Reading of the minutes of the previous meeting of the town board was dispensed with as all board members had reviewed copies of the minutes prior to tonight®s meeting. Motion was made by Justice Eaton and seconded by Justice Fish that the minutes be approved as written. County Budget Legislator Delmar Palm apprised the Town Board of hearing a Cortland County Budget hearing to be held at the Town �/ Hall at 15 Terrace Road on October 4, 1977 at 8:00 P.M. Oct. 4, 1977 Supervisor Blatchley commended Legislator Palm for his stand on the sales tax issue brought up by Mayoral Candidate.Charles Poskanzer. Justice Eaton made the following report on the Justice Eatonactivities of his office during the month of August Report for 1977. August 503 Cases completed $10,520.00 Turned over to the State Comptroller in fines and forfeitures. $ 3,345.00 being held in pending cases. Water Water Superintendent, Fred J. R 0 ] 7r I �'E" -t .), IJ1.1 0 sIVN TI-S Supervisor Blatchley apprised the board that he had STATIE attended. a meeting on September 6, 1977 concerning the. 750 million dollar State Bond Amendment to be voted on in November of 1977. This meeting, conducted by Stage Personel, showed how this bond amendment would benefit Cortland County. The State has recommended that Cortland County receive 3,41 Million. This would make Cortland eligible for 7-14 -million of Federal Funds. ThJ.s would necessitate raising.32 million in local funds maki,ng a total county impact of 10.87 mill -ion dollars. Supervisor Blatchley advised the board that he had contacted Mr. Herb Gates concerning the job of setting up the Town books for double entry bookkeeping. F EDERAL - AID -RAIL - HIGHWAY CROSSING PROGRAM PROJEC 0 gem w RESOLUTION #125: AGREEING TO PERMIT THE DEPARTMENT OF TRANSPORTATION TO CONSTRUCT A FEDERAL - AID -,RAIL -HIGHWAY CROSSING PROGRAM PROJECT ON .THE HIGHWAYS, STREETS AND/OR.ROADS OF THE TOWN OF CORTLANDVILLE. Motion by Justice Donald Eaton, seconded by Councilman Sherman Griswold. WHEREAS, the New York State'Department of Tran- sportation has proposed a Rail -Highway Crossing Program Project, pursuant to Section 203 of the Federal Safety Act of 1973 as amended by Section 203 of the Federal Highway Safety Act of 1976, and WHEREAS, the New York State Department of Trans- portation has notified this Board of the approval of plans and specifications for such a Rail -Highway Crossing Program Project, for the Rail -Highway Crossings which are under the jurisdiction of the Town of Cortlandville and which project is more completely described as Erie Lackawanna Railroad Cincinnatus Branch, Mile Post (R.R.) 234.61 Kellogg Road covered under PIN 265816 R and Erie Lackawanna Railroad Syracuse Branch, Mile Post (R.R.) 232.96, Kellogg Road, covered under PIN 265817 X.; and WHEREAS, the New York State Department of Trans- portation has made known its intention to advertise a contract for the above -described improvement and has requested an agreement from the Board to the effect that it will permit the State, its agents and employees to enter upon the highways, roads and/ or streets under the jurisdiction of the Town of Cortlandville for the purpose of performing the above -described improvement. NOW, THEREFORE, BE IT RESOLVED: That the Town Board of the Town of Cortlandville does hereby approve of -the above -described improvement to be performed on the high- ways, roads- and/or streets of this Town and does hereby agree with the State Department of Transportation that the authorities will permit the State, its agents and employees to enter upon the highways, roads and/or streets of the Town for the purposes of carrying out the above -described Rail -Highway Crossing Program Project, and IT IS FURTHER RESOLVED; That the Town Board of the Town of Cortland- ville does hereby agree with the State Department of Transportation that the Town shall retain jurisdiction over the highways, roads and/or streets within the project area and hold harmless the State of New York for any damage to -the property or persons of others due to the performance of any of the employees or agents of the Town and IT IS FURTHER RESOLVED: That upon completion of the above -described Rail -Highway Crossing Program Project, the Town will main- tain the improvement and the highways, roads and/or streets so improved :in accordance with the New York State Highway Law and the Federal Highway Safety Acts of 1973 and 1976 and Federal Standards and criteria in connection with such project, and IT IS FURTHER 1 • 1 r U 1 September 7, 19?7 P9. 5 247 40 RESOLVED;'t,That for the Rail -Highway Crossing Program Project, the Town agrees to schedule any highway resurfacing so so that it will not obliterate newly painted markings, except as necessitated by emergency situations whereby resurfacing is essential to maintaining proper traffic operations. RESOLUTION #126: AI)T THORIZATION FOR SUPERVISOR BLATCHLEY TO WRITE A LETTER TO THE LEHIGH VALLEY RAILROAD COMPANY - REGARDING CORRESPONDENCE OF MAY 2, 1977 - TELL BROWN. BE IT RESOLVED, That Supervisor Robert Blatchley is hereby authorized to write a letter to the Lehigh Valley Railroad informing them that the Town of Cortlandville is interested in improving and upgrading the Railroad Highway Crossings at M.P. 7,16, South Cortland Road (Lime Hollow Road) and M,P. 67.43, Dryden Road (Stupke Road) in the Town of Cortlandville at the town' s expense, Mr. William Clemens, acting as spokesman for the Cortland- vi ' lle Planning Board, apprised the town board of a meeting of the Cortlandville Planning Board and the Cortland County Planning Board concerning the revisions requested by the Town of Cortlandville to the (Development Plan For Cortlandville). Mr. Clemens asked for the consensus of the board regarding the printing of a supplement to the original document. The Cortland. Supervisor Blatchley advised the board of communication received from the McGraw Fire Department regarding expiration of fire contract. Mr. Blatchley appointed Justice Fish and himself to negotiate with the Village of McGraw Fire Depart- ment concerning a new contract. Justice Eaton apprised the board that he and Attorney John Gardner had perused the bids for the Municipal Building Heating contract and Mr. Scanlon's bid was sufficiently legal. WHEREAS: pursuant to resolution ##105 adopted July 20, 1977 sealed bids were solicited for installation of a new heating system at the Cortlandville Municipal Building, West Road, in accordance with the specification and terms set forth in the information to bidders, and WHEREAS, five sealed bids were received and opened and read aloud by the Town Clerk, and WHEREAS, it was determined that Walter Scanlon submitted the lowest bid per resistance factor unit. Lana concerning repair of the Town Hall roof and Mr. Lang advised him that the roof would be done by November 1, 1977 and would be guaranteed for 10 years.
