The first regular town board meeting of the month was held 217
at the Town Hall, 15 Terrace Road with Supervisor Blatchley presiding.
Other town board members present were: Justice, Donald Eaton; Justice,
Ronald Fish; Councilman Sherman Griswold; Councilman Ray Miller.
Others present: Town Clerk, Christine Canestaro; Deputy Town Clerk,
Patricia Barber; Town Attorney, John Gardner; Highway Superintendent,
Carl Eaton; Water Superintendent, Fred Walker; Fred Walker, Jr�
Legislators, Del Palm and Henry Wadsworth. Newsreporter, Paul La Dolce
and several town residents.
The meeting was called to order by Supervisor Blatchley and
the pledge of allegience was given by all in attendance.
Reading of the minutes of the previous meeting was dispensed
with a.s all board members had reviewed copies of the minutes prior
to this meeting. Motion was made by Justice Eaton and seconded by
Councilman Miller that minutes be approved as written. Votes:

Justic; Eaton called the board's attention to the fact that
resolution 90,9 authorizing the extension of water service to the
Fred Walker Jr, property on route 90 should have been rescinded
at the last board meeting and asked that the minutes be amended
accordingly.

correspondences A letter dated June 22, 1977 from the
State Department of Environmental Conservation concerning D.E.C.
the issuance of permits to mine. Re: New York" s Mined Land (permits to
Reclamation Law of 1974. Motion by Councilman Miller, mdne)
seconded by Justice Eaton to receive and file the letter.

was made by Justice Fish and seconded by Justice Eaton that r3etition

Town Clerk, Christine Canestaro, apprised the board
that she had received an application for a House Trailer House Tr.
Permit from Mr, and Mrs. Ralph Warren of Valley View Drive. permit for
Mrs. Warren had informed her that the site had been inspected Ralph
by Zoning Enforcement Officer, Don Fowler and that he had Warren
cadvised Mrs. Warren that everything was in order according
to the town trailer ordina-h-ce. County Health Department
approval was submitted with the application.

Court Justice Eaton announced the resignation of his Court Clerk,
Clerk Ms, Mary Bush as of August 1, 1977. Ms. Bush plans to attend
Resigns Cortland State College in the fall. The services of Ms. Sharon
Tucci have been enlisted on an interim basis and she is to paid
hourly.

Highway Superintendent Carl Eaton apprised the board of a
request made by Mr. George Allen concerning possible erection of

before the Town Board on July 6, 1977, in the matter
of the petition of Jean So Stiles, Edward H. Stiles
and Dean L. Potter, for the adoption of a proposed change
in the boundaries of Residential R®1 and Business Districts'
as shown on the 1968 Zoning Map of the Town of Cortland-
ville: and
After hearing the testimony and evidence held at such

recommendation of the Cortland County Planning Board
disapproving the proposed amendment and recommending
a change to an Industrial District;

Luker Rd.the recommendations of the Cortland County Planning Board are as
follows:
1. That this change is a logical extension of an existing
business district.
2. That the above,described parcel of land does not lend
itself to industrial: -use.

Letter fr. Supervisor Blatchley read a.'_l0tter-_to'the board that he
received from Mr. Pitts, of the Federal Soil Conservation Department
S. C.Dawho advised the drainage situation on Fisher Ave. has been inspected
Re: drain -and the damage caused by flooding does not appear to be extensive
age on enough to warrent Federal Assistance.

Supervisor Blatchley read a resolution passed by the Village
of McGraw supporting the concept and establishment of a County
McGraw Sewer District. A copy of this resolution is attached to and made
Res. Re: a part of these minutes. Motion by Councilman Miller and
seconded by Justice Eaton to receive and file the resolution.

