Blatchley presiding. Other Town Board members present were: Justice, Donald Eaton, Councilman, Sherman Griswold, and Councilman Ray Miller. Councilman, Ronald Fish was-late':due to an auto accident. Others present were: Town Clerk, Christine Canestaro; Deputy Town Clerk, Theresa Fortin; Town Assessor, Robert Wells; Town Highway Supt., Carl Eaton; Town Engineer, William Rowell; Town Bkkpr., Wayne_Ezick; Town Attorney, John Gardner (came in after the public hearing), News reporter Skip Chapman; Planning Board member, Willard Griswold; and several residents of the town. The meeting was called to order by the Supervisor and the pledge of allegiance was given by all in attendance. Reading of the minutes of the last regular meeting was dispensed with as all board members had reviewed copies of the minutes prior to the meeting. Motion was made by Councilman Griswold, seconded by Justice Eaton that the minutes be approved as presented. Votes: Justice Eaton, aye; Councilman.; Griswold, aye; Councilman Miller, aye; Supervisor Blatchley, aye. Motion carried. Town Clerk, Christine Canestaro, read the following petition which had been filed with her this evening: December 1, 1976 WHEREAS: We the undersigned are in full agreement of retaining all parcels of land and building lots as designated, "Sunset View Terrace." HOWEVER: We request the road passing through said land, formerly known as "Ridge Road," still be named "Ridge Road." As per map layout of Sunset View Terrace dated August 11, 1966. Signed by: Mrs. Ray Miller, Debra Rae Miller, Gretchen K. Piazza, John J.. Piazza, Walt A. Dippo, Jeanette Dippo, Delmar A. White, Molly I. White, Jane W. Zogg, Agnes DiLucci, Albert DiLucci. Motion was made by Justice Eaton, seconded by Councilman Miller to receive and file the petition. Votes: Justice Eaton, aye; Councilman Griswold, aye; Councilman Miller, aye; Supervisor Blatchley, aye. Motion carried. Highway Supt., Carl Eaton requested permission to buy a used 1969 Forj'pickup truck,in good condition, for approximately $700.00. He said this would be used by the Highway Dept. to run errands when his truck was not available. The Board gave him permission to make the purchase. Fund Balance 40,231.33 comprised of: Repairs & Improvements $ 3,988.72 Bridges 10,601.16 Machinery 13,030.75 Snow Removal & Misc. 12,231.33 Wednesday, December 1, 1976 pg. 2 Letter re: Supervisor Blatchley reported he had written to Congressman Nursing James Hanley, Governor Carey, and Legislator, Steve Harrington, at the homes request of Mr. Morris Noss, concerning the difficulties now facing the nursing homes. lie read the reply he had received from Congressman Hanley. Supervisor Blatchley said he had picked up a supply of maps from County Highway Supt., Walter Tennant and felt a fee should be charged for them. This fee to be retained by the town. RESOLUTION #135: SETTING FEE FOR SALE OF COUNTY MAPS County Motion by Justice Eaton, seconded by Councilman Miller. Map Fee Votes: Justice Eaton, aye; Councilman Griswold, aye; ® Councilman Miller, aye; Superviosr Blatchley, aye. Adopted. BE IT RESOLVED THAT County maps are to be sold for a fee of 50 cents each. Revenues received from the sale,, -of said maps are to be retained by the Town. Supervisor Blatchley reported that Mr. Robert Fragnoli wished Fragnoli to be exempted from having the newly installed water service to his request horse barn on Tompkins St. metered. A discussion followed and the for un- consensus of the Board was that since all water services supplied by metered the town are metered, a precedence should not be set. Therefore water all water installations must be metered. Supervisor Blatchley is to notify Mr. Fragnoli of this decision — RESOLUTION RESOLUTION 24136: ALL TOWN WATER SERVICES MUST BE METERED Resolutio Motion by Justice Eaton, seconded by Councilman Miller. All Votes: Justice Eaton, aye; Councilman Griswold, aye; water Councilman Miller, aye; Supervisor Blatchley, aye. services Adopted. must be metered WHEREAS, In order to maintain proper control of water supplied by the town to users in all water districts of the Town of Cortlandville, NOW THEREFORE BE IT RESOLVED, That all water installations receiving water from the Town of Cortlandville and or serviced by the Town of Cortlandville must be metered pursuant to Sec. IV of the Town of Cortlandville Water District Ordinance. Justice Eaton questioned a voucher which was submitted for audit by the town bookkeeper. The claimants name on the