HomeMy WebLinkAbout03-17-1976Wednesday, March 17, 1976 Pg. 1 The second regular meeting of the month of the Town Board was held at the Town Hall, 15 Terrace Rd. with Deputy Supervisor Councilman Sherman Griswold presiding. Other Board members present were: Justice Donald Eaton and Councilman Ray Miller. Supervisor Blatchley and Justice Fish were absent as they were on vacation. Others present were: Town Clerk, Christine Canestaro; Town Attorney, John Gardner; Town Engineer William Rowell; Sec./Bkkpr., Rene'e Bilodeau; Water & Sewer Dept. Supt., Fred Walker; Mrs. Jane Edlund; News reporter, Skip Chapman; Mr. Carl Edlund of Bell Dr.; Mrs. Delmar Palm and Mr. Melvin Pierce. The Town Clerk read the minutes of the last meeting. There were no corrections or additions. Motion was made by Councilman Miller, seconded by Justice Eaton that the minutes be approved as read. Votes: Justice Eaton, ® aye; Councilman Miller, aye; Dep.Supervi©or Councilman Griswold, aye. Motion carried. Letter re The Town Clerk read a letter from Attorney, John B. Folmer regarding non -conforming Cortland Co-operative Ins. Co. premises in Blodgett.Mills which was use of land recently rezoned from R-1 to Business. He assured the Town Board that the re -zoned Cortland Co-operative Ins. Co. was aware that a subsequent comprehensive Blodgett Mills plan for the town might reclassify the use of the premises and that the property could become a non -conforming use. Motion was made by Justice Eaton, seconded by Councilman Miller to receive and file the letter. Votes: Justice Eaton, aye; Councilman Miller, aye; Dep. Supervisor Councilman Griswold, aye. Motion carried. Justice Eaton gave the following report on cases handled by his office during the.month of February: 244 completed cases $3337 turned over to State Comptroller in fines & forfeitures $1810 being held in pending cases Homer Rec. Deputy Supervisor, Councilman Sherman Griswold reported that Mayor program Harry Calale of the Village of Homer had contacted him and requested the request Board to reconsider their decision of Jan. 7, 1976 regarding the for contribution of funds to the Village of Homer's recreation program. The funds Mayor advised him that a $10.00 charge would be imposed on Cortlandville residents availing themselves of the.Village of Homer recreation programs if the town did not make a contribution to the program fund. He said they would be charging their own residents a fee of $3.00 ea. The Board decided to abide by their original decision and not make any contributions to the Village of Homer recreation fund. D.E.C. APPROVAL Mr. Rowell, Town Engineer, reported he had conferred with D.E.C. and pump station had obtained their verbal approval of the plans for the new pumping station #3 for well #3 and has been assured that written approval will be received shortly. Attorney Gardner advised that an amendment should be made to resolution #36, 1976 to correct the description contained therein to comply with the correct map of the property. RESOLUTION # 8: AUTHORIZATION TO AMEND RESOLUTION #36 Motion by Justice Eaton, seconded by Councilman Miller Votes: Justice Eaton, aye; Councilman Miller, aye; Deputy Supervisor, ® Councilman Sherman Griswold, aye. Adopted. BE IT RESOLVED That the description of the amendment to the Zoning Ordinance contained in Resolution #36 adopted March 3, 1976, changing the boundries of R-1 and Business District in Blodgett Mills be amended to reflect the correct description of the property as follows: ALL THAT TRACT OR PARCEL OF LAND situate in the Town of Cortlandville, County of Cortland and State of New York, being bounded and described as follows; COMMENCING at a point in the South Walkline of Blodgett Mills Road at a point marked by a pin which is the Northwest corner of lands of Heller; running thence S 110 07' W a distance of 201.33 feet to a point; running thence N 800 36' W a distance of 160.40 feet to a point in the centerline of Maple Street in the said Hamlet of Blodgett Mills; running thence N 081 43, E along said centerline a distance of 72.75 feet to a point; running thence S 760 07' E a distance of 71.25 feet to a point; running thence N 150 00' E a distance of 141.00 feet to an iron pin set in the south walkline of said Blodgett Mills Road; running thence S 760 07" E a distance of 81.25 feet to the point or place of beginning, containing .52 acres more or less of land. Wednesday, March 17, 1976 Pg. 2 letter Attorney Gardner read a reply to the letter he had written to re date B. H. Koelpin, Equipment District Manager, Indianapolis Branch of of Mfg. J. I. Case Co. regarding the date of manufacture of the new Case loader/backhoe 580 B backhoe, serial #8785667. Mr. Koelpin advised that this tractor backhoe is a 1976 model built on 1/19/76 and was the "current" model at the time delivered. Attorney Gardner called the Board's attention to the letter from if S.C.Hansen read into the minutes of the last meeting which stated that the backhoe was shipped from the factory at Racine Wisconsin on 1/21/76 and that all "B" series machines are considered to be 1976 models until the new "C" series are shipped. Attorney Gardner then advised the Board that he and Justice Eaton • loader/backhoe had called the Factory at Racine,Wisconsin on 3/12/76 and talked with a Mrs. Villwock who told them it was a 1975 model and that she would send a letter of confirmation of this fact to Mr. Gardner. Mr. Gardner does not, as yet, have this letter. The matter was tabled until the letter of confirmation is received. Mrs. Jane Zogg presented a proof copy of the seal she had designed Bicentennial for the Town of Cortlandville and asked the Board to approve it, with a emblem for few modifications, as a seal or emblem for the town. The Board gave town their approval for the design to be used as an emblem or logo for Bicentennial medallions to be sold by the town Bicentennial committee. It was not approved as an official seal for the town. Mr. Carl Edlund asked the Board if the town would be doing anything Bell Dr. on Bell Dr. to prevent flooding there. He said that flooding had Flooding occurred there three times in the past six years and hoped some precautions would be taken to prevent it happening again. Engineer Rowell said he and Highway Supt., Carl Eaton, would look over the area and make their recommendations to the Board. Junk on Mel Pierce asked what constituted a junk yard as the Luther Pierce Gallagher Rd. property on Gallagher Rd. had several junk vehicles accumulated on the property. Judge Eaton advised that the Zoning Officer had been made aware of this situation and would rely on him to take the necessary steps to correct the situation. There being no further business, motion was made by Justice Eaton, seconded by Councilman Miller that the meeting be adjourned.
