HomeMy WebLinkAbout1976-08-13 124 • PUBLIC HEARING SPECIAL PERMIT - Larry Caskey AUGUST 10 , 1976 Minutes of the Public Hearing held by the Town Board of the Town of Dryden on August 10 , 1976 commenced at 7 : 30 PM . Supv . McCord read the Public Hearing Notice that was published in the newspaper stating the purpose of said hearing was to consider the application of Larry Caskey of 31 Midline Rd , Slaterville , NY for a Special Permit for the repair of motor vehicles and the sale of retail petroleum products at 1990 Dryden Rd . Present : Supv . McCord , Clm Graham , Clm Cotterill , Clm Tarr , Clm Webb Atty Amdur and Zoning Officer Stewart . Mr . Caskey was present to report that it would be a Registered and Certified general repair shop for Agway vehicles only of the 'Ithaca 41) and Cortland stores . Questions : Clm Cotterill wanted to know if the repair work consisted of body work and also if there would be a retail sale of gas or petroleum products . Mr . Caskey said it would be only repair work on Agway ' s fleet of trucks and as of now there is no intension for the sale of petroleum products . It is going to be a one man operation . Mr . Henry James from Dryden Rd . asked what the hours would be . Mr . Caskey said he would be the only one working there so it would probably be from 8 AM to 6 PM . The Town Board closed the Public Hearing and would make a decision later . Hearing closed at 7 : 40 PM Town Clerk U BOARD MEETING AUGUST 10 , 1976 Minutes of the Board Meeting held by the Town Board at the Town Hall commencing at 7 : 45 PM Called to order by Supv . McCord . Members and guests participated in the Pledge of Allegiance to the Flag . Roll call was by the Town Clerk . Present : Supervisor McCord Councilman Graham Councilman Tarr Councilman Cotterill Councilman Webb Attorney Amdur Motion was made by Clm Cotterill and 2Nd by Clm Tarr that the minutes ID of the July 13 be approved after the change under Correspondence . It should read that the Etna Community Assoc . did not express their disapproval of any business in the Etna Area , but that the Etna Community Assoc . recommend that the Cornelius Septic Tank Service not be granted a variance for specific reasons . COUNTY BRIEFING County Rep . Watros reported that the re - distribution of matching funds to the Division of Youth which didn ' t have any effect on the Town of Dryden but has a negative effect on the Village of Dryden and Village of Freeville . The Division of Youth is going into a planning phase where they would be eligible for more funds . There is a new formula which would come out to $ 2 . 25 per youth for recreational services and getanother $ 2 . 25 if you participate in the planning phase . This would include both recreation and services for the youth . There has been no decision yet on the Rt 13 corridor , hopefully we can ✓ each a consensus and go on record as favoring some of the corridor so that we can get the project moving and tell DOT what the county would like . There has been no information yet as to the sales tax distribution from Albany . There will be a Public Hearing on Paid Parking at the Airport on August 26 . Cuov . McCord wondered if the County Committee who was proposing the contract had prepared a 5 year projection . County Rep . Watros said he had n ot seen the proposal since it had been revised . Supv . McCord asked if he could request the projection so that the Town could have one and post -- it publicly in the Town Hall and check on the progress . CITIZEN PRIVILEGE OF THE FLOOR Mrs . Rosemarie Bobnick was a representative for the After School Program • for the Dryden area . Mrs . Bobnick asked the Town for some " seed money " o f $ 200 . 00 to help get the program started to buy equipment . They have applied to the United Way and are going to approach Kiwanis and other o rganizations . It would involve school children from First to Sixth Grade o f working parents . They would be equipped for about 50 children on a first come basis . The Dryden School has approved the use of their cafeteria and provide bussing for the children . This would just involve the Dryden School System . Mrs , Bobnick presented the Board with their budget . Supv . McCord had one question as to whether this would be an appropriate expenditure for the Town Gov ' t to make because of the population to be served . The Town Board would look over the budget and make a decision . Harold Case was wondering when something was going to be done about Mt . Pleasant Rd . after the flood we had in July . Hwy Supt . Humphrey said they w ere working on the road and ditches now and it would be taken care of . Kevin Clinton from Ringwood Rd . was wondering if the Town had applied to the Fed . Gov ' t for funds to repair the streams along Ringwood Td . Hwy Supt . Humphrey said they had and the Town has requested petitions . The Fed . Agent suggested that the Town send the petitions to the County . and ✓ equest that they do something about the steams , and the County in turn send the petitions to the Conservations Dept . Supv . McCord said the quickest way to get the work done would be to get all the homeowners that signed the petition on Ringwood Rd . to hire a private contractor to clean the stream , then submit the bill to the Town . The Town in turn will n ay , but before it is done to submit an estimate to the Town . QOUNCILMAN PRIVILEGE OF THE FLOOR Clm Cotterill reported on the Rt 13 corridor , that all previous alternatives had been eliminated by the State of New York and as one last effort they have come up with another alternative from Warren Rd to come back on Rt 13 n ear the TC 3 entrance . If the people of Tomp . Co . feel that this is acceptable , otherwise it will default to the present Rt . 