voucher was "Revenue Federal Sharing Fund". The Supervisor explained this was to replace monies in Revenue the Federal Revenue Sharing Fund which were not used when a certificate Fund of deposit in the amount of $42,858.09 was cashed to cover $35,000 Transfer appropriated from the Federal Revenue Sharing fund for the Public of Transportation account. The Town Board felt this should be done by resolution, not by voucher. monies RESOLUTION 7#137; AUTHORIZATION TO TRANSFER $7,858..49 from GENERAL FUND `TO REVENUE SHARING FUND • Motion by Justice Eaton, seconded by Councilman Griswold. WHEREAS, it was necessary to cash a Certificate of deposit in the amount of $42,858.09 to cover the cost of materials for the Public Transportation Account #CF-5110.4, and WHEREAS, the amount of monies appropriated for Public Transportation a/c#CF-5110.4 was $35,000, NOW THEREFORE BE IT RESOLVED, That the balance of cash remaining from the cashed Certificate of Deposit be put back into the Federal Revenue Sharing Fund. From Cortland Water Board, City of Cortland, Cortland, N.Y. Mr. Robert Blatchley November 29, 1976 Supervisor, Town of Cortlandville 15 Terrace Road Cortland, New York 13045 Dear Mr. Blatchley: At the meeting of the Cortland Water Board on November 17, 1976, the matter of a fee for hydrants that are in your water districts #1 and #2 was discussed. These are connected to our city system and unmetered. This involves one hydrant on • Vernon Drive in District #1 and four hydrants on Crestwood Court in District 712. It was unanimously adopted that a fee of $25.00 each be charged for these hydrants. This will start with the year 1977 and we will bill you accordingly. If you have any questions about this, feel free to contact me. Very truly yours, CORTLAND WATER BOARD Grover Eaton, Sup't. Motion carried. A discussion followed. The matter was tabled so that Engineer, William Rowell could conduct an investigation as to ownership of the hydrants and any other pertinent facts. 2. Blatchley November 24, 1976 Town Supervisor Town of Cortlandville 15 Terrace Road Cortland, New York 13045 Dear Mr. Blatchley: In accordance with your letter of October 21, here are prints of our Valuation Plans V-19/43 and V-19/44 showing this Company's Elmira, Cortland & Northern Branch right-of-way in the Town of Cortlandville, Cortland County, N.Y. Our inventory records indicate an area of 32.892 acres of land contained in the above described section of right-of-way. Upon receipt of your advice as to the Town's best all cash offer for the right-of-way and your intended use of the property we will be in a position to consider selling the right-of-way to the Town of Cortlandville. The regular meeting was recessed at 8:00 P.M. for the purpose of holding the advertised public hearing regarding lateral sewers for McLean Rd., Terrace Rd., Pleasantview Dr. and Munson Ave. A transcript of this hearing is on file in the Town Clerk's office. The regular meeting of the Town Board reconvened at 8:42 P.M. The Development Plan, as revised by the Planning Board, and the Citizens Advisory Committee in conjunction with the County Planning Department, will be avail -able in December 1976. It is the opinion of this Planning Board that the work of the County Planning Department has been adequate and competent. These gentlemen have been amenable to the suggested revisions recom- mended in the past four months. Such process of revision is normal in any planning operation. In order to insure continuity of the Planning Process, the Planning Board requests consideration of the Town Board in approving the offered Grant of the State in providing the use of the'County Planning Department in preparing the revised Town Zoning Map and the Zoning Ordinance. These latter phases require technical knowledge and pro- fessional direction by a full-time employee, and are not within the province of the Town Planning Board. The Town Planning Board considers it to be of the upmost importance that work be continued, as originally contemplated and that a new Zoning Map and a new Zoning Ordinance be completed in the near future. Mr. Willard Griswold, Planning Board member, explained the studies done by the Planning Board, the Advisory Committee, and the County Planning Dept. had to be done before anything could be done on the zoning map and the zoning ordinance. He said he "understands now, there is money available to the County Planning Dept. for updating the ordinance and map, at no cost to the