The first regular meeting of the month of the Town Board was
held at the Town Hall, 15 Terrace Rd. with Supervisor, Robert P. Blatchley
presiding. Other Board members present were: Justices, Donald Eaton and
Ronald Fish; and Councilmen, Sherman Griswold and Ray Miller. Others present
were: Town Clerk, Christine Canestaro; Deputy Town Clerk, Theresa Fortin;
Town Attorney, John Gardner; Town Engineer, William Rowell; Town Highway
Supt., Carl Eaton; Town Zoning Enforcement Officer, Don Fowler; Water &
Sewer Supt., Fred Walker; Bookkeeper, Rene'e Bilodeau; Legislator, Henry
Wadsworth; several residents of the town; Mrs. Theresa Benedict and Mrs.
Joyce Camp representing the Cortland County Senior Citizens Recreation
Program; news reporter, Skip Chapman.
Supervisor Blatchleycalled the meeting to order and the pledge of

allegience was given by all in attendance.
Reading of the minutes of the last meeting was dispensed with as they
had been mailed to Board members and read by them before the meeting.
Motion was made by Justice Fish, seconded by Justice Eaton that the minutes
be approved as presented. Votes: Justice Eaton, aye; Justice Fish, aye;
Councilman Griswold, aye; Councilman Miller, aye; Supervisor Blatchley, aye.
Motion carried.
Notice of The Town Clerk reported she had received a notice of order from
order re New York State D.O.T. to reduce the speed on Rte. 222, SH 446, between
speed RM 1036 (westerly Cortland City line)and RM 1033 (Rte 281), a distance
rte.222 of 0.3 + miles; effective upon completion by the regional traffic engineer.
Motion was made by -Councilman Miller, seconded by Councilman Griswold to
receive.and file the order. Votes: Justice Eaton, aye; Justice Fish, aye;
Councilman Griswold, aye; Councilman Miller, aye; Supervisor Blatchley, aye.
Motion carried.
The.Town Clerk reported she had recieved application for one house
trailer permit and two house trailer.renewal permits. The Zoning Enforcement
Officer, she said, had investigated the sites and reported that they met the
requirements of the Town of Cortlandville Zoning and Trialer Ordinances.
RESOLUTION #39: AUTHORIZATION TO ISSUE HOUSE TRAER PERMIT TO FRANK BUERKLE

BE IT RESOLVED that the Town Clerk be, and she hereby is authorized
and directed to issue a house trailer permit to Frank Buerkle, upon
payment of the proper fee. Said trailer to be located on Lot #68,
Carr Hill Rd.

RESOLUTION #42: AUTHORIZATION FOR CHRISTINE CANESTARO TO ATTEND
CONFERENCE ON VITAL RECORDS

BE_IT RESOLVED THAT Registrar of Vital Statistics, Christine
Canestaro, be and she hereby is authorized to attend the
conference on vital records for registrars of vital statistics
being held at the Hotel Syracuse on 5/19/76, and
BE IT FURTHER RESOLVED, that all necessary expense incurred
regarding same be reimbursed, subject to audit by the town board.
Letter from Justice Fish read a letter received by his wife, Legislator, Shirley •
Hilsinger Fish from Mrs. Barbara Hilsinger regarding the salt trucks speeding
re salt truck around the corner of Fairview Dr. aniGroton Rd.. She said this posed a
traffic threattothe safety of her children and other neighborhood children.
Fairview Dr. Motion was made by Justice Eaton, seconded by Councilman Miller to receive
and file the letter. Votes: Justice Eaton, aye; Justice Fish, aye;

Motion carried.
Request Fred Walker suggested that all sprinkler systems be required to
Sp�ink]er Sys. be hooked up by telephone circuit to the fire station so that extensive
be hooked to damage and water loss might be avoided in the event they went off when
tel. circuit the places of business were unattended. He said he thought that Grant's
Sys. store in the Pyramid Mall was the only one not hooked up in this manner.
The Town Board directed Supervisor Blatchley to write a letter to Pyramid
Properties regarding this situation.
Zoning enforcement officer, Don Fowler gave his monthly report on
building permits issued by him for year to date. A copy of this report
is attached to and made a part of these minutes.
Mr. Fowler reported he had begun his spring clean up. He said he
had visited a half dozen landowners known to have junk cars accumulated
on their properties and has written letters to them giving them until
4/15/76 to clean up their properties and comply with the town zoning
ordinance. He said these were people who were offenders in the past
and had co-operated in cleaning up their properties but were -again in
violation.
Dr.McLeod Supervisor Blatchley reported he had received a letter from Dr.
letter re McLeod of Deerfield Heights regarding the unkempt condition of the
Deerfield undeveloped lots and the inadequate upkeep of the roadway. Supervisor
Hts. Blatchley apprised the board he had replied to Dr. McLeod advising him
that the roads in the worst condition were repaired first.
Supervisor Blatchley gave the following financial report on the
financial status of the town as of 3/31/76:

Re: loader/ Attorney,John Gardner read a letter he had received from V.H. Koelpin,
backhoe Equipment Distribution Manager, J. I. Case Co., stating that the Case
tractor 580B backhoe/loader tractor s/n 8785667 purchased by the town is a 1976
model and built on 1/19/76. A copy of this letter is attached to and
made a part of these minutes.
Attorney Gardner read a letter from Clark Lewis, Product Mgr.
Loader/Backhoes regarding the incorrect information supplied by his
secretary over the phone on 3/13/76. A copy of this letter is attached
to and made a part of these minutes, together with supporting documents supplied.

