It's a two (2) year contract, proposed at eleven thous- and dollars ($11,000) a year, to cover the eastern side of the Town of Cortlandville. I II i Supervisor Blatchley: My answer on that is, Henry, is that the � I} E' I� ri r r es i� rate between the two, McGraw and Homer, is M� 4 i4 determined almost exactly according to the i proportion of the value of the area of the !i code. Now as I understand, before my time, i legally, they're not supposed to consider �i assessments as a basic for the contract, but u is this has been the underlying factor. and this was used at this time. +� Town Justice, Ronald Fish: When Mr. Blatchley and I negotiated with .a I Mr. Niver and Kimberly, that was one of the main things that was brought out Henry, that.. I; that it was on an equal basis concerning, as } we say, it isn't assessed valuation but but it it's a proportionate share of the Town's ® ! valuation for Homer and McGraw. And that's where we came up with the eleven thousand I� dollars ($11,000). l Mr. Henry Wadsworth: Sometime years ago when the other Town Board i was here, there. —there was a difference but I ' i !I they never administered it. They always kept the same rate througout the districts. Supervisor Blatchley: This is an increase, for your information, ;r , from eighty five hundred (8,500) to eleven } thousand (11,000).,: Yes, Gary. Gary Henry from Blodgett Mills. Mr. Gary Henry: Yes, can I just ask what the rates are.... are.':'. -;the valuation of the two (2) sections are....do you have that readily available or not? Just curiousity-- Supervisor Blatchle: Before the revaluation it was approximately nine million (9,000,000) versus thirty three, thirty five million (33,000,000), (35,000,000) somewhere in that neighborhood, Gary, Mr. Wells could give me a more accurate answer than that probably, but as I recall, it's very close to the one before. Town Assessor; Mr. Robert Wells: Do you want it right now? I can get it for you in just a minute. Mr. Gary Henry: owbllnor...61-- Supervisor Blatchley: I don't think it has to be that exact, does it Gary? Mr. Gary Henry: _ 4.No. _'no: "'it''..doesn't,:baue::_ao .be that exact, I just -- Town Assessor, Mr. Robert Wells: It worked out,,,I think, almost to 4 1 exactly twenty five percent (25%). Twenty five (25) McGraw, seventy five (75) in Homer. Supervisor Blatchley: Very, very close. Town Justice, Ronald Fish: That sounds like the figure we came up with at the time, yeah. Town Assessor, Mr. Robert Wells: I can give you the exact figure in about a minute if you want it. Supervisor Blatchley: Well, why don't we wait until after the meet- ing, if you want. Town Assessor, Mr. Robert Wells: Well if you want to come in my office after the meeting -- Mr. Gary Henry: Yeah, yeah, that's okay. Town Assessor, Mr. Robert Wells: --I'll be glad to give it to you. Mr. Gary Henry: Okay, I was just curious about it. Supervisor Blatchley: I think it's a very fair contract, really I do, and I think Mr. Fish and I both felt that way_ and I think the whole Town Board feels the same way. Anymore comments? I should have a gavel with me. If there are no more comments I'll declare the meeting .... the hearing closed ...... at this time. Pg.1 The first regular Town Board meeting of the month was held at the Town Hall, 15 Terrace -Road, with Supervisor Robert P. Blatchley presiding. Other board members present were: Justice Donald Eaton, Justice Ronald Fish, Councilman Ray Miller, Councilman Sherman Griswold was absent. Others present were: Town Clerk, Christine Canestaro, ,Town.Attorney, John J. Gardnet, Town Engineer, William Rowell, Highway Superintendent, Carl S. Eaton, Water and Sewer Superintendent, Fred Walker Sr., Town Assessor, Robert Wells, Zoning enforcement officer, Don Fowler, Legislators, Delmar Palm and Henry Wadsworth. News reporter, Skip Chapman and several town residents., • The regular meeting was cAlled to order and the pledge of allegiance was given by all in attendance. At 7:30 P,M. a Public Hearing was held on the 1978 McGraw Fire Contract. A transcript of this hearing will be on file in the Town Clerk's office. The regular meeting was reconvened at 7:40 P_,_ M. Approval Reading of the minutes of the previous Town Board meeting was dispensed with as all members of the board had re- of minutes viewed copies of these minutes prior to tonight's meeting. Motion was made by Councilman Miller, seconded by Justice Eaton that the minutes be approved as written. °Votes: Justice Eaton, aye; Justice Fish, aye; Councilman Miller, aye; Supervisor Blatchley, aye. Motion Carried. Town Clerk, Christine