The second regular Town Board meeting of the month was held
at the Town Hall, 15 Terrace Rd., with Supervisor Robert P. Blatchley
presiding. Other Board members present were: Justices,Donald Eaton
and Ronald Fish and Councilmen, Sherman Griswold and Ray Miller.
Others present were: Town Clerk, Christine Canestaro; Town Highway
Supt., Carl Eaton; Town Attorney, John Gardner came in late due to
other commitments; Attorney John Fitzgerald and his clients,Mr. &
Mrs. Michael Colasurdo; Mr. Clarence Homer; newsreporter, Skip
Chapman; and Mrs. Delmar Palm.
The meeting.was called to order by the Supervisor and the
Pledge of Allegiance was given by all in attendance.
• Reading of the minutes of the last meeting was dispensed with as
all board members had reviewed copies of the minutes prior to the
meeting.
Justice Eaton advised that Resolution #127, pg. 121 adopted at
the last meeting should be amended as the bridge improvement program
is a two year program, a fact which was not brought out at the last
meeting, when the resolution was adopted.
RESOLUTION #129: AUTHORIZATION TO AMEND RESOLUTION #127 Regarding
THE RECONSTRUCTION OF CLINTON ST. BRIDGE. McGRAW. N.Y.
Motion by Justice Eaton, seconded by Councilman Miller.

Adopted.
WHEREAS, It has been brought to the attention of the Town Board
that the Clinton St. Bridge, McGraw, N.Y., reconstruction program
is a two yer program,
NOW THEREFORE BE IT RESOLVED, That Resolution #127 adopted by the
town board 11/3/76 is hereby amended as follows:
Title to Rea :"AUTHORIZATION TO COMMIT $13,500 for THE RECONSTRUCTION
OF CLINTON ST. BRIDGE, McGRAW, N.Y."
Last paragraph to read: "RESOLVED, that the Town of Cortlandville
does hereby commit itself to the County of Cortland in sharing
the expense of reconstruction of said Clinton St. Bridge. Said
expenditure to be 1 % of the total cost, not to exceed $13,500
for the two years, whichever is less, as the Town of Cortlandville's
share of the total cost, and
BE IT FURTHER RESOLVED, That one half (1/2) of the Cost $6,750, or
7-2'-% of the total cost, whichever is less is hereby committed for the fiscal
year 1977, the first year of the program, and
BE IT FURTHER RESOLVED, That the balance of $6,750 or 7 %% of the
total cost, whichever is less, is hereby committed for the fiscal
year 1978, the second year of the program.
Supervisor Blatchley read a copy of a letter sent to Mr. Michael
• Colasurdo, Legislatoryby James V. Feuss, P.E., Director of Public Health,
Cortland County, regarding the proposed Development, Town of Cortlandville,
Rte. 13 (petition for rezoning of this property had been submitted by
Michael H. & Patricia A. Colasurdo). The letter was in response to an
inquiry made by Mr. Colasurdo concerning the residential development of
this property. A copy of this letter is attached to and made a part of
these minutes. Motion was made by Justice Eaton, seconded by Justice
Fish that the letter be received and filed. All voted aye. Motion
carried.
Attorney Fitzgerald advised that the letter was prompted by Mr.
Colasurdo's inquiry as to the feasability of developing a residential
unit on the property should his petition for rezoning to business
classification be denied. Mr. Colasurdo said he had talked with Mr.
Eric Johnson of the County Health Dept. today and he indicated to him
that there cwould be no difficulty in obtaining a proper sewage disposal
permit from the Health Dept. if the property was to be used for a
commercial business such as he intended to construct.

