The second regular Town Board meeting of the month was held at
15 Terrace Rd., with Supervisor, Robert P. Blatchley presiding. Other
Board members present were. Jusiice,Ronald Fish and Councilman, Ray
Miller. Councilman,Sherman Griswold was absent due to illness and
Justice, Donald Eaton was attending a Justice Training Seminar at
St. Lawrence University. Others present were: Town Clerk, Christine
Canestaro; Deputy Town Clerk, Theresa Fortin; Town Attorney, John
Gardner; Town Engineer, William Rowell; Highway'Supt., Carl Eaton;
Town Assessor, Robert Wells; Water & Sewer Supt., Fred Walker; Legislators,
Delmar Palm & Henry Wadsworth; Mr. Ray Ingraham; Mr. Edward Lurie; news reporter
Skip Chapman; and several residents of the town.
- The meeting was called to order by the Supervisor and the pledge
® of allegience was given by all in attenance.
Reading of the minutes of the previous meeting was dispensed with, as
all members had been given a copy of the minutes and had read them prior
to this meeting. Motion was made by Justice Fish, seconded by Councilman
Miller that the minutes be accepted as presented. Votes: Justice Fish,aye;
Councilman Miller, aye; Supervisor Blatchley, aye; Motion carried.
The Town Clerk read an invitation addressed to the Town Board Jacobi
inviting them to attend the retirement dinner in honor of Joseph Jacobi, retirement
Supt. of Public Works, Village of McGraw, on Saturday, 8/14/76 at 7:00 p.m.
at the McGraw American Legion, Solon Rd. Motion was made by Councilman
Miller, seconded by Justice Fish, that the invitation be received and filed.
Votes: Justice Fish, aye; douncilman Miller, aye; Supervisor. Blatchley, aye.
Motion carried.
Supervisor Blatchley urged all who could to attend this dinner and
the McGraw Bicentennial dinner being held 7/29/76.
Mr. Edward Lurie an aide in Senator Tarky Lombardi's office advised
that Supervisor Blatchley had contacted Mr. Lombardi's office seeking aid
in applying for funding for the proposed water and sewer projects for the
town. He said that funding for these projects were available through the
Federj1 Government. However,his office did advise Congressman Hanley's
office and the State Dept. of Environmental Conservation that they would
do anything they could to expedite the paper work involved in applying
for these funds.

Assessor, Robert Wells asked the Board's permission to have the Assessor
Supervisor's bookkeeper make a transfer of monies allocated in the request for
assessor's contractual account, as the monies allocated for expenses, trans. of monies
other than Court fees had been completely depleted.
RESOLUTION #80: AUTHORIZATION TO TRANSFER $500 IN ASSESSOR'S CONTRACTUAL ACCOUNT
Motion, Justice Fish, seconded by Councilman Miller
Votes: Justice Fish, aye; Councilman Miller, aye; Supervisor Blatchley,
aye. Adopted.
BE IT RESOLVED, That the sum of $500 be transferred from account A-1355•4
Assessor Appraisal & Court Fees, to account A-1355.4, Assessor Contractual.

Justice Fish reported that the 701 Master Plan map had been completed Report on
by the County Planning Board and would be presented to the Town Planning 701 Mater
Board at their next meeting, 7/26/76, for their approval. After approval Plan
of the Town Planning Board, the maps would be presented to the Town Board
for approval and a public hearing. He commended the Citizen's Advisory
Committee for the excellent job they had done and the tremendous amount
of effort they had put into the rooster plan project.
Supervisor Blatchley commented he would like to see the South Cortland
water problem and the Terrace Rd. sewers resolved within the next couple of Groton
months. He reported there was a legal problem holding up the formation of A.Sewer
the sewer district at the Groton Ave. Plaza as Mr. Porter had sold some of the
property which will be included in the sewer district. Mr. Blatchley read a
letter from Mr. Porter which advised that his lawyer wauld draw up a
transfer, regarding the dedication of the present sewer system, as soon as
he returned from vaction.

