Blatchley presiding. Other Board members present were: Justice Donald Eaton; Councilman Sherman Griswold and Councilman, Ray Miller. Justice Ronald Fish was absent. Others present were: Town Clerk, Christine Canestaro; Town Attorney, John Gardner; Town Engineer, William Rowell; Town Highway Supt., Carl Eaton; Town Assessor, Robert Wells; Water & Sewer Dept., Supt., Fred Walker, Sr.; Legislators, Delmar Palm and Henry Wadsworth; News reporter, Paul LaDolce; Peter Radmore of the State Dept. of Education; and several town residents. Reading of the minutes was dispensed with as all town board members had reviewed copies of the minutes prior to tonights meeting. Upon motion of Councilman Miller, seconded by Justice Eaton, the minutes were approved as written. Votes: Justice Eaton, aye; Councilman Griswold, aye; Councilman Miller, aye; Supervisor Blatchley, aye; motion carried. Assessor, Robert Wells reported that the Zoning Board of Appeals had received and decided just under 300 grievances. Mr. Wells gave each member of' the town board, a report he had compiled on sales of properties in Cortlandville during the months of May & June which shows that the sales price on 16 out of the 20 properties involved is higher than the C.L.T. assessed valuation. A copy of the report is attached to and made a Dart of these minutes. Mr. Wells made the following Zoning Officer's report: July 7 thru July 20, 1977 Certificates of Occupancy - 3 issued after inspection Building Permits - 9 issued Building permits in process Demolition Permits - 1 issued Cases pending: Zoning Board of Appeals - 2 Justice Eaton made the following report on the activities of his office during the month of June 1977: 78 cases completed 7,017-00 turned over to State Comptroller in fines & $4,015-00 being held in pending cases ASSESSOR REPORT ON GRIEVANCES BUILDING PERMIT REPORT JUSTICE forfeitures REPORT Supervisor Blatchley gave the following financial report on the financial status of the town as of 6/30/77'. General Fund Balance Federal Revenue Sharing Balance Water District #1 Balance Water District 7#2 Balance Water ..Di strict #3 Balance Water District #4 Balance Sewer District #11 Balance Highway Fund Balance comprised of: Repairs & Improvements $75,636.72 Bridges 7,601.16 Machinery 62,033.82 Snow Removal & Misc. 33,981-38 Anti Recession Fund Balance $81 8�5:65 39:2 3•45 58,051.27 1,142-37 7,113.26 92,693.55 32,443.16 179,253.08 3,233.62 Supervisor Blatchley apprised the Board that an additional Anti Recession Fund check had been received since July 1 in the amount of $5,405-00. Supervisor Blatchley reported he had requested an audit by the Dept. of Audit and Control. They advised him -there will not be any audits in the County of Cortland this year due to the lack of personnel. However, Mr. Ray Alger from the Dept. of Audit & Control, Binghamton, N.Y. did come in and go over the accounts with the supervisor and his bookkeeper. He assured them that the accounts were being handled properly. Mr. Blatchley suggested that the town board consider the feasability of yearly audits by a private auditor. SUPERVISOR FINANCIAL REPORT AUDIT REQUEST 228 Wednesday, July 20, 1977 Pg. 2 LAFAYETTE to Supervisor Blatchley apprised the board that he had received a copy of a petition requesting that hearings be OAKDALE reopened on the Lafayette -Oakdale 345 KV Transmission Facility 345 KV in order to permit the introduction of evidence relevant to health 1RANS. LINE and safety issues. This line will pass thru the Town of Cortlandville and Supervisor Blatchley thought the town board should be concerned for town residents who are in the construction area. FISHER AVE. Supervisor Blatchley reported that federal funding for a DRAINAGE drainage district on Fisher Ave. had been rejected. He met with the area residents on Monday and the residents decided they would fund the project themselves on a benefit basis. Councilman Miller advised that Justice Fish wished to go on record as being against it. 701 MASTER Supervisor Blatchley reported that a meeting had been held PLAN on V19/77 concerning the correction of the Town Master Plan and the redoing of the maps as prepared by the County Planning Board. He request for read a letter