Pg. 1- The second regular meeting of the month of the Town Board was held at the Town Hall, 15 Terrace Rd, with Supervisor, Robert P. Blatchley presiding. Other Board members present were: Justices Ronald Fish and Donald Eaton and Councilmen, Ray Miller and Sherman Griswold. Others present were: Town Attorney, John Gardner; Town Engineer, William Rowell; Town Clerk, Christine Canestaro; Town Assessor, Robert Wells; Town Highway Supt., Louis Wagner; Water & Sewer Dept. Supt., Fred Walker; Bookkeeper to the Supervisor, Rudy Krauklis; Renee Biladeau; Legisltors, Shirley Fish, Delmar Palm, and Henry Wadsworth; Dr. Edward Steinfeldt; Mrs. Frank Taylor; Mr. Larry Taylor; newspaper reporter, Skip Chapman; and several residents of the Town. The Town Clerk read the minutes of the last meeting. There were no corrections or additions. Upon motion of Councilman, Miller, seconded by Coucilman Griswold, All voting aye, the minutes were approved as read. The Town Clerk read a note received from the County Beautification Council thanking the Town for permitting them to use the Town Hall for their meetings. Upon motion of Justice Eaton, seconded by Councilman Miller, the note was ordered received and filed. Motion carried. The Town Clerk read a legal notification received from the Town of Dryden advising of a Public hearing to be held at the Dryden Town Hall on January 28, 1975 at 7:30 P.M. upon the question of the enacment of proposed amendments to the Zoning Ordinance. Upon motion of Justice Eaton, seconded by Coucilman Griswold, all voting aye, the notice was ordered received and filed. The Town Clerk read a letter from Corad, Miami, Fla, regarding water meter prices. Upon motion of Coucilman Miller, seconded by Justice Eaton, all voting aye, the letter was ordered received and filed. Supervisor Blatchley reported he had received complaints regarding the dangerous intersection of Rt.90 and Starr Rd. and had written a letter to the State Dept. of Transportation regarding it. He read the reply received which advised that several investigations had been made in the past couple of year and as a result a 40 MPH speed had been established between Rte. 13 & Rte. 90 and on Rte. 90 between the city line & Starr Rd. and new stop signs had been installed last week on both approaches of Starr Rd. They stated a flashing signal is not justified at the interesection of Rte.90 and Starr Rd. at this time. Upon motion of Justice Eaton, seconded by Coucilman Miller, all voting aye, the letter was ordered received and filed. Supervisor Blatchley introduced Dr. Edward Steinfeldt, Mrs, Frank Taylor and Mr. Larry Taylor. Dr. Steinfeldt, Chairman of the Frank K. Taylor memorial fund, presented a portrait of Mr. Taylor to the Town Board with the following comment "It gives me great pleasure to present to the Town of Cortlandville and to the Taylor family this portrait of Frank Taylor, on behalf of the donors, to be displayed in the Town Hall; dedicated to his memory and years of service to the Town of Cortlandville and the County of Cortland. i don't feel that the dedication and service of this great man should go unnoticed by the citzens who have all benefited by them". Attorney Gardner advised the Town Board that a lawsuit was being brought against the Town by Walter Westendorf who, he thought, is seeking clear title to the property that had been annexed to the City of Cortland. 128 Wednesday, January 22, 1975 Pg.2 RESOLUTION #1 : AUTHORIZATION FOR ATTORNEY GARDNER TO APPEAR IN AC ON BROUGHT BY WALTER WESTENDORF AGAINST TOWN Upon motion of Justice Donald Eaton, seconded by Councilman, Ray Miller, all voting aye, the following resolution was adopted, RESOLVED,That Attorney John Gardner be, and he hereby is, authorized to appear on behalf of the Town in the action brought against the Town by Walter Westendorf. Town Engineer, William Rowell reported he had been reviewing d the South Cortland water system and now has maps of the system which he feels will be helpful. He and Fred Walker are to investigate and make a survey of the water system �} on 1/28/75. He will advise the Board the results of this investigation. Mr. Rowell reported, since the P.T.M. request for a municipal sewer system was the most urgent at present, he had completed that investigation first. He submitted four proposals in a detailed report, for the Board's consideration. Each member of the board was given a written copy of this report. A copy is also on file in the Town Clerk's office. Mr. Rowell briefed the Town Board on the latest development in the Meadowbrook project. He reported he had met with Mr. Gorman's engineer for a comprehensive study of the plans for that portion of the project which lies within the village of Homer and the water and sewer lines which will be installed within the Town. He discussed the sewer layout, drainage problems as they related to the town and the installation of a water main. He presented