near future, -with server and water facility extensions and that priorities should be set; and that with the cooperation of the Homer Fire Dept., the fire protection problem could be put off for a few more years. Mr. Riter assured him that they would be prepared to supply the coverage needed for a number of years yet. RESOLUTION #23: PROHIBITION OF BUILDING CONSTRUCTION ON TOWN PROPERTY LOCATED AT THE CORNER OF MCLEAN AND TERRACE RDS. Upon motion of Justice Donald Eaton, seconded by Coucilman, Ray Miller, all voting aye, the following resolution was unanimously adopted: WHEREAS, The Town Engineer has advised the Town Board that the construction of any building on the Town property located at the corner of McLean and Terrace Rds. would be a possible threat to the safety of the Town's water supply, and, WHEREAS, The Town Board of the Torn of Cortlandville feels that the water supply should be protected from any threat of pollution, now therefore, BE IT RESOLVED, That the construction of any building on the Town property located on the corner of McLean and Terrace roads be, and it hereby is, forever prohibited. Roland Oaks, speaking as a tax payer.-, commended the Cortlandville Fire Dept. and requested that the Town Board look for a permanent site for a fire station and asked that his .,remark be entered into the minutes of this meeting. RESOLUTION 124: AUTHORIZATION TO LOOK FOR FUTURE MUNICIPAL LAND Upon motion of Justice Donald Eaton, seconded by Coucilman, Ray Miller, all voting aye, the following resolution was • unanimously adopted: WHEREAS, In the interest of the safety of the Town of Cortlandville's water supply, the Town Board has prohibited the construction of any buildings on the Town property located at the corner of McLean and Terrace roads, now therefore, BE IT RESOLVED, That the Town Board investigate possible sites for future Municipal building purposes. of Pleasantview Dr Mr. and Mrs. Leon Moore/wished to be considered for sewer hook-up whenthe sewer line is laid for Terrace Rd., as they have been having problems frith their sewage system. Mr. Rowell said he had not considered Pleasantview Dr. in any of the four proposals presented to the Town Board, as he was not aware of any existing problems. However, he would investigate the possibility of working that area into plan #2 of his proposals. Wednesday, February 5, 1975 Pg. 4 Justice Fish suggested they get a petition requesting a survey of -the area and in this way, it could be determined how many residents wish to be hooked -up to the sewer system. Justice Eaton suggested that the Town Board request Mr. Powell to pursue Plan #2 of his proposals. All members of the Board agreed that this was the most feasable at this time, and requested Mr. Rowell to proceed with this plan. Supervisor Blatchley asked the Board if they were ready to take action on the building codes as yet. He indicated adoption of the code was necessary to.come under the Federal Flood Insurance program. The Board members stated they were not prepared to take action at this time as they were still studying the codes. • Mr. Rowell stated he was reviewing the fire codes with Mr. Fish. However, he felt that a letter of intent to adopt the building codes would be sufficient for the Federal Flood program. The matter was tabled. Supervisor Blatchley advised that the Task Force which had been appointed to review the Ordinance, would be meeting on Monday night, February 24. Mr. Rowell brought up the subject of annexation of a certain portion of the Town of Cortlandville to the village of Homer, which he had discussed at the last meeting; and requested the Board's feelings on this possibility. The Board indicated they would be willing to meet with the Village Board to discuss the possible annexation. Justice Eaton gave a report on the cost of portable generators for the Water and Sewer Dept. as follows: Farm Line ® 17 AAmp. 5 HP, SF, Alternator,about $350,00 Skyline Elec. 18.8 Amp.5HP,SF, it 297.69 Kellogg Auto 18,0 Amp.5HP,Sf,Generator 320.00 Justice Fish stated he would like to know the manufacturers of the above before purchasing, as some generators were known to be troublesome. Fred Walker was directed to obtain a quote from Cortland Wholesale Elec. also. RESOLUTION #25: AUTHORIZATION TO PAY AUDITED BILLS Upon motion of Justice Fish, seconded by Coucilman Griswold, a1.1 voting aye, audited bills were unanimously approved for payment as follows: General Fund Water Dist 1 Water Dist 2 Water Dist 3 Sewer Dist 1 Highway Fund claims #'s 1-52 claims#1®16 claim #1 claim #1 claim #1.' & 2 Claims #1-L1 Total $16,553.62 1,393.82 215.55 253.60 19255.00 39,848.07 759, 519.66 Supervisor Blatchley requested that the remainder of the meeting be a closed meeting. Closed meeting in session: RESOLUTION #26: APPOINTMENT OF HARRY THOMAS AS TEMPORARY ZONING ENFORCEMENT OFFICER Upon motion of Justice Donald Eaton, seconded by Coucilman Sherman Griswold, all voting aye, the following resolution was unanimously adopted: BE IT RESOLVED,That Harry Thomas be, and he hereby is, appointed as Temporary Zoning Enforcement Officer for the Town of Cortlandville until such time as a permanent Zongin�Enforcement Officer can be appointed. Robert Bean's trailer park was brought up for discussion. 137 Wednesday, February 5, 1975 Pg. 5 Mr. Rowell explained that several years ago when Mr. Bean wished to extend his trailer park, he was requested to supply plans to show what the construction was going to be, the location of streets, and the location of water and sewer facilities. To the best of his knowledge, Mr. Rowell said, "Mr. Bean did not sewer the lower section of the park, although the maps show some existing sewers there, as of that time, and I do not know what part of the lower park has public sewers. With the recent concern of septic tanks and tile fields not working properly, the park has been investigated by the Health Dept, and others. The Health Dept. requested that Mr. Bean tell them which units were on the public sewer system and which were not. Mr. Bean has not supplied this information to the Health Dept., but has provided them with some general information. The Health Dept. event back to the site and had further conferences with Mr. Bean and at this time, found that the first information given by Mr. Bean was completbly inadequate and inaccurate. The -Health Dept. does not know which trailers are on public sewer and which are not and they are considering taking some action to ask Mr. Bean to supply the proper evidence as to the number of units in the park and which are connected to the sewer system and which are not.". Mr. Rowell state the Health Dept. indicated to him they would not issue a permit until Mr. Bean supplys them with more and proper facts. Mr. Rowell said he had also heard rumors that,the park was not meeting the Town's trailer ordinance requirements as to lot size and placement of units. There are provisions, he advised, whereby the Health Dept. could demand that all units be put on the public sewer system and they wish to know what the Town Board's feelings are on the subject. Justice Eaton recalled that when the new trailer ordinance went into effect, Mr. Bean, at a hearing, was told that he would have to comply with the requirements of the new ordinance. Mr. Bean indicated he would thereafter comply. Each time a trailer was moved out, he would see that any replacements would meet the requirements -of the ordinance. Justice Fish stated that he and Mr. Brookins had made a complete survey of the park at that time and had written dorm each visable violation of which they counted 18 in the lower park alone, as he could recall. Mr. Bean, he said, had promised to take care of the violations by moving trailers into the -new park as soon.as it was developed. However he did not do this. The Town Board concurred that the Town Board would sanction the fact finding hearing which is planned by the Health Dept. and that The Town Board also sanctions the enforcement of the Public Health Laws in the Torn of Cortlandville.