Adopted, pursuant to Sections 264 and 265 of the Town Law
WHEREAS, A public hearing was duly called and held before
the Town Board on October 27, 1976, in the matter of the
Petition of Michael H. Colasurdo and Patricia A. Colasurdo, his
wife, for the adoption of a proposed change in the boundaries
of Residential R-1 and Business Districts as shown on the 1968
Zoning Map of the Town of Cortlandville; and
After hearing the testimony and evidence heard at such
public hearing: and after receiving the written report of
Cortland County Planning Department, recommending approval of
the proposed amendment accompanied by full statement of such
recommendation:
NOW, THEREFORE, Be it
RESOLVED, That the boundaries of Residential R-1 and Business
Districts in the Town of Cortlandville, as shown on the 1968
Zoning Map of the Town of Cortlandville, be,and the same
hereby are, changed so that the following described parcel of
land be, and it hereby is, placed entirely in a Business
District, instead of a Residential R-1 District, as it is at
present:
ALL THAT TRACT OR PARCEL OF LAND situate in the Town of
Cortlandville, County of Cortland, and State of New York
being a part of Lot No- 56 in said Town, bounded and
described as follows to wit: Beginning at the intersection
of the east right-of-way line of NYS #13 and the north
line of the access road to the Yellow Lantern Kampground;
running thence North along the easterly right-of-way line
of said Route #13 a distance of 137+ feet to the stream
marking the existing division line of the current
Business District; running thence in an easterly direction
along said stream as it winds and turns and the division
line of the current Business District to the east line of
the premises owned by Petitioners (See Book 333 of Deeds
at Page 417); thence running S 100 40' W along the east
boundary of Petitioners' premises to the north line of the
access road to the Yellow Lantern Kampground; running
thence N 881 16' W along the north line of said access road
a distance of 364.23 feet to the point or place of beginning
and containing more or less of land.
BE IT FURTHER
RESOLVED, That the Town Clerk be, and she hereby is authorized
to publish such change as required by law; and be it further
RESOLVED, that the Town Clerk Be, and she hereby.is, authorized
and directed to enter such change upon the aforesaid Zoning Map.
Mr. Blatchley gave the following reasons for voting nay:
1. He had 10 contacts with people in the area. Six were against it
two were for it and two were neutral.
2. One landowner said that if this petition were approved, he would
petition for the same type rezoning for his tract of land and
if it were not granted, he would sue the town.
3. He knows a farm family who are getting up in age and as soon as
they retire will probably petition the town for a like zone change.
4. Long range plans for that area is for residential or open land.
5. The Town Planning Board wrote him a letter recommending that they
were against it.
6. A commitment had been made to the Planning Board not to re -zone
during the Master Plan revision.
7. It is one of the few uncommercialized entrances into the City of
Cortland.
8. One of the objectives of the Master Plan Advisory Committee is to
maintain as much open land and open space in the town as possible.

Mr. Blatchley read the letter he had received from the Town
Planning Board. Motion was made by Councilman Miller, seconded by
Justice Fish to receive and file the letter. All voted aye. Motion
Carried. A copy of this letter is attached to and made a part of
these minutes.
Mr. Blatchley advised Mr. Clarence Homer regarding his petition
for annexation of his land to the city, he had talked with City
Attorney Gilhooey who recommended that Mr. Homer contact Mr. Gee
and have him contact Attorney Gilhooley and Attorney Gardner.
. Mrs. Canestaro presented a voucher from Mrs. Inez Sandy for
janitorial services performed during the month of October. The voucher
.had been received the day after the audit meeting of the Town Board.
RESOLUTION #131: AUTHORIZATION TO PAY AUDITED BILL SUBMITTED BY MRS.
INEZ SANDY
Motion by Councilman Griswold, seconded by Justice Eaton.

BE IT RESOLVED, That audited claim voucher #513 in amount $50.00
submitted by Mrs. Inez Sandy be ordered paid.
Justice Eaton gave the following report on the activities of his
office during the month of October 1976:
363 completed cases
$3,085 being held.in pending cases
$5,599 turned over to the State Comptroller in fines & forfeitures
$29,737.50 has been returned to the town., by the state for ;justice
court fines for the year 1976.
Supervisor Blatchley reported;
1. He had received a copy of a letter sent to the Town Clerk from
the Dept. of Audit & Control, Albany requesting additional data
and material for the application made for the Creation of Water
District #5. Mrs. Canestaro advised that the material and data
had been compiled and turned over to the Town Attorney yesterday.
2. He had received a letter from Mr. Bill McGrath, Senior Planner,
Southern Tier East Regional Planning Development Board, regarding
ARC funding for the South Cortland Water Supply project. He read
the letter and his reply to the letter.
Motion was made by Justice Eaton, seconded by Councilman Miller
that both the letters be received and filed. All voted aye.
Motion carried. A copy of these letter are attached to and made
a part of these minutes.