Attorney, John Gardner Opinion: - according to above letters and
Legal opinion specifications, the bidder, S. C. Hansen, Inc. has complied
re:' Backhoe/ with the specifications set forth in the information to bidders
loader Tractor and has delivered to the Town of Cortlandville one, new and
unused 1976 backhoe/loader tractor s/n 8785667 and that in view
of these facts, the voucher submitted by S.C. Hansen could be
approved for payment.
Fred Walker confirmed that all specifications had been met.

WITER1AS, J. I. Case Co., Indianapolis, Ind. has provided sufficient
proof to the satisfaction of the Town Board that the Case 580B
backhoe/loader tractor, SIN 8785667, purchased by the Town of
Cortlandville from S. C. Hansen, Horseheads, N.Y., low bidder, is
a 1976 model as specified in the information to bidders, and
WHEREAS, the Town Board has deemed that S. C. Hansen, Inc. has met
all the specifications set forth in the information to bidders,
NOW THEREFORE BE IT RESOLVED That Invoice #072364 submitted by
S. C. Hansen, Inc. in the amount of $8,395.00 be, and it hereby is

B�ac�toffor Mr. Clyde Berger of Greenwood Rd. told the town board the road
Greenwood had not been blacktopped in the last 35 years and requested that it be

Mrs. Theresa Benedick, Director and Mrs. Joyce Camp, Special
Request for Interest Communications were present to request $2,000 for the Cortland
fund Sr.Senior Citizens Recreation Program which she said Citizens ens Rec �' ,- , would be matched with
Program the same amount by state aid. Justice Fish stated he thought this was a
county sponsored program and asked why this request was not being made to
the County Legislature. Mrs. Benedick explained that the County Legislature
had cut their budget request $10,000. Since state aid was available to
the extent of $2,000 per municipality, -she was appealing to the individual
municipalities to make 'up the deficit in order to insure continuation and
expansion of the program. She said there were over 100 participants from
the town of Cortlandville and requested the town give it's fair share.
Cortlandville residents now participating in the program and present to
speak in behalf of the program were:

The Board deferred action until they could study the matter further.
Supervisor Blatchley recommended that the town join the Cortland
County Planning Federation and further recommended that, as suggested by the
federation, the Chairman of the Town Planning Board, the Chairman of the
County Town Zoning Board.of Appeals and the Town Supervisor be designated to
Planning represent the Town in the Federation. Supervisor Blatchley said he had
Federation spoken with Gordon Hatheway and Russell Parsons and both indicated they would
be willing to serve in this capacity.

RESOLUTION #44; AUTHORIZATION FOR TOWN TO JOIN THE CORTLAND COUNTY
PLANNING FEDERATION
Motion by Justice Eaton, seconded by Councilman Miller

WHEREAS, a number of municipalities in Cortland County have
expressed an interest in creating an organization to be known
as the "Cortland County Planning Federation", for the purpose
of effectively bringing about the exchange of information on
municipal and planning problems and promoting a cooperative
relationship among.; state, county and local planning agencies;
and
WHEREAS, a proposed set of by-laws for said Federation has been
prepared by an ad hoc committee of local planning and zoning
officials, and is on file with the Clerk of the Town of Cortlandville,
and
WHEREAS, the Town Board of the Town of Cortlandville has
determined that it would be in the overall public interest of this
municipality for it to become a member of said Federation; now
therefore be it
RESOLVED, THAT the Town of Cortlandville does hereby elect to
become a member of the "Cortland County Planning Federation", and
that the by-laws of said Federation, on file with'the Clerk of the
Town of Cortlandville be and the same hereby are approved, and
be it further
RESOLVED, that the following persons are hereby designated to
represent the Town of Cortlandville at meetings of said Federation;

RESOLVED, that the Supervisor of the Town of Cortlandville is
hereby authorized to make payment of $15.00 to the "Cortland
County Planning Federation" for membership in said Federation.
Supervisor Blatchley reported that the Citizens Advisory Committee
701 Program working with the County Planning Board on the 701 program has had several
productive meetings. So far, he said they had discussed the historical
background of the town, the housing characteristics; population, highway
inventory, economic study (employment situations, age brackets, etc..
Further discussions will be had on town finance, community facilities,
open space.
Mr. Fred BoXger of the County Planning Dept. said that the next
701 program several meetings will be very important and stressed that members of the
town board be present as they will be discussing actual planning for the
town development. Supervisor Blatchley reminded the Board that Justice
Fish and Councilman Miller and himself had been designated to represent
the Town Board at these meetings. He requested they be present, if
possible.
Supervisor Blatchley read the following excerpt from the minutes
of the March 22, 1976 Planning Board meeting:
Town Planning "Motion was made by Mr. Clemens; seconded by Mr. Metcalf, that
Bd.Res. re: during the period of the currently "going on" study of the 701 Comprehensive
zoning changes Revision Plan for the Town of Cortlandville no deviations from the
during 701 , present
study Zoning Regulations, should be considered; and further, the Planning Board
suggests that the Town Board of Cortlandville adopt this same policy. This
motion was carried unanimously".