maps showing the layout of drainage holding ponds, sewer and water lines plus the railroad culverts that take the runoff across the property under the railroad tracks and into the river. He indicated that -there could be many problems regarding the water under the railroad as there were only two small culverts of limited capacity and considered inadequate,to handle any large run off. Mr. Rowell pointed to the northern area of the map and suggested that the board consider allowing this portion to be annexed to the Village of Homer, so that sewer and water lines that are installed by them,- would be their responsibility to maintain. He pointed out, that also included in this area would be the proposed holding ponds which.could -prove to be a problem in the future. Mr. Rowell indicated that Mr. Gorman is intending to 1 proceed in the very near future with the portion of his project that is in the Village of Homer, plus portions of -the area that lie within the Town of Cortlandville, adjacent to Bell Drive. He feels that the board should make a decision regarding the possible annexation very soon. Fred Walker requested the Town Board purchase a portable generator which is needed by his -department. He was advised to obtain specifications and prices and present them to the Board at the next meeting. Supervisor Blatchley reported he had attended some Planning Board meetings, an industrial committee meeting held by the Chamber of Commerce, Beautification Committee meetings, Fire Dept. meetings here and in McGraw, Bi-Centennial committee meetings, and had talked with Zoning Officer applicants. He reported that the Bi-Centenial committee was planning a bus tour to Lexington, Mass. on April 18, 1975 for Lexington's 200th anniversary of Patriots Day. He invited everyone to participate. Justice,Ronal.d Fish reported on the street lighting investigation he had been asked to make at the last Board meeting and as a result the following resolution was made upon his recommendation. • 1 Wednesday, January 22, 1975 Pg. 3 RESOLUTION 116: AUTHORIZATION TO INSTALL STREET LIGHTS ON TIOUGHNIOGA AVE., PENDLETON ST. EXT., & RIDGE RD. Upon moition of Coucilman Miller, seconded by Justice Eaton, all voting aye, the following resolution was adopted= RESOLVED,That street lights be installed as follows: 1 175 W mercury light on pole 6 - Ridge Rd. 4 175 W mercury lights on Pendleton St. Ext. (to complete lighting on Pendleton St.txt.) 1 175 W mercury light on Tioughnioga Ave. on pole #8 Replace 3 old type existing lights on this street with 3 175 W mercury lights Annual cost to the Town, he said,would be as follows: Ridge Rd. $ 45.75 Pendleton St. Ext. $183.00 Tioughnioga Ave. $178.00 Supervisor Blatchley.read the following letter from Earl L. Oot, attorney for Stiles Farms, Inc.: January 22, 1975 Town of Cortlandville 15 Terrace Rd. Cortlandville, New York ATTN: Robert Blatchley RE: Stiles Farms Dear Mr. Blatchley: As you are no doubt aware, Jared Stiles, principal in the development of Stiles Farms, passed away unexpectedly. We Also understand that your Town is preparing planned unit development district requirements. We, therefore, feel it advisable and do hereby withdraw the prior application made in behalf of the Stiles interest for the development of the Stiles Farms under the planned unit development. We wish to thank the Board.`, for the time given and the presentation as well as the interest given by individual board members. Yours' -truly, Earl L. Oot Upon motion of Justice Eaton, seconded by Coucilman Miller, all voting aye, the letter was ordered received and filed. RESOLUTION 117: ACCEPTANCE OF WITHDRAWAL OF APPLICATION OF STILES FARMS, INC. FOR A P U D Upon motion of Justice, Donald Eaton, seconded by Coucilman, • Ray Miller, and votes poled as follows: Coucilman Miller, aye; Coucilman Griswold, aye; Justice Fish, aye; Justice Eaton, aye; Supervisor Blatchley, aye. the following resolution was unanimously adopted. RESOLVED, That the Town Board accept, and we hereby do accept, the withdrawal of the application for a Planned Unit Development, made by Stiles Farms Inc. on March 25, 1974. Supervisor Blatchley asked the Town Clerk to read the recommmendation made by the Town Planning Board at their meeting on 1/20/75/ The recommendations follow as they appear in the minutes of that meeting: as Motion was made by W. Clemens, seconded'by G. Hatheway that the Planning Board of the Town of Cortlandville, recommend to the Town Board that said Town Board appoint a special Task Force Committee to meet with County Planners for the 130 Wednesday, January 22, 1975 Pg.4 purpose of a study to amend Article 11 of the Zoning Ordinance. This was passed unanimously.'