13 . Clm Webb reported that in reference to Rt 13 that it would be necessary to have an overpass where it intersects with Rt 38 near the High School . It could not be an intersection with , 2 major highways . It would have to • be considered if Rt 13 went ahead . If this plan goes into effect there should be some type of freeze on Rt 13 between TC 3 and the Cortland Co . line . Clm Webb felt that we should not allow any more commercial build up • along Rt 13 if this is going to be our major route of getting into Tomp . Co . Clm Webb felt that if was not safe and wise to allow another Elmira Rd . tyne of building situation . After some discussion it was decided that III Sunv . McCord would schedule a meeting with the Village of Dryden and Dryden High School to discuss Rte 13 and then contact Mr . Liguori . Gary Sheely and. Ray Baker were present to see who was on the Youth Program . They wanted to gathe football program started and were not sure how much money was available to them . Mr . Sheely had a . list of equipment they had and what was needed to buy . Supv . McCord said that there was a budget for the Youth Program . It was decided that Supv . McCord would meet with Gary Sheelv , Rav Baker , Jim Thorpe , and Bud Thorpe on Thrus . August 12 at .8 : 00 AM to decide the rest of the program and who would be responsible . CLm Graham - nothing Clm Tarr - nothing i 126 ATTORNEY Atty Amdur reported she had received a letter from the State Dept . of Audit & Control on the proposed McLean Fire Dist . The letter was dated August 6 , 1976 . Audit & Control would have to forward a copy of the application to the Tomp . Co . Board of Rep . There would then be a 15 day waiting period after they have received it . So by the end of the month the Town should receive an order from the State Comptroller approving the McLean Fire Dist . Some discussion was had about appointing the fire commissioners . Atty Amdur said legally the Board cannot appoint them until the order is received . Zoning Officer Stewart had presented to Atty Amdur on July 22 , 1976 with 2 letters on Unsafe Buildings & Structures in the Town of Dryden . 1 - Keith Pool Town on Rt 13 and Johnson Rd . 2 - Eugene Jackson on the corner of Sheldon Rd and Bone Plain Rd . Atty Amdur reported that in ,: pursuant , to the Town of Dryden ' s new 411 ordinance. , she had prepared the notice and order that the property be made safe by either the removal of rubble or else the repair has to be started . This has to be done within 10 days after receipt of notice . Atty Amdur would mail out the notice and Z . O . Stewart would post the notice on both parcels of property . Both parties are out of the state . Atty Amdur said the Town Board would have to appoint a building inspector and architect . RESOLUTION # 102 APPOINT BUILDING INSPECTOR Supv . McCord offered the following resolutions and asked for its adoption . RESOLVED , that this Town Board appoint John Doll as building inspector . for the Town ' s new Ordinance of Removal or Repair of Unsafe or Collapsed Buildings and / or Structures . 2nd Clm Cotterill Carried RESOLUTION # 103 APPOINT ARCHITECT Supv . McCord offered the following resolution and asked for its adoption . RESOLVED , That this Town Board appoint Robert O ' Brien as architect , for the Town ' s new Ordinance of Removal or Repair of Unsafe or Collapsed Buildings and / or Structures . 2nd Clm Cotterill Carried . Atty Amdur reported on tha cable TV , that there was discussion on line extension provision by two different representatives of Sammons Commun - ication . This was not made part of out Franchise agreement with either Sammons or Cerracche but the Town did ask for the cable extension formula . This is a formula worked opt by Sammons for their system in Cortland and is not yet approved by the State Cable Commission . So far Cerracche ' s formula has not been approved by the Cable Commission , and Sammons is under consideration but not yet approved . TOWN CLERK Reported that there would be the quartert3 business meeting of the Tomp . Co . Municipal Officials Assoc . on Wednesday , Sept . 15 at 7 : 00 PM at the Sheraton Inn . If anyone was interested infgoing ' to let her know by Sept 11 for reservations . ZONING OFFICER 410 19 building permits for the month of July . 6 - } family residence , 5 additions , 1 replacement for a mobile home , 3 garages , 1 greenhouse , 1 chicken house and 2 swimming pools . $ 190 . 00 in building permits and $ 25 . 00 for a Special Permit . Zoning Board of Appeals denied Congers request for a variance . HIGHWAY SUPERINTENDENT Reported that he had been out with the Fed . engineers and conservation men for 2 different weekends . The survey reports come to a little over $ 56 , 000 . 00 for road damage . This does not represent personal damage to private property . This has to be sent to Washington to be approved , and will come back to the Town either cut or approved as submitted . Whatever work the Town does has to be kept track of . Man hours , equipment used and material . CORRESPONDENCE Letter from Gary Lee with regard to a meeting to be held on 8 - 31 - 76 at 7 : 30 PM at New York State Electric and Gas Corp . on the flood in July . Letter from M E Hartz thanking the Town Board for assisting in the repair o f the creek on the lower part of Ringwood Rd . Notice from the Lehigh Valley Railroad Co . The one effecting the Town of Dryden would be from East Ithaca to Cortland . This is to become effective o n Sent . 3 , 1976 of the abandonment . — Letter from the Dept . of Enviromental Conservation . Reouest from the County Sewer Agency for a Resolution . RESOLUTION # 104 ACCEPTING THE COMPREHENSIVE • SEWER STUDY Clm Tarr offered the following resolution and asked for its adoption . W HEREAS , Consulting Engineers O ' Brien and Gere have submitted to the County Sewer Agency and the Ad Hoc Ithaca Urban Area Sewer Committee the completed sewerage study as a master plan for the provision of sewerage service throughout Tompkins County for the next fifty years , WHEREAS , the final draft of this study has been reviewed and accepted by the NYS Department of Environmental Conservation , and WHEREAS , the concerns expressed by the Village of Dryden in relation to the impact of the study recommendations upon that village have been partially addressed by letters from the NYS Department of Environmental Conservation and the Consulting Engineers in relation to the classification' o f Virgil Creek , therefore be it RESOLVED , that the report has been received by the Dryden Town Board , and RESOLVED , further , that the Agency does authorize the submission of a final request for payment to the NYS Department of Environmental Conservation . 2nd Clm Graham Carried RESOLUTION # 105 APPOINT DOG ENUMERATOR Clm Cotterill offered the following resolution and asked for its adoption .
