The first Town Board meeting of the month was held at the
Town Hall, 15 Terrace Rd. with Supervisor, Robert P. Blatchley
presiding. Other Town Board members present were: Justices,
Donald Eaton and Ronald Fish and Councilman, Sherman Griswold.
Councilman, Ray Miller was absent. Others present were, Town Clerk,
Christine Canestaro; Deputy Town Clerk, Theresa Fortin; Town Attorney,
John Gardner; Town Engineer, William Rowell; Water & Sewer Supt.,
Fred Walker; Town Bookkeeper, Wayne Ezick and several residents of
the town.
An executive session of the Town Board was held at 7:15 p.m.
The regular meeting was called to order by the Supervisor at 7:40
® p.m. and the pledge of allegience was given by all in attendance.
Reading of the minutes of the last meeting was dispensed with
as all board members had read them prior to the meeting. Upon motion
by Justice Fish, seconded by Councilman Griswold, the minutes were
approved as presented. Votes: Justice Eaton, aye; Justice Fish, aye;
Councilman Griswold, aye; Supervisor Blatchley, aye. Motion carried.
Mrs. Canestaro read a letter from Cortland County Office for the Letter
Aging announcing that individual municipalities will continue to be from County
eligible for state aid for senior recreation projects. The cost ratio Office for
is 50150. The letter advised that the Cortland Office for the Aging Aging
could offer assistance in planning development, coordination and
integration of local projects. Motion was made by Justice Eaton,
seconded by Justice Fish to receive and file the letter. Votes: Justice
Eaton, aye; Justice Fish, aye; Councilman Griswold, aye; Supervisor
Blatchley, aye . Motion carried.
Mrs. Canestaro read a notice from New York State Dept. of Transportation
regarding Case #28442-proceeding on motion of the Dept. as to proposed Greyhound
increased fares of Greyhound Lines, Inc.. The public hearing is to be Fare Incre-
held at the State Office Bldg., 333 E. Washington St., Syracuse, N.Y., ase notice
on Tuesday 11/9/76 at 10:00 A.M.. Motion was made by Justice Fish,
seconded by Justice Eaton to receive and file the notice. Votes: Justice
Eaton, aye; Justice Fish, aye; Councilman Griswold, aye; Supervisor
Blatchley, aye. Motion carried.
Assessor,Robert Wells made the following report and recommended
that the Town accept the law "as is" without changing the percentage
of exemption reduction:
COMMERCIAL & INDUSTRIAL EXEMPTION
Chapter 278 - Real Property Tax Law - adds section 485 B - Laws of 1976.
Permits a 10 year exemption to Business, Commercial, and Industry uses Assessor
of 50%, first year, for new construction, alterations, improvements Report
and installations if they exceed $10,000. Does not apply to Apartments, Re Bus.
Condominiums or Cooperatives, (Residential use. Construction must Comm.&
have been started after January 1, 1976 and completed after July 1,1976. Indus.
51"lo reduction in exemption each year until none remains after 10 years. exemptions
Exemption terminates if use changes to a non -eligible use.
Eligibility and amount of exemption, determination of Assessor.
® Town may, by local law, reduce % of exemption or entirely eliminate
the exemption. Town may establish "incentive Board" (an officer or
a group) to review economic conditions, make recommendations as to
actions deemed desirable to improve economic climate. Any local law
to reduce or eliminate % of exemption is subject to referendum on
petition. (Municipal Home Rule Law, Sec.24).
The Board decided to accept the law "as is" and not make any
reduction in the amount of exemption specified.

a portion of the streets and highways in the Town shown on the map of
lands of Nathan J. Munson, Lot No. 83, Cortlandville, New York, made by
M. C. Bean, Surveyor, and filed as Map No. 225 in Cortland County
Clerk's office on November 18, 1925, as follows: A distance of 1218
plus or minus feet easterly along McLean Road from its intersection
with Terrace Road; a distance of 600 feet southerly along Terrace Road
from its intersection with McLean Road; a distance of 500 feet southerly
along Pleasantview Drive from its intersection with McLean Road; a
distance of 400 feet southerly along Munson Avenue from its intersection

WHEREAS, a resolution was adopted by the Town Board of the
Town of Cortlandville, Cortland County, New York, on the6th day
of October, 1976, pursuant'to Section 199 of the Town Law, proposing
the construction of lateral sewers.in and along a portion of certain
streets in said Town known as McLean Road, Terrace Road,Pleasantview
Drive and Munson Avenue and a proposed easement running over private
lands all within the.confines of Sewer District No. 1 of the Town; and
WHEREAS, the expense of providing such improvements shall be
approved and assessed, pursuant to Section 202 of the Town Law, upon
several lots and parcels of land deemed benefited in proportion to
the amount of benefit which the improvement confers upon the same; and
WHEREAS, the maximum amount proposed to be expended for such
improvement is $90,000.00; and
WHEREAS, the area to be benefited by such improvement is shown
on the Plan View of Terrace and McLean Sewers, Sewer District No. 1,
Town of Cortlandville, Cortland County, New York, made by Rowell and
Associates, Surveyors -Planners -Engineers, dated April 7, 1976, and

hear all persons interested in the subject matter thereof concerning the
same, and for such other action on the part of said Town Board with
relation to the said proposal as may be required by law or proper in the
premises.