3. A copy of the County Interim Land Use Plan is on file in the Town
Clerk®s office. A meeting is planned on this subject on Thursday
January 12, 1977 at the Town Hall.
4. A Highway safety study is now being conducted by the State D.O.T.
They have pin -pointed 20-25 bad intersections in the Town of Cortlandville,
• he said, which are currently being studied., -:,They will make recommendations
sometime in the near future.
5. He had a letter from Capt. Jack Harvey, Frank K. Taylor Hose Co. #4,
which he read to the Board, requesting the Town Board to meet
with the firemen 12/7/76 at the fire house at 8:00 P.M.
Motion was made by Justice Eaton, seconded by Councilman Miller to
receive and file the letter. All voted aye. Motion carried.
6. There will be a meeting, at the request of the Cortland County Development
Corp., on Wednesday, 12/1/76 at the town hall at 3:00 p.m. to discuss
the P.T.M. sewer situation. Present will be: Mr. Blatchley, James
O'Mara, James Feuss, Morris Noss, Cortland County Development Corp. and
Cortland Industrial Co.

7. There will be a flood control meeting 12/2/76 at the
State University, Binghamton, N.Y., Vestal Parkway. He
feels the town should be represented at this meeting.
8. A :Nuclear Waste Seminar is scheduled for Tuesday, 11/23/76
at 7:00 p.m. at B.O.C.E.S.

Miller to receive and file the announcement letter. All voted
aye. Motion carried.
9. He had contacted Tom Pitts regarding the study of the Fisher Ave
area drainage. Mr. Pitts advised him this problem had been
discussed at their nine cowtty regional (RC & D) committee
meeting and they thought/ak appropriate project to study
but the engineer has not evaluated it as yet.

RESOLVED, that the Town Board of Cortlandville shall, pursuant to
section 199 of the Town Law, construct lateral sewers in and along
a tortion of the streets and highways in the Town shown on the map
of lands of Nathan J. Munson, Lot No. 83, Cortlandville, New York,
made by M. C. Bean, Surveyor, and filed as Map No. 225 in Cortland
County Clerk's Office on November 18, 1925, as followss
A distance of 1218 plus or minus feet easterly along McLean Road
from its intersection with Terrace Road; a distance of 600 feet
southerly along Terrace Road from its intersection with McLean Road;
a distance of 500 feet southerly along Pleasantview Drive from its
intersection with McLean Road; a distance of 400 feet southerly
along Munson Avenue from its intersection with McLean Road; and
along the boundary line between Lots Nos. 24 and 25 as shown on
said map and extended southerly for a total distance of 173 feet

Justice Eaton reported he had three people who will be giving
him estimates for a new heating system for the Municipal Bldg. on
Rte. 281. He will report on this as soon as these estimates are
received.
Justice Eaton submitted a form he had devised to facilitate
adequate reports to be made by the Water & Sewer Dept. pursuant
to Resolution #115 adopted by the Town Board on 10/6/76. The
Town Board gave their approval of the form.
Justice Fish requested to have his office changed from Town
Justice to Town Councilman as of the first of the new year. He
asked Attorney Gardner to research the law as to the proper
proceedure to accomplish this.
• The appointment of an interim Zoning Enforcement Officer
during the illness of Don Fowler iias discussed and the following
resolution adopted.

terminated at the pleasure of the Town Board, and
BE IT FURTHER RESOLVED, that Robert Wells shall serve in
this capacity at no additional salary, but he shall be paid
for mileage necessary to perform the duties of this office.
Regarding a request made by Justice Fish to have the Town
Attorney research the law regarding the power of the Town Board to
provide drainage facilities on private properties, Attorney Gardner
advised that Section 64 subdivision 11 of the Town Law provides
such authority.
Justice Eaton requested the Town Attorney draw up an easement
for channel improvements across the property of Donald Rutan.
There being no further business, upon motion of Councilman
Miller, seconded by Councilman Griswold, all voting aye, the meeting
was adjourned at 8:28 p.m..