Canestaro presented a request for a trailer renewal permit for Charles Stafford. RESOLUTION #174 AUTHORIZATION TO ISSUE HOUSE TRAILER RENEWAL PERMIT TO CHARLES STAFFORD. BE IT RESOLVED, THAT the Town Clerk be, and she hereby is directed to issue a house trailer renewal permit to Charles Stafford, upon paymartt of proper fee, for a trailer located on the Tower_ Road, Cortlandville, New York. Town Clerk, Christine Canestaro read a letter Mt. Vista received from Mount Vista Enterprises, Cortlandville, New York requesting approval by the Town Board to make Enterprises sewer lnnta.11dtions in the Town of Cortlandville. Motion was made by Justice Fish to receive and file the letter, seconded by Councilman Miller. Votes: Justice Eaton, aye; Justice Fish, aye; Councilman Miller, aye; Supervisor Blatchley, aye. Motion carried. • Legislator Delmar Palm reported that he has Water Dist. received complaints in regard to cuts, made in driveways during the installations of Water District #5. Water #5 and.Sewer Superintendent, Fred Walker reported that this situation has been taken care of to the satisfaction of the residents. Legislator Henry Wadsworth reported that a tenative County budget has been adopted. Justice Eaton made the following report on the activities of..his office for the month of November 1977: County Budgei 597 Cases completed Justice $11,747,,paid in fines and forfeitures for that period report which has been turned over to the State Comptroller. Nov. $ 3,145.00 being held in pending cases. 286 Wednesday, December 7, 1977 Pg, 2 Highway Superintendent, Carl. S. Eaton reported that S.O.S. he had attended a.County meeting regarding the S.O.S. program Program. The Lime Hollow Rd. and'Stupke Road projects' for the Town of Cortlandville have been given top priority for the County. 78J of the total cost of this project- $30,000 estimated total -will be reimbursed by the State. The Town of Cortlandville'will pay'30% of this cost. Water Superintendent, Fred Walker Sr. reported that Water Dist, the South Cortland Water line, Water District #5 is #5 completed and it has been charged and flushed. Testing and chlorination will be done this week. Zoning enforcement officer, Don Fowler gave a report • Zoning Off. of the activities of his office for the month. of November. A copy of this report has been attached to and*made a report for part of these minutes. Nov. At 8:00 P.M. the regular meeting -was recessed and OPen bids receiving of bids for one 4X4 four wheel-d:;ri(e truck was for water officially closed. The Town Clerk opened and read the dept. truck. following,bid received: 1. Ames Chevrolet, Cortland, N.Y-. Price of New vehicle $7,282.00 Trade in allowance 29022.00 Trade Figure 5,260.00 Motion to receive and file the bid was made by Councilman Miller, seconded by -justice -Eaton. Gardner to examine for sufficiencies and legalities. Water tower Justice Fish apprised the board that the"meter at the water tower is not functioning,properly and a new one is being installed. Supervisor Blatchley recommended that action be taken on the Fire Contract with McGraw, New York, McGraw Fire contract RESOLUTION #175 AUTHORIZATION FOR SUPERVISOR TO SIGN FIRE PROTECTION CONTRACT WITH THE VILLAGE OF MCGRAW. Motion by Justice Fish, seconded by Councilman Miller. Votes: Justice Eaton, aye; Justice Fish, aye; Councilman Miller, aye; Supervisor Blatchley aye. Adopted. WHEREAS, the.fire.protection contract with the Village of McGraw for the contract period of January 1, 1978 through December 31, 1979 was • read and reviewed by the Town Board; and WHEREAS, a duly advertised public hearing was held by the Town Board of the Town of Cortlandville, pursuant to Section 18LP of the Town Law, on December 7, 1977; and WHEREAS, no person appeared in opposition of the approval of said contract; NOW THEREFORE, BE IT RESOLVED, THAT said contract be, and it hereby is, approved by the Town Board of Cortlandville. WHEREAS, our highly esteemed associate, Honorable • Sherman 0. Griswold, Town Councilman, has tendered his resignation as indicated in the minutes of this meeting as elected Town Councilman for the years 1976'through 1979; and WHEREAS, the record indicates that Sherman 0. Griswold has served as elected Town Councilman and a member of the Town Board for almost twenty-five consecutive years, serving -the office with great ability, keen judgment, intrepid honesty and ability to win friends, and that his experience as a success - full -agriculturist and as a member and officer of many agricultural organizations, has qualified him to render valuable advice and