The second regular Town Board meeting of the month was held
at the Town Hall, 15 Terrace Rd. with Supervisor, Robert P. Blatchley
presiding. Other Board members present were: Justices, Donald Eaton
and Ronald Fish; and Councilmen, Sherman Griswold and Ray Miller.
Other town officials present were: Christine Canestaro, Town Clerk;
Theresa Fortin, Deputy Town Clerk; William Rowell, Town Engineer;
Carl Eaton, Highway Supt.; Robert Wells, Town Assessor. Others
present were° Mr. Warren Eddy, Mr. Paul Geibel, and Dr. Boll
representing the Cortland Free Library; Legislator and Mrs. Delmar
Palm; Mrs. Goldner of the Cortland Housing Authority and news reporter,
Skip Chapman.
The Supervisor called the meeting to order and the pledge of
allegiance was given by all in attendance.

The Town Clerk read the minutes of the special meeting held on Approval

The Town Clerk read the minutes of the last regular meeting held Approval
on Sept. 1, 1976. There was one correction noted on page 2 (pg.91 of Min.Reg.Mtg.
minutes book). The name Mrs. Wright should be corrected to Mrs. Reichard. 9/l/76
Upon motion of Justice Eaton, seconded by Councilman Miller, the minutes

Motion carried.
Supervisor Blatchley announced that the public . hearing scheduled Public
for this evening had been cancelled due to the fact that the hearing notice Hearing
had not been published by the attorney. Cancelled
The Town Clerk read the following correspondence:
1. A letter from N.Y.State Dept. of Environmental Conservation, Letter from
Albany, N.Y. requesting information on the newly enacted D.E.C. re:
Wetland Law. These questions must be answered and filed Local Law #1
with D.E.C. within 30 days of the adoption of this Local Law.
Motion was made by Councilman Miller, seconded by Justice
Eaton that the letter be received and filed. Votes: Justice

carried.
Motion was made by Justice Eaton, seconded by Councilman
Griswold that the Supervisor and the Town Attorney obtain

The Town Clerk read a letter received from Katherine J. Wolpert,

DISTRICT #I - no substitute election inspectors
DISTRICT #4 - no substitute election inspectors
DISTRICT #5 - Mrs. Agnes Waas, 806 N. Lamont Cr. will replace
Mrs. Jessie White as a regular election inspector
DISTRICT #6 - Mrs. Catherine VanDonsel will replace Mrs. Nitamae
Goslee as a regular election inspector
Mrs. Catherine VanDonsel is removed as a substitute

Mrs. Canestaro reported that Mr. N. Ross Hall of Lamont Cr. had
Complaint entered a complaint regarding the conditions of the polling place in
Re:Elec.Dist. Election District #6 (South Cortland Grange. Justice Eaton stated
#6 he had also received a similar complaint from another person and he
had also had complaints from the election inspectors. Justice Eaton
recommended that action be taken to change the polling place from the
Grange building to the town owned municipal building, 111 West Rd.
RESOLUTION #99: AUTHORIZATION TO CHANGE POLLING PLACE IN ELECTION DIST.#6

BE IT RESOLVED, That the polling place of Legislative District
#7, Cortlandville Election District #6, be, and it hereby is,
changed from the Grange building, Rte.#281, to the municipal building
111 West Rd., and
BE IT FURTHER RESOLVED, That the Board of Elections, South Cortland
Grange, and the Frank Taylor Hose Co. #4 be duly notified of said
change.
Discussion A discussion was had on the need for insulation of the municipal
re insulating building, 111 West Rd. It was felt that if the building were properly
municipal insulated and perhaps heated by two oil burning furnaces, the heating
bldg.-W.Rd. problem would be solved. Futher study of the problem will be made.
Town Assessor, Robert Wells presented a "Status and Information"
Assessor report as of 9/15/76. A copy of this report is attached to and made a
Status & part of these minutes. Upon motion by Justice Eaton, seconded by
Information Councilman, Griswold, the report'was ordered received and filed.