° "A Resolution was adopted by the Cortlandville Planning Board as follows: Motion was made by Wm. Clemens, seconded by Willard Griswold that the Cortlandville Planning Board realizing that eight years have elapsed since the adoption of existing Master Plan, Zoning Ordinance, recommends to the Cortlandville Town Board that a Comprehensive Review of the above be initiated with the intent of.bringing these up to date and adding an official Map and a Capital Improvement Program. This motion was passed unanimously." The need for a Task Force to review the ordinance was discussed by the Town Board. Justice Eaton stated that the ordinance did need updating, but didn't feel a great deal of money should be spent in doing so. As far as the Planning Board's recommendation to revise Article 11, he stated he felt the present ordinance:makes adequate provision for P.U.D.'s as it gives the Planning Board the right to impose regulations they deem necessary. "Each PUD," he said °'presents it's own situation and should be treated individually" He was concerned that if strict requirements are made in an ordinance, the Planning Board would lose the flexibility it now has. 1 C7 J>>stice Fish stated he thought minimum requirements for all P.U.D.'s should be written into the ordinance as he felt a lot had been learned regarding this type of development since the ordinance was written in 1968. RESOLUTION #18: APPOINTMENT OF A TASK FORCE TO STUDY & REVIEW"J THE PRESENT TOWN ZONING ORDINANCE Upon motion,of Justice Fish, seconded by Councilman Miller, all voting aye, the following resolution was adopted: RESOLVED ,That the following people be, and they hereby are, appointed to form a Task Force to make a comprehensive study of the 1968 Zoning Ordinance of the Town of Cortlandville and to make their recommendations for a possible revision of the ordinance: All members of the Town Planning Board; Justice, Ronald Fish Supervisor, Robert P. Blatchley One member of the Town Zoning Board of Appeals Town Attorney, John Gardner Town Engineer, William Rowell with advise from County Planner, Theodore Zollendeck. RESOLUTION #19: AUTHORIZATION FOR TEMPORARY RESTRICTION OF TOWN HIGHWAYS Upon motion Miller, all adopted: of Justice Eaton, seconded by Coucilman • voting aye, the following resolution was RESOLVED, That the Town Highway Superintendent be, and he.hereby.is, authorized to temporarily restrict any portion of any town highway as to weight as defined in Sec. 1660, Sub.11 of the New York State Vehicle and Traffic Law. BE IT FURTHER RESOLVED, That the Town Highway Superintendent be, and he hereby is, authorized to issue, upon written application of any operator of a vehicle subject to this section, a permit providing appropriate exemption to such vehicle, if it is deemed that said vehicle is performing essential local pickup or delivery service and that failure to grant such permit would create a hardship. Such permit to be only for the duration of the temporary 1 restriction. 131 Wednesday, January 22, 1975 Pg. 5 RESOLUTION #20: APPOINTMENT OF MARY FOWLER AS COURT CLERK Upon motion of Justice Eaton, seconded by Councilman Miller, all voting aye the following resolution was adopted: RESOLVED, That Mary D, Fowler be , and she hereby is, appointed as Court Clerk of the Town of Cortlandville Justice Court. Adoption of the State Building Codes was discussed. Each member of the Board was given a complete set of these codes consisting of four books, A. B, C & P. Attorney Gardner advised the Board to study the codes thoroughly before taking any action on their adoption. Highway Supt,, Lou Wagner, suggested that a request for a performance bond be written into the ordinance to insure the proper reconstruction of highways which have been open cut. Attorney Gardner read the following resolution: RESOLUTION 121: HONORING RUDY KRAUKLIS Upon Motion by Justice, Ronald Fish, seconded by Councilman, Ray Miller, the following resolution was unanimously adopted: WHEREAS, Rudolph Krauklis has indicated his desire to terminate his employment by the Town Board as Bookkeeper to the Supervisor as of the last day of January, 1975; and WHEREAS, the members of this Board recognize that he has served the Town in this capacity for a period of over ineteen (19) years during the tenure of four Supervisors, namely: Hon. M. Cady Hulbert, Hon, Glen R. Alexander, Hon. Frank K. Taylor and Hon, Robert P, Blatchley, giving to each of them the benefit of his keen advice and assistance concerning the fiscal affairs of the Town, be it RESOLVED, That the members of this Board accept the termination of his employment with regret, and extend to him our continued friendship and our hope that good fortune will come to him in the future; and be it further RESOLVED, That Saturday, February first, 1975, be, and it hereby is, proclaimed as Rudolph Krauklis Day in the Town of Cortlandville; and be it further RESOLVED, That this Resolution be made a part of the Minutes of this meeting of this Board, and that a copy thereof be transmitted to Rudolph Krauklis as its testimony of the esteem and respect in which he will always be held by his former associates.
