Blatchley presiding. Other Board members present were: Justices,Donald Eaton and Ronald Fish and Councilmen, Sherman Griswold and Ray Miller. Others present were: Town Clerk, Christine Canestaro; Deputy Town Clerk, Theresa Fortin; Town Attorney, John Gardner; Town Engineer, William Rowell; Highway Supt., Carl Eaton; Zoning Enforcement Officer, Don Fowler; Town Assessor, Robert Wells; Water & Sewer Dept. Supt., Fred Walker; Bookkeeper, Wayne Ezick; Legislator, Delmar Palm and news reporter, Skip Chapman. A public hearing was held on the preliminary budgets at 7:30 p.m. Public Hrg. Re; budgets A transcript of the hearing is on file in the Town Clerk's office. • The regular meeting was called to order by the Supervisor at 8:08 p.m. Minutes of the special meeting held on 10/1/76 were approved as Min. of 10/1 presented on motion of Justice Fish, seconded by Councilman Miller. approved Votes: Justice Eaton, aye; Justice Fish, aye; Councilman Griswold, aye; Councilman Miller, aye; Supervisor Blatchley, aye. Motion carried. Minutes of the previous, meeting of the Town Board held on Oct. 6, Min of 1976 were approved as presented on motion of Justice Eaton, seconded by 10/6/76 Justice Fish. Votes: Justice Eaton, aye; Justice,Fish, aye; Councilman approved Griswold, aye; Councilman Miller, aye; Supervisor Blatchley aye. Motion carried. The Town Clerk presented an application for the renewal of a house Renew Hse. trailer permit received from Frank Buerkle, Jr.. Zoning Enforcement tra.permit Officer, Don Fowler said he had inspected the trailer site and found no Frank Buerkl ordinance violations. RESOLUTION #117: TRAILER PERMIT RENEWAL -FRANK BUERKLE, JR. Motion by Councilman Miller, seconded by Justice Fish. Votes: Justice Eaton, aye; Justice Fish, aye; Councilman Miller, aye; Councilman Griswold, aye; Supervisor Blatchley, aye; Adopted. BE IT RESOLVED, That the town :clerk is hereby authorized and directed to issue a house trailer renewal permit to Frank Buerkle, jr. upon payment of the proper fee, for his house trailer located on lot #68, Carr Hill Rd. Legislator Delmar Palm apprised the board that the County Legislature County had passed the County Recreation Program resolution at the last meeting. Rec.Program He hoped the town would consider participation in the program when the passed time comes. Supervisor Blatchley said he had contacted Legislator, Robert Bays and advised him theAown will be interested in participation in the program. Justice Fish advised that the Cortland County Development Co. was, at new the present time, working on bringing two major industries into the town. industries Highway Supt., Carl Eaton said he.had been asked to get permission from the town board to burn an old building. The building is to be torn permission requested down and transported to the town landfill site and burned there. The land to burn fill site is closed to public use. Justice Eaton advised that the policy bldg. • of the town board, in the past, has been that if a permit could be obtained from D.E.C. and the County Health Dept. to burn material of this nature, the board would not object. Carl was advised to proceed accordingly. Upon question from Justice Eaton, Fred Walker advised he had not, as filed Water yet, work orders weekly with the town clerk, as he had been directed Dept. to do by the town board. He said he would start this week as he did not work order, have a full week last week. Supervisor Blatchley reviewed a letter he had received from James O'Mara, Letter County Safety Coordinator, in which Mr. O'Mara points out -that the Cortland from County Self Insurance budget has increased from $38,375.50 to $83,121.08 J.O'Mara annually, &it has been determined that a great percentage of claims are the re. result of carelessness which could be corrected by stressing defensive driving Self and operating techniques. A list of possible faults, due to carelessness, Ins. was attached. Motion was made by Justice Eaton, seconded by Councilman Miller Program to receive and file the letter. Wednesday, October 20, 1976 pg. 2 Ld.tter Supervisor Blatchley read a letter he had received from Letter from D.E.C. Peter A.A.Berle, Dept. of Environmental Conservation, Albany, N.Y. from D.E.C. re:solar regarding the concern for energy, in which he asked that serious- re:solar heating consideration be given to the possibilities of solar heating for new heating buildings and for retrofitting existing homes. Enclosed were guide- lines prepared by the D.E.C. to help people learn some of the requirements of solar heating. Motion was made by Councilman Miller, seconded by Justice Eaton to receive and file the letter and guideline. All voted aye. Motion carried. Water Supervisor Blatchley advised that application for the Water Dist.#5 creation of Water Dist. #5 had been filed with the Dept. of Audit & Dist.