Attorney Gardner asked Mrs. Canestaro to read from his letter
dated 10/6/76, the list of items necessary for the preparation of the
application to the Dept. of Audit & Control for the creation of
Water District #5. A discussion followed.
Supervisor Blatchley turned over the application for F.H.A.
funds for the South Cortland Water project to Attorney Gardner and
asked him to review it. Attorney Gardner said he would review the
application and return it to the Supervisor.
Mel Pierce, a resident of South Cortland, requested assurance
from the Town Attorney that the application to the Dept. of Audit and
Control, for the creation of Water Dist. 5 would be completed within
10 days after approval of the creation of Water District #5 by the
Town Board, as required by law.

Justice Eaton asked Attorney Gardner if the previous approval
were rescinded and a new resolution adopted for the approval of the
district, would he have enough time to make the application to the
Dept. of Audit and Control. Attorney Gardner said if the data he
requested in the letter read by Mrs. Canestaro was given to him, he
could and would do it.

WHEREAS, The Town attorney did not have at his disposal the
proper maps and pertinent information necessary to draw up
the legal resolution for the creation of Water -District #5; and
WHEREAS, additional time is needed to compile data for the
preparation of the application to the Dept. of Audit and Control,
NOW THEREFORE BE IT
RESOLVED, That Resolution #101 (Approval of the Creation of
Water District #5) adopted 9/15/76 by the Town Board is hereby
rescinded.

WHEREAS, a Petition for the creation of a Water District to be
known as "Water District No. 5" in.the Town of Cortlandville,
Cortland County, New York, said Petition being dated the 28th
day of July, 1976, was duly presented to this Town Board, together
with the necessary map and plan attached thereto; and
WHEREAS, an Order was duly adopted by the Town Board on the 4th
day -of August, 1976, reciting the filing of said Petition, the
improvements proposed, the boundaries of the proposed district
and the estimated expense thereof and specified August 25, 1976,
® at 8:00 o'clock PM as the time and the Town Hall in the said
Town of Cortlandville where said Board would meet to consider the
petition and to hear all persons i_nterested,in the subject thereof
concerning the same; and
WHEREAS, such Order was duly posted and published as required by
law; and
WHEREAS, a hearing in the matter was duly held by the Town Board
on the.4th day of August, 1976, commencing at 8:00 o'clock PM
at the Town Hall in the said Town, and considerable discussion
upon the matter having been had and all persons desiring to be
heard having been duly heard, including the petitioners in person,
and various other persons speaking in favor of the establishment
of the proposed district.

Now, upon the evidence given upon said hearing and upon
motion of Justice Donald Eaton, seconded by Justice
Ronald Fish and unanimously passed, it is
RESOLVED AND DETERMINED, That (a) the petition aforesaid is
signed and acknowledged or proved as required by law and it
duly complies with the requirements of'Section 191 of the
Town Law as to sufficiency of the signers and it is other—
wise sufficient; (b) all the property and property owners within
the proposed district are benefited thereby; (c) all the
property and property owners benefited are included within
the limits of the proposed district; and (d) it is in the
public interest to grant in whole the relief sought; and it
is further
RESOLVED AND DETERMINED, That the establishment of a Water
district as proposed in said petition be approved; and that
the improvements therein mentioned be acquired and the
service therein mentioned be provided for upon the required

Water Dist. .RESOLVED, That the proposed improvements, including costs
#5 of rights of way, costs of acquisition, legal fees and all other
expenses shall be financed as follows: By a'serial bond issue
extending,over a.forty (40) year life period; and it is further
RESOLVED, That the Town Clerk of this Town shall within ten
(10) days after the adoption of this resolution, file certified
copies thereof in duplicate in -the office. of the State Department
of Audit& Control at Albany, New York, together with an application
by this Board in duplicate, for permission to create such district
as provided by the Town Law, Section 194; and that -such application
shall be.executed by and in behalf of the Town Board by the.:Supervisor
of the Town.
Michael H. Colasurdo explained in detail the petition he
had filed with the Town Clerk on 10/1/76. The petition requests an
amendment to the zoning ordinance and zoning map to change the use
and classification of certain lands lying on the East side of N.Y.S.
Rte.13 from residential district (R-1) to Business District. This
request was made so that he could construct and operate a minature golf
course and soft ice cream parlor on the property. Motion was made by
Justice Fish, seconded by Justice Eaton to receive and file the petition.