Supervisor Blatchley advised the Town Board that he had
Letters received reports from Town Engineer, William Rowell regarding,
Re: 3-rd Camera inspection of (3rd) third W0.11 - Department Environmental
well- Conservation hearing and easement for the Sun Oil Co. regarding
D.E.C. Sewer project for McLean Road, Terrace Road, PleasantVilevI,__ -,
Hearing - and Munson Ave. These letters were not read to the Town Board,
Supervisor Blatchley also reported that a Water rate study
Sun Oil has been received and copies of this have been distributed to
Easement Board members.
Supervisor Blatchley stated that Mr. Rowell has written to
the Hall Company, who drilled Well #3 regarding assistance in
rectifying problems concerning conditions of Well #3.
Town resident Mrs. Reynolds requested the installation of
Street li4 street light for Hart Drive and Highland Road. The consensus
for of the Town Board is to continue with the moritorium on Street
Hart Dr. lights established early last year. •
Supervisor Blatchley reported to the town board that the
Town Planning.Board has requested that the Town Board have maps
Land use printed according to town land use plan. Legislator, DElmar
Maps Palm stated that he felt that since the County Planning Department
had been engaged as consultants to do this phase of the Town Master
Plan, they should make any corrections necessary and that he had
advised County Planner, Ted Zollendeck .of his feelings. There
are'county monies available for this purpose, he :said. A discussion
followed. As a result, the consensus ;of the Town Board was that
the "Development Plan" and map should be revised according to the
decisions made by the town planning board and the advisory committee,
and that the cost of the revisions should be borne by the County
Planning Department o6nsultants of the project. Mr. Palm agreed
to contact Mr. Zolfendeck and tell him of the Board's decision. He
will report back to the Town Board at the next scheduled meeting.

Town resident Martin Gibson of 21P Halstead Road requested 221
assistance in reducing noise and odor caused by Locko Glazers Noise &
and Farm Line Corporations on Tompkins Street Ext, Mr, Gibson
was advised that the Town of Cortlandville Zoning Ordinance is odor on
being updated and the subject of noise will likely be covered* Halstead
As to -the odor problem, he was advised to contact the Health
Department,
Town resident N. Ross Hall ask�Town Clerk, Christine Canestaro
if she had received a reply from New York State Department of Dept.
Agriculture and Markets concerning business operations on Lamont of Ag
Circle. Mrs. Canestaro advised Mr. Hall that she had contacted a
Mr, Ronald Dix and in return Mr. Dix had spoken with one of the & Mart's
business men and was in the process of contacting the other one.
His written findings on this matter are forthcoming, she said,

Mr, Hall asked Supervisor Blatchley if Lamont Circle had been
inspected by Highway Superintendent Carl Eaton and he was informed
that it had. Mr. Hall then asked Mr. Carl Eaton if there were Road
plans to reconstruct the pavement on Lamont Circle to handle over -
the -road transport trucks, Mr. Eaton advised Mr. Hall that none Repair
of the town roads are paved for ;heavy truck traffics that all for
town roads are constructed according to town specifications. There
is not a specified truck route in the town of Cortlandville® Justice
Eaton advised Mr. Hall that the town has a highway program which is
budgeted and when roads are damaged by traffic the highway department
makes necessary repairs and resurfacing. Lamont Cir.
Mra Hall referred to the last paragraph of Mr. Gardner's letter
regarding restriartive signs Which can be installed limiting the Use of
weight of truck traffic on certain roads. He asked why such a Restrictiv
sign could not be erected on,Lamont Circle, Carl Eaton advised him
that such signs are only temporary signs which are posted usually signs
in the spring of the year to protect the roads from breaking up
during the spring thawing period. Justice Eaton advised Mr. Hall on
that if such signs are erected - a permit must be issued by the
town to anyone requesting one for the purpose of delivery in the Lamont
restricted area (Section 1660 of.';the Vehicle and traffic law). Cir.
Mr. Leonard Bacon of McGraw,'Neiv York asked what could be
done regarding the dangers of the intersection at Route 41 to
McGraw and Route 11 to Polkville. Mr, Bacon was advised that Interco
Supervisor Blatchley has spoken to the State Department of section
Transportation about this intersection and it is under study at
the present time and that there are plans for reconstruction at McGraU,
of this intersection. & Polkville
Supervisor Blatchley requested that a 61, Water line be Extend 6"
extended to the Fred Walker Jr, property on Owego St, Ext.
Justice Eaton wished to know who was going to pay for the Water Line
extension, Supervisor Blatchley stated they had agreed to pay
@ the rate of $3.00 per foot for 5 lengths of 61, line (this to Fred
agreement was made at a closed:
meeting of the town board after Walker Jr,
the regular meeting on June 15, 1977. Cost of this pipe per
voucher #48 & 49 is 5,470 per foot) Supervisor Blatchley stated
that it was his opinion that it would be enough of a benefit to
the district to warrant the extra cost to the district, Justice
Eaton advised that pursuant to Sections 199 and 202 of the Town
Law a public hearing must be held before monies could be expended
for improvement to the district. Justice Fish stated that he
felt this could be classified as "maintenance", Justice Fish
claimed this method had been used in other instances and felt it
could be done again. Properties he named where this had been done
in the past were: Frank Taylor, Owego St. Ext., Gary Law,
Joe Sonnacchio and Carmen Ricotelli on Starr Road.