Mr. Mel Pierce presented a petition from the residents of South
Cortland requesting the formation of a water district and a letter
from S X.M. signed by W. J. Stockton, stating that they wanted to
be included in the list of petitioners.
Attorney Gardner advised the petition was not acceptable
as the petition should have specified ''ad' valorem-;" instead of
a "benefit' district. He also advised that he had not had proper
time to discern if the signatures were legal and if the signatures
constitute 51% of the owners of the assessed valuation in the
proposed district. Also, he said, the maximum amount of monies
specified to be spent on the project was not properly stated.
He recommended the town board not accept the petition as presented.
The petition was not accepted. Mr. Pierce took back the
petition and letter and will re -submit a proper petition at the
next town board meeting.
Some discussion followed as to the proper proceedure and
amount of time required for the formation of a water district.
Attorney Gardner advised that after the petition for the creation
of a district is received, it must be accepted by the town board,
a public hearing held, and then it must be submitted to the Dept.
of Audit & Control for their approval, which sometimes took a year.
The town board, he said, cannot approve the district until it has
been approved by the Dept. of Audit & Control.
In answer to a question from Supervisor Blatchley, Mr.
Walter Spencer, Jr. said it had been his experience, on projects
he had worked with, that the town boards may authorize pre -application
for funding through Federal agencies, pending the approval of the
creation of a district by the Dept. of Audit & Control. His notes,
made at a meeting with Mr. Blatchley, Mr. Rowell, Mr. Jennison,
Mr. Cooley, and himself, indicated, he said, "F.H.A. has been
approving applications after close consultation with the Dept. of
Audit & Control and that they do not expect the town to commit
to go to project until after the approval ��-is received from the
Dept. of Audit & Control".
Mr. Rowell stated that all correspondence he had seen from
F.H.A. indicates "that the district should be formed and the
consent of expenditure by the Town Board and the pending taxpayers
should be obtained before sending in the application. However, at
the meetings he had attended with F.H.A. representatives, they had
indicated that both steps could go on concurrently".
RESOLUTION #81: AUTHORIZING SUPERVISOR TO SIGN PRE -APPLICATION FOR
APALACHIN FUNDS FOR SOUTH CORTLAND WATER PROJECT
Motion by Justice Fish, seconded by Councilman Miller.
Votes: Justice Fish, aye; Councilman Miller, aye; Supervisor
Blatchley, aye. Adopted.
BE IT RESOLVED, That the Supervisor is hereby authorized to sign
and submit a pre -application form for Apalachin funds for the
proposed South Cortland water project.
Soap Box Supervisor Blatchley advised the Board that Mr. Stan Connally
Derby of Virgil had asked for Town Board approval to hold the annual Soap
Box Derby on the Starr Rd. Mr. Blatchley said he had talked with
three or four residents on Starr Rd. and they showed no objection to
the derby being held there. He said that Walter Tennant, County
Highway Supt, had given his approval. The Town Board gave their approval.
Complaint Justice Fish reported that he had a complaint from Mrs. Smith on
Re:Fisher Fisher Ave. regarding the flooding of her property due to the rebuilding
Av & Rte of the State Highway at Fisher Ave. She told him that she had been to
281 flood- the State D.O.T., both local and Syracuse, and had not received any
ing. satisfaction to her complaint. Justice Fish stated he felt since the
State had rechanneled the,creek, it was their responsibility to eliminate
the problem which they created.

Supervisor Blatchley advised that he had talked with Mr. Cody of the
State D.O.T. regarding this situation and, through his conversation with him,
was under the impression that something was going to be done about the problem,

RESOLUTION ##82: COMMENDATION OF MR. & MRS. RAYMOND INGRAHAM, CO-CHAIRMEN OF
TOWN OF CORTLANDVILLE BICENTENNIAL COMMITTEE
Motion by Councilman Miller, seconded by Justice Fish.
Votes: Justice Fish, aye; Councilman Miller, ayes Supervisor Blatchley
aye. Adopted.
® WHEREAS, the Town of Cortlandville is an official bicentennial
community; and
WHEREAS, it is conducting a series of successful bicentennial
activities including, among others, three trips to historical
places, namely: Concord, Mass., Ft. Ticonderoga, N.Y., and
Philadelphia, Pa.; the identification of the oldest homes in
the town of Cortlandville; the planning and execution of "Festival
'7611, one of the.most successful events ever conducted by the town
and held at Dwyer Memorial Park on June 27, 1976; and the publication
and presentation of several historical highlights of the town; and
WHEREAS, all of the above have been or are being done with dignity
and dispatch and have brought forth much favorable credit to the
town;