Mr. Wells commended the Assessment Review Board on the excellent
job they had done.
Supervisor Blatchley stated the greater assessment base produced by
the County Re -Valuation Program would not be used as an excuse, on his part,
to increase town expenses. He would try to maintain a conservative budget.

Justice Eaton gave the following report on the activities of his
department during the month of August, 1976:
412 cases completed
$7,770.50 turned over to the state comptroller in fines & forfeitures
$1,564.00 being held in pending cases
Highway Supt., Carl Eaton reported that the paver he has been
using is a new demonstrator which has been used only twice by others.
The rest of the time, it has been used by the Town of Cortlandville.
He said the town could purchase the paver for approximately $6,000.
The Highway Supt. reported that his budget for the year is nearly
used up due to the increase in price of materials but he has more work
which should be done during the good weather. He said tl-d-, 17.3 miles of
road improvements had been done in 1975 at a cost.of $34,700. This year,
17.3 miles of road improvements cost over $40,000. He requested an
appropriation of $7,500 to cover the cost of 5/10 of a mile of blacktop
and 1&5/10 mile of stone and oil which he would like to get done before
bad weather sets in. Supervisor Blatchley said he thought there was an
unexpended balance in the revenue sharing account that could be used for
this purpose. The consensus of the board was, he should proceed according
to the monies available. He should discuss this with the bookkeeper and
Supervisor to see if there is enough money available in the highway budget
which could be transferred to the road improvement account. If there is
no money available in this account they should see what revenue sharing
monies are available to use for this purpose.
Supervisor Blatchley read a letter he had received 6/4/76 from
Gerald A. Cooley, County Supervisor, F.H.A. regarding the proceedure to
be followed for making application for F.H.A. funding for South Cortland
water. The letter stated "The Farmers Home Administration and the
Appalachian Regional Commission cannot proceed further with this request
until the residentsand the Town Board have authorized the project. The
engineers must finalize the scope of the project and project cost. The
Town must determine how user costs will be established and how vacant
property owners will be charged for benefit of the system'.
"When the above items have been concluded, the Town should provide
the balance of the documents and Form AD624, Application for Federal
Assistance".
Supervisor Blatchley apprised the Board that County Treasurer,
Walter Spencer, Jr. and Town Engineer, Wm. Rowell are working on the
information needed and all that is now lacking is the authorization
to form the district and authorization for the supervisor to sign the
application. Approval for the formation of the district was given on
8/25/76 but since the application to form the district was not made to
the Dept. of Audit & Control within 10 days of that authorization,
Attorney Gardner advised him that Resolution #90 should be rescinded.

The consensus of the Board was that since the Town Attorney had Water Dist.
neglected to draw up the necessary papers and resolution for the formation #5
of this district, the town engineer should be empowered to prepare the
necessary data for the application and the resolution describing the metes
and bounds of the proposed district and forward them to the Supervisor who
is to get in touch with the Town Attorney and ask him to review the data
for legalities. If the Town Attorney is unable to do so, the Supervisor
should contact another attorney to perform this task.

RESOLUTION #102: AUTHORIZATION FOR ENGINEER, WM. ROWELL TO PREPARE
NECESSARY DOCUMENTS AND RESOLUTION FOR THE CREATION OF WATER DIST.#5

authorized and directed to write up a formal resolution describing
the metes and bounds of Water District #5 and,which is to be used
as the text of Resolution #101.

After some discussion, upon motion of Justice Eaton, seconded by
Justice Fish, it was decided to hold a special meeting of the 'town board
on Friday, 10/1/76 at the town hall at 7:30 p.m. for the purpose of
reviewing, modifying and approval of the tentative budget for the year

RESOLUTION #104: SETTING DATE FOR PUBLIC HEARING REGARDING SEWERING FOR

public hearing be held,regarding sewering for the Terrace Road
area, on 10/6/76 at the town hall at 7:30 p.m.

Justice Fish reported on the survey he had been requested.to make

Supervisor Blatchley read a letter received from Attorney John
Petition A. Gee III stating a petition had been enclosed requesting the annexation
for annex. of lands owned by his clients, Clarence Homer, Marie Olney and Paul Olney,
C.Homer to the city of Cortland. Motion was made by Councilman Miller, seconded
& by Justice Eaton that the letter and petition be received and filed.