Line
BE IT RESOLVED, THAT the town board of the town of Cortlandville
does hereby authorize the extension of the 6" water main on New
York State�Route 90 a distance of 922 feet to serve the Fred
Walker Jr. property subject to the approval of the New York State
Department of Trarige...and subject to obtaining necessary easements
from land owners whose property the line will traverse, and
Cost of BE IT FURTHER RESOLVED, THAT the cost of said water main extension
Extension to Fred Walker Jr, shall be $277.50 ($3.00 fer ft) and the remainder
of the cost shall be borne by Water District #1 of the town of
Cortlandville.
Supervisor Blatchley advised the board that the townis
Fire Hydra-&e+ing charged a sum of $25.0,0 for a fire hydrant on Wilson and
at ° Green property on West Road. It was the consensus of the board
Wilson & -that since this hydrant is on private property and has not been
Greene deeded over to the town, as yet, the town should bill Wilson and •
Greene for this hydrant.

RESOLVED, THAT the bid of Stan Payne Construction Co.,
Inc., received April 20, 1977, for the construction
and completion of said project in the amount of
$71,020.00 be, and hereby is, accepted; and that the
Supervisor be, and he hereby is, authorized and directed
to enter into a contract with Stan Payne Construction
Co., Inc., for the construction of said project according
to the terms of said bid and the provisions of said
plans and specifications prepared by the Town Engineer.

WHEREAS, at a regular meeting of the Town Board
of the Town of Cortlandville, Cortland County, New
York, duly held and conducted on June 1, 1977, said
Town'Board approved the construction of lateral
sewers in and along portions of McLean Road, Terrace
Road, Pleasantview Drive and Munson Avenue within
Sewer District No. 1 of the Town pursuant to Section
199 of the Town Law at an estimated cost of $90,000.00;
and
WHEREAS, it is now desired to provide for the
financing thereof;
NOW, -THEREFORE, BE IT
RESOLVED,by the Town Board of the Town of
Cortlandville, Cortland County, New York.as
follows:
Section 1. The construction of lateral sewers in
and along certain streets known as McLean Road,
Terrace Road, Pleasantview Drive and Munson Ave,
within the confines of:Sewer District No. 1 of the
Town of Cortlandville,, Cortland County, New York,
is hereby authorized at a total estimated cost of
$90,000.00.
Section 2. The plan of financing such object or
purpose is by the issuance of not exceeding
$90,000.00, serial bonds of the Town of Cortlandville,
which are hereby authorized pursuant to the provisions
of the local Finance Law, Such bonds are to be
payable from amounts which shall annually be levied
on all the taxable real property in Sewer District
No, 1 of the Town and the faith and credit of the
Town of Cortlandville are hereby pledged for -the
hereon.