RESOLVED, that the members of the town board show appreciation for
the above successful bicentennial co-chairmen, Mr. and Mrs. Raymond
A. Ingraham, and the other members of the committee for its
dedication and devotion to the conduct of these many fine events;
and be it further
RESOLVED, That this Resolution be made a part of the minutes of
this meeting of this board and that a copy thereof be transferred
to Mr. and Mrs. Raymond A. Ingraham in testimony and appreciation
for their efforts as town bicentennial co-chairman.
Mr. Raymond Ingraham presented the Town of Cortlandville Bi1ient1GfinA 1
Bicentennial Committee's financial statement. Motion was made by Comm. Financia
Councilman Miller, seconded by Justice Fish that the statement be report
received and filed. Votes: Justice Fish, aye; Councilman Miller,
aye; Supervisor Blatchley, aye. Motion carried.

Mr. Ingraham advised that in order to qualify as a "Bicentennial Bicentennial
Community", three projects had to be undertaken and completed in the Projects
areas of "Heritage '76", "Festival U.S.A." and"Horizons '76". Town of

Cortlandville projects undertaken are as follows:
1. "Horizons '76" - an authentic colonial herb garden was planted at
® Dwyer Park and dedicated to the County of Cortland
June 27, 1976.
2. "Festival U.S.A." - Trips were taken to Concord Mass., Ft. Ticonderoga,
& Philadelphia, Pa.
A presentation was made by the Concord Minutemen
and the Country Dance and Song Society at the
festival held at Dwyer Park on June 27, 1976.
Craftspeople demonstrated their crafts at this
festival.
3. "Heritage '76" - documentation and recognizing of the older historical
homes in the Town of Cortlandville. There is a lot of
paper work yet to be done on this project.

Sewers
TOWN ENGINEER, WILLIAM ROWELL REPORT:
Re: Proposed Terrace Rd. Sewers Funding
A recent bill passed in Washington makes public funds
available for accelerated public works projects. In
order to receive federal funds from this program, an
application must be submitted with the proposed
project ready for construction within 90 days.
Mr. Rowell recommended submitting the detail application
immediately as only a limited number of applications will
he approved on a "first come","first served" basis.
Supervisor Blatchley reported he had called Congressman
Hanley's office and'at the suggestion of Mr. Hanley's aide,
he wrote to the Dept. of Commerce in Washington to get
Cortlandville's name in line for this funding program.
Mr. Rowell advised that they had talked with Mr. Feuss of
the County Health Dept. regarding this application and he
promised he would do all he could to expedite the reviewing
of plans and the necessary paper work required from'his
department.
Fred Walker suggested that the town engineer draw up the
construction plans necessary and proceed with the construction
of this project,using town personnel.
Mr. Rowell suggested that the legal aspects of the project
be checked out before any further action is taken. However,
he did stress the urgency of an early decision.
Justice Fish said he would check out the legal aspects with
the town attorney. Also he would check to see if capital
funds, now in the district, can be used for professional
services necessary to prepare the documents and if these
funds can be used to buy materials for the construction
of the project by town personnel.
There being no further business, motion was made by Councilman
Miller, seconded by Justice Fish, that the meeting be; -adjourned. All
voted aye. The meeting was adjourned at 8:56 p.m..

COMMENDATION OF MR & MRS RAYMOND INGRAHAM & BICENTENNIAL COMMITTEE

Upon motion by _Councilman Ray Miller , and seconded by
Justice Ronald Fish the following Resolution was
unanimously adoped:
WHEREAS, the Town of Cortlandville is an official
bicentennial community and
WHEREAS, it is conducting a series of successful bicen-