assistance to the officials -of the Town of Cortlandville and that his retirement leaves a vacancy which will be very difficult to replace and that he should receive a wholehearted commendation and our deserving thanks for all he has contributed to the'Town; be it RESOLVED, THAT we, officers of the Town of Cortland- ville, accept the resignation of Sherman 0. Supervisor Blatchley made the recommendation to Amend Res##143 amend the fee charged for copies under the.Freedom of 197a. Information.Law. RESOLUTION #177 AMEND RESOLUTION #143 FOR THE YEAR 1974 FEE CHARGED'FOR COPIES ISSUED UNDER THE FREEDOM OF INFORMATION LAW. The town officer or employee charged with the custody and keeping of the records shall, upon request, make a copy or copies C-, C7 G e) . 288 Wednesday, December 7, 1977 Pg. 4 of any records of such inspection upon the payment of a fee of twenty five cents (25) per page. If a copy or copies are desired thereof by the requestor, the Town officer or employee charged with the custody and keeping of the records shall make the same and mail or deliver the same to the requestor within one week depending on the volume and number of copies requested.. (2). Certification. Any town officer or employee charged with the custody and keeping of such records, shall, upon request, certify a copy of the document or record prepared pursuant to the provisions of Sub- division c (1) hereof upon.payment of a fee of twenty-five cents (25) per certificate. This resolution becomes effective January 1, 1978. Seal floor of Supervisor Blatchley apprised the board of a request received to seal the floor of the Cortlandville Municipal Municipal building. After some discussion it was decided that Building Justice Donald Eaton would look into this patter and report back to the Town'Board at the next scheduled meeting. Supervisor Blatchley apprised the board of correspond- ence received from the New York State Department of Tran- sportation -Dated November 25, 1977 regarding the right of the Town of Cortlandville to exercise preferential acquisi- tion rights to abandoned railway property. Supervisor Blatchley has recommended.that the Town of Cortlandville exercise the right, he stated his reasons : 1. Possible industrial development , 2. Possible future Sewer and Water lines. 3. Flood control for Village.of McGraw. RESOLUTION #178 AUTHORIZATION FOR SUPERVISOR TO NOTIFY Pref, rights NEW YORK STATE DEPARTMENT OF TRANSPORTATION to Railway REGARDING RAILROAD PREFERENTIAL RIGHTS. property Motion by Councilman Miller, seconded by Justice Eaton. Town EngineerTOWN ENGINEER REPORT: Sewer District #1 - Basically the work has been Report completed and negotiations are being made for final pay- ment. Certificate of completion should be ready to sign Sewer #1 by the end of this month. The town will retain 2% of payment in the amount of $1,200,00 for 1 year. $1,500,00 will be retained for pavement and lawn restoration. Application to the State Department Water of,Environmental Conservation for completed works Dist. #1 should be made before full use of the pump is resumed. Adopted, BE IT RESOLVED, THAT authorization is hereby given the Supervisor to sign an application -for approval of completion - required by the New York State Depart- ment,of Environmental Conservation - regarding restoration of use of pump in Well #3 in the Town of Cortlandville, Supervisor Blatchley apprised the board that payments will have to be made to Water District #5, Town Engineer, William Rowell recommended that the voucher submitted for payment of Water District #5 be Wate,-r Dist approved, subject to,approval from The Farmer's Home #5 Administration. After some discussion it was decided that this matter would be taken up at the next schedul6d Town Board meeting, December 2$0 1977. Justice Fish inquired about maximum time allowed for hook-up to, Sewer District #1. RESOLUTION #181 MAXIMUM TIME ALLOWED RESIDENTS FOR HOOK-UP TO SEWER DISTRICT tl Motion by Justice Fish, seconded by Justice Eaton. Sevier Dist. #1 BE IT RESOLVED, THAT the owner of zany house, building or property how in use for human occupancy, employment, recreation or other purpose, situate within Sewer District No. 1 of -the Town, abutting on any street, alley, or right-of-way in which a public sanitary sewer is located shall connect any toilet facilities therein with such public sanitary sewer on or before the first' day of January,-1980, in accordance with the provisions of the Ordinance constituting the Rules and Regulations for the operation of Sewer District No. 1 enacted July 13, 1960. Vrs. Canestaro read a letter from Raymond Bilodeau which listed the qualifications plumbers must meet before being licensed by the City of Cortland, together with a list of licensed plumbers. Mrs. Canestaro advised the Town Board that Tom Granato had made a sewer installation at 6 Munson Ave. without first 'being approved by the Town Board. Attorney Gardner was instructed to write a letter to Mr. Billodeau advising that all plumbers must also be certified by the Town Board before any installations are made in the Town of Cortlandville. 