he had written to Mr. Theodore Zollendeck, Director corrections of the County Planning Board regarding this matter. A copy of the letter is attached to and made a part of these minutes. TERRACE RD. AREA SEWERS: Engineer William Rowell reported that the contracts have been signed and delivered to the contractor. TERRACE RD. He held a job conference with the contractor today to go over AREA SEWERS the details of the project. Shop drawings have been submitted for the engineer's approval. Others will be required. The contractor indicated to him that materials for the project will be delivered on or about August 3 and work will commence shortly thereafter. Engineer Rowell advised he had issued, today, an order to proceed which gives the contractor 90 days to complete the work in accordance with the contract documents. A copy of the letter giving notice to proceed is on file in the town clerk's office. WATER DISTRICT #4 : Supervisor Blatchley advised that he and WATER DIST. Engineer Rowell had inspected the fire hydrant at the Pyramid #4 Mall which was hit .by a car, to see the extent of da*e . The pipe which protects the hydrant was severely bent. Mr. Rowell recommended that the pipe be repaired to facilitate hooking up of fire hose to the hydrant in case of fire. The cost of repair was estimated by Fred Walker, Sr. at approximately $60 to$75. The consensus of the board was to have the Water & Sewer Dept. repair the damage and the town to proceed with the acceptance of the facilities. RESOLUTION #104: ACCEPTANCE OF WATER DISTRICT #4 WATER FACILITIES ACCEPTANCE Motion by Councilman Ray Miller, seconded by Sherman Griswold. OF WATER DIST.#4 Votes: Justice Eaton, aye; Councilman Miller, aye; Councilman FACILITIES Griswold, aye; Supervisor Blatchley, aye. Adopted. WHEREAS, Pyramid Properties Company has agreed to accept the sum of $87,129.01 for conveyance to the Town of the cast iron pipes, hydrants, valves and all other appurtenances and equipment together with a perpetual easement used in connection with the transportation of water from the water tank in Water District No. 1 to Pyramid Mall in Water District No. 4; and WHEREAS, Pyramid Properties Company has agreed that the Town may deduct from said payment the sum of $2,910.00 to be held in escrow and to be used in payment of interest due November 1, 1977, on the statutory installment bond of Water District No.4, dated May 1, 1977; and WHEREAS, Pyramid Properties Company has delivered to the Town a Bill of Sale and Deed dated June 28, 1977, conveying title to the Town of said Water supply system and easement; BE IT RESOLVED, that the Supervisor pay to Pyramid Properties Company the sum of $84,219.01 from moneys now on hand to the credit of Water District No. 4; and be it further IL J is 11 is 1 RESOLVED, that the Town Clerk accept de:rvdry of said Bill of Sale and Deed and record said Deed in the Cortland County Clerk's Office. 1 229 Wednesday, July 20, 1977 Pg• 3 WATER DISTRICT # : Engineer,William Rowell reported an application has been sent to Albany for approval of the district.A Public hearing has been set for August 2. If no petition to be WATER heard is filed, the hearing will be cancelled. DISTRICT Completed contract documents and drawings are on file in #5 the Town Clerk's office. Cast iron pip has been specified but has asked for prices on comprable size P.V.C. pipe also, as a possible alternate. Attorney Gardner advised that pursuant to Sec. 197 of the Town Law, plans and specifications have been submitted by Air. Rowell as authorized by the Town Board (Res.1#83, 1977). The Town Board must now review these plans and specifications and either adopt or reject them prior to advertising for bids on the project. WATER RATE STUDY : Supervisor Blatchley advised that Rowell & Associates had submitted their water rate study. -He read a`r2etter from WATER Mr. Rowell which suggested a change in the bookkeeping procedure whereby each district will be a separate method RATE of bookkeeping. Supervisor Blatchley and his bookkeeper STUDY will discuss this with Mr. Rowell further. Motion was made by Justice Eaton, seconded by Councilman Miller that the water rate study and letter be recieved and filed. Votes: Justice