Mrs. Weeks of Isabel Dr. inquired what steps would be taken next on
this petition. Supervisor Blatchley advised her that a public hearing would
be held and that interested parties would be kept informed on any further
action regarding this petition.

Mrs. Weeks requested that the Zoning Enforcement Officer inspect Mr.
Homer's property again as she felt that he was making a multiple dwelling of
the barn, which is against the zoning ordinance for that area.

Supervisor Blatchley read a letter from Shirley G. Heppell,
President of the Cortland Free Library Board of Trustees, requesting
that an appropriation of $17,500 be made in the town°s 1977 budget.
The letter stated substantiating figures for the request. Motion was
made by Councilman Miller, seconded by Justice Eaton that the letter
be received and filed. Votes: Justice Eaton, aye; Justice Fish, aye;
Councilman Griswold, aye; Councilman Miller, aye; Supervisor Blatchley

Mr. Paul Geibel, a member of the Board of Trustees stated that
he and his board felt that the request made was "moderate and conservative
on the basis of the amount of use of the library by Cortlandville residents.

Authority explained the new ruling for participation in the rent subsidy Cortland
program under Section 8 of the existing housing assisstance program. Housing
This is a rental assisstance program and for the first time, the program program
will be extended to residents outside the city limits. There are 50
units available to residents outside the city. The program makes it
possible for eligiable participants to remain in their present units,
providing the units meet with the standards set forth by the housing
authority. The program provides subsidies for lower income families
paying more than 25110 of their annual income for rent. The appropriation
is for $104,000 per year for a contract period of five years. Mrs. Goldner
said, if the need arises for more units, she will make application for them.
Some concern was shown by board members that the program would cause
some landlords to raise the rents on their units and that after the five
year program was completed, the program would be defunded. Mrs. Goldner
assurd them this was not the intent of the program and that every precaution
would be used to prevent these things happening. She requested the board
to write a letter stating the Housing Authority is invited to administer
the Section 8 Housing Program in the Town of Cortlandville.

TO THE CORTLAND HOUSING AUTHORITY

BE IT RESOLVED,That the supervisor is hereby authorized and directed
to write a letter to the Cortland Housing Authority inviting them
to administer the Section 8 Housing Program in the Town of Cortlandville.
Engineer, William Rowell reported:that construction of the pump station
for well #3 had been started
2. The concrete block at the water relocation site on rte. 281 had Engineer
been removed. Report
3. He had inspected the test well on the Lamont Cr. playground and
found that a 6" well had been installed rather than the 4" requested.
4. He is in the process of preparing details relating to the
additional funds due for the 281-McLean Rd. water line relocation
® project. Mr. Blatchley signed the detail papers today and they
will be submitted for payment before the end of this week.
In answer to a question asked by Justice Eaton, Mr. Rowell reported
that the contractor for the water line relocation (Edlund Mfg. Co.) had Edlund
now fulfilled his obligation to his satisfaction and monies still due the Mfg. Co.
contractor could be approved for payment when the proper time comes.
There being no further business, upon motion of Justice Fish, seconded
by Councilman Miller, all voting aye, the meeting was adjourned at 9:30p.m..

1. Prediction: For the most part (70-30) actual tax
dollars should vary only slightly. The exception:
Those cases where current assessments are way out of
line, high or low...
h. A caution: Budgets -for the next year, '78, must be
watched very closely. Tax base will be increasing
sharply. County, Towns, Schools may be tempted to
enlarge budgets. This would be possible and still be
able to show a decrease in tax rate per thousand.
VI. To conclude: In my opinion Cortlandville is in good condition
generally. We are healthy, physically and economically;
growing at a desirable rate and in an orderly and reasonable
manner. Our assessment program is solid and relative to the
rest of the County, in excellent condition. We have great
input and cooperation from our People of the Town, and in
turn I'm very sure we give them our best, which is as it should
be. I personally want to .give every assurance and guarantee
that everyone in the Town will be treated as fairly and
equitibly as is possible within my powers.