Section 3. Subject to the provisions of the Local:
Finance Law, the Dower to authorize the issuance of
and to sell bond anticipation notes in anticipation
of the issuance and -Bale of the serial bonds herein
authorized, including renewals of such notes, is
hereby delegated to the Supervisor of the Town, the
chief fiscal officer. Such notes shall be of such
terms, forms and contents, and shall be sold in
such manner, as may be prescribed by said Super-
visor of the Town, consistent with the provisions

Section 4. It is hereby determined that the period
of probable usefulness of the aforesaid project or
purpose is forty years pursuant to subdivision 4
of paragraph a of Section 11.00 of the Local Finance

Section 5 The proposed maturity of the serial bonds
hereby authorized will be in excess of five years.
Section 6. This resolution shall take effect

Attorney John Gardner advised the board that all.o.papers have
,been prepared for the Town to take possession of the water lines now
Water Dist.owned by Pyramid Properties (to be known as Water District #4).
The deed conveys (3) three easements in the Cortlandville Mall
plus the large easement that"goes to the water tank® according to
Town to the surveys and maps which have been approved by Engineer William
Rowell. The approved total project cost is $97,129,01 of which
take poss. $87,129.01 is to be paid to Pyramid -Properties to -cover construction
and easement and engineering costs. Attorney Gardner advised
that he has made arrangements with Pyramid Properties to accept
the deed and bill of sale. The total amount to be paid to
Pyramid Properties is $84,219.01. This reflects $2,910.00 in
interest due on Bond, November 1, 1977. This will be held in
escrow until the due date as there is not,as yet, any funds
in the Water District #4 account whereby interest and principal
payments can be made. He cautioned that the new 1978 budget is
provide for the payment of interest and principal on
this bond.
Damage to Water Superintendent, Fred Walker advised there was some
damage to a post near the water hydrant on the Pyramid Property
post on and thought perhaps the damage should be repaired before the
Pyramid town took possession of the facilities. Attorney Gardner said
Properties that he would contact the Pyramid Properties attorney regarding
this matter. Further action on acceptance of the facilities was
tabled until this matter is resolved.
Re: Water District #5
Water Dist. Supervisor Blatchley.- advised the board there would be a
Department of Environmental Conservation Hearing on this project
August 2, 1977. D.E.C. approval must be obtained before going
Need D.E.C.to Bond Counsel. Mr.'-;Blatchley stated that Keith Jennison had
approval advised him he thought Bond Counsel could be contacted prior to
Department of Environmental Conservation approval. Attorney
Gardner advised he had received a letter from Bond Counsel
stating the requirements necessary prior to bonding and a cert-
ified copy of Department ;of Environmental Conservation approval
was one of the requirements. This eanno.t be obtained until
after the hearing on August 2, 1977.
Water Superintendent, Fred Walker, Sr. inquired about
Inspection inspection procedures for sewer project on McLean Road,
Terrace Road, Pleasantview Drive and Munson Avenue. It was
of neW determined that the inspection of the job is the responsibility
sewer projof Rowell and Associates with assistance from Water and Sewer
Superintendent of the Town of Cortlandville.

Building inspector in the absence of the present
Zoning Enforcement Officer, Don Fowler.
Justice Eaton reported that the specifications for the
Heating heating project in the Municipal Building on West Road are
Proj. for nearly completed. This project will be ready for bids in
Municipal August of 1977. Justice Eaton stated that the roof of the
Building Town Hall building, 15 Terrace Road is badly in need of repairs
and he presented a proposal for repairs. Cost estimates will be
forthcoming. Supervisor Blatchley said he did not feel these
repairs should be made at this time as monies had not been
Town. Hall budgeted for them. ,Justice Eaton said the roof was in bad shape
Roof needsand it would be a preventative measure -possibly saving a
repairs considerable amount of money because if it is not repaired now,
a new roof will be needed in the not too distant future.
