The second regular meeting of the month of the Town Board
was held at the town hall, 15 Terrace Rd. with Supervisor Robert
P. Blatchley presiding. Other Board members present were:
Justices Donald5a41rfd Ronald Fish and Councilman Ray Miller. Council-
man Sherman Griswold was absent due to illness. Others present
were Town Clerk, Christine Canestaro; Town Attorney John Gardner;
Town Engineer William Rowell; Deputy Town Clerk, Theresa Fortin;
Town Highway Supt. Carl Eaton; Water & Sewer Dept. Supt. Fred
Walker; Legislators Shirley Fish, Delmar Palm, and Henry Wadsworth;
news -reporter Skip Chapman and several residents of the Town.
The meeting was called to order by the supervisor and the
pledge of allegiance was given by all in attendance.
® The reading of the minutes of the last meeting were dispensed
with as each member had been mailed a copy of the minutes and had
read them. Upon motion of Justice Fish seconded by Councilman
Miller the minutes were approved as presented. Votes:
Justice Eaton aye; Justice Fish aye; Councilman Miller aye;
Supervisor Blatchley aye. Motion carried.
The Town Clerk read the minutes of the special meeting held
on May 12, 1976. Upon motion of Justice Fish, seconded by Council-
man Miller, the minutes were approved as read. Votes: Justice
Eaton, aye; Justice Fish, aye; Councilman Miller, aye; Supervisor
Blatchley, aye. Motion carried.
Supervisor Blatchley announced that the 701 program hearing
originally planned for May 26, 1976 has been rescheduled for
6/28/76 at the town hall.
Mrs. Canestaro read a letter from Thomas H. Huhn, Manufacturers
agent for Automatic Voting Machine Division, requesting that a check
be made on voting machine inventories and supplies and orders placed
for needed equipment as soon as possible before price increases
went into effect. The letter was ordered, received and filed on
motion of Councilman Miller and seconded by Justice Fish. Votes:
Justice Eaton, aye; Justice Fish, aye; Councilman Miller, aye;
Supervisor Blatchley, aye. Motion carried.
Mrs. Canestaro read a communication from Sammons Communica-
tions, Inc. regarding their intention to file applications for
Certificate of Compliance for its existing grandfathered cable
television system serving the City of Cortland and the Town of
Cortlandville. CATV service had commenced in the Town of Cortland-
ville on June 19, 1968. The expiration date of Sammon°s grand -
fathered local franchise authorizing CATV service in the Town of
Cortlandville is 11/19/1985.
Mrs. Canestaro said she had given these papers to the Town
Attorney for his review. Mr. Gardner advised that no action
was required on this communication except to receive and file
it. Upon motion of Justice Eaton, seconded by Justice Fish, the
communication was ordered received and filed. Votes: Justice
Eaton, aye; Justice Fish, aye; Councilman Miller, aye; Supervisor
Blatchley, aye. Motion carried.
® Councilman Miller reported that Councilman Griswold had
been operated on. Everyone sends him their best wishes for a
speedy recovery.
Justice Fish reported that the 701 Program Committee had
applied to the State for a 60 day extension. He said there is a
considerable amount, of work yet to be done. On Thursday night
they would be working on the master plan itself and hoped much could
be accomplished at this meeting. Supervisor Blatchley commended
the Planning Board and all members of the 701 Advisory Committee
for the many hours spent on this project and the commendable job
they were doing.

Justice Eaton gave the following report on the activities
of his office for the month of April as follows:
1423 completed cases
$7623 turned over to State Comptroller
$1355 being held by the Court in pending cases
Highway Supt. Carl Eaton reported they had removed two
heaters at the highway garage as they were very bad and dangerous
to use. The heaters all had a one year guarantee on them and
had been in service for at least seven years. Cost to replace
these heaters will be $491 plus freightyr4"�Delivery would be
four to six weeks.
Carl Eaton reported he had received a request from Mr. Bell
to repair the Fairground Rd. south to Planck Motors. Since this •
is a private road owned by the Fair Assoc. and the Holstein Assoc.,
Supervisor Blatchley suggested that if they paid for the material,
he saw no reason why the town shouldn't apply it.
Carl Eaton reported that Mr. Zogg had given him permission to
remove gravel from the creek bed on his property as he has done
in the past many years and wondered if there was any reason why
the town shouldn't continue to do so. After some discussion due
to some legal -technicalities, Atty. Gardner advised to hold off
on it until the matter could be studied further.
Carl Eaton reported that the building from the old Cortland-
ville waste disposal area had been moved and was now on its
foundation at the Highway Garage. The overhead door on the building
needs to be modified or replaced. He obtained the following quotes
from Overhead Door Co.:
Repair to overhead door to increase door height; install
two new 12' sections, replace vertical and horizontal
tracks, replace torsion spring, cables and hardware -- $525.00
or
Remove and replace overhead door 12'x1216", torsion spring,
rubber weatherstrip, primed wood stops, remove old
door -- $640.00
Carl Eaton and Justice Eaton were designated to check if
there were funds available for this item and for the four heaters
needed for the garage and will report back to.the board at the
next meeting.
Supervisor Blatchley reported he had received the first payment
from the State of New York, for the relocation of the water lines
on Route 281, in the amount of $31,162.61 with $7000 more still
due. Of the $7000, $3600 is still due the contractor. He had
also received the Town's share of the mortgage tax for the first
half of the year in the amount of $10,900.
At 8:00 p.m. acceptance of bids was closed on the paving of
the town hall driveway and parking lot. Two sealed bids had been
received and were opened and read aloud by Mrs. Canestaro as
follows: '