#5 Control and application for F.H.A. funds had been filed with Mr. Keith Jennison. Polling Mr. N. Ross Hall of Lamont Cr. thanked Mrs. Canestaro and Dist.6 • Place the town board for changing the voting place Legislative Dist. 7- Polling place Dist.6 Cortla.ndville Dist. 6, from the South Cortland Grange to the municipal building on Rte. 281. Intersection Mr. Hall complained that the reconstruction of the Intersection Rt.281,Rt.13 intersection at rte.281, Lamont Cr. & Rte.13 was very poorly done Rte.281,Rte. Lamont Cr. and that the location of the stop lights and the stop lines posed a 13,Lamont Cr. improvement threat to safety at this intersection. He wondered if the town board improvement complaint could do something about the situation. complaint Legislator, Delmar Palm advised he had been in contact with the state dept. regarding this problem and they had told him they wanted to go through one winter with the present set up to see if there were any real problems. Supervisor Blatchley said he and Legislator Palm would make personal contact with D.O.T. to see what can be done about the situation. Proceedure Proceed.fo3uk. followed Mr. Hall asked what parlimentary proceedure was followed for Town town board town meetings. Supervisor Blatchley advised him he had been following Board meetings Roberts Rules of Order, for the most part. However, Town Law requires Meeeting the Supervisor to vote on every issue and he is also permitted to make and second motions. Justice Eaton advised that the Town Law states "the Supervisor shall conduct the meeting" and this is what is done. An agenda is drawn up in advance and followed at each meeting. Municipal B1dg.Rte.281 Fire Chief, Bruce Moss requested the following items for the Municipal Frank K. Taylor Hose Co. #4 station: Bldg. Skating rink heat 1. A 2" water line to supply water for flooding the skating rink. Rte. thermostat 2. An additional heater for the meeting room. He said they 281 would install a heater and insulation if the material were provided. 3. A thermostat for the heater in the main room. Justice Eaton advised him thELt Justice Fish had studied the problem and had recommended that the doors to the meeting room be left open when not in use to take advantage of the warm air circulating from the main room and the heaters in the meeting room be turned on 2 to 3 hrs. before use of the room. Justice Eaton suggested that, in order to conserve heat when the engines were running, an exhaust port be installed in the • overhead doors: Highway Supt. said there was an exhaust hose in the highway dept. which could be used by the fire dept. Justice Eaton is to follow through on this. RESOLUTION #118: AUTHORIZATION TO INSTALLTPE & HOSE CONNECTIONS AT MUNICIPAL BLDG. - RTE. 281 Motion by Justice Eaton, seconded by Councilman Griswold. Votes: Justice Eaton, aye; Justice Fish, aye; Councilman Griswold, aye; Councilman Milbr, aye; Supervisor Blatchley, aye. Adopted. BE IT RESOLVED THAT;' the Water Dept. Supt. be and he. hereby is authorized and directed to install ateeand a hose connection in the existing 2" water line at the municipal building on Rte.281 to supply water for flooding the skating rink. Wednesday, October 20, 1976 Pg. 3 Mrs. Canestaro reported she had been compiling a list of Amend.appt. town officials and their terms of office, and in so doing, had of Francis discovered that Francis Sears had been reappointed to the Board of Sears Assessment Review 1AI75 and his term of office did not expire until 4/30/75. Also that Willard Griswold had not been rea pointed to the Town Planning Board. His term of office expired 12 31/74. RESOLUTION #119: AUTHORIZATION TO AMEND RESOLUTION #5-1975 pg.121 Motion by Justice Eaton, seconded by Councilman Miller® Votes: Justice Eaton, aye; Justice Fish, aye; Councilman Griswold, aye; Councilman Miller, aye; Supervisor Blatchley, aye. Adopted. • WHEREAS, an error wa&_made in the date of appointment of Francis Sears to the Board of Assessment Review, NOW THEREFORE BE IT RESOLVED, That resolution #5, 1975, Pg. 121 of the minute book be amended to read "commencing May 1, 1975 and expiring April 30, 1980'.' RESOLUTION #120: RE -APPOINTMENT OF WILLARD GRISWOLD TO TOWN PLANNING BOARD Motion by Councilman Griswold, seconded by Justice Fish. Votes: Justice Eaton, aye; Justice Fish, aye; Councilman Griswold, aye; Councilman Miller, aye; Supervisor Blatchley, aye. Adopted. WHEREAS, The re -appointment of Willard Griswold to the Town Planning Board was inadvertantly overlooked, and WHEREAS, his term of office expired December 31, 1974, NOW THEREFORE BE IT RESOLVED, That W illiard Griswold is hereby re -appointer) to serve a five year term on the Town of Cortlandville Planning Board, and BE IT FURTHER RESOLVED, That his term of office commence retroactively to January 1, 1975 and expire on December 31, 1979. Appt. of W.Griswold to planning bd. retroactiv, Supervisor Blatchley advised that the Town Planning Board had recommended appt.of a geologist be appointed to the Citizens Advisory Committee for the J.Fauth 701 program and recommended the appointment of John Fauth, Professor of to Advisor, Geology.- Comm. RESOLUTION #121: APPOINTMENT OF JOHN FAUTH TO THE CITIZENS ADVISORY COMMITTEE Motion by Councilman Miller, seconded by Justice Fish. BE IT RESOLVED, on recommendation of the Town of Cortlandville Planning Board, John Fauth, Professor of Geology, is hereby appointed to the 701 Citizens Advisory Committee. RESOLUTION #122: EXTENDING FEDERAL HOUS ING.ASSISTANCE PAYMENT PROGRAM • _ (SECTIONS) TO THE TOWN OF CORTLANDVILLE Motion by Justice Eaton, seconded by Councilman Miller. WHEREAS, the Cortland housing Authority is a participant in the U.S. Housing and Urban Development's Housing Assistance .Payment Program (Section 8), and WHEREAS, H.U.D. desires that the said program be extended beyond the territorial limits of the City of Cortland, and WHEREAS, the Board desires that the said program be extended to include the territorial limits of the town excluding the territiorial limits of the Village of McGraw, Federal Housing Assist..