The second regular town board meeting of the m-.Qnth was
held at the Town Hall, L5,-',`Terrace Road with Supervisor, Robert
P. Blatchley presiding. Other board-membe'rs pre . sent were:
Justice Donald Eaton; Councilman, Sherman Griswold; Councilman,
Ray Miller. Justice Ronald Fish was absent. others present

Barber; Town Attorney, John J. Gardner; Town Engineer, William

Delmar Palm; Newsreporter, Skip Chapman and several town residents.
Water & Sewer Superintendent, Fred Walker, Sr. was also present.
Supervisor Blatchley galled the meeting to order and the
pledge of allegience was given by all in attendance.
Reading of the minutes.of'the last meeting was dispensed
with as all members had reviewed them prior to tonight's meeting.
Motion was made by Justice Eaton, seconded by,Councilman Miller
that the minutes be accepted as written. Votes: Justice Eaton,
aye, Councilman Griswold, aye; Councilman Miller, aye; Supervisor
Blatchley, aye. Motion Carried.
,Town Clerk, Christine Canestaro apprised the board that Supple-
strpplements are available for member's copies of Fraser's Town ments to
Law Book: It was determined that four supplements are needed Fraser Tn
and Mrs. Canestaro agreed to order these. Law Books

BE IT FURTHER RESOLVED, that the Town Clerk is hereby
authorized to remove the small legal document drawers
and one metal cabinet, containing paper supplies, from
the vault.
Clean drain Legislator Delmar Palm apprised the board that he had
on Louise D:.received requests from Town residents to inquire about
having the drain cleaned on Louise Drive and the need for
patching of pavement on Summit Street. Highway Superintendent,
Patch Pav°m-t Carl Eaton will attend to these matters.

Town Bookkeeper, Mrs, Ida Locke, after some investigation
Hire account -of the cost involved, suggested that the town board consider
ant to set up hiring an accountant to set up the town books for double •
double entry entry bookkeeping, rather than to pay her. expenses to seminars
bookkeeping offered by the Department of Audit and Control.
Supervisor Blatchley aggeed to look into the cost of
hiring an accountant for.this purpose,He will report back to
the board.

Sewer job is Water Superintendent, Fred Walker, Sr. reported that
the new sewer job got under way Monday morning, August 15, 1977

Mrs. Sandy Levin, a representative of Blue Cross, Blue Rep. 0i
Shield, from Syracuse, gave a presentation on available dental Blue Ci
plans for tovm employees. Mrs. Levin gave copies of various
plans available to each board member and asked them to review them.
She outlined group plans and their costs. In order for the
town to participate, a minimum of ten (10) people must participate.

At 8:00 P.M. the regular meeting was recessed and receiving
of bids for the proposed heating project at the Municipal Building
was officially closed, The Town Clerk opened and read the

The bids were turned over to the Town Attorney, John
Gardner and Justice Eaton to examine for sufficiencies and
legalities.
Justice Eaton advised that he had contacted several
contractors for the proposed repair of the Town Hall roof,
of those he contacted, only F.H. Lang had proper equipment
for the proposed repairs and he recommended the town board
hire E.H. Lang to do the job.

BE IT RESOLVED, That authorization is hereby given to
hire Elmer Lang to do the proposed roofing repair job at the
Town Hall Building, 15 Terrace Rd, at the figure given
$1160.00.
BE IT FURTHER RESOLVED, That Town Attorney, John Gardner
was instructed to write to Elmer Lang requesting, in
writing, the figure quoted and necessary legal papers
regarding proper insurance coverage Etc.
Justice Eaton apprised the board of the need for the
ereetion of a fence around well #3. This fence would be
for the protection of the well. against vandals, animals,
etc.
Justice Eaton was instructed to get bids on the proposed
fence and report to the town board at the next regular meeting.
Town resident, N. Ross Hall of Lamont Circle requested N. Ross
more specific answers to his questions about business's being H,-tll
conducted on Lamont Circle. Mr. Robert Wells, Interim Zoning
Officer will answer Mr. Hall in writing.

Supervisor Blatchley apprised the board. that Cortland
St. Health County is eligible for funds from the State Health Insurance
Ins. Funds Reserve Fund and that he had made application for Cortlandville's
Avail -able share in the amount of $2,624.00, It was determined, by the
board, that a Certificate of Deposit should be purchased with
the Town of Cortlandville's share of these funds - this
certificate to be deposited in a special account and the town
would have use of the interest on the money.
Notion made by Justice Eaton, seconded by Councilman
Miller, that letter be received and filed. Votes: Justice
Eaton, aye; Councilman Griswold, aye; Counhilman Miller, aye;
Supervisor Blatchley, aye. Motion was carried.
William Rowe Town Engineer, William Rowell advised the board that
ih sewer project now being installed must be completed
to compose and approved by the Health Department before individual
hook-up will be permitted. Since there has been some
letter for misunderstanding regarding this by home owners in the area,
Residents Re$Mr.°Rowell has agreed to formulate a letter to be -sent to
each homeowner regarding hook-up and will send it to
Sewer Hook- Supervisor Blatchley for review.