B.J. Mastronardi Paving Inc. •
Cortland, N.Y. $6800.00
Motion was made by Justice Eaton seconded by Councilman Miller
that the bids be received and filed. Votes: Justice Eaton,
aye; Justice Fish, aye; Councilman Miller, aye; Supervisor
Blatchley, aye. Motion carried. The bids were turned over to
the town attorney to examine for sufficiency and legality.
Town Engineer, William Rowell, advised that he had notified
the successful,low bidder, C.O. Falter Co. of North Syracuse,
that they had been awarded the bid for the pump station and
asked them to submit to. the Town Attorney the necessary bonds
and insurance papers.

Legislator Shirley Fish asked if any information had been
received regarding the request for a lower speed limit on Fisher
Ave. Supervisor Blatchley advised her that he had spoken to Mr.
Bassler regarding Fisher Ave., McLean Rd. and Pendleton St. Ext.
and had been told these places were under study.
Supervisor Blatchley advised the Board that the Wright Way
Oil Co. on Rte. 11 has requested a sewer hook-up to the Village of
Homer sewer line. He presented a signed approval of terms and
rates from the Village of Homer & asked the Board's approval to
sign the "contract" for the Town of Cortlandville. There will
be a contract between the Village of Homer and the Town of Cort-
landville and another contract between Wright Way 01.1 Co. and
® the Town.of Cortlandville. The Village of Homer will bill the
Town of Cortlandville and the Town, in turn, will bill Wright
Way Oil Co.

After some discussion, the consensus of the Board was that
the contract should be drawn up with Wright Way Oil Co. so that
the town would break even on the cost including the cost of
clerical work.
Action was deferred until the next meeting.
Mr. Mike Frontuto of Eastern Copy Products gave a presen-
tation on the advantages of buying the Minolta 101 Copier. He
had left a demonstrator in the Town Clerk's office for the past
two weeks. Both the Town Clerk's office and the Justice's office
had used it extensively during this period and expressed their
satisfaction with the superior copying qualities and versitility
of the machine in comparison to the 660-1 Xerox machine now in
use.. There was only one disadvantage expressed by Justice Eaton
that the machine would not copy on both sides of the paper. But
he felt this was minor in comparison to the advantages of the
machine.
The machine could be leased or purchasedyor leased for a
period of three years or five years with the option to purchase.
The lease cost will be applied against the purchase price of the
machine. The cost of the Minolta is $2395.00 if purchased out-
right. Plus $200 for a cabinet. It can be leased as follows:
3 year lease $86.22 per month
5 year lease $62.27 per month
Average supply cost per copy is -- $.026 - $.031
Xerox cost per copy is -- $•035
He suggested the cheapest plan would be to lease the machine
on a three year basis with the option to buy at the end of that
period.
Action was deferred until the June 2 meeting so that the
Xerox contract could be checked out and terminated.
Attorney Gardner reported that the bids submitted for the
paving met all the requirements set forth in the information to
bidders and that all the necessary papers had been signed.
RESOLUTION #64: AWARDING OF BID FOR THE PAVING OF THE TOWN HALL
DRIVEWAY AND PARKING LOT
Motion by Justice Eaton, seconded by Councilman Miller
Votes: Justice Eaton, aye; Justice Fish, aye; Councilman
. Miller, aye; Supervisor Blatchley, nay. Adopted.
WHEREAS, Pursuant to resolution #54 dated 4/21/76 sealed
bids were solicited for the paving of the Town Hall driveway and
parking area, and
WHEREAS, two sealed bids were received and read aloud by
the Town Clerk at 8:00 p.m. on 5/19/76, and