town". "However, he said, "Mr. Zollendeck told me there will be a charge of approximately $1000 - $1200 for the printing of the zoning map:i, all other work will be included in the funding programV He explained some of the revisions which had been made on the land use map since the time of the public hearing. Supervisor Blatchley said the Town Planning Board requested a joint meeting with the Town Board to discuss this matter. A meeting was set for 12/8/76 at 7:30 p.m. at the Town Hall. Supervisor Blatchley reported the Town Planning Board had requested an Interin interim member be appointed to their board during the absence of Victor member Metcalf. Justice Eaton suggested that a letter should be required from the Town Plng. Planning Board making this request before any action is taken. The Board discussBd e agreed. Wednesday, December 1, 1976 Pg.5 ENGINEER, WILLIAM ROWELL REPORT. Pump for 1. The pump for the new well has been shipped and a time for Well #3 installation will be scheduled as soon as the pump arrives. 2. A meeting was held this afternoon with representatives of P.T.M. P.T.M. and others regarding the best method of providing Sewers sewers to serve P.T.M. properties. A number of facts were discussed. P.T.M. will consider them further and report back to the town. RESOLUTION #138; AUTHORIZING JUSTICE EATON TO ATTEND THE JUSTICE Judge Eaton TRAINING PROGRAM AT TC3, to attend Motion by Councilman Griswold, seconded by Councilman Miller. Justice Votes: Justice Eaton, aye; Justice Fish, aye; Councilman Griswold, Training aye; Councilman Miller, aye; Supervisor Blatchley,aye. Program Adopted. BE IT RESOLVED, That Justice Eaton is hereby authorized to attend the Justice Training Program being held at TO 11/16/76-4/17/77, and BE IT FURTHER RESOLVED that all necessary expenses incurred for same be reimbursed, subject to audit by the Town Board. Ridge Rd. Supervisor Blatchley asked if the Board wished to take action on the Petition petition submitted tonight by the residents of Ridge Rd. Attorney Gardner advised that this request should be taken up with the Town Planning Board. Also all road names and changes have to be cleared with County Highway Supt., Walter Tennant. Supervisor Blatchley was authorized to write letters to Mr. Tennant and the Town Planning Board and report back to the Town Board the outcome thereof. Heating Justice Eaton reported he has not received any estimates for the Sys. proposed new heating system for the municipal building on West Rd. as W.Rd. yet but hoped to have some forthcoming soon. RESOLUTION #139; AUTHORIZATION TO SOLICIT BIDS FOR ONE NEW AND UNUSED Solicit PORTABLE AIR COMPRESSOR bids for Motion by Councilman Miller, seconded by Councilman Griswold. compressor Votes: Justice Eaton, aye; Justice Fish, aye; Councilman Griswold, aye; Councilman Miller, aye; Supervisor Blatchley, aye. BE IT RESOLVED, That the Town Clerk be,and she` -hereby is, authorized and directed to advertise publicly for sealed bids for the furnishing and delivery of one new and unused portable air compressor in accordance with the information for Bidders and specifications set forth therein. Delivery to be made within 30 days of awarding of the bid.tffix x2mx ]=xdvi Delivery to be made to the Town of Cortlandville Water District #1, 15 Terrace Rd., Cortland, N.Y., and BE IT FURTHER RESOLVED, That sealed bids received will be opened at 8:00 P.M. on December 15, 1976 at the Town Hall, 15 Terrace Rd., Cortlandville, N.Y. Allen Dr. Mr. Willard Griswold asked why Allen Dr. had not been included in the & Sewere District #1. Mr. Rowell explained that the irregularity of the Sewer Dist. line of the sewer district in that area was due to the fact that the original district, which did not include Allen Dr., was extended at the request of the developers of the apartment complexes located westerly of Tompkins St. ext. Construction of these sewer lines was done at their own expense. The new development, which is presently under consideration at the end of Allen dr., he explained, is already in the sewer district. An 8" line will be constructed at the expense of the developer, WhenF,the people on Allen Dr. desire to come into the district, the sewer can be constructed on Allen Dr. and connected to that sewer line as it meets the minimum requirement of the County Health Dept. 1 1 is 1 Wednesday, December 1, 1976 pg.6 RESOLUTION #14.0_ AUTHORIZATION TO PAY AUDITED BILLS Motion by Councilman Griswold, seconded by Councilman Miller.
