HomeMy WebLinkAbout11-16-1977Wednesday, November 16, 1977 Pg. 1 7:30 P.M. 277 1 11 E The second regular Town Board meeting of the month of November, 1977 was held at the Town Hall, 15 Terrace Rd., Cortlandville with Supervisor Robert P. Blatchley presiding. Other board members present were: Justice Donald F. Eaton, Justice Ronald Fish, Councilman Sherman Griswold, Councilman Ray Miller. Others present were: Town Engineer, William Rowell; Town Attorney, John Gardner; Deputy Town Clerk, Patricia L. Barber; Highway Superintendent, Carl S. Eaton; Town Assessor, Robert Wells; Fred Walker, Jr; Town Historian, Betty Palm; Newsreporter, Skip Chapman and several town residents., Zoning Enforcement officer, Don Fowler. The meeting was called to order and the pledge of allegience was given by all in attendance. Reading of the minutes of the previous Town Board Approval meeting was dispensed with as all board members had reviewed of min. copies of these minutes prior to tonight's meeting. Motion was made by Justice Fish, seconded by Councilman Miller that the minutes be approved as written. Votes: Justice Eaton, aye; Justice Fish, aye; Councilman Griswold, aye; Councilman Miller, aye; Supervisor Blatchley, aye. Motion Carried. Deputy Town Clerk, Patricia Barber presented an application for,a trailer -permit from Mrs. Martha Smith. Zoning enforcement Don Fowler investigated the site and found everything to be in accordance with the Townt House Trailer Ordinance. RESOLUTION #161 AUTHORIZATION TO ISSUE HOUSE TRAILER PERMIT House TO MA.RTHA, S. SMITH. _ Trailer Motion by Councilman Miller, seconded by Justice Eaton. Permit Votes: Justice Eaton aye; Justice Fish, aye; Councilman Griswold, aye; Councilman Miller, aye; Supervisor Blatchley, aye. Adopted. BE IT RESOLVED, That the Town Clerk is hereby authorized and directed to issue a six months house trailer permit to Martha S. Smith of Marathon, New York upon payment of the proper fee. Said trailer to be located at R.D.#1 Rt 11, Marathon, New York. Deputy Town Clerk, Patricia Barber read a letter received from the election inspectors at the Cortlandville Grange Hall Request apprising the Board of the poor condition of voting machine new votii #30719 and requesting that it be replaced for the next election machine Motion by Councilman Miller, seconded by Justice Eaton that the letter -be received and filed. Deputy Town Clerk, Patricia Barber read a letter of applica- tion from Mr. Ken Romer stating his qualifications for connecting ARRRR: sewers. Motion by Justice Eaton, seconded by Councilman Miller, that the letter be received and filed. RESOLUTION #162 APPROVAL OF QUA.LIFICA.TIONS OF MR. KEN ROMER TO MAKE SEWER CONNECTIONS IN THE TOWN OF CORTLA.NDVILLE . Motion by Councilman Ray Miller, seconded by Justice Eaton. RESOLUTION #163 A.UTHORIZA,TION TO HIRE FEE APPRAISER to FOR A. PRELIMINARY APPRAISAL OF BARKER'S PLAZA. Motion by Justice Fish, seconded by Councilman Miller. WHEREAS, a certiorari proceeding has been brought • against the Town Assessor by the Barker's Plaza Association in Cortlandville, NOW THEREFORE BE IT RESOLVED, that authorization is hereby given the Town Assessor, Robert Wells to hire The Pomeroy Appraisal Company of Syracuse, New York to make a preliminary fee appraisal of the Barker's Plaza Cortlandville, New York. The cost of said appraisal not to exceed $500.00. Justice Report Justice Donald Eaton made the following report on the activities of his office during the month of for Oct. October,1977• 497 Cases Completed $8,812.00 turned over -to the State Comptr-oller in fines and forfeitures. $3,970.00 being held in pending cases. Highway Superintendent, Carl S. Eaton apprised the board that plans are being formulated for road improve- ments in regard to the federal funded program "S.O.S." Mr. Eaton also apprised the board that the Poor Condition Clinton Street bridge in McGraw is in poor condition.. Warning signs have been posted and traffic is urged to Of Clinton St. route around the bridge. Heavy traffic will aggravate Bridge the condition. The condition may warrent closing of the bridge in the future, however at the present time Mr. Eaton is watching it very closely. Justice Eaton apprised the board that the specifications for a new truck for the Water Department are ready. Solicit bids RESOLUTION #164 A.UTHORIZA,TION TO SOLICIT BIDS FOR A HALF TON - 4X4 - Four WHEEL DRIVE for truck for PICKUP. Water -Dept. Motion by Justice Eaton, seconded by Councilman Griswold. BE IT RESOLVED, that the Town Clerk be and she hereby is authorized and directed to advertise for sealed bids for the furnishing of a one-half ton - 4X4 - Four -Wheel Drive pickup truck for the