HomeMy WebLinkAbout11-03-1976Wednesday, November 3, 1976 7°.30 p.m. Pg.l The first regular Town Board meeting of the month was held at the Town Hall, 15 Terrace Rd. with Supervisor Robert P. Blatchley presiding. Other Board members present were: Justices Donald Eaton, & Ronald Fish, and Councilmen, Sherman Griswold and Ray Miller. Others present were: Town Clerk, Christine Canestaro; Deputy Town Clerk, Theresa Fortin; Town Attorney, John Gardner; Town Engineer, William Rowell; Zoning Enforcement Officer, Don Fowler; Highway Supt., Carl Eaton; Town Assessor, Robert Wells; Bookkeeper, Wayne Ezick; Legislators Delmar Palm and Henry Wadsworth; news reporter, Skip Chapman and several residents of the Town. The meeting was called to order by the Supervisor and the pledge of allegiance was given by all in attendance. • The Town Clerk read the minutes of the last meeting. There were no corrections or additions. Motion was made by Justice Eaton, seconded by Councilman Miller that the minutes be approved as read. Votes: Justice Eaton, aye; Justice Fish, aye; Councilman Griswold, aye; Councilman Miller, aye; Supervisor Blatchley, aye. Motion carried. Supervisor Blatchley advised he had contacted Air. Tom Pitts of the Fisher Ave. Soil Conservation Service concerning the drainage problem on Fisher Ave. Drainage and that he had written to the Lehigh Valley Railroad Co. regarding the LEHIGH possible purchase of the railroad line from the McLean Rd. to the town Valley RR line. The Town Clerk read the minutes of the special town board meeting held on October 27, 1976. Motion was made by.Justice Eaton, seconded by Justice Fish that the minutes be approved as read. Votes: Justice Eaton, aye; Justice Fish:, aye; Councilman Griswold aye; Councilman Miller, aye; Supervisor Blatchley, aye. Motion carried. Mrs. Canes -taro presented an application for the renewal of a house trailer permit she had received from Patricia Batsford. Zoning Enforcement Officer, Don Fowler said he had inspected the site and found no ordinance violations. RESOLUTION #123: HOUSE TRAILER RENEWAL PERMIT-PATRICIA BATSFORD Motion by Justice Eaton, seconded by Councilman Miller Votes: Justice Eaton, aye; Justice Fish, aye; Councilman Griswold aye; Councilman Miller, aye; Supervisor Blatchley, aye. Adopted. BE IT RF50L'VED, That the Town Clerk is hereby authorized and directed to issue a house trailer renewal permit to Patricia Batsford upon payment of the proper fee, for her house trailer located on Ridge Rd. Highway Supt., Carl Eaton reported he could obtain two used radios for the cinder trucks at a total cost of $1100, installed. The radios are two years old and carry a guarantee. A similar #16 radio had been purchased last year at a cost of $942.35 for one. RESOLUTION #124.- AUTHORIZATION TO PURCHASE TWO USED RADIOS FOR THE • HIGHWAY DEPT. Motion by Justice Fish, seconded by Councilman.Miller. Votes: Justice Eaton, aye; Justice Fish, aye; Councilman Griswold aye; Councilman' Miller, aye; Supervisor Blatchley, aye. Adopted. BE IT RESOLVED, That the Highway Supt.,is hereby authorized to purchase two (2) used, guaranteed, radios offered by Bush Electronics at a total cost of $110.0.00, installed. All voted aye. Motion carried. Supervisor Blatchley reported briefly on the activities and accomplishments of his office during the past year. He commented on the excellent cooperation he had received from the local level of State Government, County Government, and Town Government in resolving problems brought to his attention. Supervisor Blatchley gave the following report on the financial status of the town as of 10/31/76: General Fund Balance $59,313.30 Federal Revenue Sharing Fund Bal. 3,800.56 Water Dist.#1 Balance 103,128.33 Water Dist. #2 Balance 1,108.77 Water Dist. #3 Balance 5,786.54 Sewer Dist. #1 Balance 45,746.34 Highway Fund Balance 62,885.91 comprised of: Repairs & Improvements $17,683.64 Bridges 10,615.58 Machinery 15,174.60 Snow Removal & Misc. 19,412.09 Colosurdo Supervisor Blatchley advised the Board that Attorney John Petition Fitzgerald, representing Michael & Patricia Colosurdo had called and asked that action on the petition for re -zoning be postponed for two weeks. Terrace Rd. Regarding the hearing on the Terrace Rd. area sewers, Mr. Sewers Blatchley advised that Attorney Gardner and Engineer Wm. Rowell were working on changes in the description in the resolution and more time would be needed for its completion. F.H.A. Supervisor. Blatchley advised he had contacted Mr. Keith Jennison Funding for who told him it was possible to get F.H.A. funding for this sewering Sewers project if there was enough funds maining.