WHEREAS, the Economy Paving Co., Cortland, N.Y. submitted
the lowest bid in the amount of $5650.25, and -
WHEREAS, the bid submitted by the Economy Paving Co. met
all the specifications set forth in the information to bidders,
NOW THEREFORE BE IT
RESOLVED, that the bid of Economy Paving Co.,,.Cortland, N.Y.
in the amount of $5650.25 be, and it hereby -is accepted, and
BE IT FURTHER RESOLVED, that the certified check in the amount
of $340 be returned to the unsuccessful bidder, B.J: Mastronardi
Paving Co., Inc._
Engineer William Rowell reported:
1. Re: Pump Station for Well #3: C.O. Falter Co. notified
they had been awarded the bid and contract documents
had been sent to them for their signature.
Unsuccessful bidders had been notified.
2. Re: Sewer District #2: Mr. Porter has requested prices
from two contractors for work that has to be done
and hopes to have this information within a week
or 10 days.
3. Re: South Cortland Water: He and Mr. Blatchley will be
meeting Friday with F.H.A. to discuss further funding
for this project. Also, cost of individual wells
is being considered vs. the cost of a 4" line installed
by Cortlandville Water Dept. Mr. Rowell recommends
the installation of the 4" line to assure water
supply for fire protection. The County Health Dept.
also recommends the 4" line.
Justice Eaton commented that they had been given the impression
in the past few months that the private line servicing this area
was(3F.teriorated and leaking and would "blow up" at any time and
need was urgent. Mel Pierce responded that he had not observed
any leaks anywhere other than on his own property and was willing
to make repairs there himself. Above him, he said, the pipes are
very close to the surface of the ground, therefore unprotected,
but as the pipes come down and cross the street, they are imbedded
deeper and better protected. Supervisor Blatchley suggested a meeting,
be held with the people in the hamlet to see what their feelings are.
4. Re: Gorman Tract: Mr. Gorman has received in detail
the proposed rate structure with the Village of
Homer. He has agreed that negotiations to date
are all that could be expected and would like to
proceed with the formation of a Water and Sewer
District for his development. Mr. Rowell recom-
mended that the Board authorize Attorney Gardner
and himself to get the papers in order and to review
the situation and material to date. They will re-
port back to the Board at the next meeting, if
possible. Justice Fish suggested that before any
action was taken by the Board, the Town Engineer
and the Town Attorney find out exactly what the
status of this project is before any authorization
for the forinatioh - of any. -
districts is given.
Legislator. Shirley Fish.wanted to know if
the Board intended to act on the suggestion made
by the Town Planning Board to change the zoning
in a portion of the subdivision from R-3 back to
an R-1 zone. A great deal of discussion followed
with a decision deferred until the report on the
status of the project is given to the Town Board.
Supervisor Blatchley requested the Board's
permission to audit and pay the bill submitted by
Mr. Chamberlain of Rowell and Assoc. for a consultation

and fire study he had done at the request of Super-
visor Blatchley. The amount of the bill is $165.40.
Justice Eaton said the bill will have to be paid
as it was a service to the Town, but cautioned the
Supervisor in the future these studies should be
sanctioned by the Town Board before expending monies
for this purpose.
RESOLUTION #65: AUTHORIZATION TO PAY ROWELL AND ASSOCIATES BILL
FOR FIRE STUDY

BE IT RESOLVED, that the bill submitted by Rowell and Associates
dated 3/9/76 for a fire study requested by the Town Supervisor
be paid in the amount of $165.4o.
Mr. Rowell reported that some time ago he had been asked
to make a feasability study on providing sewers for the Terrace
Rd. and adjoining areas around the Town Hall area primarily for
the purpose of protecting the town water supply. At that time,
they had come up with some proposals and cost estimates and how
the project would be financed. He suggested some additional
thought should be given to this project with the possibility of
having the Walkers install the sewer lines to lower the cost of
the project and cost estimates along this line will have to be
projected. Previously costs had been estimated on a contract
basis. There are other methods that could be considered such
as, construction by Town forces. The Town possibly should be
taking a look at different methods of financing. He suggested
the Board should give some urgency to these considerations if
there was to be anything done within the next year.
RESOLUTION #66: AUTHORIZATION FOR ENGINEER WILLIAM ROWELL TO
CONTINUE FEASABILITY STUDY FOR PROVISION OF A SEWER SYSTEM
IN THE IMMEDIATE AREAS OF TERRACE ROAD
Motion by Councilman Miller, seconded by Justice Eaton.
Votes: Justice Eaton, aye; Justice Fish, aye;. Councilman
Miller, aye; Supervisor Blatchley, aye. Adopted.
BE IT RESOLVED, that Town Engineer, William Rowell be, and he
hereby is, authorized and directed to make a feasab ility study
for the cost and construction of a sewer system in the immediate
area of Terrace Road and Town Water Supply, and
BE IT FURTHER RESOLVED, that this study also include the cost
of construction of this project by the Town employees, and
BE IT FURTHER RESOLVED, that the cost of this study is not
to exceed $2000.00.
Supervisor Blatct-ley introduced the new Town Bookkeeper,
® Wayne Ezick.
RESOLUTION #67: AUTHORIZATION TO HIRE KAREN STONE AS GENERAL
CLERK FOR THE TOWN OF CORTLANDVILLE
Motion by Justice Fish, seconded by Councilman Miller.
Votes: Justice Eaton, nay; Justice Fish, aye; Councilman
Miller, aye; Supervisor Blatchley, aye. Adopted.
BE IT RESOLVED, that the Town Board does hereby hire Karen
Stone as General Clerk for the Town of Cortlandville under the
direction of Supervisor Blatchley at an annual salary of $5200.00.
Justice Eaton clarified the reason he voted nay on this
resolution saying that Miss Stone would be working for him 90%
of the time and therefore felt she should be under his supervision
as the Supervisor did not know anything about what his office
required of the General Clerk and that the friction with the prior
General Clerk stemmed from this exact situation, since the

Supervisor did not know how to co-ordinate her Fork.
There being no further business, upon motion of Councilman
Miller, seconded by Justice Fish, all voting aye, the meeting
was adjourned at 9:34 p.m.