Cortlandville Water Department, in accordance with the specifications and terms set forth in the information to bidders, and 1 • 1 Wednesday, November, 16, 1977 Page 3 279.. BE IT FURTHER RESOLVED, that sealed bids will be opened and read aloud by the Town Clerk at 8:00 P.M. on December Open bids 7, 1977 at the Town Hall, 15 Terrace Rd., Cortlandville, Town Resident Ed Stiles presented a site plan to the Town Board for approval. This site plan regards the Stiles Property on Luker Road. See Minutes of July 6, 1977- Resolution #96 regarding zone change. Motion to receive and file the site plan was made by Justice Eaton and seconded by Councilman Miller. Motion Carried. ® Mr. Stiles apprised the board that upon acceptance of the site plan, ownership will be transferred to Mr. Thomas Gallagher. Mr. Gallagher assured the town board that proper, sewage permits have been received from the Cortland County Health Department. C • RESOLUTION #165 ACCEPTANCE OF SITE PLAN FOR LUKER ROAD PROPERTY. Adopted. property WHEREAS, in accordance with the stipulation made in Resolution #96 adopted July 6, 1977, that a satisfactory site plan be presented to and approved by the Cortland- ville Town Board regarding the Stiles property on Luker -Road in the Town of Cortlandville., sai-d site plan has been presented and filed. NOW THEREFORE, BE IT RESOLVED, that said site plan is hereby accepted and approved by the Town Board of the Town of Cortland- ville. Supervisor Blatchley gave the following report on the Super'; financial status of the Town for the month of October, 1977. The Benefit Reimbursement Method - This is a dolar for dollar -payment to the State Agency for all former, employees whocsebenefits are charged to the town account. RESOLUTION #166 ADOPTION OF BENEFIT REIMBURSEMENT METHOD FOR PAYMENT OF UNEMPLOYMENT TAX FOR THE TOWN OF CORTLANDVILLE Motion by Justice Eaton, seconded by Councilman Miller Votes: Justice Eaton, aye; Justice Fish, aye; Council= man Griswold, aye; Councilman Miller, aye; Supervisor, Blatchley, aye. Adopted. BE IT RESOLVED, that Authorization is hereby given to adopt the Benefit Reimbursement Method of payment for, unemployment tax in the Town of Cortlandville. Town resident, Mel Pierce apprised the board that he was asked by Mr-. Norman Grant to inquire as to why the Town Board had not approved his qualifications for- hooking -up sewers on the Terrace Road sewer project. Mr. Pierce was asked to advise Mr,. Grunt that a formal letter of application has not been received from Mr-. Grunt, in accordance with the Town Sewer Ordinance and therefor-e he could not be approved until such a letter was received and presented to the Town Board. RESOLUTION #167 ADOPTION OF FINAL BUDGET FOR THE TOWN Adopt final OF CORTLANDVILLE FOR 1978 AND ADOPTION budget for, OF SPECIAL DISTRICTS BUDGETS FOR 1978. 1978 Motion by Justice Donald Eaton, seconded by Justice Fish. WHEREAS, the preliminary budget for the Town of Cortlandville and the preliminary budgets for Water'District #1, Water -District #2, Water -District # 3, Water District #4, Water District #5 and Sewer -District 7#1 for the year 1978 have been duly presented to the Town Board by the Town Clerk and a duly advertised public hearing has been held thereon, NOW THEREFORE BE IT, RESOLVED, that pursuant to Section 109, Subdivision 1 through 3 of the Town Law, the said preliminary budgets as revised and approved by the Town Board, be, and they hereby are, adopted as the budgets for the Town of Cortlandville and said Special Districts, for the year 1978. 1 • 0 1 281 Wednesday, November 16, 1977 Page 5 Supervisor Blatchley apprised the board that it is his recommendation that the Town retain the use of the Fire Hydrant that is located on private property owned by the True Value Fire Hy - Hardware Store on the corner of West Rd. and Crestwood Court, drant at (former Wilson and Greene property). After considerable True Value discussion as to the feasibility of this recommendation it Hardware was decided that Town Engineer, William'Rowell and Town Attorney, John Gardner would look into this matter and report back to'the board at the next scheduled Town Board meeting. Supervisor Blatchley apprised the board that Mr. Herb Gates would set up town books for double entry bookkeeping ® for a fee not to exceed $200.00. RESOLUTION #168 AUTHORIZATION TO HIRE MR. HERB GATES TO Set books SET UP THE TOWN BOOKS FOR DOUBLE ENTRY BOOKKEEPING BY JA.NUARY 1, 1978. up for Motion by Justice Eaton, seconded by Councilman Miller. BE IT RESOLVED, that authorization is hereby granted for Supervisor Blatchley to hire Mr. Herb Gates to set up the town books for double entry bookkeeping at a cost not to