��f.ter:L$ifal-lap.cpir® j is already funded had been completed. Ext.of The extension of Sewer Dist. #1, to include some properties on Sewer Dist.1 West Rd. & P.T.M. was discussed. Justice Fish raised the question, "if the district was extended, would funding be available for the entire project on one application or would two applications have to be made?". Mr. Rowell explained that two applications for funding would have to be made; one for funding for an improvement within an existing district and the other for the funding of an extension of the district and construction of new facilities. Attorney Gardner explained these funds could be available by grant, loan or both. Terrace Rd. Legislator, Delmar Palm asked if the application for Appalachin funds had been explored. He explained this funding program and said he thought the Town of Cortlandville stood a good chance to qualify.'fpr funds under this program as sewers are big priority items. Funds have been allocated for the year 1976 but he thought the town should apply for funds to be allocated for the year 1977. He also explained funding under the new "Economic Development Districts". These funds are 50% grants and if a municipality is in an Economic Development District, there will be an additional 10% grant. He said Cortland County will be in an Economic Development District._,:ac: He thought these funds would possibly be made available next year and applications may be available after February, 1977. He will keep abreast of this funding program and keep the town informed. He felt if it was at all possible to wait for these funds, the town should do so. Terrace Rd. Sewers Supervisor Blatchley suggested that the town move ahead Terrace Rd. with plans for construction of the Terrace Rd. area sewers and make Sewers application for funds as soon as they become available through whatever source possible. The Town Board agreed. Supervisor Blatchley advised Mr. Clarence Homer, who was in C.Homer attendance, that he had talked with the Mayor of the City of Cortland Petition for and the Town Attorney regarding Mr. Homer's petition for annexation annexation of his land to the city and so far, he has had no response from the mayor regarding a joint hearing on the petition. Attorney Gardner suggested he have his attorney contact him. (Atty. Gardner) RESOLUTION #125: ADOPTION OF BUDGET FOR THE TOWN OF CORTLANDVILLE FOR 1977 & ADOPTION OF SPECIAL DISTRICTS BUDGETS FOR 1977 Budgets Motion by Justice Eaton, seconded by Councilman Miller. Votes: Justice Eaton, aye; Justice Fish, aye; Councilman Griswold, aye; Councilman Miller, aye; Supervisor Blatchley, aye. Adopted. WHEREAS, The preliminary budget for the Town of Cortlandville and the preliminary budgets for Water District A, Water District #2, Water District #3, and Sewer District #1, for the year 1977 have been duly presented to the Town Board by the Town Clerk and a duly advertised public hearing has been held thereon, NOW THEREFORE BE IT RESOLVED, that the following addition be made to the Sewer District #1 preliminary budget: add $1,950 to a/c#SS9010.8 to cover the cost of Sewer District #i's share of the retirement plan for the employees of the sewer district. This makes a total appropriation for Sewer District #1 budget of $32,850.00 with estimated revenues of $20,295.00 and $11,925.00 used in unexpended balance leaving a zero amount to be raised by taxes, and BE IT FURTHER RESOLVED, That pursuant to Section 109, Subdivision 1 through 3 of the Town Law, the said preliminary budgets as revised and approved by the Town Board be, and they hereby are, adopted as the budgets for the Town of Cortlandville and said Special Districts, for the year 1977. RESOLUTION #126: APPOINTMENT OF WAYNE EZICK AS HEALTH ADMINISTRATOR FOR THE TOWN OF CORTLANDVILLE Health Motion by Justice Eaton, seconded by Councilman Griswold. Adminis. Votes: Justice Eaton, aye; Justice Fish, aye; Councilman Griswold, Appt/ aye; Councilman Miller, aye; Supervisor Blatchley, aye. Adopted. BE IT RESOLVED, That Wayne Ezick be, and he hereby is, appointed Health Administrator for the Town of Cortlandville with his term of office running concurrently with his term of office as bookkeeper to the Supervisor. l 1,20 Wednesday, November 3, 1976 Pg.4 Supervisor Blatchley read the following letter from the Town Planning Board: Letter Robert Blatchley, Supervisor from Town Town of Cortlandville, Planning Bd. 15 Terrace Rd. Re. Roads Cortland, New York 13045 on 701 map Dear Bob: Re: Recommended Changes Land Use Plan as prepared by V. Metcalf. The Planning Board and CAC members would like an opinion from the Town Board relative to #22 in his summary prepared October 18, 1976. They would like a written report on or before the next scheduled meeting which will be held on