Atty opinion Attorney Gardner advised that a policy of this type would not be
re above legal. Sec. 264 & 265 of the Town Law and under the present Zoning Ordinance,
petitions coming before the Town Board must be honored, he said. A hearing
must be held and a decision made.

701 program Mr. Bolger of the County Planning Board said that since the
town is involved in revising its master plan plus revising the zoning
ordinance, according to Director, Ted Zollendeck, there is provision
whereby a moratorium can be declared for a period of 18 months.
Provisions must be made, however, that if a request for a zoning change
is made, it should be considered and if it is not in conflict with the
master plan, it could be treated as a special permit.
Attorney Gardner again pointed out the fact that the Planning
Board resolution reads "No deviations shall be made". Mr. Bolger said
this wording would have to be amended as it was not correct.
Town Board After some discussion, the consensus of the town board was that
policy they are aware of the 701 program study being made by the County Planning
during Board and the Town Planning Board and that they will consider their work
O1 study when petitions are received. The policy of the board, during this period,
will be "any petitions for amendments to the zoning ordinance and map
will be considerd with the 701 study in mind".
RESOLUTION #45: AUTHORIZATION FOR SUPERVISOR TO SIGN APPLICATION FOR
YOUTH RECREATION PROGRAM
Motion by Justice Eaton, seconded by Councilman Miller.

WHEREAS, Monies have been allocated in the 1976 budget in the Town
of Cortlandville for recreation with the Village of McGraw, as well
as monies for the purchase of materials for a youth recreation program
in the nature of arts and crafts, to be used in the Town outside of the
village of McGraw for a Youth Recreation Program,
THEREFORE BE IT
RESOLVED, That the Town Board authorize the Supervisor, Robert P.
Blatchley, to sign an application of this project and that the Town
Clerk, Christine Canestaro, be authorized to sign the certification
of the resolution.

new pump station on 4/21/76 at 8:00 p.m.

Mr. Rowell advised that:
He had talked with Mr. Gorman and assisted him with his plans
for the development of a water and sewer district.
He had received communication from Mr. Porter and the city
of Cortland regarding details on sewer district #2. He had
received a proposed agreement from the City of Cortland for
consideration.
Justice Eaton asked Mr. Rowell what the status of the Locko Glazer
problem was. Mr. Rowell read the last communication he had received from
them dated 3/26/76 which indicated"required proceedures had been set up
to enable the compiling of an accurate count of tank line processing activities.
Reports will include the cleaning of tanks and the dumping of materials.
These records when matched with the data promised the Cortland County Health
Dept. should give information needed to immediately reduce, if not eliminate,
the -present problem'. The letter also stated that they had "presented the
problem to several manufacturers of sewage treatment equipment in the
hopes of finding a sound and economical answer to the problem."

Salt Truck A discussion was had on Mrs. Hilsinger's letter -requesting .
traffic control of the salt truck traffic on Fairview Dr. It was felt
Fairview Dr. that perhaps this problem would be eliminated after the contruction
on rte. 281 was completed. Supervisor Blatchley was authorized to
reply to Mrs. Hilsinger's letter along these lines.
Justice Fish said Paul Sepe who had recently purchased property
Paul Sepe on Rte. 11 had complained to him that the drain pipe on his property to
Rte.11 the creek was 3/4 filled. He asked Carl Eaton.if Mr. Sepe had contacted
drain pipe him. Mr. Eaton said he had not been contacted but would look into
the matter.

This letter is to confirm my conversation with you in regard
to the 1976 Case 580 delivered to you on February 3rd, 1976.
This machine was shipped out of the factory at Racine, Wisconsin on
January 21, 1976. We reeieved if on the 28th of January.
We did attend an introductory meeting held for all Case dealers at
.Kansas City on the 26th and 27th of January where a new Case 5606
was introduced -0 us. They will begin snipping these machines in
the next two or three months. However in the mean time all B series
shipped in 1976 are considered to be 1976 machines until the new C
series are shipped.

On March 12 you called my office asking for the build date of a 580B
Loader/Backhoe, Serial #8785667.
Based on information received through our Service Department on Serial
Number Cut Off by Year, my secretary told you that the unit in question
was built in 1975. Upon further investigation, we have determined
that the Serial Number Cut Off was incorrect and that your unit was
actually started on the line on January 8, 1976, released to shipping
on January 16, 1976 and shipped on January 21, 1976.
I am attaching xerox copies of our plant documents which will serve
to document this information.
I hope this will serve to correct our previous information and hope
this has not inconvenienced you in any way.