-,,: program NOW THEREFORE, BE IT I A" Wednesday, October 20, 1976 Pg. 4• RESOLVED, That the Board on behalf of the Town of Cortlandville, hereby consents that the Cortland Housing Authority extend the Housing Assistance Payment Program (Section 8) to include the territorial limits of said Town excluding the territorial limit of the Village of McGraw. Eng.Re t. ENGINEER-WM. ROWELL REPORT Water Dist.#5 L. WATER DIST.#5 - application has been sent to the Dept. of Audit & Control. Water Rates 2. WATER RATES: an investigation is being conducted and data is being gathered for review of present water rates in the various water districts. Sewers 3. SEWERS = TERRACE RD.AREA a public hearing will be held Terrace Rd. regarding the construction of these sewers at • the town hall on Oct. 27, 1976 at 8:30 p.m. Groton Ave. GROTON AVE:- has responded to correspondence received from W ill iam Porter regarding details of Groton Ave. Sewer Dist. and is presently awaiting further word from Mr. Porter. Fisher Ave. 4. FISHER AVE. DRAINAGE- he attended a meeting regarding the Drainage problem feasability of forming a drainage district for this area. A committee was established, informally, at this meeting to act as a liaison back to the town. The purpose of the meeting was to talk about the encasement of some of the drainage on properties adjacent to the fairgrounds. Mr. Rowell recommended that any expense undertaken in that area, be done, if possible, in accordance with the general overall plan. A copy of the prelimina3y plan for improvement had been presented ly, him at the meeting. The area encompassed in the plan, was basically from the existing pipes near rte. 11 to the drainage facilities across rte.281. Thoughts were discussed on what might be done. He is presently awaiting possible further action of the property owners. Justice Fish requested the Town Attorney to research the law relating to the town rechanneling of streams in the town which,cIrun; through private property. Attorney Gardner advised that in a prior investigation of this same situation, it was concluded that perhaps the culverts running across route 11 were not large enough and recommended discussing this with the State Highway Engineers. Justice Eaton said he did not think the Town would have any obligation unless a road or bridge was in jeopardy. Attorney Gardner concurred. Justice Fish stated that there was a road in jeopardy. Engineer, Rowell drew a sketch of the problem area on the Mack board and explained it in detail, including the rechanneling of the stream. Attorney Gardner suggested, if this extensive work was to be done, a Drainage District of the benefited area should be formed to pay for the is of the improvements. Supervisor Blatchley advised that he had talked with County Highway Supt., Walter Tennant regarding this problem and Mr. Tennant suggested he contact Tom Pitts of the Soil Conservation Service. Mr. Blatchley has not been able to contact him, as yet, but will pursue it and report back to the board. Mr. Blatchley reported that Gutchess Lumber Co. is interested in Re:possssible purchasing the part of the railroad that goes through their property, and purchase of the strip that lies behind Lamont Cr. which extends to Stupke Rd. with the ,ehigh Valley possiblity of also purchasing the entire strip which runs from the Gutchess RR line property line to Freeville. At, the present time, Lehigh Valley Railroad plans to abandon the line ,a�dotmencing at the end of the Overhead Door Co. property line. Wednesday, October 20, 1976 Pg. 5 1 -. 5 1 • 1 • 1 After some discussion, Mr. Rowell recommended that, if possible, Lehigh the lines should be obtained by the Town or the County, as they provide Valley RR excellent locations'for highways, water transmission lines, sewer trunk lines, etc. Attorney Gardner read the letter received by the Supervisor from Lehigh the Dept. of Transportation regarding the abandonment and sale of the Valley RR railroad property. Motion was made by Justice Eaton, seconded by Councilman Miller to receive and file the letter. All voted aye. Motion carried. Mr. Rowell recommended that if the cost was modest, the town should consider the purchase of strip of railroad that runs through the town in order to maintain control over it. Permission can then be granted to those persons wishing to use the line. Supervisor Blatchley was authorized to write a letter to the Sup. auth.to Lehigh Valley Railroad Co. regarding the possible purchase, by the write letter Town, of the strip of -line discussed above. to L.V.RR Regarding grading work at Well #3 site, Mr. Rowell said he would Well #3 contact the contractor and advise him that it was not satisfactory. Justice Eaton reported that the improvements requested for the Municipal Bldg. on Rte. 281, at the last meeting of the Town Board, had been taken care of. Supervisor Blatchley advised he had talked briefly with Mayor Re.C.Homer Forcucei regarding the petition of Clarence Homer and Paul Olney request for for the annexation of their lands to the City of Cortland. No date annexation has been set for the joint public hearing as yet.