Nov. 8, 1976 at 7:30 p.m. at the F.K.Taylor Fire Station, 111 West Road. Motion carried. Roads 701 map Justice Eaton stated his opinion was that any road going into a development would go in at the time of development and be put in by the developer. He did not feel the Town Board could write these roads in the map, as they did not know who was going to develop the land nor where the land was going to be developed. Attorney Gardner said he had advised the Town Planning Board at Roads 701 map their meeting that the proceedure followed in the past was that the land owner developed the road then deeded it over to the Town and that by laying out roads in undeveloped lands, would bind future administrations. He advised against it. The Town Board concurred that the roads so placed in these areas, should be deleted from the map and not written in until the time of development. The Town Board directed the Town Attorney to write a letter to the Town Planning Board advising them of this decision, the letter to be signed by the Supervisor. Env.Comm. Supervisor Blatchley advised the Board that the Environmental project Commission had raised enough money through the sale of the Rte.281 & 13 Cortlandville medallions to make beautification improvements at the triangle of Rte. 281 & 13. Their plans are to place a flag pole, which is being donated by Brockway Motors, Inc., and a flag on this plot of land, also some boulders and a sign"Welcome to the Town of Cortlandville". He said the state has given their permission for this project and the Environmental Commission wanted the Town Board's approval also. When asked by the Supervisor if the Board would give their consent to this project, there was no response. He asked if they thought there would be any problem with it? There was no response. Firemen rgquest for Supervisor Blatchley said he had met with the firemen and they heating & would like improvements made in the heating system of the meeting ceiling improv. room and the ceiling of the meeting room. Justice Eaton suggested that if the recommendations made by Justice Fish at previous meetings do not work, then the town should consider putting in a new heating system before anything is done to the ceiling and before insulation is installed, to facilitate the installation of heat ducts, etc. The Board asked Justice Eaton to look into the cost of a new furnace which would accommodate the entire building. In the mean time, the firemen were given permission to move a heater from the front bunk room to the meeting room at their expense. Clinton St. Supervisor Blatchley advised that County Highway Supt., Walter Bridge Tennant had called him requesting a resolution from the Town Board stating that the town wishes to co-operate with the county on the reconstruction of the Clinton St. bridge in the Village of McGraw. The town's obligation would be 1510fo or up to $6,750.00. BRIDGE, McGRAW' Motion by Councilman Miller, seconded by Justice Fish. Votes: Justice Fish, aye; Councilman Griswold, aye; Clinton St. Councilman Miller, aye; Supervisor Blatchley aye. Bridge Justice Eaton did not vote as he was not in the room when this resolution was made. Adopted. WHEREAS, in the interest of safety and welfare, it has been deemed necessary to reconstruct the Clinton St. Bridge in the Village of McGraw, and WHEREAS, The County of Cortland has asked the co-operation • of the Town of Cortlanville to pay its share (I-V.) of the cost of said reconstruction, NOW THEREFORE BE IT �( RESOLVED, That the Town of Cortlandville does hereby , commit itself to the County of Cortland in sharing the expense of the reconstruction of said Clinton St. bridge, said expenditure to be 1% of the total cost, not to exceed $6,750.00, whichever is less, as the Town of Cortlandville's share of the cost. TOWN ENGINEER, WILLIAM ROWELL'S REPORT GROTON AVE. SEWERS: He, Mr. Blatchley, and Attorney Gardner met with Mr. Porter and his attorney regarding the details of the formation of Sewere Dist. #2. There is more work to be done on these details by Mr. Porter. He will get back to the town when this work has been completed. Groton Ave. sewers DRAINAGE. FISHER AVE. AREA: - He and Mr. Blatchley met with Fisher Ave. interested parties today and discussed details drainage of the district and a possible source for minimum funding and technical service which they are at present investigating. RESOLUTION #128: AUTHORIZATION TO PAY AUDITED BILLS Motion by Justice Fish, seconded by Councilman Miller. Votes: Justice Fish, aye; Councilman Griswold, aye; Councilman Miller, aye; Supervisor Blatchley, aye. Justice Eaton did not vote as he had been called out of the room and was not present when this resolution was made. Adopted.