Eaton, aye; Councilman Griswold, aye; Councilman Miller, aye; Supervisor Blatchley, aye. Motion carried. HEATING SYSTEM FOR MUNICIPAL BUILDING -WEST ROAD Justice Eaton reported the specifications for the heating HEATING system were ready and will be given to Attorney Gardner for SYSTEM review. MUNICIPAL RESOLUTION #105a AUTHORIZATION TO SOLICIT BIDS FOR HEATING SYSTEM BLDG. W.RD. MUNICIPAL BUILDING -WEST RD. Motion by Justice Eaton, seconded by Councilman Griswold Votes: Justice Eaton, aye; Councilman Griswold, aye; Councilman Miller, aye; Supervisor Blatchley, aye. Adopted. - BE IT RESOLVED, that the Town Clerk is hereby authorized and directed to advertise for sealed bids for the furnishing and installation of a heating system for the Municipal Building, West Rd., in accordance with the specifications and terms set forth in the information to bidders; and BE IT FURTHER RESOLVED, that sealed bids received will be opened at 8:00 p.m. on August 17, 1977 at the Town Hall, 15 Terrace Rd., Cortlandville, N.Y; and BE IT FURTHER RESOLVED, that funds to cover the cost of this project shall be appropriated from the Anti Recession Fund a/c #CF4720. Supervisor Blatchley apprised the Board that $40,000 had been • appropriated from Federal Revenue Sharing Fund for 1977 paving projects which are now underway. Mr. Mel Pierce apprised the Board that, according to a letter he had received from N.Y.State Dept. of Health, 10010 Federal Funding FEDERAL is available for sewering around a water supply when it is determined FUNDING that the improvement is for the protection of that water supply. The AVAILABLE FOR consensus of the Board -is that if a Federal Grant is available, application should be made for it to pay off the bond anticipation PROTECTION OF note obtained for the current Terrace Rd. area sewer project which is WATER SUPPLY being installed to protect the water supply. Attorney Gardner and Engineer Rowell will look into this matter further. i I \J 230 Wednesday, July 20, 1977 Pg• 4 REDUCE Justice Eaton proposed a resolution be adopted pursuant to Sec. 60-a of the Town Law, to reduce the number of town NUMBER OF justices in the Town of Cortlandville to one, as there has been TOWN only one acting justice for the town in the past seven years. JUSTICES This,he said,would save the town money. He advised that under this law, in case of necessity, justices can serve outside their own jurisdiction. RESOLUTION #106: AUTHORIZATION TO REDUCE THE NUMBER OF JUSTICES IN THE TOWN OF CORTLANDVILLE Motion by Justice Donald Eaton, seconded by Councilman, Sherman Griswold. Votes: Justice Eaton, aye; Councilman Griswold, aye; Councilman Miller, aye; Supervisor Blatchley, aye. Adopted. BE IT RESOLVED, That the Town Board determines in the best interests of the Town that, pursuant to Section 60-a of the Town Law, the number of Town Justices shall be reduced from two to one; and be it further RESOLVED, that this resolution shall become effective December 31, 1977, and shall be subject to permissive referendum. Mr. Clarence Homer inquired if Mr. Andy Grossi had a building permit for the structure he is building on the Starr Rd.. The matter was turned over to Interim Zoning Enforcement Officer, Robert Wells. There being no further business, upon motion of Justice Eaton, seconded by Councilman Miller, all voting aye, the meeting was adjourned at 8:22 p.m.. The meeting='idas..attended by four town. planning board members, two town board members', and County legislators Delmar Palm, Shirley FS.sh, and Henry Wadsworth. It was unanimously agreed that the proposed land use map .and its accompanying 200 page master plan entitled, "Development Plan for Cortland- ville", was printed prematurely (pior to the public hearirig) thus allowing for no changes as suggest by the various town boards or the general public. It was also agreed that corrections as desired by the town concerning the land use map and the aforementioned master plan, should be done by the County planning dept. with no additional expense to the town. ' As the town planning board is anxious to get started on the up- dated zoning ordinance for the , town, we would like all corrections made to the satisfaction of the town by Oct. 01,, 1977..