exceed $200.00. This job is to be completed to meet the required deadline of January 1, 1978. RESOLUTION #169 AUTHORIZATION FOR SUPERVISOR TO SIGN ONE YEAR CONTRACTS FOR LA.MONT LIBRARY, CORTLA.ND FREE LIBRARY AND CORTLAND COUNTY S.P.C.A.. Motion by Justice Fish, seconded by Justice Eaton. BE IT RESOLVED, that authorization is hereby given Supervisor Blatchley, to sign new one year contracts for 1978 with Lamont Library, McGraw, New York in the amount of $2,500.001 Cortland Free Library, Cortland, New York in the amount of $17,500.00 and the Cortland County S.P.C.A.. for stray animal service in the amount of $4,000.00. BE IT RESOLVED, that a public hearing be held in the matter of a service contract with the McGraw Fire Department, McGraw, New York on December 7, 1977 at 7:30 P.M. at the Cortlandville Town Hall, 15 Terrace Road, Cortlandville, New York. BE IT FURTHER RESOLVED, that a notice of said public hearing shall be published in accordance with the requirements of the laws of the State of New York. 282 November 16, 1977 Page 6 Supervisor,Blatchley apprised the board of the need Consultants to hire consultants for up -dating the town zoning ordinance. It was the consensus of the board that for up -dating the contract mentioned would affect the new town board ordinances of January 1, 1978 and the matter was tabled. Supervisor Blatchley suggested that the water and Water and sewer, billing cards could be addressed for a minimal charge at Wilkin's'Printers, thus saving a considerable Sewer billing amount of clerical work. It was the consensus of the cards town board that this matter could be taken up by the new town board in January. No action was taken at this time. Town Engineer, William Rowell reported: Town Eng. Report 1. Water Line to South Cortland is underway, Water South Cora. & Sewer Superintpndent, Fred Walker, Sr -.is making water line day to day inspections and installation of the line seems to be moving along properly. 2. Terrace Road sewer project. This project has been Terrace Rd. completed for -this year and request for final payment Sewers will be forthcoming. 3. Well #3. The contractor has been instructed to proceed in accordance with Resolution #159 adopted at the November 2, 1977 Town Board meeting. RESOLUTION #171 DESIGNATION OF FIRST NATIONAL BANK AS DEPOSITORY FOR WATER DISTRICT Depository #4. for Water Dist. Motion by Councilman Miller, seconded by Justice #4 Fish. Votes: Justice Eaton, aye; Justice Fish, aye; Councilman Griswold, aye; Councilman Miller, aye; Supervisor Blatchley, aye. Adopted. Depository for Water Dist. #5 BE IT RESOLVED, that the First National Bank of Cortland, New York is hereby designated as the official depository for Water District #4 of the Town of Cortlandville. RESOLUTION #172 DESIGNATION OF FIRST NA.TIONA.L BANK AS DEPOSITORY FOR WATER DISTRICT # Motion Votes: by Justice Fish, seconded by Councilman Miller. BE IT RESOLVED, that the First National Bank of Cortland, New York is hereby designated as the official depository for the.Water, District #5 located in the Town of Cortlandville. 1 1 0 1 Wednesday, November,16, 1977 Pg. 7 283 1 1 Justice Eaton apprised the board that the Town Clerk, Christine Canestaro, while checking on sewer service applications, discovered that the former Town Clerk, Mr. Lelan Brookins neglected to charge Dr,. David Hollenbeck of 236 Tompkins St. for sewer service which he had been receiving since August 23, 1965 and Sewer for which he had not set up proper billing records for this Service/ account. Mrs. Canestaro had contacted Dr. Hollenbeck and ad- vised him of the error. Dr. Hollenbeck did not feel that he should Dr. pay any arrears on this account since he was not at fault Hollenbeck for the err -or. Mrs. Canestaro calculated the arrears at approximately $150.00 for the period from 8/23/65 - 9/30/77• She advised Dr. Hollenbeck that she would take the matter up with the Town Board and that he would have to abide by their decision. RESOLUTION #173 AUTHORIZATION TO FORGIVE THE SEWER SERVICE CHARGE ARREARS OF DR. DAVID HOLLENBECK. Motion by Justice Eaton, seconded by Councilman Miller. WHEREAS, in checking the sewer, applications of arrears. former years, it has been discovered that charges for sewer service have not been billed to Dr. David Hollenbeck, 236 Tompkins St., since he made application on August 23, 1965 and WHEREAS, the Town Board deems that the town should assume full responsibility for the neglected billing. NOW THEREFORE BE IT RESOLVED, that Dr. David Hollenbeck is hereby released from paying any arrears due for sewer service thru September 30, 1977 and that he shall commence payment for- said service as of October 1, 1977.
