The second/town board meeting of the month was
held at the Town Hall, 15 Terrace Road, Cortlandville
with Supervisor.Robert P. Blatchley presiding. Other
board members present were: Justice Donald F. .Eaton,
Justice Ronald Fish, Councilman Sherman Griswold and
Councilman Ray Miller. Others present were: Town Clerk,
Christine Canestaro; Town Engineer, William Rowell_;
Town Attorney, John Gardner; Zoning Enforcement Officer,
Don Fowler; Town Assessor, Robert Wells; Water and Sewer
Superintendent, Fred Walker, Sr., Highway Superintendent,
Carl S. Eaton; Newsporter Skip Chapman and several town
residents.
The meeting was called to order by Supervisor
Blatchley and the pledge of allegiance was given by
all in attendance.
Reading of the minutes of the previous town board
MINUTES meeting was dispensed with as all board members had
reviewed copies of these minutes prior to tonight's
APPROVED meeting. Upon motion by Councilman Miller and seconded
by Justice Eaton, the minutes were approved as written.

The following correspondence was read aloud by the
Town Clerk, Christine Canestaro
Letter Dated Sept. 20, 1977: Christine Canestaro entered
COD. -'.PLAINT a formal_ complaint against Stan Payne Construction Co.
for the way they handled the trees and shrubs on her
AGAINST STAN property during the construction of the sewer line in front
PAYNE CONT. Ccbf her. house. She said that her nursery man advised her
that they would more than likely die because of the improper
handling. Motion by Councilman Miller, seconded by Justice
Eaton that this letter be received and filed. Votes:

for voting machines. As of January 1, 1978 the rent would
be increased to $100.00 per year. Motion by Justice Eaton,
seconded by Justice Fish that the letter be received and

re'oorted. -that the Terrace Road sewer project is progressing
very well.
Town EfIngineer, William. Rowell reported that the
contractor
would -nut an air -test on the sewer line first,
then Rowell and Associ-ates will test the line. After a
satisfactory testing, approval will be requested from the TestS
Cortland County Health Department. After this the
homeowners wil.1 be allowed to connect to the sewer system.
Zoning Friforcement Officer, Don Fowler withdrew his,
request of September 7, 1977 to attend the New York State
Building Official,,-; Seminar and Meeting in New York City
on October 5 thrl) '?, 1977.

Supervisor Blatchley apprised the board of a
BUDGET- WORK work meeting for Town Board budget scheduled Tuesday
MEETING September 27, 1977 at 7:30 P.M, at the Town Mall,
15 Terrace Road.
Supervisor Blatchley reported that he and several
UP -DATING
members of the Cortlandville Planning Board had met
today with Mr, Robert Kelly of the firm Crenshaw and
ZONING ORD.
Kelly regarding the up -dating of Town of Cortlandville
Zoning Ordinance.
Mrs. Heppel', Cortland County Historian spoke in
TOWN
support of the position of the Town Historian. She
HISTORIAN
listed the qualifications necessary for this position
stating that the position required a special type of
•
person who would be dedicated to the work. She highly
recommended Mrs. Betty Palm whom she felt possessed
-the necessary qualifications and dedication for the job.

to serve as the Town Historian until December 31, 1977.
The regular Town Board meeting was adjourned at

road crossings in the Town of Cortlj-andvillle.

BE 1T FURTHER RESOLVFD, THAT the Mighway Superintendent,
Carl S. Eaton is hereby authorized to begin the work to
remove the tracks, grade, and pave the crossings to im-
prove the riding qiiallities of Time Hollow Road
Cortland) at Mile Post 67.16 and Stupke Road. (Dryden Rd)
at Mile Pose6?.4-1 iinder the following terms and conditions:
1. The Town will, at its sole cost and expense, remove
or cause to be removed the crossing, track, and other
necessary railroad ap-ourt-enances, and store the rail
and other materials on adjacent railroad right-of-way.
All removed materials are to remain the property of the
railroad.
2. The Twwn will, at its sole cost and expense, 'remove

crossing indicating to tihe highway user the presence

Supervisor Blatchley will write a letter to Dr.
Kenneth Macleod informing him that at this time there
is nothing in the Town of Cortlandville ordinance
regarding up -keep of unoccupied lots.
MCGRAW Supervisor Blatchley and Justice Fish recommend that
FIRE CONTR _.the two (2) year contract with McGraw Fire Department
ACT. be accepted. This contract calls for a $2500 increase
making the total $11,000.00 per year.
Town Attorney, John Gardner reminded the Board
that a public hearing must be held regarding the acceptance
of this contract, however, no date was set at this time.

Mr. William Bean, Supervisor Robert Blatchley, Zoning
Enforcement Officer, Don Fowler and Mr. Raymond Thorpe,
all of the Town of Cortlandville, County of Cortland
and State of New York, be,- and they hereby are,
appointed, pursuant to the provisions of Section 266
of the Town Law, as, for and to be a Commission to be
known as the Zoning Commission of the Town of Cortland-
ville with said Gordon Hatheway as Chairman thereof,
to recommend the boundaries of the new original zoning
districts to be formed in said Town and to recommend
new appropriate regulations to be enforced therein.
Such commission shall make a preliminary report to this
Board and shall hold public hearings thereon before
submitting its full and final report to this Board.
Town Engineer, William Rowell reported that the bids •
BIDS OPENED had been opened at 2:00 PvM. September 21, 1977 for
Water District #5. Stolar Construction Company submitted
FOR WATER DIS'ALthe low bid of $80,091.00. Bids were canvassed for legal
sufficiencies and Town Engineer, William Rowell recommended
the bid be awarded to Stolar Construction Company.

Dear Mr. Blatchley;
In reply to your letter of September 8 advising of your interest to remove
two road crossings in the Town of Cortlandville.
The Trustee of the Lehigh Valley Railroad Company is agreeable to permit the
Town of Cortlandville to remove the tracks, grade, and pave the crossings to r
improve the riding qualities of Lime Hollow Road (South Cortland Road) at
Mile Post 67.16 and Stupke Road (Dryden Road) at Mile Post 67.43 under the
following terms and conditions:
1. The Town will, at its sole cost and expense, remove or cause to be
removed the crossing, track, ,and other necessary railroad appurtenances, and
store the rail and other materials on adjacent railroad right-of-way. All
removed materials are to remain the property of the railroad.
2. The Town wM., at its sole cost and expense, remove or cause to be
removed the warning devices at the crossing indicating to the highway user
the presence of a rail -highway grade crossng and store the devices on adjacent
railroad right-of-way. Allremoved materials are to remain the property of
the railroad.
3. The Town -of Cortlandville would assume no liability for the warning
devices or rail which is removed and placed on railroad right-of-way.
4. All advance warning signs and pavement markings will be removed or
obliterated by the Town at its sole cost and expense.
5. All necessary reports concerning the closing of the grade crossings to
rail traffic shall be made to Mr. William Galloway, Director of Transportation
and Safety Division, New York Department of Transportation, State Campus Building
7A, 1220 Washington Avenue, Albany, NY 12226 - ATTN: Mr. Richard Witta.
This letter is prepared in duplicate, and if the foregoing terms are acceptable
to the Town., please have it signed by the proper official, returning the original
for our files.