290 Wednesday, December 7, 1977 Pg.'6 Town Engineer, William Rowell recommended that the Fire fire hydrant at the former Wilson and Greene property Hydrant at -the corner of 281 and Crestwood'Court be retained as Water Dist. a public hydrant. An easement will be obtained from the ##2 existing owners - True Value Hardware - giving the Town access to the pipes that run underneath the building. As a public facility the hydrant will become a part of the Water District ##2 and this district will assume the cost of the hydrant. Following a lengthy discussion, itwas decided that this matter would be acted on at the next scheduled Town Board meeting,''December 21, 1977. Justice Fish offered the following resolution for Town adoption&' That all employment and discharge from employment of all employees of the'town and provision Employees for their compensation from the town, except Deputy Town Clerks and employees of the Highway Department, shall be made soj-y, by the Town Board after recommendation from Department Heads. Votes were polled as follows: Councilman Miller, aye; Justice Eaton, nay; Justice Fish, aye; Supervisor Blatchley, nay. There being a tie vote, the motion was not carried. Town Attorney, John Gardner. declared the bid for the new 1PX4 four wheel truck for the water department truck satisfactory. WHEREAS, pursuant to Resolution ##164 for the year 1977, sealed bids were publicly solicited for the furnishing and delivery of one new IPX4°:Four Wheel Drive pickup truck and WHEREAS, one sealed bid was received, opened and read aloud by the Town Clerk® Said bid being from Ames Chevrolet, Cortland, New York. NOW THEREFORE, BE IT RESOLVED, THAT the Town Board of the Town of Cortlandville does hereby award the bid to Ames Chevrolet, Cortland, New York for the furnishing and delivery of one new, 4X4 Four Wheel drive pickup truck. Price of new vehicle - $7,282.00- Trade in allowance 2,022,00 Trade figure .5,260.00 Supervisor Blatchley apprised the board that"the Town Notice ofhas been served a notice of defect. This notice regards defect. action taken by Lilio and Anna DeLibertis regarding damages caused by.the draining of surface water from a culvert located underneath the surface of Starr Road., Attorney, John Gardner will attend to this matter. 1 n U • 1 291 Wednesday, December 7, 1977 Pg. 7 Supervisor Blatchley agreed to write a letter to the Sewer Mt. Vista Enterprises apprising them of the proper procedure Dist.#1 to follow regarding approval from the Town Board to hook-up sewer systems in the Town of Cortlandville. Supervisor Blatchley apprised the board that a date Year end should be set for the year end meeting of the Town Board. After some discussion,it was decided that this meeting would meeting be held on Wednesday, December 28, 1977 at 7:30 P.M. at the Town Hall, 15 Terrace Road, Cortlandville; New York. • Councilman Miller questioned Water and Sewer Superintendent Fred Walker, Sr., about voucher submitted regarding Rockwell repair parts purchased by the Water Department. Fred Walker, Sr. explained that the parts are used for repair of inside Water water meters and at the same time to convert these meters meter parts to outside readers. BE IT RESOLVED, THAT audited bills are hereby ordered paid as follows: ,,-.Wth the exception of Vouchers #528.and 529 which must be held until approval for payment has been received from the New York State Department of Environmental Conservation. Voucher #460.was not signed for payment by Justice Eaton because authorization for this bookkeeping service was not given at an open meeting of the town board by resolution and therefore he does not feel it is a legal expenditure and refuses to sign for its payment. Audit bills • Respec`Tully submitted, Deputy Town Clerk The Letter of resignationglf Sherman 0. Griswold was erroneously omitted in the, w clerk's correspondance. Town Clerk, Christine Canestaro read a letter of resignation from Town Councilman Sherman 0. Griswold. The letter requested that Mr. Griswold be relieved of his duties as Town Councilman as of November 30, 1977.