BE IT RESOLVED, That a public hearing be October 27, 1976
at 7:30 P.M. at the Town Hall in the matter of the Application
of Michael H. Colasurdo and Patricia A. Colasurdo to amend
the Zoning Ordinance of the Town of Cortlandville and the
Zoning Map Made a Part thereof to change the use and
classification of certain lands plying on the East Side
of'NYS Route #13 from a Residential District (R-1) to
Business District.
RESOLUTION #114: AUTHORIZATION FOR VICTOR METCALF TO ATTEND NEW YORK
STATE FEDERATION OF PLANNING OFFICIALS CONFERENCE

BE IT RESOLVED, That Victor Metcalf be, and he hereby is
authorized to attend the NEW YORK State Federation of Planning
Officials Annual Meeting being held at Kutsher's Country Club,
Monticello, New York on Oct. 10, 11 and 12, 1976; and
BE IT FURTHER RESOLVED, That all necessary expense incurred
for same, be reimbursed, subject to audit by the Town Board.
Supervisor Blatchley announced that on October 19, 1976,
there will be a meeting of the Planning Board and Citizens Advisory
Council concerning the use of the new tax maps. Mrs. Palm advised
that this meeting was not open to the public as it was going to be a work
meeting.
Supervisor Blatchley advlse6rhetthad made three minor changes in
the budget as follows:
1. The change in the salary of Fred Walker, Jr. was made pursuant
to the direction of -the board.
2. $710.00 was added to the ambulance account (A4540.4) to cover
additional cost of new equipment for the ambulances.

salary being transferred to Water District #3. This will change
the tentative tax rate in Water District #1 from .568 to .5114 per
$1, 000 .
Supervisor Blatchley announced there will be a meeting at Fisher Ave.
the Seven Day Advantist School House, Fisher Ave. on Monday 10/11/76 Drainage
at 4130 pm to discuss the drainage problem in the area of Fisher Ave. Meeting
Justice Fish advised that the sluce on South Main St. and the
sluce on Saunders Rd. were plugged and that the Highway Supt. should Sluce
be made aware of this. Justice Eaton said he would apprise the So.Main &
Highway Supt. of the problem. Saunders Rd.
• Justice Fish said he had made further study of the heating Heating study
system at the municipal bldg. on West Rd. He recommended that the Munic.Bldg.
doors to the meeting room be kept open when the building is not in West.Rd.
use so that it will draw.heat from the heater in the main building.
If this doesn''t work, he suggested one more heater be installed in
the meeting room.
Justice Eaton apprised the board that he had received one Munic.Bldg.
estimate,for the insulation of the municipal building on West Rd., Insulation
from Insulation Contractors. The estimate of $5,123.15 was based Estimates
on complete insulation of the entire building including ceiling
and outside walls. He is expecting estimates from two other
companies.
Justice Eaton suggested that the Water & Sewer Supt. file,
with the town clerk, work orders on work he performs during the Water & Sewer
week. This, he said, would provide better internal control and Supt. to file
the proper districts can be charged for the material and labor used. work orders

BE IT RESOLVED, That the Water & Sewer Dept. Superintendent
file work orders weekly with the Town Clerk, on work his
department performs during the week. This is to include
mileage, material and labor and"c,�rh6rer�ithe�-x6rk<--,:waab�performed,
so that the cost can be charged to the proper districts.
Re: Mr. Clarence Homer®s petition for annexation: Attorney
Gardner advised that the town must have a joint hearing with the C.Hoeti
City of Cortland before any action can be taken. Supervisor Blatchley Petition
said he would contact Mayor Foreucci regarding this petition. for annex.
Justice Eaton recommended the following improvements be made
at the municipal building on West Rd. to make it more suitable as a
polling place:
1. Install a light over the back door.
2. Provide distance marker signs
• 3. Repair the cord and curtain on the voting machine

Supervisor Blatchley said he would contact the Board of Elections
and make them aware of the needed repairs to the voting machine.
Justice Eaton said he would see to the signs and the light.
Justice Eaton and Justice Fish questioned the legality of the
luncheon for the beautification committee charged by the supervisor on
his expense voucher #366. After somediscussion, the item was deleted
from the voucher and the Supervisor asked to get an opinion from the
Dept. of Audit & Control before submitting the bill.