As a follow-up to our telephone conversation of November 4, 1976, I will
outline briefly my specific request for information concerning the above cited
project. The Department of State is concerned that a public water supply may
be an undesirable alternative to individual wells considering the total project
cost and the number of people benefited. You have indicated that the possibility
of individual wells has been explored and found to be unfeasible for a number

Our Town Engineer, William Rowell of Rowell and Associates,
East Syracuse, New York, and I have discussed at great length the
various ways of getting good water to the residents of the hamlet
of South Cortland. The following are the major reasons for
recommending our town water supply for these people:-
1. Providing residents with a safe dependable source of
water was our primary concern. The soil texture in the area is
very porous and there are at least two very large, dirty barnyards
that are within the very limits of the hamlet. These yards accomodate
upwards of 200 head of cattle during the year.
Also the Monarch Machine plant just south of the hamlet had
to drill at least five very expensive wells before they obtained
suitable water for their use. Much of the water in the area is
of a high sulphur and mineral content.
2. Fire protection was our second major concern. Our Engineer
tells us that an 8 inch line is about minimum for fire protection,
so this is what we plan to install.
3. According to present cost estimates, over a 40 year period,
municipal water can be supplied cheaper than each home owner can
drill, install and maintain his own water system.
4. Lastly, we feel that the proposed water line to South
Cortland could and no doubt would lead to future town expansion.
The town water line already extends to a large shopping mall and
also to the large Smith Corona typewriter manufacturing plant,
both of which are more than half way from our source of water to
South Cortland. There is already an industrial plant beyond South

Cortland from our town supply and another industry has purchased
property even further to the southwest of the factory just mentioned.
The area is zoned and will continue to be zoned industrial for it
is considered to be the prime industrial area in the vicinity of
Cortland. Certainly a water line to the area would be an added
incentive to future industrial growth which the area sorely needs.
As mentioned previously, the health and safety of the residents
are our prime concern and after lengthy deliberation, we feel that
a municipal water supply to the area is the most advantageous, not
only to the residents but to the entire Cortland area as well.
And as you know, time is of the very essence for the present water
supply has been condemned. We will appreciate support for this
vital project.

In accordance with your inquiry concerning residential develop-
ment, we have reviewed the map prepared by Yale L. Hughes dated
September, 1976.
The lot size and shape as shown on the drawing are not in
accordance with the County regulations. An application for a
variance could be submitted to this Department for consideration,
but I could not recommend approval to the Board of Health for
the following reasons:
1. Other land is owned by the developer contiguous with the
area zoned residential,
2. Assuming the soil conditions are satisfactory, the minimum
distance between the sewage system and the stream must be 100
feet (see attached page 5 from the State°s "Waste Treatment
Handbook". The system must also be a minimum of 10 feet from
the property line. The sewage system ►rust, therefore, be in the
area of the proposed sign.
If the area of the lot is increased to 30,000 square feet, the
minimum front footage increased to 135 feet and the soil condi-
tions are satisfactory for seepage pits, it is possible that we
will grant a permit. If the seasonally high water table is too
high to permit the use of seepage pits, it will be extremely
difficult, if possible, to install a sewage system and maintain
the legal distances from the stream and property lines.

Soils vary widely in character. "lost soils are mixtures of
ston-es, sand, silt, clay and organic matter. Soil maps and
reports have been developed for most counties in New York
Sate and are available from the U.S. Soil Conservation
Service. While helpful in determining general soil and
soil -.Moisture characteristics, and suitability for various uses,
they are not substitutes for an on -site soil investigation.
The nature of the stratum immediately under the upper
soil can affect the disposal of v,astes. Dense substrata, such
as clay layers, fragipan, sha'e, argillite, and cemented
limestones set the limits of vertical movements of
wastewaters. Highly fractured rock substrata 'underlying
&.`tallow soil profiles may promote such rapid water
movement that contamination of the groundwater, nearby
streams and lakes could occur. To locate such strata deep
test holes are dug in the area of the proposed disposal site.
Deep test holes or soil borings are used to determine
de.,:hi to groundwater and bedrock, types of soils
penetrated and other features such as root systems, land
drains, etc., which could interfere with the sewage disposal
system.
Reference made to highest groundwater level will refer
to the depth to and estimated duration of the seasonal high
water level and the type of water table — perched, apparent
or artesian. The Soil Conservation Service often refers to
th"s as soil moisture regime.
The depth of deep test holes is determined by the type
of s/stem to be installed. if a shallow subsurface disposal