Town Engineer, William Rowell apprised the board that
plans and specifications for the proposed Water District #5
water system had been approved by the Cortland°Health Dept.
and°he has had verbal indication that they would be approved
by the Department of Environmental Conservation shortl;r.r He
urged-their.approval by the town board so that bids might
be solicited at an early date.

the plans and specifications prepared by the Town
Engineer, William Rowell, for the proposed construction
of a new water supply system for Water District No. 5
of the town, at an estimated expense of $100,000.00.
Attorney John Gardner advised the board that Bond Counsel

necessary from talks they had with people in the Department
of Environmental Conservation offices, both in Syracuse and
Cortland, On the basis of this, Justice Eaton suggested that
the town board move forward with this tproject on the assumption
that an impact study was not needed. ,

COUNTY, NEW YORK TO PAY THE COST OF
THE CONSTRUCTION OF A WATER SUPPLY for Water
SYSTEM FOR WATER DISTRICT NO. 5 OF
SAID TOWN. Dist. #5

Section 1. For the purpose of paying the cost of
the construcTT-on of a water supply system for Water
District No. 5 of the Town of Cortlandville, Cortland
County, New York, consisting of water supply pipes,
mains and hydrants running northeasterly and south-
westerly along New York State Route No. 13 for a distance
of approximately IP300 feet and running southeasterly and
northwesterly along Cortland -Virgil Road for a distance
of approximately 800 feet, including incidental expenses
in connection therewith, and the acquisition of land or
rights in land, as previously authorized pursuant -to
proceedings duly had and taken by the Town Board of said
Town in accordance with the provisions of Article 12 of
the Town Law, there -are hereby authorized to be issued
$100,000 serial bonds of said Town pursuant to the Local
Finance Law, Futher details concerning said bonds will
be prescribed in a further resolution or resolutions of
this Town Board.
Section 2. The maximum estimated cost of such
specififcob-je or purpose is $100,000, and the plan for
the financing thereof is by the issuance of $100,000
serial bonds of said Town, hereby authorized to be issued
pursuant to the Local Finance Law; provided, however, that
the amount of bonds ultimately to be issued shall be
reduced by the amount of any State and/or Federal grants-
in-aid received by said Town for.such project.
Section It is hereby determined that the period
ob of prat—le—u-3stfulness of the aforesaid specific object or
purpose is forty years, pursuant to subdivision 1 of
paragraph a of Section 11.00 of the Local -Finance Law, It
is hereby further determined that the maximum maturity of
the serial bonds herein authorized will exceed five years.
Section 4, The faith and credit of said Town of
Cortlandville, Cortland, County', New York, are hereby
irrevocably pledged to the payment of the principal of and
interest on such bonds as the same respectively become due
and payable, There shall annually be assessed upon all
the taxable real property in said Water District No. 5 at
• the same time and in the same manner as other Town charges,
an amount sufficient.to pay said principal and interest as
the same become due and payable, but if not paid from such
source, all the taxable real property within said Town shall
be subject to the levy of ad valorem taxes without limitation
as to rate or amount's'uffici6nt to pay the principal of and
Interest on said bonds,
Section. Subject to the* provisions of the Local
Finance Law$ the power to'authorize the issuance of and to
sell bond anticipation notes in anticipation of the issuance
andsale of the serial bonds herein authorized, including
renewals of such notes, is hereby delegated to the Supervisor,
the chief fiscal officer. Such notes shall be of such terms,
form and contents, and shall be sold in such manner, as may be
prescribed by said Supervisor, consistent with the provisions
of the Local Finance Law.

Section 6. The validity of such bonds and bond anticipation
notes may be contested only if®
1) Such bonds are authorized for an object or purpose for
which Town is not authorized to expend money, or
2) The provisions of law which should be complied with at
the date of publication of this resolution are not
substantially complied with,
and an action, suit or proceeding contesting such validity is
commenced within twenty days after the date of publication, or
3) Such bonds are authorized in violation of the provisions
of the Constitution.
Section 7. This resolution, which takes effect immediately,
shall be published in full in Cortland Standard the official
newspaper, together with a notice of,the Town Clerk in
substantially the form provided in Section 81.00 of the Local
Finance. Law.
The question of the adoption of the foregoing resolution was
duly put to a vote on roll call, which resulted as follows:

BE IT RESOLVED, THAT the Town Clerk is hereby authorized and
directed to advertise for sealed bids for the furnishing,
delivering and installing complete 6® and 8® inch watermains,
valves, hydrants and appurtenances in the Town of Cortlandville°s
Water District No. 5, New York State Route 13 and Virgil Roads,
in accordance with plans and specifications prepared by Rowell
and Associates, P.C., Surveyors = Planners® Engineers, and
BE IT FURTHER RESOLVED, THAT sealed bids received will be
opened at 2:00 P.M. on September 21, 1977 at the Town Hall,
15 Terrace Road, Cortlandville, New York.

Supervisor Blatchley asked for consensus of the board

concerning Wilson and Greene fire hydrant.
Councilman Miller stated that the board had determined at a

previous meeting that a quaterly charge of $90.00 must be made in
accordance with the Water District Ordinance and the town should
proceed accordingly. If the„service was not wanted, it should be
-turned off.

Town Engineer, William Rowell apprised the board that if the
hydrant was to be discontinued, Water Superintendent, Fred Walker
should be notified at time of this prodedure.
After some discussion, it was determined that Supervisor
Blatchley would attend to this matter.

Town Attorney, John Gardner reported that on 8/10 /77
Town Assessor, Robert Wells was served with a copy of a notice
of petition and a request to review the tax assessment for the
Barker's Stores. The action is brought against the Board
of Assessment Review, the Town of Cortlandville, and the
Assessor of the Town of Cortlandville.
